Gonarthrose : le Conseil d'Etat confirme le déremboursement des dispositifs médicaux à base d'acide hyaluronique

Le Conseil d'Etat a confirmé le déremboursement, en vigueur depuis juin 2017, des dispositifs médicaux à base d'acide hyaluronique indiqués dans la gonarthrose, dans une décision rendue vendredi.

Par un arrêté daté du 24 mars 2017, le précédent gouvernement a décidé de radier du remboursement, à partir du 1er juin, 10 dispositifs médicaux à base d'acide hyaluronique indiqués dans la gonarthrose en raison d'un service rendu (SR) jugé insuffisant par la commission nationale d'évaluation des dispositifs médicaux et des technologies de santé (Cnedimts) de la Haute autorité de santé (HAS) (cf dépêche du 28/03/2017 à 12:30).

Sont concernés Arthrum* (LCA), Ostenil* (TRB Chemedica), Adant* (Daiichi Sankyo), Durolane* (Bioventus/Genévrier), Euflexxa* (Ferring), Go-On* (Meda, groupe Mylan), Sinovial* (Genévrier), Structovial* (Pierre Fabre), Synocrom* (Croma Pharma/Bausch & Lomb, groupe Valeant) et Synvisc-One* (Sanofi).

Saisi par TRB Chemedica et LCA, le Conseil d'Etat avait toutefois suspendu, en référé, l'arrêté de radiation pour Ostenil* et Arthrum*, quelques jours avant l'entrée en vigueur de la décision (cf dépêche du 16/05/2017 à 18:21 et dépêche du 06/06/2017 à 12:51).

Parmi les motifs, la haute juridiction administrative avait notamment retenu que l'arrêté portait une atteinte illégale aux règles de concurrence car un autre acide hyaluronique indiqué dans la gonarthrose qui a le statut du médicament, Hyalgan* (Expanscience), restait remboursé (à 15%).

Pour mettre un terme à cette incohérence, le gouvernement a publié le 12 octobre 2017 deux arrêtés mettant un terme au remboursement et à l'agrément aux collectivités de Hyalgan* à compter du 1er décembre 2017, considérant que son service médical rendu (SMR) n'est pas mineur mais insuffisant (cf dépêche du 12/10/2017 à 10:36).

En conséquence, le Conseil d'Etat a mis un terme, en novembre 2017, à la suspension de déremboursement d'Ostenil* et d'Arthrum* à compter du 1er décembre 2017 (cf dépêche du 22/11/2017 à 15:48).

La procédure ne s'est pas arrêtée là car les recours de TRB Chemedica et de LCA ont été étudiés au fond par la haute juridiction administrative, de même que les dossiers déposés par les autres industriels concernés par le déremboursement (sauf Croma Pharma/Bausch & Lomb).

Tous les points avancés par les laboratoires qui ont attaqué l'arrêté de déremboursement du 24 mars 2017 ont été rejetés.

Une irrégularité constatée du côté de la CnedimtsLe Conseil d'Etat indique que, dans ses avis concluant au service rendu insuffisant des produits concernés, la Cnedimts n'a pas pris en considération deux nouvelles études médico-économiques produites par LCA, et qu'elle a ainsi commis une irrégularité.

"Toutefois, si les actes administratifs doivent ��tre pris selon les formes et conformément aux procédures prévues par les lois et règlements, un vice affectant le déroulement d'une procédure administrative préalable, suivie à titre obligatoire ou facultatif, n'est de nature à entacher d'illégalité la décision prise que s'il ressort des pièces du dossier qu'il a été susceptible d'exercer, en l'espèce, une influence sur le sens de la décision prise ou qu'il a privé les intéressés d'une garantie", écrit le Conseil d'Etat.

"En l'espèce, il ressort des pièces du dossier que l'absence de prise en considération de ces deux études, qui n'a pas privé la société LCA d'une garantie, n'était pas susceptible d'exercer une influence sur l'appréciation du service rendu par le produit Arthrum* ni, par suite, sur le sens de la décision prise", ajoute-t-il.

La haute juridiction administrative juge par ailleurs qu'au vu de l'ensemble des éléments à disposition, le gouvernement a pu, sans commettre d'erreur manifeste d'appréciation, estimer que le service rendu des dispositifs médicaux à base d'acide hyaluronique injectable indiqués dans la gonarthrose était, "eu égard à la faiblesse de leur effet", insuffisant pour justifier le maintien de leur remboursement par l'assurance maladie.

L'erreur manifeste d'appréciation est rejetée "en dépit des conséquences de l'arthrose pour les personnes qui en sont atteintes et alors même que la reconnaissance à la spécialité Hyalgan* d'un SMR faible permettait de le maintenir sur la liste des médicaments remboursables".

Dès lors que l'arrêté attaqué est justifié par l'insuffisance du service rendu, "la circonstance, qui au demeurant n'est pas établie par les pièces des dossiers, que les radiations qu'il prononce conduiraient à une augmentation des dépenses à la charge de l'assurance maladie est sans incidence sur sa légalité".

Différence de statuts avec Hyalgan*

Sur la différence de statut entre les dispositifs médicaux et Hyalgan*, le Conseil d'Etat estime que la circonstance que l'administration aurait laissé subsister l'autorisation de mise sur le marché (AMM) accordée à un produit qui aurait été qualifié à tort de médicament (au sens du droit européen) est sans incidence sur la légalité de la décision de déremboursement.

De même, la circonstance, "à la supposer établie", que, du fait de son remboursement par l'assurance maladie, Hyalgan* bénéficierait d'une aide d'Etat, incompatible avec le marché intérieur et non notifiée à la Commission européenne, serait sans incidence sur la légalité de l'arrêté attaqué.

Par ailleurs, les dispositifs médicaux ont obtenu le marquage CE permettant leur mise sur le marché postérieurement à la délivrance de l'AMM de Hyalgan*. "Si, ainsi que les sociétés requérantes l'affirment, ces solutions possèdent les mêmes propriétés que Hyalgan*, il leur était loisible de demander une AMM et, le cas échéant, de contester les décisions prises à la suite de cette demande en se prévalant, notamment, de la méconnaissance du principe d'égalité et des règles de concurrence", souligne le Conseil d'Etat.

"En revanche, elles ne sauraient, eu égard aux régimes différents dont relèvent [...] les dispositifs médicaux qu'elles commercialisent et le médicament Hyalgan*, utilement se prévaloir d'une telle méconnaissance [...] pour contester la radiation prononcée par l'arrêté attaqué", ajoute-t-il.
