It was the medical examiner, not the doctors at the hospital, who removed Lillian from Crain’s womb. His autopsy didn’t resolve Fails’ lingering questions about what the hospitals missed and why. He called the death “natural” and attributed it to “complications of pregnancy.” He did note, however, that Crain was “repeatedly seeking medical care for a progressive illness” just before she died. Last November, Fails reached out to medical malpractice lawyers to see about getting justice through the courts. A different legal barrier now stood in her way. If Crain had experienced these same delays as an inpatient, Fails would have needed to establish that the hospital violated medical standards. That, she believed, she could do. But because the delays and discharges occurred in an area of the hospital classified as an emergency room, lawyers said that Texas law set a much higher burden of proof: “willful and wanton negligence.” No lawyer has agreed to take the case.

"See you dont understand law."
Lmao. I literally went to law school. I'm a certified paralegal (that is a person who does the majority of the actual legal work that lawyers are credited for) and I've worked in law. I have a pretty well documented history of understanding law so if there is one of us here who doesn't "understand law" it's certainly not me.
"If it was as cut and dry as you were making it, there would be zero malpractice lawsuits."
That's not just a statement that shows you have no understanding of how law works it shows that you just lack common sense. Sorry but "If it were cut and dry there wouldn't be any lawsuits" is an objectively stupid statement.
"A medical expert would testify and say "I agree with what the doctor did" or they would say "No I would have to say the decisions they took were unreasonable for X Y and Z reasons". And yet these court cases arnt cut and dry."
I would encourage to research something called "the judicial system" and learn how court cases work. It sounds like you get all your information from TV shows. You thinking all a lawsuit takes is the testimony of an expert witness illustrates that this subject matter is way too advanced for your current intellectual abilities.
"Sec. 170A.004. CRIMINAL OFFENSE.
There I found the hidden oppression! Im sorry you dont understand how things work, but that is okay! I pointed it out for you!
See if it is a first degree criminal offense.... uhhh here it is!
12.32. FIRST DEGREE FELONY PUNISHMENT. (a) An individual adjudged guilty of a felony of the first degree shall be punished by imprisonment in the Texas Department of Criminal Justice for life or for any term of not more than 99 years or less than 5 years.
No less than 5 years!
That is why not because doctors are doing political stunts with women's bodies but the state of Texas is."
I don't know what you think you just proved but I'm sitting here laughing that you think this debunked anything I said. Yes, abortion is prohibited in Texas and is a criminal offense if performed in a situation that was not considered a medical emergency.
You responded to nothing I said. You showing the part of the abortion law that says abortion is a criminal offense if it's not considered a medical emergency is information we were both already aware of and were discussing. In the case being discussed in the article abortion would not have been considered a criminal offense because it falls under the exceptions.
And I notice you couldn't even respond to anything I said and just ignored the fact that the woman was treated, the baby was removed and she still died of sepsis and had she had an abortion it likely would have ended the same way.
So again, you are a failure in explaining in any way shape or form why abortion was needed here and how abortion laws had anything to do with this case when that wasn't even the treatment the doctors were seeking and how the abortion laws prevented her from being treated when she actually was treated and why you think having an abortion would have prevented her from getting sepsis.
All you're doing here is proving that people are only pro-abortion because they are embarrassingly uneducated and lack even basic thinking skills.

So you can only go back between 2 and 4 years for a wrongful death claim. But if they actively covered it up and are actively covering it up, then you can go back further. But if it wasn't discovered, then the statue of limitation applies. But if they actively didn't cover up and continue to do the cover up then you can go back as far back as the cover up....
So you have to look into fraud and abuse and concealment laws. To see if you can go back farther than the above mentioned statue of limitations.

So yes, it's true, you can Sue for anything. But do you have standing and does the court consider it frivolous? Meaning are you the person negatively affected And is there really any substantial harm? And this is why we have small claims court. So whatever small claims court considers the minimum. Anything less is considered frivolous.
Quora

Can I sue for incompetence?
Yes, you can. You can sue for anything you like, at least in the US. The question is whether you stand any chance of winning the lawsuit.
So yes, sewing for incompetence means that they did it because they didn't have the ability to Do it correctly. Now melpractice means they knew they couldn't do it correctly and still did it. Meaning you're trying to see if it was perceived negligence. They knew better or it was just negligence because they were incompetent but they didn't know they were incompetent. So it wasn't wilful.
The statute of limitations for filing a lawsuit varies depending on the type of legal claim. For example, the statute of limitations for personal injury in California is two years from the injury, or one year from the date the injury was discovered if it wasn't discovered right away. In Texas, the statute of limitations for medical malpractice claims is two years, but there is also a ten-year statute of repose. Some states extend the statute of limitations for patients who were infants or minors when they were harmed.

So, the patient in this example has a total of 6 years to file a lawsuit after the injury was inflicted. "Infancy" and "Minority" Tolling for Young Patients. Some states also extend the statute of limitations for patients who were infants and/or minors when they were harmed, either: for a certain number of years after the malpractice occurred, or. until the patient reaches the age of majority (18 years old). For example, let's say an OBGYN injures a patient in utero. If this happened in a state with a 10 year infancy toll, then the infant will likely have until they're 10 years old to file the lawsuit.

To win a malpractice case against a lawyer, you must prove that they: Failed to use reasonable skill, Breached their duty, and Caused damages.
Some common reasons for a malpractice claim include:
Failure to apply the law correctly
Poor strategy
Inadequate research
Failure to file required papers
Procrastination
Fraud
You should not sue your lawyer unless:
They are truly bad and violate your legal rights
They commit malpractice
You have another advocate who has shown interest in the case
So, if somebody has a sexually transmitted disease or any contagious disease, but they have no idea they have it and then it gets transmitted to you that is done by accident. But if they have the ability to take annual physicals, they Nicole's, they have mandatory screening for sexually transmitted diseases, then it is wilful negligence. So this is very important on what the government requires health insurance companies to put in place like screening at every annual physical for sexually transmitted diseases. Because if it's an add on and you don't have any signs then you're doing it by accident... Then you have to prove a reasonable man standard. Meaning a reasonable person would have every so often Got a test for sexually transmitted diseases. But if they didn't have any signs and a reasonable person wouldn't have screened or wouldn't have screened for so many years. Then it's hard to be able to claim that they did something to intentionally harm you.... And that means they're not liable.... Since ignorance of the law is no reason to break the law and the government didn't make it a requirement to get Checked for all forms of contagious diseases. Then again, it's not their fault. But this means they have no signs of illness.... If they had signs of illness and they neglected those signs of illness then it is their fault.... So the prudent man...
The reasonable person standard, also known as the reasonable man rule, is a legal definition that judges the conduct of others by comparing it to what a hypothetical reasonable person would do in similar circumstances. In legal terms, "reasonable" means ordinary. A reasonable person is someone who: Obeys the law, Doesn't put themselves or others in danger, and Minimizes risk when it's unavoidable.

Sep 19, 2022 — If it's decided that a reasonable person would have acted with more care or caution than the defendant, the defendant behaved negligently and is responsible for the harm caused. What characteristics make someone reasonable? Acting reasonably depends on the circumstances, but there are certain characteristics that the objective reasonable person has. The reasonable person: Obeys the law. Does not put themselves or others in danger. Minimizes danger or risk when it is unavoidable. Is the reasonable person test fair?

Reasonable person - Wikipedia
In law, a reasonable person, reasonable man, or the man on the Clapham omnibus, is a hypothetical person whose character and care conduct, under any common set of facts, is decided through reasoning of good practice or policy.
Adam S. Kutner, Injury Attorneys
What is a Reasonable Person Standard
The legal definition reasonable person standard hinges on what's considered typical behavior. In legal terms, 'reasonable' means ordinary. The court considers the usual behavior of an average person under the same circumstances. Persons who meet or exceed an expected typical response aren't negligent. Those who fail to meet the standard for typical behavior are negligent.

Part 14. Negligence versus Malpractice: The "Reasonable Man ...
1.1 The "Reasonable Man Rule" By definition, "a person has acted negligently if they have departed from the conduct expected of a reasonably prudent person acting under similar circumstances. The hypothetical reasonable person provides an objective by which the conduct of others is judged".
If a defendant's actions are considered less careful than a reasonable person's, they are considered negligent and are responsible for any harm caused. For example, in one case, a farmer was held liable for burning down his neighbor's cabin with a haystack after the jury found his actions were objectively unreasonable.
The reasonable person standard can vary depending on the circumstances. For example, a court might define a reasonable standard for medical professionals based on the training and experience of other medical professionals in the same position. The standard is also modified for children and minors.
Now the prudent man standard....
The prudent man rule, also known as the prudent investor rule, is a standard that states that fiduciaries should manage trust investments as a prudent person would. This means that trustees should:

A wealthy Massachusetts resident named John McLean left his estate to his wife, and had the funds managed by a trustee. After his wife died, part of funds went to Harvard College, as he requested. But when Harvard received the money, they noticed the estate had lost value under the trustee's supervision. They charged that the trustee had invested the money speculatively.
The rule originated in the 1830 Massachusetts estate law case Harvard College v. Amory. In the case, Harvard College charged that a trustee had invested funds speculatively after the death of a wealthy Massachusetts resident, causing the estate to lose value.
The prudent man rule is an objective standard that doesn't consider how any one individual owner may have acted. It sets the appropriate interest rate based on what a reasonably prudent person would have invested to produce a reasonable rate of return.

The Role of a Personal Injury Lawyer
In the bustling coastal city of Corpus Christi, accidents and injuries are unfortunate realities that many residents face. Whether it's a car crash on South Padre Island Drive, a slip and fall at a local business, or a workplace injury at one of the area's industrial sites, the aftermath of such incidents can be overwhelming. In these situations, seeking the assistance of a personal injury lawyer becomes crucial. This article delves into the significance of personal injury lawyers in Corpus Christi, their role in navigating the legal landscape, and how they advocate for the rights and compensation of their clients.
Understanding Personal Injury Law:
Personal injury law encompasses a wide range of legal issues, including car accidents, premises liability, medical malpractice, and more. In Corpus Christi, as in other parts of Texas, these cases are governed by statutes, precedents, and legal standards that can be complex for the average person to navigate. A Personal injury Lawyer Corpus Christi understands these intricacies and can provide invaluable guidance to individuals seeking justice and compensation for their injuries.
Investigation and Evidence Gathering:
One of the primary roles of a personal injury lawyer is to conduct a thorough investigation into the circumstances surrounding their client's injury. This may involve gathering evidence such as accident reports, witness statements, medical records, and expert testimony. In Corpus Christi, where evidence preservation is crucial for building a strong case, skilled personal injury lawyers leverage their resources and expertise to ensure that no stone is left unturned in the pursuit of justice.
Legal Advocacy and Representation:
When pursuing a personal injury claim in Corpus Christi, having competent legal representation can make all the difference. Personal injury lawyers serve as staunch advocates for their clients, negotiating with insurance companies, opposing counsel, and other parties involved in the case. Whether through out-of-court settlements or litigation in the courtroom, these lawyers work tirelessly to secure fair compensation for their clients' medical expenses, lost wages, pain and suffering, and other damages.
Navigating the Legal Process:
The legal process can be daunting for those unfamiliar with its complexities. From filing paperwork and meeting deadlines to attending hearings and depositions, there are numerous procedural hurdles to overcome in a personal injury case. Personal injury lawyers in Corpus Christi guide their clients through each step of the process, providing clarity, reassurance, and steadfast support along the way. Their goal is to alleviate the burden on their clients so they can focus on recovery while their legal team handles the rest.
Maximizing Compensation: Injuries resulting from accidents can have far-reaching consequences, both physically and financially. Personal injury lawyers understand the true cost of these injuries and fight tirelessly to ensure that their clients receive maximum compensation for their losses. This may include compensation for medical bills, rehabilitation expenses, lost income, diminished earning capacity, and pain and suffering. By skillfully negotiating settlements or presenting compelling arguments in court, these lawyers strive to secure the financial resources their clients need to rebuild their lives.
Expertise in Texas Law: Navigating the legal landscape in Texas requires a deep understanding of state laws, court procedures, and local regulations. Personal injury lawyers in Corpus Christi possess this expertise, allowing them to anticipate potential challenges, exploit favorable legal precedents, and effectively advocate for their clients' rights. They may have established relationships with medical providers, accident reconstruction experts, and other professionals who can provide valuable support and testimony in personal injury cases. Additionally, these lawyers may be actively involved in community organizations and advocacy groups, further enhancing their ability to serve their clients' needs and address broader issues related to safety and justice in Corpus Christi.

What to Know as Your Guide to Personal Injury Attorneys in Texas
Tumblr media
Suffering an injury or loss due to someone else’s negligent actions can catastrophically alter life forever. Navigating the confusing legal claims process while coping with health issues or grief over lost income or a loved one can become overwhelmingly stressful. An experienced personal injury attorney simplifies the navigation providing personalized guidance.
When is Hiring a Lawyer Necessary?
Not every minor injury requires attorney assistance, but anything more than trivial harm merits a consultation. Common situations making legal help worthwhile include:
Serious or Disabling Injury If an injury from any accident causes anything more than basic first aid like sutures, consider contacting an Workplace Compensation Lawyer Texas. Significant health impacts with ongoing care needs, disabilities, or loss of mobility/capabilities deserve compensation above self-funded medical expenses.
Wrongful Death Losing a loved one is painful enough without adding legal action. However, their loss also greatly impacts family members left behind. An Wrongful Death Attorney Texas fights to gain compensation for grief and financial strain from lost companionship, wages, and services the deceased can no longer provide.
Malpractice Cases When trusted professionals like doctors breach standards harming health/finances, the intricate laws around medical malpractice and professional negligence necessitate legal guidance.
If unsure about needing a lawyer, reputable attorneys offer free case assessments clarifying rights to take further action for reasonable settlements.
What Qualities to Seek in Legal Counsel
With lawyers abundantly available to market their services, it helps to know indicators setting apart genuinely supportive counsel:
Local Knowledge Seeking out locally established law firms familiar with the legal landscape, trending compensations and reputations of insurance/corporate entities proves useful compared to big national names lacking regional experience. Local connections also smooth proceedings coordinating between medical care, authorities, expert witnesses, and court systems during a case.
Willingness to Go to Trial While preferable to settle outside court, having an attorney ready to take decisive action proves vital leverage in motivating reasonable settlements. Competent lawyers prepare every case as if going to trial, using diligent evidence gathering and legal arguments to compel fair compensation.
Specialized Experience Not all lawyers handle Personal Injury Lawyer Texas equally well. Look for focused experience with similar previous cases to understand medical/technical intricacies and achieve substantial outcomes meeting each client’s unique needs.
How are Costs Handled?
Aside from financial losses from injury, legal expenses also worry those seeking justice especially when unable to work. Selecting the right payment model matters:
Contingency Fees Rather than any upfront retainer, lawyers collecting contingency fees take cases with strong legal grounds. They receive an agreed-upon percentage of final settlements ONLY if reaching a positive outcome, charging nothing otherwise. This removes client financial barriers to top-notch representation.
Free Consultations Reputable firms offer free first meetings allowing potential clients to present details while mutually determining if sufficient grounds justify moving forward together. These risk-free meetings build understanding.
