15 Up in the air
Anton paced his small cell. Instead of lying in wait to take the King hostage, he was in prison. Luckily he had a card up his sleeve – the documents that supported the fact that at the time Constantine took the throne, his own grandfather, Alfred, came out of exile in Monaco to make a counter claim on behalf of the Severus family. He had disappeared in mysterious circumstances, and Anton’s parents never returned to the country. His mother died when he was very little, and he was brought up largely by his father, who had died some five years ago.
His father had drummed into him the idea that he should be on the throne, that Constantine was corrupt and despotic. He had died a bitter man, making Anton swear that he would gather his forces and take power. In his childhood the Nevrakis family had visited them twice, and he had met his intended queen when she was a baby. They had brought with them copies of the ancient agreement that stated that should the Severus and Nevrakis heirs be of a gender and age to be betrothed, that a marriage would be binding subject to the signing of the documents that they brought with them. That and the clause in documents held by both Nevrakis and the Crown that stated that should the ruling line (in this case the Rys family) not have an heir by the end of the first year of a new monarch’s reign, that the Crown should be claimed by the Nevrakis, gave him what he thought was an iron clad claim. It just would have been a lot easier had Constantine or Liam abdicated in his favour, or died in power or just before being crowned.
He heard the key in the cell door, and it opened to reveal his lawyer and three guards – one prison guard and two King’s men.
‘Prisoner, hold out your hands’ intoned the prison guard, revealing a pair of handcuffs. He scowled, but his lawyer made a reassuring gesture.
‘It’s alright Mr Severus, you’re being transferred to you new quarters.’ She said ‘Until you reach your destination, you must, by law, be restrained. Once you are there, you will be afforded freedom within your own suite and will have access to outside space. I can assure you it is a far more suitable place than this cell’ He held out his wrists and felt the cold steel click around them. He glowered at his escort party.
‘I demand to know the names of these men’ he asserted ‘When my claim to the throne is acknowledged, the manner in which I am treated will determine whether they are rewarded or reprimanded’ He held his head high as one of the men stepped forward to escort him outside.
‘My name is Parker, Mr Severus, and my colleague is Marcus’
‘Make a note of that’ Anton commanded his lawyer, who nodded and took out her cell phone and tapped away for a few seconds.
‘Follow me please’ Parker directed, and he lead the way, flanked by his lawyer and followed by Marcus. They walked to the end of the corridor to the first locked gate, and beyond past three more, and in the lobby, two more guards waited. Anton was handed back his belongings and signed himself out of the prison into the custody of the King’s Guard. He was hurried swiftly from the outside door to a waiting van in the prison courtyard. No photographers could record his release, and he did not see if any other vehicles accompanied the van, due to the small high windows in the van. He was strapped in to a four point seat belt that doubled as a restraint when locked.
‘This is outrageous’ he growled ‘If there was an accident I would be unable to escape’ Marcus made a grimace.
‘Don’t worry, Severus, there are contingency plans’ he replied before he spoke into his security microphone ‘All stowed away’ he intoned, and the van lurched into motion.

‘So you sent him to High View?�� Olivia asked Liam as they travelled to Valtoria, the Royal limo flanked by King’s Guard vehicles. It was comprised of outrider motorcycles and SUVs, and Regina was to follow an hour later with a similar retinue. ‘I presume you’ve closed it to the public’ She referred to a manor that in the past had served as a summer residence for the Royal Family before Constantine’s father chose Applewood. It had consequently been converted into half self catering, half stately home, and was open for visitors to look around. It had fallen out of favour as a tourist destination in the last few years, and had been largely converted into apartments and cottages for both short term and holiday lets, though it struggled to make money. It was located on a small peninsula an hour’s drive from the capital, accessible only by one road and surrounded on three sides by sheer sea cliffs.
‘Of course, Livvy’ he answered ‘All the bookings have been cancelled and transferred to other properties and everyone has been cleared out.  Anton will be staying in a first floor apartment, and the main ground floor flat will be staffed by the Guard.’
‘Will he have his own staff?’ she asked
‘Just the bare minimum – cook, cleaner and personal assistant’ he answered. ‘We had to negotiate hard not to allow him any more than that’
‘And the security arrangements?’ she asked ‘Will he be allowed visitors?’
‘His movements will be monitored round the clock. At night he’ll be under lock and key, and any visitors have to be approved – Bastien or Lewis, myself and Anton’s lawyer will be consulted in every case. The outside of the castle is already monitored by security cameras, and the guard will randomly deploy surveillance drones.’ She sighed heavily
‘I suppose that will do’ she said ‘Perhaps we can enjoy the Lantern festival somewhat, but my nerves are on edge’ Liam put his hand on her arm
‘I know exactly what you mean’ he said ‘I can barely imagine being free of Anton’s machinations. I live in hope that we can refute his claim’

The manor bustled with activity not seen for decades. The housekeeping team were kept busy directing nobles to their rooms or suites and fulfilling their various demands and requests. Gladys had done an excellent job – all was spotless and floral arrangements adorned every room and corridor, though a few had to be moved for various guests suffering from allergies. The festival was to be held the following day, allowing time for guests to settle in and eat before retiring for the night. Marquees and stalls were being set up, and folk could either eat in the marquees or picnic in the grounds. The Valtorian public were intrigued to see the grounds of the Manor after so many years of it being private, and crowds were expected.
There was no formal dinner that night. Instead, caterers had been brought in to set up a giant informal buffet, and apart from a table for Liam, Regina and invited guests, everyone was free to sit where they wished at tables set for six. Bastien and Sophia shared a table with Drake and Riley, and Damien joined them with a pretty young woman accompanying him – a minor noble that Bastien had only come across once or twice.
‘Hey, there’s Adelaide’ Drake commented as he sat with a plate piled high with food, nodding at a table on the other side of the room. ‘She doesn’t look so well – has she been ill?’ Damien looked round furtively, and Bastien made a discreet cough. Sophia glared across at the Duchess, who she knew Bastien had some involvement with in the past. She sat at a table while her daughter picked her out some savouries. The older woman looked across at them and gave a weak smile. Drake chuckled ‘Maxwell will be able to relax, Addy doesn’t look like she’ll be chasing him tonight’
Sophia amused herself by looking round the room and identifying as many nobles as she could. Some months ago Bastien had given her files on many of them in order for her to help him with a little surveillance. She had been serving drinks and listening to gossip to glean useful information for him on the social tour when Liam was deciding on a bride. Neville Delacouer sat with Lady Penelope, and Rashad Domvallier sat at the same table talking to Lady Kiara Lady Hana Lee sat with a minor noble but looked bored at his attempts at conversation. Olivia sat with Liam and Regina, and Lord Domvallier senior sat next to the Queen Mother. They had been seen together a few times recently. He had been a close friend of the couple and had been widowed only a year ago.
‘Should Olivia be sitting with Liam?’ Sophia murmured to Bastien as the other on their table talked. ‘Tongues will wag’
‘I think they want that to happen’ he said ‘The sooner folk get the idea that she’s close to the King the better.’
‘But it’s rather complicated by Anton’s claim, and the betrothal agreement’ she pointed out. Bastien shrugged.
‘I think they deserve a little diversion from all the drama’ he said ‘and hopefully we’ll find a way round that yet’ He looked up as one of his men approached the table.
‘Sir’ he said ‘Lewis sent me to fetch you. We’ve made a breakthrough concerning who hired the assassin at the cathedral’

The conversation between Madeleine and her mother had been challenging. She had already arrived at Valtoria when Madeleine booked in to her suite – or rather, their suite. Her usual icy calm demeanour cracked when they met in their shared lounge.
‘Mother, where the hell have you been?’ she snapped, not caring that she looked pale and thin. ‘Why didn’t you answer my texts?’ Her mother stood, gripping the back of a chair for support.
‘I’m sorry Maddy, I was ill’ she replied faintly
‘Why didn’t you tell me?’
‘I didn’t want to worry you, darling. You really couldn’t have done anything’
‘But I’d at least have liked to know’ she fumed ‘Did you see a doctor?’
‘I – I was in hospital, Maddy’ she admitted, tears starting to her eyes. ‘Please don’t ask me anything else. I’m back, and I’m fine’ She sank into the chair, fumbling in her pocket for a handkerchief.
‘Hospital?’ Madeleine tried to keep her composure ‘and just where was that hospital? Why didn’t they inform me?’
‘I can’t…’ the Duchess held the hankie to her face, dabbing at her eyes. Madeleine scoffed.
‘At least tell me whether you left the country or not’ she asked, and her mother nodded faintly.
‘Let me guess, it was one of your assignations’ she said, and paused in thought. ‘Was it some weird sex game that went wrong?’ Adelaide’s eyes grew wide with horror but she didn’t deny it. Madeleine squeezed the bridge of her nose and screwed her eyes shut.
‘Really mother, you should know better’ she said in a strangled voice ‘Did you have to pay anyone to keep it quiet?’ There was a shake of the head at this question. She couldn’t look her daughter in the eye, and tears started to flow.
‘Can’t you show a little compassion, Maddy?’ she pleaded ‘Maybe give me a hug?’ Madeleine sighed in exasperation
‘How can I be sympathetic if you won’t tell me what happened?’ Adelaide made a big effort to stem the tears, taking a deep breath and sitting straighter.
‘I just wanted to protect you, Maddy. The King may have told you he won’t marry you, but he hasn’t married anyone else. He has to have an heir, and maybe you could make some sort of arrangement’ Madeleine’s eyes opened wide.
‘You really think so?’ her tone was sarcastic. ‘I offered him a Cordonian marriage and he turned it down, what makes you think he wants me to be mother to an heir?’ Adelaide wrung her hands together.
‘He may have a change of heart’ she said hopefully.
‘Well, you’ll be interested to know that I brought the subject up again, and yet again he turned me down.’ She sniffed and Adelaide’s face fell.
‘Oh my baby’ she sobbed ‘I can’t understand it. You’re pretty, and clever, and your father and I made sure you got the best training. You’re the best Queen Cordonia could hope for’
‘Yes well, maybe if you’d allowed a little space for the possibility that I might fail, I’d have some idea what to actually do with my life now’ she said bitterly. ‘Not that I don’t appreciate you pushing me to be my best – but your ambition was rather specific.’
‘I’m sorry Maddy. Everyone needs a purpose – heaven knows I should understand that’ Madeleine sighed.
‘What was so bad you couldn’t tell me?’ she asked ‘You’re my mother, it’s not like I’d stop talking to you’
‘You’d be so disappointed though’ she replied, downcast. ‘and it might have repercussions’ Just then there was a knock on the door, and a one of the staff entered to let them know food was being served.
‘This isn’t over, mother’ Madeleine said sternly ‘I’ll get to the bottom of this ‘

‘So Lucretia was the one who hired the gunman?’ Bastien said incredulously. Damien looked puzzled.
‘That doesn’t make sense. She was in league with Anton, why didn’t she just go with his plans?’
‘I don’t know’ said Lewis ‘It took quite some time, but we managed to track back the payment he received, and it couldn’t have been anyone else.’
‘It looks like we have to question her again’ said Bastien. ‘But as Anton is under control, I don’t think we all need to go right now.’ He turned to Lewis ‘But I think you should go and have a word with her, see what you can find out. If she’s stubborn, then I’ll go to see her. Damien – it’s up to you. Will your work schedule wait longer? I’d appreciate your help, but it’s not essential’
‘I’ll go with Lewis if we go now’ he said ‘If we move swiftly we may even be back in time for the festival’
‘That’s fine by me’ answered Lewis.
‘Very well’ replied Bastien ‘Keep me informed, let’s see if she’ll co-operate this time’

The next day Sophia woke alone, hearing the shower running in the bathroom. She rose and opened the curtains to the tall windows, and found herself looking out over a sea of marquees, tents and stalls on the lawn outside. People bustled about setting out goods and firing up grills and ovens, and flags and bunting adorned the temporary structures. Bastien came back into the bedroom, naked and towelling himself off. He joined Sophia at the window, wrapping his arms around her and kissing the nape of her neck.
‘Good morning my goddess’
‘Bas, people will see’ she protested ‘Go and put some clothes on’ Her body betrayed her by melting back into his embrace. He smelled clean and his skin was still damp.
‘I don’t care’ he murmured in her ear ‘And I don’t have to get dressed just yet’ He snuck his hand under her nightdress, skimming his hand over her belly. She could feel him pressing hard against the small of her back, but she grabbed his hand and pulled his little finger to the side, just enough to make him yelp in pain and surprise.
‘You just showered’ she scolded ‘You’ll have to do it all over again’
‘Come and shower with me and that’s two birds killed with one stone’ he insisted, this time bringing his hand to her backside and squeezing her cheek. She laughed, turning round and throwing her arms around his neck.
‘You are a persistent man, Mr Lykel’ she sighed, and stretched up to kiss him on the lips. The kiss lingered and she pressed herself to him.
‘I notice you’re not saying no, Miss Turner’ he said in a low tone, picking her up easily off the ground so that she had to wrap her legs around him and cling on to stop from falling. She squealed in protest as he carried her off to the bathroom. His gait was an undignified waddle, but he kept hold of her all the way.
‘I can never say no to you’ she laughed as he shut the door and bore her to the shower.

Susanna stepped out of her bathroom with a towel tied around her body while using a second to squeeze water from her red hair. She looked up as the doorknob to the apartment turned and smiled softly as the lumbering frame of her boyfriend slipped in.
“Long day?” Sue asked, taking in his ragged appearance and tired eyes.
It had been a whirlwind romance and admittedly a complete accident. She had come to the tower when she got a frantic voicemail from Layne about having been kidnapped and being unable to get a hold of the team. Sick with worry she had hopped on her motorcycle and drove all the way from Minnesota to New York barely stopping. When things with Layne had settled and she met Thor the connection was instantaneous. She was a forty-year-old divorcee and had given up on the thought of love, putting all of her energy into her music and her friends. Thor was the first man in a long time to make her feel beautiful and wanted.
She would be the first to admit that this whole thing had gotten a little out of control. Susanna went from hiding the fact that she was born with the mutant gene to now being an Avenger. Albeit, an Avenger that was off the radar. Layne, Wanda, and Natasha were constantly hinting that she should be joining them during press conferences, especially after missions that succeeded thanks to her, they always press how more women on the team the better. But she just couldn’t, she had grown kids and the last thing she needed was for them to be worried sick about her all the time.
She had already been chewing over how she would bring up to Thor and the team that she would have to step away for a little while. She owned a mechanic shop back in Minnesota and while she had a very competent team running it in her absence, between the tour and the Avengers it’s been almost six months since she last stopped in to make sure her business was still standing. The weight of her responsibilities back home battling the taste of actually contributing to keeping the world safe was starting to wear on her.
“Only because you were not beside me,” Thor answered with a dopey smile and followed her into their bedroom.
Sue was digging through her clothes drawers trying to find something comfy to wear, her muscles pleasantly sore from her work out earlier. Thor walked up behind her and wrapped his hands around her waist, pulling her up and against his hard body. Sue giggled as his beard tickled up the side of her neck as he spattered kisses along the soft expanse of skin.
“A good thing I wasn’t, you never pay attention when I’m around,” Susanna teased and Thor simply hummed in agreement.
“How can I? You are the most distracting creature I have ever come across.”
Sue felt the heat of a blush creep up her chest and flare the tips of her ears. “Flatterer.” She spun in his grasp so she could lean up and catch his lips with her own and creep her arms up around his neck.
Thor growled in want and softly bit at Sue’s bottom lip until she allowed his tongue access. They made outstanding in the middle of their room until both needed to break away, dizzy from lack of air.
“How was Layne this morning?” Thor whispered, not wanting to break the soft mood between them as he rested his forehead on hers.
Sue shrugged, a slight frown creasing her features. “I think it was just a fluke. We’ll have to see if it’s a pattern that’s going to continue, but I think she scared herself a bit.”
Thor placed a kiss on her forehead before sliding his arms down under the round of her ass and lifting her easily into his arms. Susanna let out a less than delicate squawk of surprise, still not used to being handled like a delicate little thing like Thor often did, only for him to carry her over to the bed.
“What did they say about Barnes?” Susanna asked, running her hands up Thor’s chest as he climbed onto the bed to hover over her.
“Rogers seems to think that he can be given some extent of trust. He’s not a mindless machine like he was last time I suppose, I was not around when problems with Barnes were happening in the past so I couldn’t really say. He reminds me of how he was when I first met him after he was brought back from Africa.”
“So, what? Are we rotating babysitting duty?” Sue questioned, tangling her fingers in Thor’s blond locks.
Thor sighed, darkness falling over his expression that had Sue furrowing her brows in concern.
“Unfortunately, I am needed back with my people for a little while. There are apparently issues with the government and our settlement. They gave us land to make our own, but they have asked that we follow their laws. We are Asgardian but also Norwegian and my people are finding issue with that as are the locals. My people still see me as the king, but Norway has a…president? And they have laws that are not our own,” Thor sighed again and fell to his side next to Sue where he buried his face in her neck once more, inhaling her scent to bring him comfort.
“Well, being refugees can’t be easy, but you can’t exactly colonize a chunk of Norway and declare it Asgard. You’ll start a war,” Susanna insisted softly.
“But they gave it to us,” Thor pressed.
“That’s not how things work.”
Thor grumbled into her skin and sucked softly on her earlobe. Susanna huffed with amusement at Thor’s antics, even during a rather serious discussion the man was insatiable.
“Will you come with me? Help me navigate the laws of this world?” Thor asked, his voice soft and small.
Susanna sat up and looked down at Thor. “I’m not some kind of political lawyer, Thor. I’m a mechanic. You should talk to Pepper about borrowing some of the legal team.”
“Well. Will you come for support?” He looked up at her with big blue puppy dog eyes and Sue sighed in frustration.
“I can’t just go to Norway, Thor. I need to go back to my home too at some point. Check in with my family and the shop. And I can’t just leave Layne for an extended period with everything going on.”
“But I need you,” Thor said, pouting slightly.
“I have my own responsibilities.” Susanna insisted.
Thor sighed in defeat but then a wide smile took over his face. “Why did I have to fall in love with such a strong woman?”
Susanna mirrored his smile and reached over to run her thumb over his scruffy cheek before sobering and looking him seriously in the eyes. “Because no one else will put up with your bullshit, my king.” She teased lightly.
“Hmm. Well, how about I show my queen my fealty?” Thor suggested and rolled so he was caging her in between his thick arms once more.

Layne sat curled up in the corner of the long sectional couch in the common space. Everyone had their dinners and cleaned up after themselves and then parted to do their own things. It was Wednesday and normally on Wednesdays those who weren’t on missions would get together and watch a movie or just hang out and socialize, but after the incident with Bucky and no one really getting any rest after long missions it went unspoken that no one would be coming to hang out that night.
So Layne enjoyed the expansive room by herself, curled up with an acoustic guitar and notebooks scattered on the cushions around her. Snow was falling softly outside and Layne had turned on the gas fireplace when the sun dipped down behind the other buildings. It was quiet and cozy and Layne loved the small moments like this that she could get in the tower. Normally she had to lock herself away in her apartment for this sort of peace, but she couldn’t stand being in her old room right now.
As she slowly plucked at the strings of her guitar, pausing every so often to scribble a number or dot on a blank piece of sheet music, her gaze flashed back to the windows. Where it had just been softly snowing only a few minutes earlier suddenly sheets of freezing rain were falling from the sky followed by a flash of lightning and an immediate crash of thunder. Layne sighed and went back to her music, trying not to feel bitter.
When the little hairs on her arms and the back of her neck rose she didn’t falter.
“Escape from your watchdog?” Layne asked, not even bothering to look up from her notebooks.
“He’s a bad handler,” the Soldier answered stepping into Layne’s field of vision.
Layne hummed and looked up at him to examine his face. The emotionless mask was gone, replaced with one that was pinched in concern and confusion. There was a soft sparkle behind his eyes, it gave Layne hope.
“That’s because he’s not a handler,” Layne corrected going back to her notebooks. “He’s your best friend. Where is he?”
“Medical.”
Layne’s eyes flicked up to him sharply and he winced, just barely, in what seemed to be guilt.
“Sparring get out of hand?” she asked nonchalantly. It wasn’t anything new, Steve or Bucky usually ended up in medical getting their nose set or a shoulder relocated every time they sparred. Both were too stubborn to let the other win.
“I broke his cheekbone, maybe his eye socket.” The Soldier admitted and shifted his weight from one foot to the other. Layne motioned to the empty expanse of couch and the Soldier hesitantly sat down on one of the ends, a good three cushions away from her.
“This arm is lighter than Hydra’s. Hurts less,” he continued.
“Shuri is very good at what she does,” Layne murmured, trying to keep her heart rate steady and looking focused on what she was doing.
The Soldier was now actively seeking her out, trying to hold a conversation with her. This was good, this was what she wanted. If she kept playing hard to get like this then maybe they could start getting somewhere. She tried to pretend like she wasn’t bothered or concerned about his uncomfortable fidgeting as her pencil scratched along the notebook. This felt so much more familiar to her, her sitting and working on music while Bucky would watch TV with the sound off or just read on the other end of the couch, that she started to forget that it was different.
It was when the feeling of his intense gaze on her got too heavy that she startled out of her reverie and looked up at him.
“Who is with Steve now?” Layne asked after clearing her throat.
“Natalia.”
Layne hummed and plucked a little at her strings. “Does that bother you?”
The Soldier’s eyes moved over Layne’s face, he could hear her heart pick up with nervousness and he watched as her tongue poked out and anxiously wet her lips. His gaze moved down to her long fingers that wrapped around the neck of her guitar, his eyes narrowed as a memory surfaced. He had gotten it for her for her birthday earlier in the year. It looked like the one he had seen from her memories before they were ever together. In her memory, he had watched as her father smashed it against her bedroom wall. He remembered Layne cried when she opened the case and it seemed to get more play than her electric.
“No. Natalia doesn’t remember us,” he admitted finally. It used to hurt him, that her eyes would shift over his with nothing more than simple recognition - like the kind of look you’d give an acquaintance. But then Layne had joined the team and suddenly it didn’t matter. Bucky had kept Layne at an arms length for months after seeing her had stirred the Soldier, Bucky had felt it, the animalistic need to protect the new girl.
“Does that bother you?” Layne pressed and the Soldier shook his head.
“Not anymore,” he answered immediately and honestly, his eyes connecting with hers.
She sucked in a small, sharp breath and broke their gaze to look at her fingers on the fret board, a soft pink blush gracing her cheeks. Clearing her throat she looked back up at him through her lashes as he inched a little closer to her. She smirked and moved a pile of notebooks on his side of the couch over to the other side.
“I wanted to thank you,” he said slowly, lacing his fingers together in his lap and cracking the knuckles of his right hand nervously.
“For what?” Layne asked, setting her guitar aside and pulling her legs up under her and wrapping her arms around her knees.
“For not being afraid.”
Layne tilted her head to the side in confusion and chewed on her bottom lip. “Why would I ever be afraid of you?”
The Soldier shrugged. “Well, I’m not him,” he swallowed hard, his gaze on the floor darting back and forth as he tried to recall something. “I’ve done all the bad things.”
Layne scooted closer and the Soldier flinched, Layne hesitated before throwing caution to the wind and moving right next to him. She held her hand out to him, palm up. “Do you trust me?”
The Soldier looked between her and her hand. She was leaving him with the choice, just like she always did. He took it last night because he was so ridiculously tired, but now when he was awake and aware it was a different story.
“I have always seen you. Please, let me show you,” Layne begged. “Just give me your hand.”
The Soldier hesitated for a moment more before reaching out with his right hand to brush his calloused fingers across the soft skin of her palm. She smiled softly and gently laced her fingers with his. This time instead of the sensation of being hit with a bucket of ice the Soldier felt himself sucked into a vacuum, his ears popped and his vision went dark momentarily and when his vision came back he was looking up at himself from Layne’s perspective.

#IrishAmericanHeritageMonth 🇺🇸🇮🇪 John Carroll O’Connor Carroll O'Connor, an Irish American, was the eldest of three brothers. He was born on August 2, 1924, in Manhattan,[3] New York City, to Edward Joseph O'Connor,[4] a lawyer, and his wife, Elise Patricia O'Connor. Both of his brothers became doctors: Hugh, who died in a motorcycle accident in 1961, and Robert, a psychiatrist in New York City.[3] O'Connor spent much of his youth in Elmhurst and Forest Hills, Queens, the same borough in which his character Archie Bunker would later live.[5] O'Connor graduated from Newtown High School in Elmhurst. In 1941, he enrolled at Wake Forest University in North Carolina but dropped out when the United States entered World War II. During the war, he was rejected by the United States Navy and enrolled in the United States Merchant Marine Academy for a short time. After leaving that institution, he became a merchant seaman and served in the United States Merchant Marine during the war.[6] After the war, O'Connor attended the University of Montana, where he worked at the Montana Kaimin student newspaper as an editor; in 1949 he resigned his editing position in protest to the pressure from the campus administration that led to the confiscation and destruction of an issue of the paper, which carried a cartoon depicting the Montana Board of Education as rats gnawing at a bag of university funds. At the University of Montana, he also joined the Sigma Phi Epsilon fraternity.[7] O'Connor did not take any drama courses as an undergraduate at the University of Montana, but he did act in student theater productions. He met Nancy Fields (born 1929), who later became his wife, when she was working as a makeup artist on a student play he was acting in. It’s unfortunate to think about, but accidents can occur when on vacation. It’s understandable that people might assume their insurance benefits are available to them while traveling. However, the family of an Alberta woman who was vacationing overseas recently found out from a decision from the Court of Appeal of Alberta they won’t be able to claim insurance benefits after a car accident in the Philippines.
The accident
The insured was a pedestrian on vacation in the Philippines when she was struck and killed by a motorcycle. Her spouse and her estate (the “plaintiffs”) sued her insurance company claiming entitlement to Section B benefits and damages pursuant to their SEF 44 Endorsement, which is available to provide indemnity to insured people who suffer injuries caused by an inadequately insured motorist, such as the driver of the motorcycle.
The insurer denied the claim and requested a summary dismissal of the action on the grounds that the insured’s vehicle was parked in Edmonton when the accident occurred and that she was not “in Canada, the United States of America or upon a vessel plying between ports of those countries” as stated in the policy’s territorial limitation provision.
During the initial trial, a master in chambers ruled that the territorial limitation provision does not apply to Section B of the policy, and the general exclusions do not apply to the SEF 44 Endorsement.
The insurer appealed to the Court of Queen’s Bench, but the appeal was dismissed. They then appealed to the Court of Appeal.
On Appeal
The appeal focused on whether the meaning of “automobile” in the SEF 44 Endorsement and the meaning of “insured person” in Section B of the policy and the application of the policy’s territorial limitation provision.
In focusing on the territorial limitation provision, the court held that it applies to the entire policy, including the SEF 44 Endorsement. The court wrote, “the policy’s territorial limitation applies to the whole policy, of which the entire SEF 44 Endorsement forms a part. Thus applied, the territorial limitation restricts its coverage territorially, in the same manner, and to the same extent as applied to the underlying policy,” adding that the SEF 44 Endorsement is not travel insurance.
Since the territorial limitations provision applied to the SEF 44 Endorsement, and that the Endorsement is part of the general provisions of the policy, there was no coverage available. Similarly, coverage was also not available under the Section B benefits.
The decision is worth noting in that it underscores the importance for travelers to check with their insurance providers before traveling abroad. It would be terrible to be caught in a situation where insurance benefits are needed but not available.
