THE BEACH TRIANGLE
Everyone loves beaches and heading towards the water bodies. Be it summer, winter or rainy, the beaches everywhere in the world are always crowded and well equipped to handle large numbers.
As for me, the endless horizon widens my perspective making me aware of the infinite solutions to a situation at hand. The vast seashore makes my heart dance in glee.
Having travelled to many cities gave me access to visit varied coasts and lakes. The Daman and Diu beaches in Gujarat, Fort Kochi beach at Vasco da Gama square in Kerala’s Kochi, Ukkadam lake in Coimbatore, Ooty lake, Fateh sagar lake in Rajasthan’s Udaipur and the Panchmarhi lake, The lakes in Bhopal, Bee falls in Madhya Pradesh are great places to visit. Fortunate to have this experience in my kitty and eager for more.
THE KONKAN COAST
The coast of Maharashtra also known as the konkan coast includes Maharashtra, Goa and some parts of Karnataka. This coast is a gem in the vast treasure chest of India. Several years ago, we had visited the Kashid beach but we couldn’t explore the beach triangle of Shrivardhan, Diveagar and Harihareshwar in the Raigad district of Maharashtra.
STAY IN SHRIVARDHAN
So… it was time to pack the bags and hit the coast in Raigad. A weekend trip means everything has to be hurried up. From a 3:30 am wake up to a 4:45 am exit from home, the rush to reach Shrivardhan was there so that we could have an entire day to explore the places nearby. Soon, my driver Nilesh had the car heading towards the city exit to reach Shrivardhan well in time.
With a pretty stay in a 3-star resort, we checked in early. The entire day was planned such that the beach triangle in this area could be covered well. However, the time slot of 1 pm to 4 pm wouldn’t be utilised due to the high temperatures outside. But we decided to go for lunch at that hour.
LUNCH TIMES IN SHRIVARDHAN
Shrivardhan is home to many homestays. With a pre booking, one can avail lunch at these homestays and relish the coastal treats that it offers. We decided to head to Tavsalkar’s for lunch. Tavsalkar’s is one of the renowned home stays with great options for meal. A veg and non-veg meal later, we realised the simple meal that we had just had was tastier than any in a 5 star in Mumbai. The farm fresh ingredients added taste and health and the simple taste was a memory to be cherished. A tour of their small homestay left us happy and we decide to return to the resort.
HEADING TO DIVEAGAR
As the sun began to shed its heat and warmth, we headed out to Diveagar. The sea route from Shrivardhan to Diveagar is the most scenic route we have ever driven on. A stretch of 20 kms running parallel to divine waters and plantations is a sight to behold. Just looking at the shining waters was akin to finding Gods. The sight was mesmerizing and we couldn’t take off our eyes from the coastline.
DIVEAGAR
Diveagar is a small village nestled between Shrivardhan and Harihareshwar. Its famous for the beach and coconut and betel nut plantations. There are “wadis”(plantations) owned by locals where one can catch up with some rest before exploring the place.
ON reaching Diveagar, we visited the Suvarna Ganesh Mandir where one can find a golden idol of Lord Ganesha. From here we went to the Diveagar beach.
Now the beach here was full of people and water sports activity could be undertaken. We took a stroll along the shores and captured great moments to relish later. The liveliness on the beach was rubbed onto each other and everyone on the beach was having great fun.
With our feets full of Diveagar sands, we were heading back to Shrivardhan. The Shrivardhan beach was just 1 km of our stay and we decided to go there in the morning.
HARIHARESHWAR
DAY 2 and we were required to check out today and the Harihareshwar trip needed to be done today itself. So the clock hit 6 and we were already out for Harihareshwar. We visited the kaalbhairav temple and the Harihareshwar Beach. Though one could do with a full day at Harihareshwar, we did not have a day to spare since we were required to check out on time due to a felicitation ceremony at Kharghar and roadblocks were expected to be in place.
So we stepped back to Shrivardhan and headed to the last place on our itinerary Shrivardhan beach. We had been told that Dolphins are sighted at the Shrivardhan beach and we could spot them if lucky. Unfortunately we couldn’t as the sun was up by now and the warm waters at the top wouldn’t be suitable to their sighting. It was disappointing, nevertheless this pending circuit was completed and the memory reel is still fresh with beautiful moments from here.

1993 BOMBAY BOMBINGS 1993 - The Bombay Bombings 1993 was a terrorist attack in Bombay, Maharashtra, India on 12 March 1993 which resulted in 257 people’s deaths and 713 injured. The bombings were a series of 12 bomb explosions, the coordinated attacks were the most destructive bomb explosions in Indian history. These were the first serial bomb blasts of their kind in the world. There had been 13 blasts. The attacks were coordinated by Dawood Ibrahim, leader of the Bombay-based international D-Company, with the help of his subordinates Tiger Memon and Yakub Memon. The government executed Yakub Memon in 2015.
Three days before the bombings on 9 March, a small-time criminal, Gul Noor Mohammad Sheikh “Gullu” was detained at the police station. He was one of the participants in the riots that happened the previous year, Gullu was one of the 19 men picked by chief mastermind, Tiger Memon who sent Gullu to Pakistan in 1993 to be trained of using guns and bomb making. After he completed his training, Gullu returned to Mumbai that same year, to find out that the police picked up his brothers in an attempt to get him to surrender and Gullu surrendered to the police. He confessed in his role in the riots, his training in Pakistan and the conspiracy to bomb locaitons around the city. However his claim was dismissed by police as “mere bluff”. The arrest of Gul Mohammed spurred Tiger Memon to advance the date of these blasts which were meant to be taken place with the Shiv Jayanti celebrations in April 1993 and instead planned to carry them out on 12 March 1993 instead.
At 1:30pm on 12 March 1993, a car bomb exploded in the basement of the Bombay Stock Exchange building, the 28-story office building was damaged and nearby office buildings also was damaged. 50 people were killed by this explosion. 30 minutes later, another car bomb exploded in front of the Mandvi Branch Coporation Bank near Masjid. From 1:30pm to 3:40pm a total of 12 bombs exploded throughout Mumbai. Most of the bombs were inside cars but some were in scooters. Three hotels: the Hotel Sea Rock, Hotel Juhu Centaur and Hotel Airport Centaur were targeted by suitcase bombs left in rooms booked by the perpetrators. Banks, the passport office, the Air India Building, and a major shopping centre was also hit. Bombs exploded at Zaveri Bazaar, in an area opposite of Century Bazaar, Katha Bazaar, Sena Bhavan, and Plaza Theatre. A jeep bomb at the Century Bazaar also exploded. Grenades were thrown at Sahar International Airport and at Fishermen’s Colony, targeting certain people. A double decker bus very badly damaged in one explosion, which caused the greatest loss of line in a single incident – up to 90 people were killed.
On 25 August 2003, 2 large bombs left inside taxis exploded in South Mumbai in a busy area which killed 52 people and wounded more than 100 others.
In 2006, Sharad Pawar, Chief Minister of Maharashtra, admitted that he deliberately misled the public after the 1993 Mumbai blast by saying there was 12 and not 11 explosions and had added the name of Muslim-dominated locality to show that people from both communities had been affected. He attempted to justify his lies and deception by claiming that it was to prevent riots from Hindu and Muslim communities. He also admitted to lying about evidence recovered and mislead the public into believing that the Tamil Tigers were possible suspects.
The bombings caused a major rift within the D-Company, the most powerful criminal organisaiton in the Mumbai underworld, headed by Dawood Ibrahim. His right-hand man, Chotta Rajan left the organisation, taking most of the leadership level Hindu aides with him. This split divided the Mumbai underworld which put Chotta Rajan’s Hindu gang against Dawood Ibrahim’s Muslim D-Company. The gang war took the lives of more than a 100 gangsters and is still continuing. Seven of the accussed was assassinated by Chotta Rajan’s hitmen.
Many hundreds of people were arrested and detained in Indian courts, many suspects are still missing including main conspirators and masterminds of these attacks. Family members of Tiger Memon escaped to go to Dubai and Pakistan. Yakub Memon was executed by hanging in 2015. Dawood Ibrahim, believed to have been the mastermind of the terrorist attacks, is the Don of the crime syndicate D-Company, he is believed to have connections to terrorist elements such as al-Qaeda and its leader, Osama bin Laden, as well as Lashkar-e-Toiba and was declared a terrorist in 2003. He is believed to be hiding in Pakistan, which Pakistan denies. Yakub Memon was held in prison in 1994 and was sentenced to death in 2007 and was executed in 2015 in jail.

Therefore, below mentioned list of precautions to be taken and some of the important aspects one must look at before finalizing or buying a home. 1) Clear Title Property & Zero Risk ::- Clear title with zero risk property is one of the most important factor to be considered before purchase. There are various points which required to investigate the title of the property such as:: (A) by studying the documents of title to ensure that the owner or builder has proper ownership of the property. The documents of title should be studied very carefully as any shortfall may lead to a defective title or dispute may occur later (B) To inspect the original title deeds. (C) To search the records of the society where the property is located currently. 2) Inspect sanctioned plans & Permissions ::- Required necessary sanctioned plans with due permissions and commencement certificate by the respective authority should be inspected, especially if work of the buildings under construction. If the building is not built in accordance with sanctioned plans, the completion certificate will not be granted. For buildings that are complete, occupation certificate/completion certificate should be verified and checked. 3) Legality Check of Property ::- Ensure the property is legally authorized to be constructed on the plot it stands on. The developer should have approvals and NOCs from Area development authorities, water supply and sewage boards, electricity boards and Municipal Corporation. However if you are taking a home loan, the concerned bank will validate your property documents before loan sanction. 4) Land Tenure ::- This is very important & essential aspect should have to come in your thought list and also be considered if property is under freehold or leasehold. For example, Leasehold refers to a property tenure, where one party buys the right to occupy the property for a given length of time (30 to 99 years). In a leasehold land, the authority (usually, a government agency) remains the owner of the land and gives the land to builders, to develop apartment projects on a leasehold basis. Anyone who buys a residential flat, will own it only for the leasehold period. 5) Permitted user and Restrictions ::- This aspect should be verified as well. For example, one should see whether the property is residential or commercial as per the Development Control Regulations. Other factors such as heritage rules, set-back for road widening or any future development may apply to certain buildings, which should also be considered. 6) Documentation ::- Proper documentation should be put in place for purchase of the property. The sale document should be properly stamped and registered with duly signed and the original title deeds should be taken by the purchaser from the seller. 7) Ready reckoner rates ::- The burden on the buyer is set to increase with the recent hike in the Ready Reckoner (RR) rates. The Maharashtra government is on its way to increase the ready reckoner rates for properties between 5% and 30%, depending on the size and location in Mumbai and the rest of Maharashtra.The Ready Reckoner is used to calculate the market value of flats for stamp duty and registration charges, which are major sources of revenue for the government after sales tax and value-added tax. 8) Estimate the total cost of ownership ::- This Including parking charges, stamp duty, registration charges, maintenance, amenities, new furniture / furnishings that a customer may have to purchase. Then, a tripartite agreement is entered upon between the buyer, the bank and the builder for the rest of the amount. This agreement should be read and understood in detail before signing on it. All the clauses must be clearly understood and if any doubts, should be raised at this point itself to avaoid futher delay or any diputes. 14) Location of the Flat or Project ::- Not to forget, it is important to look around the area where you are going to be eventually residing in. The amenities, physical infrastructure and reach to all the basic places are important to be analysed. These factors will help you have a peaceful living in the house. The flat should be in a safe and secure place, offering some security to families living in the flat. 15) Estimate total cost of running the home ::- This will include maintenance charges, property tax, increased commuting charges as compared to your present place. From The Bubonic Plague To COVID-19: Impact On The Legal Profession In India

The COVID-19 Pandemic has fundamentally disrupted our social and economic order. It has affected the functioning of most institutions and the Indian Judiciary is no exception. The Guardian of Law now finds itself compelled to guard against this deadly virus, its fraternity and litigants alike. The declaration of lockdown in India was accompanied with Courts across the country restricting functioning to limited matters in order to curb the number of lawyers / litigants entering court complexes. Soon, all hearings were being conducted through videoconferencing only, in order to avoid any human contact whatsoever. However, just like previous health emergencies in India like the Bubonic Plague of the late 19th century and the Spanish Flu of 1918, Corona Virus has made many its victims including the Judiciary, and the legal profession. In order to fully appreciate the impact of the virus, the author attempts to provide an account of the effect of Covid-19 with reference to historical health emergencies and their impact on the judicial apparatus.
Pendency in Indian Courts:
The Indian Judiciary has been over-burdened for several years and COVID-19 is only adding to this menace. As of May 27, 2020, there are approximately 3.24 crore pending cases in India’s subordinate courts[i] and about 48.2 lakh pending cases in the High Courts[ii].
The Supreme Court via its Notification dated March 13, 2020 restricted functioning of the Court to “ urgent matters ” only ( w.e.f. March 16, 2020 )[iii], thereby only entertaining bail matters, suspension of sentence matters and the like.
High Courts too have restricted their functioning to urgent matters. In normal course, a High Court hears north of 400 matters a day. However, since late March, High Courts across the country are hearing anywhere between 10-100 matters a day.[iv]
Subordinate courts account for over 80 % of the pendency of cases. On April 30, 2020 the Karnataka High Court extended the closure of all District Courts, Family Courts, Labour Courts and Industrial Tribunals in the State until May 16, 2020[v]. On April 29, 2020 the Punjab & Haryana High Court ordered that all the district and sub-divisional Courts in Punjab, Haryana and Chandigarh will function “restrictively” from May 1 “till the lockdown / curfew is in force in the respective area”[vi]. These restrictive measures have led to a glut of pending cases, thereby increasing the burden on courts.
Justice Delayed Is Justice Denied:
Pendency in India’s courts has always been a hindrance in securing timely justice for people, if not denying justice altogether. As the usual functioning of courts has been disrupted, many under-trials and even many of those whose appeals are pending are left with no recourse. It can hardly be denied that the subject adage has particular force in the criminal sphere.
In pursuance of the Apex Court’s directions dated March 23, 2020, States and Union Territories have been asked to constitute High Powered Committees “ to determine which class of prisoners can be released on parole or an interim bail for such period as may be thought appropriate. ” Therefore, each State is free to determine its own criteria for granting bail. Further the Supreme Court has clarified vide its order dated April 13, 2020 that it has not directed the States / Union Territories “ to compulsorily release the prisoners from their respective prisons.”[vii] This clarification has allowed High Courts to further restrict the nature of cases in which they are prepared to grant bail.
On March 29, 2020, the Insolvency And Bankruptcy Board Of India announced the insertion of regulation “ 40 C ”, which laid down that the period of lockdown imposed in the wake of COVID19 shall not be counted for the purposes of the time-line for any activity that could not be completed due to such lockdown, in relation to the corporate insolvency resolution process ( CIRP )[viii]. While this move has come as a relief for companies undergoing the CIRP, it has left creditors waiting for repayment of dues for longer than the mandated 330-day period. NCLT benches across the country are hearing only urgent matters until the lockdown is lifted. This has left many other matters, which do not qualify as urgent, pending. [ix]
Plight Of Advocates:
A PIL was filed in the Supreme Court urging that non-payment of rent for professional premises belonging to advocates should not be made a ground for eviction, during lockdown. However, on April 30, 2020 the Apex Court refused to entertain the plea remarking that it was "not going to enter into this issue," and dismissed the petition as withdrawn. [x] Further on May 8, 2020 a three- Judge bench of the Supreme Court dismissed a plea urging the court to direct the government to formulate a uniform welfare scheme for lawyers affected across the country.[xi]
Daily appearances in court are the main source of income for most advocates, and cash flow has come to a drip, if not completely dried up. In the month of April, 82,725 cases were filed in India’s courts as compared to 8,80,000 cases in March [xii]. This steep decline in cases filed has consequently resulted in a significant dip in court fee, besides Lawyers’ income.
Younger lawyers are left with little or no work. Today, a senior lawyer has the time, and the need to address minor matters, if any, personally, rather than refer them to a junior, which may have been done prior to the lockdown.
A petition was filed in the Madras High Court, seeking a direction to the State and the Bar Council to release Rs. 50,000/- to advocates, in order to compensate for the loss of work[xiii]. However, the Bar Council Of Tamil Nadu & Puducherry has resolved to disburse only Rs. 4000/- each to needy lawyers. The Bar Council was not in a position to release any more money because of limited resources.[xiv]
Law Firms:
Law Firms have also been severely affected. Many partners have either chosen to renounce salaries this financial year or agreed to take significant pay cuts. Firms which charged clients anywhere between Rs. 20,000 and Rs 75, 000 per hour, our now renegotiating their fee, since cash-strapped clients are no longer willing to pay exorbitant sums. Moreover, clients are questioning the actual amount of time that firms are spending on their matters, thereby making firms consider implementing technology that would track the number of hours spent by an executive on a client’s job, in order to provide proof to clients[xv]. This is great innovation; however, it comes with a significant cost in a day and age when law firms are suffering unprecedented lows in business.
Prisoners:
Corona Virus cases have already sprung up in various jails across India. Amongst other jails, there are over 180 cases in Mumbai’s Arthur Road Jail[xvi]. Authorities have been compelled to take drastic measures such as - release a large number of inmates, shift inmates to different prisons and designate temporary places as jails for keeping new undertrials.
By end February, nearly the cases (233 of 565) of COVID-19 reported in Wuhan, China, were from the city’s prison system.[xvii] This fact is reflective of just how dangerous prisons are today.
Indian prisons have historically been overcrowded and may potentially become breeding grounds when threatened by a contagion like Covid19. Considering the difficult living conditions and lack of hygiene, which is an unfortunate reality of our prisons, containing the spread would become nearly impossible.
Coping With This Challenge:
We are now in the age of what has come to be known as “Virtual Courts ” which function through videoconferencing, e-filing, telephonic mentioning of urgent matters and online payment of court fees. These are not bereft of teething problems. Perhaps, the biggest drawback of this new system is the inability to provide public access to courtroom proceedings. Virtual proceedings are being held in camera, and are therefore not open to public which is discordant with what has been held in Naresh Shridhar Mirajkar v State of Maharashtra[xviii], where the Apex Court observed that the public has a right to be present in court and to watch proceedings.
Lawyers are facing problems with basics such as uploading petitions on the Supreme Court website, since the data restrictions put in place are just 5 MB for a petition and 2 MB for additional documents, thereby compelling lawyers to break up the file into multiple volumes.[xix]
Déjà Vu
Historically, the Bubonic Plague of the late 19th century and Spanish Flu of 1918 are two points of reference when the entire framework of judiciary was disrupted on account of a health emergency.
The arrival of the Bubonic Plague in Bombay ( now Mumbai ) in 1896, brought courts to a grinding halt. A J C Mistry, a managing clerk at the Bombay law firm, Wadia Ghandy & Co. has given a grim account of the situation in early 1897. Mistry noted that the judges of the Bombay High Court “had no work to do.” The staff of the firm returned to work after four months, however over the next decade three members fell victim to the plague and died.
Mahatma Gandhi on page 72 in his book - The Law and The Lawyers[xx], while discussing an appeal which was to be heard in Veraval in Gujarat, writes that there were as many as fifty cases heard daily ( a lot of cases for that day and age ) in the Court at Veraval which had a population of about 5,500 people, however at the time of writing the “plague was raging ” and it was “ practically deserted ”. This anecdote bears a striking semblance to the scenario today.
Property which was seized in discharge of debts those days included pots, pans, utensils, bedding etc. These items were regularly hauled in and out of court. Legal historian Mitra Sharafi on page 48 in her book - Law and Identity in Colonial South Asia: Parsi Legal Culture, 1772–1947, writes that this practice of bringing property inside court rooms had become a “ particularly unsavoury phenomenon when the bubonic plague swept through the city. ”
When the Spanish Flu arrived in 1918, the judiciary was hit once again. Jurors, lawyers and assistants of the Calcutta High Court were severely affected. The Court was functioning on somewhat similar lines of how the courts are functioning today, thereby causing consequent pendency issues. [xxi]
Even in Bombay, law offices were bought to a standstill. In late June 1918 the Times Of India reported,
“ Nearly every house in Bombay has some of its inmates down with [influenza] fever and every office is bewailing the absence of clerks. ”
The flu soon found its way into jails and a need was felt to decongest prisons as inmates began to fall sick and the jails were short-staffed. The District Magistrate of Bijapur particularly wanted to release sick prisoners from jail, but the then Government was not ready to cooperate.[xxii]
It may be relevant to mention here that an eminent lawyer by the name of, Mohandas Karamchand Gandhi was himself laid down with the Spanish flu with a faltering heartbeat. However, destiny had charted out a different path for him, and India.
Conclusion:
This piece has only covered some of the ramifications of COVID-19 on the legal profession and there are other areas such as legal education which also need to be addressed on a priority. The existing delays in the legal system will only be exacerbated by the impediments COVID-19 will inevitably present to the progress of investigations, charging decisions, pre-trial processes etc. It appears that Corona Virus is here to stay, and the Judiciary needs to cope with it. We have been through a pandemic before and have come out of it as well. Normal functioning or rather “ New Normal ” functioning of courts is going to take its own time. Hopefully, it shouldn’t take too long, lest Lady Justice will soon have to, along with a blindfold, sword and scales, be adorned with — a mask.

The plot of the story is unique and interesting. I liked how the author started the story. But, with every chapter, it was getting a bit tedious. There were too many errors and unnecessary details shared by the author. The narration is a bit boring though the author tries hard to keep the reader hooked throughout. This book has a lot about ancient times. The only reason why I was able to finish the book. There are some sketches that are super interesting, giving the reader a gist. The writing style of the author is simple. The book could have been more interesting with proper editing.I liked how the author started the story with the backdrop of streets of Mumbai. overall it’s an ok read. Rating: 2.5/5.
