Missouri’s restrictions on puberty blockers and hormone treatment for transgender minors are constitutional and may remain in place, Wright County Circuit Court Judge Craig Carter wrote in a 74-page ruling Monday. Soon after the ruling became public, the ACLU of Missouri and Lambda Legal promised to appeal. The state’s restrictions on gender-affirming care, passed by state lawmakers in 2023, not only bar minors from beginning cross-sex hormones and puberty blockers and undergoing gender transition surgeries. It also blocks the state from paying for gender-affirming care for adults through Missouri Medicaid and care in state prisons. Many providers in Missouri have ceased offering gender-affirming care for minors, including patients that had begun prescriptions prior to the law’s effective date.
Plaintiffs in the case — which include gender-affirming health care providers, transgender minors and their families — had the burden to prove the statute “clearly and undoubtedly violates a constitutional provision,” the judge wrote. And because plaintiffs challenged the law in its entirety, they had to prove that there is “no set of circumstances under which the provisions would be valid.” Carter determined the challenge did not clear the high bar on multiple arguments, but the overarching debate looked at medical consensus on gender-affirming care. His ruling focuses on a U.S. Supreme Court precedent that allows lawmakers broad discretion in areas “fraught with medical and scientific uncertainty.” Carter concluded that there is “an almost total lack of consensus as to the medical ethics of adolescent gender dysphoria treatment,” granting the state legislature authority to ban the care.
[...] Apart from these concerns, Carter said three witnesses were particularly compelling: Chloe Cole, a young woman who transitioned as a minor in California and since stopped treatment and has spoken publicly about her regrets, along with bioethicist Farr Curlin and plastic surgeon Patrick Lappert, both who emphasized potential side effects of gender-affirming care. Because the risks were high for gender-affirming care, the treatment couldn’t be compared to experimental treatments with few known side effects, Carter wrote, and allowing teenagers to opt into an experimental treatment is dubious. “If we don’t let a 16-year-old buy a six pack of beer and a pack of smokes, or let an adult buy those items for them, should we allow the same kid/parent team to decide to change a teenager’s sex forever?” Carter wrote in his ruling.

Carter’s justifications for the ruling upholding SB49 was based on anti-trans pseudoscience.

Families sue to stop Missouri’s trans health care ban from going into effect next month
A lawsuit to block Missouri’s ban on gender-affirming care was filed in a state court in Cole County earlier this week. Missouri Gov. Mike Parson (R) signed S.B. 49 into law in June. It bans all gender-affirming treatments, including reversible puberty blockers, for trans youth until August 2027. Any healthcare providers who violate the law risk losing their license. The law also bans both adults in Missouri state prisons and adults on the state’s Medicaid program from accessing gender-affirming care. --- Related Stories Kansas City declares itself a “sanctuary city” for transgender people The move comes in response to the state’s Republican-led legislature passing two bills aimed at limiting the rights of transgender Missourians. --- The law goes into effect on August 28, but a group of families, medical providers, and LGBTQ+ organizations is trying to stop that from happening, arguing that the ban violates the state constitution’s equal protection guarantee and interferes with parental rights when it comes to determining their kids’ health care. Get the Daily Brief The news you care about, reported on by the people who care about you. “S.B. 49 is the latest chapter in Missouri’s relentless attacks on transgender people, and the stories of the families challenging the law demonstrate the immense, devastating harm it is already inflicting on their lives,” said Lambda Legal’s Nora Huppert. “S.B. 49 would deny adolescent transgender Missourians access to evidence-based treatment supported by the overwhelming medical consensus. This law is not just harmful and cruel; it is life-threatening.” The plaintiffs include several people who were plaintiffs in a previous lawsuit to block Missouri Attorney General Andrew Bailey’s April emergency rule that imposed severe restrictions on gender-affirming care for trans people in the state, including adults. They won a temporary injunction against the rule and Bailey later rescinded it, but a month after he rescinded it, Parson signed S.B. 49. The plaintiffs in Noe v. Parson include three families of transgender youth, including the family of Nicholas Noe, a 10-year-old trans boy. The complaint says that Noe first made his gender identity known when he was six years old. At that age, the complaint says, he decided to wear “boy clothes” and hasn’t stopped since. He has been seeing a therapist and has been diagnosed with gender dysphoria. He has socially transitioned but has not started any medical process for his transition. He wants to go through male puberty and be a man one day. As such, the standard of care would be to start puberty blockers at the onset of puberty and then later, hormone replacement therapy. But now he’s worried that he will be forced to go through female puberty because of S.B. 49. His mother tried to keep the news of the law away from Nicholas, but he heard about it through family members. “Nicholas broke down sobbing and asking his mother if Missouri would — as some other state’s policies have threatened to do — take him away from his family,” the complaint states. Southampton Community Healthcare is also a plaintiff in the case, and they provide gender-affirming care for transgender youth. If S.B. 49 goes into effect, they say they will have to deny patients medically necessary and life-saving care, conflicting with their professional oaths. PFLAG and the American Association of Physicians for Human Rights are also plaintiffs in the case. Londonienne de naissance, Celeste a toujours été cette petite fille admirative de ses parents, gens ordinaires au passé ordinaire. Enfin, ordinaire à leurs yeux, de personnes bien courageuses aux yeux de certains autres. En effet elle était la merveilleuse conséquence d’une union rapide, de deux jeunes personnes. Sa mère n’avait à l’époque que dix-sept ans lorsqu’elle accoucha de la jolie et fragile Celeste, et le père seulement dix-neuf ans. Mais rien n’empêcha ces deux personnes de continuer leurs études, de devenir des parents responsables et d’élever leur fille sans aucun soucis apparent.
Ils n’avaient pas des milles et des cents, mais un appartement en centre ville, une voiture et de quoi se nourrir. Que demander de plus ? Ils ne s’offraient pas ce qu’il y avait de plus cher ou de plus beau, mais en même temps cela aurait été bien inutile puisqu’ils étaient déjà tous très heureux ainsi. Aucune faille dans la petite famille parfaite.
Un petit frère plus tard, et la famille était enfin au complet et allait vivre sans encombre jusqu’au bout.

Londres c’est bien, mais la vie y est chère. Pour vivre plus confortablement toute la petite famille se vu déménager alors que Celeste n’était âgée que de douze ans à cette période. Rien de bien triste me diriez vous que d’aller habiter à Manchester, une ville tout de même active et très belle. Mais il semblerait que la jeune Spring ne soit pas de cet avis. Le caractère de celle-ci avait bien changé en cette période et elle se sentait en insécurité partout où elle allait, devoir déménager et quitter le seul « chez elle » qu’elle avait connu n’était pas la meilleure expérience pour elle. C’est à cette période qu’elle débuta ses crises d’angoisses, ses terreurs nocturnes, ces moments incompris de stress profond. Les médecins ne savent pas pourquoi la petite fille est atteinte de telles choses, d’ordinaire cela n’arrive que lorsqu’un réel traumatisme a eu lieu dans la vie de quelqu’un. Peut-être quelque chose sommeille en elle mais son corps et son esprit font tout pour qu’elle ne s’en souvienne jamais.
Autant dire que la petite famille parfaite ne comprenait que peu tout cela. Mais ils firent de leur mieux pour soutenir la jeune fille qui occupait ainsi beaucoup de place dans le foyer. Au final, Celeste réussit à passer outre, elle grandit comme tout les autres, élève modèle et fille assez populaire au collège puis au lycée. Lycée où elle rencontra d’ailleurs son premier amour. Un grand blond aux traits angéliques, lui-même bien populaire à l’époque. Peut-être au fond Celeste voulait-elle réitérer l’histoire de ses parents à sa manière, mais elle tombait amoureuse bien jeune. À dix-sept ans elle était en couple avec celui qu’elle aimait appeler l’homme de sa vie. À dix-huit ans, elle se considérait la plus heureuse au monde. À dix-neuf ans, il la demandait en mariage. Les choses étaient bien précipitées et trop jeunes dans la t��te de certains, mais pour une personne comme Celeste qui avait comme exemple des parents bien jeunes et un amour pourtant parfait, elle ne pouvait que faire confiance en son instinct. Et cet instinct avait raison. Il était l’homme de ses rêves. Il la faisait rire ; la rendait heureuse. Ensemble ils firent une immensité de bêtises, il lui apprenait à passer outre ses crises de panique qui la torturait encore, mais avec lui tout était mieux. Il lui apprenait à être elle-même et vivre chaque chose qu’elle désirait à cent pour cent.

Ce soir là, la jeune femme avait prit un peu trop confiance en elle, elle avait bu, dansé, rigolé, et couché. Elle avait couché avec un homme, mais pas le sien.Au lendemain elle se souvenait que de peu de détails, était-ce de sa faute puisqu’elle avait trop bu ? Avait-on mit quelque chose dans son verre ? Avait-elle juste perdu la tête ? Elle s’était même demandée si elle ne s’était pas laisser prendre de panique par le mariage approchant, par une peur de faire les choses mal tellement importante qu’elle se conduisit elle-même à sa fin.
Et cela n’y manqua pas. Nous passerons les détails, mais la relation parfaite qu’elle s’était imaginée prit fin bien rapidement. Et depuis, elle ne revu jamais le jeune homme qui était pourtant supposé être sien.Uɴᴇ ꜰᴇᴍᴍᴇ ꜰᴏʀᴛᴇMais depuis un peu de temps à passé. Celeste a eu du mal à s’en remettre. Mais on lui avait apprit que les épreuves étaient là pour nous rendre plus fort. Ainsi elle avait tenté de se forger une carapace, elle avait préféré prendre beaucoup de temps avec sa famille, renouant des liens avec son frère qu’elle avait presque délaissé par sa relation amoureuse. S’inscrivant à l’université de Manchester, la jeune femme reprit même les études avec une hargne à toute épreuve, tellement qu’elle eu l’honneur d’être sélectionnée parmi les étudiants partant en échange scolaire avec une université prestigieuse aux États-Unis.
Prête à tout pour mener la vie de ses rêves, elle n’hésitera plus à se faire entendre. Celeste n’est plus une petite fille maintenant, et elle compte bien le montrer à tous ceux qui oseront se mettre sur son chemin. Elle n’a peut-être pas l’air d’être dangereuse, mais essayez-donc de vous en prendre à quelqu’un qu’elle aime et vous le regretterez.

Elle ne comprend pas très bien d’où vient toute cette haine des saint-léo à l’égard de ceux qui ont moins d’argent. Elle cherche donc à essayer de les comprendre quitte à avoir des problèmes.

Cela te créer un noeud dans l’estomac, des frissons, une crise d’angoisse, mais tu survivras n’est-ce pas ?

Missouri’s defense of a state law barring minors from beginning puberty blockers and cross-sex hormones will depend on whether the judge in the case puts stock in expert witnesses touting retracted studies and conspiracy theories about Jerry Sandusky.
Wright County Circuit Court Judge Craig Carter, who is presiding over a lawsuit challenging Missouri’s gender-affirming care restrictions, will have to weigh the credibility of expert witnesses alongside his judgment. Questions of credibility came up Tuesday, when the Missouri Attorney General’s Office called as a witness John Michael Bailey, a psychology professor at Northwestern who testified about his now-retracted study entitled “Rapid Onset Gender Dysphoria,” which concludes that adolescents identify as transgender as a result of social contagion. But it was his social media post about the accusers of Jerry Sandusky that appeared to concern Carter. Sandusky, a former college football coach, was convicted of molesting young boys over a period of at least 15 years. Bailey repeatedly posted on social media that he believes Sandusky is innocent.
“You believe the people testifying against Jerry Sandusky are lying?” Carter asked. “I can see that if you are not familiar with the evidence that I am familiar with, you would be shocked,” Bailey told him. “Mmhmm,” Carter replied. Bailey said he had listened to a podcast and lauded the work of conservative commentator John Ziegler. “Do you know (Ziegler)? Have you talked to anybody that was an eyewitness in that case?” Carter asked. “I have read testimony, but I have not talked to anyone,” Bailey said. Although the underlying case was not about Sandusky, the exchange may have chiseled away at Bailey’s credibility and showed a greater pattern of basing conclusions on secondary sources. Bailey’s research on transgender youth has been retracted, which he chalked up to pressure from activists. The academic journal that retracted his article cited an issue with informed consent protocol, meaning participants didn’t know their responses would be in an article. On cross-examination, the circumstances of his research became clearer.
The anti-trans side has a witness credibility problem in the Noe v. Parson case, as John Michael Bailey has emerged as a Jerry Sandusky defended.
