Amit Kumar had everything going for him. After graduating in engineering and landing a decent job, Amit wanted to settle down with his childhood sweetheart Renu. The couple had known each other since Class IX and dreamt of a life together. The only difficulty was that Renu belonged to a Brahmin family and Amit was a Dalit.
With their homes barely a kilometre apart in Garhwa district of Jharkhand, Renu knew her family would never approve of the match. The couple decided to run away and tie the knot in another State. And thus began their tale of unending harassment and tragedy.
The couple married at a temple in Dehradun and got their marriage registered there. They had just about settled down at Paonta Sahib in Himachal Pradesh when, in a midnight raid, the Uttar Pradesh police took away Renu, claiming that she had been abducted. Amit and Renu have not seen or spoken to each other since that fateful night of August 13, 2021.
Amit’s life has been a quagmire of legal battles and dismissed habeas corpus petitions since then. “I fear my wife is no more,” he told The Hindu.
Activists say such tragic situations can be avoided if couples like Amit and Renu are provided safe houses and special protection by the State governments as mandated by the Supreme Court.
According to data from the National Crime Records Bureau (NCRB), the number of “honour killings” in the country was 24, 25 and 33 in 2019, 2020 and 2021, respectively. Punjab, Madhya Pradesh and Jharkhand topped the list in 2021 and 2020, while Manipur was on top in 2019.
The government in 2021 informed Parliament that there were 145 “honour killing” incidents in the country between 2017 and 2019.
Interestingly, though the NCRB report attributed only 25 deaths to “honour killings” in 2020, it said there were 27 deaths due to casteism and 1,558 due to “illicit relationship”. Similarly, in 2021, 33 deaths were listed under “honour killings”, but 1,544 and 1,532 under “illicit relationship” and “love affairs”, respectively.
So far, only Delhi, Haryana and Punjab have safe houses for inter-faith and inter-religious couples. Kerala has only announced the setting up of a safe house.
In fact, only 21 States have said that they have complied with the Supreme Court directives, which means that they have asked the police officers concerned of a State for strict compliance, according to Dhanak for Humanity, a non-governmental organisation which works with such couples, helping them solemnise their marriages and providing legal support.
The Supreme Court had in 2018 directed that safe houses be set up in every district as well as a special cell in States for couples facing opposition from families and community.
Gaurav Yadav, an engineer from IIT Chennai, said he was working with survivors of “honour crimes” and couples who are in hiding to petition the government for more safe houses across the country.
“Soon we will form an official grouping and petition the government to follow the Supreme Court directives on safe houses and special cells,” Mr. Yadav said, adding that he had organised a convention regarding the same in Delhi recently.
He said though couples had been demanding that safe houses be set up, the State administrations had looked the other way.
An example is of Ravikant Chandrawanshi and Alisha, who had a harrowing time getting married under the Special Marriage Act in Chhattisgarh.
The inter-faith couple at first decided to elope and marry in Bilaspur. However, a lack of support system and security, including finances, saw them return home in Kawardha within four days.
“As my wife’s family were well to do and politically connected, they kept up the pressure on us. Finally, we had to take legal recourse and approached the High Court asking them to direct the State administration to provide the mandated safe house and police protection.
“However, we were informed that there was no safe house and Alisha had to go to a sakhi centre or a women’s safe house,” Mr. Chandravanshi said.
Though the couple approached the highest of authorities, they were not given any police protection either and had to go into hiding for around six months after their marriage.
According to Asif Iqbal of Dhanak for Humanity, most States send the girl to a Nari Niketan after couples approach them. “It is here that the girl is the most insecure as her family mostly approaches her and puts pressure to go back. Many a time, this also leads to what is known as honour killing of the girl”.
Sanjay Sachadev of Love Commandoes, an organisation which rescues and shelters such couples, said, “The need of the hour is safe houses across the country. In almost every case, the police try and send the girl to a women’s shelter and the boy is left to fend for himself.”
A couple who are staying in a Delhi safe house and did not wish to be identified said that they could not have thought of living together had it not been for the security of the safe house.
Mr. Iqbal, whose organisation has helped many couples seek legal recourse to stay together and get married, said that of the distress calls he receives, the most were from Uttar Pradesh, Maharashtra and Rajasthan.

Between Controversies to Landmark Verdicts: This is why 45th CJI Dipak Misra tenure will be remembered
On October 2, 2108, Chief Justice of India Dipak Misra tenure concluded.
No doubts, Justice Dipak Misra’s tenure will be always remembered for historic landmark judgments but his tenure will also be remembered for the controversies that have surrounded him at the top post of the apex court. Perhaps the most controversial tenure in the history of the supreme court of India.
The judgments passed by his bench will certainly rank him as a Chief Justice who vindicated the spirit of the Constitution through his pronouncements.
Justice Misra joined the Supreme Court bench in the year 2011. In the last eight years, firstly as a judge of the apex court of the country and then as the CJI, Justice Misra was associated with several landmark judgments during his tenure at the Supreme Court. He interpreted the Constitution to expand the scope of fundamental rights. Also, during his tenure as the CJI, four senior judges held a dramatic press conference, which was seen as a mutiny in the Indian judiciary, which has been famous for its brotherhood. Justice Misra’s 13-month tenure as the 45th CJI, of which he assumed office on August 28, 2017 was cinematically eventful, adored by a series of landmark judgments, two unconventional midnight hearings at the Apex Court, differences with the government, rumors of him being nepotistic and an unprecedented press conference by four senior judges of the Supreme Court.

Controversies
Outside his judicial functions, he dragged the supreme court into a period of chaos and earned the dubious distinction of being the first chief justice against whom an impeachment motion was attempted.
Within a month of Misra taking over as chief justice came what is now called the “medical colleges scam.” A first information report registered by the Central Bureau of Investigation on Sept. 19, 2017 claimed that attempts had been made to manipulate supreme court proceedings to obtain permissions in favour of a medical college run by the Lucknow-based Prasad Education Trust, and named former Odisha High Court judge IM Quddusi as an accused.
In October, activists moved petitions seeking an independent inquiry into the matter. On Nov. 9, the petitions were mentioned before a bench headed by justice J Chelameswar, who was then the second most senior judge, as Misra was presiding over a constitution bench. Chelameswar sought the formation of a five-judge bench to deal with the petitions.
The next day, following an order from a two-judge bench handling a similar petition, a constitution bench was quickly put together to nullify the orders of Chelameswar’s bench. In the process, the power of the chief justice as master of the roster was asserted. Later, the petitions were dismissed.
This resulted in Four senior judges of the supreme court who comprised the collegium at the time—Chelameswar, Ranjan Gogoi, Madan B Lokur, and Kurian Joseph—meeting the press in January and, in the process, laid out a series of questions on the functioning of the chief justice in assigning cases to particular benches.
“The administration of the supreme court is not in order,” the judges said at the press conference. The implication of the statement was clear. There was an attempt to fix benches and senior judges were being kept out of important cases. The independence of the judiciary was in peril.
In the interview, Justice Chelameswar was reported saying that “the administration of the Supreme Court is not in order and many things which are less than desirable have happened in the last few months. We owe a responsibility to the institution and the nation. Our efforts have failed in convincing CJI to take steps to protect the institution.”
After the press conference, several opposition party came forward to bring impeachment motion against Dipak Misra. The draft proposal has called Misra’s case as “abuse of authority to arbitrarily assign individual cases to select judges”, according to media reports.
Prasad Education Trust case: One of the cases under the radar is illegal gratification in the Prasad Education Trust case, according to News 18. The case pertains to accepting bribery by medical institutions for getting clearances to set up medical colleges. It has been alleged that Misra had submitted a false affidavit allowing the acquisition of lands to the institutions for building medical colleges.
Justice Loya’s death: Dipak Misra had allegedly refused SC judges’ petition, which demanded an independent probe against Loya’s death, according to the presser of the four senior SC judges.
The impeachment motion was later dismissed by Vice President.
Dipak Misra at the Independence Day function organised in the Supreme Court by the Supreme Court Bar Association, said that it was easy to criticise, attack and destroy a system but instead an endeavour should be made to transform and reform it. “There may be some elements who try to weaken the institution,” but the judiciary will refuse to succumb, Chief Justice Misra said in an apparent reference to discordant voices coming from within the top judiciary and outside.
After the storm of the press conference and impeachment motion, the focus was back on the judicial functions of the chief justice. Despite the protests of the four judges, they continued to be kept off important cases.

Hearing petitions filed by a few politicians including Rahul Gandhi from Indian National Congress, Arvind Kejriwal of Aam Aadmi Party and Subramanian Swamy of Bhartiya Janta Party in May 2017, Justice Dipak Misra held reputation of a person could not be allowed to be crucified at the altar of the other’s right of free speech. Justice Dipak Misra ruled, “The right to reputation is a constituent of Article 21 of the Constitution. It is an individual’s fundamental right.” The bench upheld the 156-year-old defamation law. Can elected representatives practice Law
A PIL was filed by BJP Leader and Sr. Advocate Ashwani Kumar demanding ban on the practice of lawyers who are elected as a MLA/MP or a Minister. The bench led by Justice Misra held that as the profession of an elected representative does not fall within the rule 49 of the Bar Council of India Rules, lawmakers (with a law degree) can practice law as a profession.
Supreme Court Live
The Justice Misra led bench also held that there would be live telecast of the cases involving national and international importance. The bench held that live streaming of the Supreme Court proceedings would bring transparency and accountability to the judicial process and was a step to be taken in public interest.
RamJanmbhoomi-Babri Masjid case(Ayodhya)
A three judge bench headed by Chief Justice Dipak Misra, by a majority of 2:1 declined to set up a larger bench for a relook of its 1994 verdict which held a “mosque is not an essential part of the practice of Islam”. The apex court will now hear the main Ayodhya title suit from October 29.
Hadiya Case
A 24 year old girl from Kerala married a boy from another religious group and the Kerala High Court invalidated the marriage. In the order authored by CJI Misra set aside the impugned judgment, while allowing continuation of the NIA probe.
Khap Panchayat Case
In this case Hon’ble Supreme Court held that the right to choose life partner is fundamental right, consent of family, community, clan not necessary for marriage between two adults.
The Euthanasia Case
Constitution Bench of Supreme Court of India led by Justice Misra has held that right to die with dignity is a fundamental right. The Bench also held that passive euthanasia and a living will also legally valid. The Court has issued detailed guidelines in this regard.
Meesha Case
Supreme Court bench led by Justice Misra dismissed a petition seeking ban on a Malayalam novel “Meesha” which is about a woman who stood up against caste based practices of worships.
AAP vs. Delhi LG case
In the controversy over who is going to rule Delhi, the Supreme Court led by Justice Misra held that constitutional morality should guide governance and to work in accordance with the rules.
The Midnight hearings
Yakoob Menon death sentence case and the case of Karnataka government formation were the two occasions where Justice Misra was kind enough to allow midnight proceedings to ensure justice is done.

While healthcare has largely been a neglected issue in past Indian general elections, major parties started talking about health in their manifestos from 2004. In some states, there’s evidence it is becoming increasingly important, this 2014
Lancet
report
said, citing the
Rajiv Aarogyasri Community Health Insurance Scheme
for poor families as a major reason for a second term in 2009 for the late Andhra Pradesh chief minister Y S R Reddy, and Gujarat’s
Chiranjeevi Yojana
, which provides skilled healthcare to pregnant women in collaboration with the private sector and contributed to Prime Minister Narendra Modi’s popularity when he was chief minister. Healthcare is important to political and economic debate because inadequate public healthcare and healthcare expenses push an additional 55 million people back into poverty in India every year, according to this 2015

However, health-related political discussions are, currently, limited to debates around major
health scams
, or state failure during
severe epidemic outbreaks
. In general, electoral battles have not been won or lost because of healthcare issues.
India has a healthcare crisis, but solutions need to be state- and district-specific

–about 40 million–the rate of obesity recorded an 8.6-fold increase in India’s rural areas over 14 years and a 1.7-fold

More than half of India’s rural population uses private healthcare, which is four times as costly as public healthcare, and can cost the poorest 20% of Indians more than 15 times their average monthly expenditure; shortages of doctors at public health centres have risen 200% over a decade, and even cities such as Mumbai need to double staffing of public healthcare (details

). The five states going into polls represent the good, the bad and the ugly of nutrition and health in India, our analysis showed. The trends are so diverse that it is clear that no single set of solutions can be the answer. India needs state-specific, if not district-specific, solutions in health and nutrition.
Problems with early marriage and sex ratio in relatively advanced Manipur and Goa
The percentage of women currently aged 20-24 who were married before reaching the age 18 has declined in all the states going to elections, with the exception of Manipur, where their percentage increased from 12.7% to 13.1%, according to the
National Family Health Survey
(NFHS) reports for 2015-16, released over 2016 and 2017. In 2015, Punjab had an even lower proportion of women (currently aged 20-24) married before age 18 than Goa, declining from 19.7% in 2005 to 7.6% in 2015. Goa still has 9.8% women (currently aged 20-24) who were married before age 18. Manipur also has
65.9%
children fully immunised. The latest NFHS data release shows that between 2005 and 2015, Manipur’s sex ratio at birth
declined
from 1,014 to 962. For a state known to be a showcase of
women’s empowerment
, this must come as a wake-up call. A girl born in Manipur was more likely to be educated; more likely to be working as an adult; more likely to survive childbirth and more likely to not be the victim of crime than in most Indian states.

Infant, maternal mortality: Vast variations within states, districts reveal clearer picture
Uttarakhand has shown the slowest improvement in infant mortality rate (IMR)–deaths per 1,000 live births–although NFHS data for UP are yet to be released. Still, as
SRS data show
, UP’s IMR has come down from 57 to 48 between 2011 and 2014, suggesting that NFHS data will show improvement between 2005 and 2015.

However, as our state-specific analysis to follow will show, states such as UP reveal wide variations within districts in terms of IMR. For example, according to the
Annual Health Survey (2012-13)
, the latest district level data available for UP, the IMR in Shrawasti district at 96 (the worst IMR in India was 56 in
Madhya Pradesh
in 2012) was almost three times as much as in Kanpur Nagar, which had an IMR of 37 (comparable to Gujarat’s

in 2012).

The government does not provide maternal mortality ratio (MMR)–deaths per 100,000 births–estimates for small states such as Goa and Manipur,

in July 2016. Still, there are not many indicators that reveal inter-state health variations within India like MMR does. The MMR in UP and Uttarakhand is almost five times that in Kerala, the state with the lowest MMR among major states. Yet, in states with high maternal mortality, political parties do not discuss plans to reduce these preventable deaths.

Undernutrition is key determinant of ill-health in all five states
Undernutrition is a major underlying determinant of ill-health in all the election-bound states, and the difference between states is not as stark, as it is with, say, MMR. For example, across the electoral-battleground states, the proportion of stunted children under the age of five were similar: 29% in Manipur, 20% in Goa, 26% in Punjab and 34% in Uttarakhand for the year
2015-16

Doing too much is as bad as doing too little: The nuances of healthcare
Under-provisioning of healthcare is a major Indian problem, but so, often, is over-provisioning. In 2015, for instance, in rural areas of Kapurthala district in Punjab,
61.5%
of all deliveries in private hospitals and clinics were caesarean. In Manipur’s Imphal West district, almost two of every three deliveries in private hospitals were caesarean. Public facilities also have a high proportion of caesarean deliveries, although not to the extent reported from private facilities, as we analyse in the state-specific stories. Similarly, undernutrition is a major issue, as is over-nutrition. In Punjab’s Fatehgarh Sahib district,
36.5%
of men surveyed by NFHS in 2015-16 proved to be obese or overweight, as were 41% of all the women surveyed. In Uttarakhand districts such as Dehradun, Nainital and Udham Singh Nagar,
one in every four women
surveyed was obese or overweight
.
With non-communicable diseases becoming the leading cause of death in the country, the twin burdens of malnutrition and ill-health, and the resulting policy choices, will require discussion. Will such health- and nutrition-related issues be debated in the battle states? Will people demand better health and nutrition? Will politicians see the merit in developing a constituency of long-term supporters linked to human development? The coming weeks could provide some answers. Meanwhile, district level data analysis will raise more questions.
