Order: The Habeas Corpus Petition of the mother for the custody of the child aged 13 years and having exceptional maturity was dismissed as the child in unequivocal terms said he did not want to go with the mother and wanted to go with his aunt, uncle, and cousin.
The petition was dismissed on April 4, 2024
Facts
The petitioner is the mother having filed writ of habeas corpus seeking production of the detenue boy aged 13 years before the Court. The petitioner mother after the dissolution of her marriage with the father of the detenue, re-married and had a daughter from her second marriage.
The alleged detenue was living with his father at Dubai where he was working and detenue was studying at Sharjah. The father of the detenue died in October 2023 of Cancer. After the death of the father of the detenue, the detenue was shifted to Dubai and he was got admitted in the same school where he was studying under the care and protection of the sisters and brother-in-law of the deceased.
Upon direction the detenue was produced before the Court but the boy was reluctant to go with the mother.
Interaction was made with the mother and the boy individually and collectively in the Chamber of Hon’ble Judges and Consultant Psychologist at the Counselling Centre also interacted with the boy.
During the interaction with the Hon’ble Judges the boy made it clear that he was not willing to go along with his mother. The reason he stated is the mental pain suffered by him by the act of his mother, who had no reservations in speaking bad about his father, who had left for his heavenly abode.
The boy who was having emotional attachment of a high grade with his father, felt it extremely hard to hear verbal abuse and ill-will uttered by the petitioner against her former husband
The detenu even tried to show the Judges his mobile phone, where the petitioner has sent abusive chats about his father.
The boy clearly and in a calm demeanor told the Judges that he is comfortable with his aunt, uncle and cousin and he gets pleasant atmosphere at home and at school and he will not be able to adjust with his mother, step sister and step father.
Observation of the Court
The petitioner was not able to establish that the act of the respondent’s uncle and aunty keeping the custody of the detenu with them, and taking care of his affairs including education and grooming up, is in violation of any law applicable to the parties.
The court rejected the contention of the counsel of the petitioner that being mother Petitioner stands on a better footing for the custody of the boy than his uncle and aunty.
As the boy who is having mental maturity far beyond his age, has conveyed to the Court in unequivocal terms that he will not be able to live along with his mother who often ventured to hurt him by saying bad words about his deceased father with whom he was having deep affectionate bondage.
In the writ of habeas corpus relating to the custody of children, the paramount consideration should be the welfare of the children.
If an order directing the custody of a child with a parent is likely to be detrimental to the interest of that child, especially when the child is of advanced age, and having considerable maturity in mind to decide his future course of action, it is not possible for the Court to pass an order compelling that child to live with such parent who is totally unacceptable to him.
We understand from the interaction with the detenu separately and jointly with the petitioner, that he is likely to suffer emotional trauma leading to disruption of his studies and peace of mind if he is compelled to live with the petitioner.
In view of the child’s clear disinterest to go with the petitioner, the request of the petitioner to have custody of the detenu cannot be entertained in this petition for a writ of habeas corpus.

So on my old account I used to hc he is Indian-British, whose family hails from Travancore (Kerala nowadays). This was based on what I ASSUMED was canon info since back in January, all Chicken Run wiki articles about him mentioned he's Indian-British. But apparently that's not 100% settled info what his ethnicity is?? And the wikis have been edited since. His VA Nick Mohammed is from a mixed Cypriot/Indo-Trinidadian family though and I spent time reading about Indian-British immigrant history to get Fry's characterization accurate, so imma keep with that hc.
Anyway! I headcanon Marcus is the only child of wealthy businessmen that owned a highly successful trade company. His Vaishya grandparents moved to Britain during the late Victorian era; after all one of the only ways a PoC family could make it back then in Britain was by being filthy rich, and very early on the Fry family had been forced to adopt a "British" way of living in order to be taken seriously by the shitass imperial society. Such as switching to a British surname and avoiding to display too much of their original culture in public. A colonial trauma that still prevails, since Fry's parents christened him with a heavily English name.
I REEEALLY wanna give a try to designing Fry's parents sometime!! But I imagine his parents as sort of a healthier parallel to Melisha's parents; his father is a pristine and calm gentleman with a soothing voice and a love for theatre and literature (a trait that Marcus inherited LMAO) while his mother is more stern, headstrong and very, VERY proud of her status. (but she also has a infectuous smile and laughter and has a bombastic overdramatic streak...something that Fry inherited as well)
They're both native Malayam speakers, and while their family in public strives to keep Keralite culture hidden, they made sure to teach Marcus to speak his native language fluently as well, along with Hindi, Bengali, Tegulu and Tamil. Along with that, they frequently go on family trips to Travancore and enjoy things like inji neer, Kathakali performances (which inspired Fry on his love for theatre <3) and Carnatic music.
Both parents pushed Marcus to study hard and gain multiple academic degrees - it was all out of love and concern, because they wanted Marcus to be able to survive in the cruel world out there without only relying on his money. (Once again, a PoC immigrant family experience that I can identify with as well... even if society nowadays is not nearly as racist as it was back then, unfortunately PoC people are often forced to study waaaay harder than white people in order to make it.) Because they had lived through the years of great depression in the 1930s, and while they managed to survive with most of their wealth intact, they knew that one should not rely only on money for support since anything could happen.
Fry, as a child, was a gifted A+ grade student and a very well-behaved, so his parents called him a little ray of sunshine and a future hope. He yearned to be perfect so his parents would never be disappointed in him. Something that later on contributed MASSIVELY to Fry's gifted child burnout, and how he adopted a sinister, sadistic fascination with mind control and manipulation during his Cambridge years.
Once Marcus came out as trans and genderfluid to his parents, his father was very patient and accepting, but his mother spent several years in denial before finally accepting him. Not directly out of transphobia - but because she was afraid that Marcus would be discriminated, attacked and hurt by people, and that he should focus first on building a career for himself instead of bringing a bad name to the Fry family like this, with an outrageous gender identity. But she soon realized that hiding himself would only hurt her child on the long run. Also - the way Fry managed to fully bribe (cough mind control cough) British officials to switch the gender in his personal info and passport was nothing less than impressive to both of his parents LMFAOOOO and they're very proud
However despite all of this, Fry retains a loving relationship to his parents!! He goes to their mansion every Christmas, and they're also VERY accepting and encouraging to his marriage to Melisha. In fact, his mom was relieved to see Fry had married a very orderly, stern and no-nonsense woman, because Marcus had always been a scatterbrained mess and a reckless money-spender. He made a wonderful scientist, but business-running had never been his thing, so Melisha taking care of all that is like a lottery win to the Fry parents. ESPECIALLY since Melisha came from a poor household - a woman like this, who knows what it's like to live at the rock bottom, surely knows to keep Marcus humble and not let him make flimsy business decisions!! (either way Melisha is still a bit intimidated by Fry's mom, which says a lot considering what kind of a girl Melisha herself is LMFAO)
Pluuuus... the Harsh Expectations(TM) is something that Melisha can relate to </3 It's something that catches her entirely off guard, when she learns this detail about Fry's past. After all, the silly goofy doctor is like an endless ray of sunshine, he's rich and successful. (and we all know what Melisha's mother told her about money bringing happiness...) How could he ever have any worries or feelings of inferiority??
It's a detail that makes (in my hcs) Melisha fall even deeper in love with Fry and become tenfold more protective over him :''') <3 Once she realizes what a horrific burden this goofball is carrying on his back, and yet he still finds the energy every day to stay positive, be optimistic and support Melisha during her hard days.

So basically my dad doesn’t talk a lot much. But when he does he’s either talking abt how he lived in India or the bible( even tho he doesn’t believe in it ik weird asf💀)
But like basically he’s super antisocial. But my mom said that he used to be super social and funny and stuff. I figured she was js making it up to say smth yk. But like when we went back to India to his state Kerala, he was super talkative and smiling and laughing.
And I was like ????huhh?? Who tf is this guy?? This is not my dad???🤨🤨
And I was js thinking abt ur hc for Steve being African and I lowk think this is how his dad is. Like he is kind of disassociated cuz he js never got used to America. And he loves Steve but he can’t rlly show it cuz like he is js completely out of place w his life.😕
And like maybe one time they got the money to go to a trip back home. And Steve was kind of like annoyed cuz he didn’t want to get stuck w his dad for 2 months. But when he went he saw like this whole new side of him.
And like my dad speaks Malayalam and he loves speaking it cuz it’s his native language obv. But me and my brother never learned cuz our parents speak diff languages and our dad never spoke it to our mother or around us. So like I hc Steve the same like he feels kind of guilty or whatever for not knowing it. And like his dad obv beats on him and shit and Steve will get bitter over it(justified). But he knows he loves him in his own way and after that trip feels guilty for not knowing more abt his roots and not being able to make him feel at home.
Sorry for going on a rant lmfao but js felt like relating to Steve and ur hc was so perfect for it so I had to let u know☺️☺️

YEA THATS KINDA WHAT IT IS, i would say that the reason why steves father is the way he is is for a multitude of reasons, but one of them is bc he just never rlly understands america and the frustrates him a lot that he cant “fit in”, he wants to take care of his family just doesnt know how to in this new environment

CHENNAI: Theatres in Tamil Nadu on Sunday decided to abstain from screening Sudipto Sen’s ‘The Kerala Story,’ citing its poor performance and the law and order issues. The Madras High Court had earlier dismissed a petition seeking a ban on the multilingual venture.
Tiruppur Subramaniam, president of the Tamil Nadu Theatre and Multiplex Owners Association, refused to call this a ban. “It is purely based on market reasons. We don’t usually take up small-scale Hindi films for screening. The film has no star value and these films have a history of not doing well here. Only films with stars like Shah Rukh and Aamir Khan can generate buzz here.”
Mariappan, owner of the Chennai-based Albert Theatres, said audience safety is another reason for the move. “Audience safety is paramount. Screening this film could lead to law and order and safety issues.”
Protest against The Kerala Story in TN
Protests against the film were seen in several parts of the state since its release on May 5. The film’s trailer had generated controversy by claiming 32,000 Kerala women had been forcibly converted to Islam and recruited by ISIS. After the veracity of the figure was questioned by the Kerala HC, the filmmakers agreed to take down the trailer.

Mohammad Niyas, raised concerns over the delay in the release of funds, questioning why the state government had not provided accurate figures when seeking assistance from the central government. The bench pointed out that precise data should be presented when requesting financial aid. The finance officer of the SDRF appeared before the court and stated that there was ₹677 crore in the fund. However, when asked for details on how much of this could be spent, the officer failed to provide clear answers. The bench confronted the officer, saying, “You are not sure that ₹677 crore exists in the SDRF account. This is why you have repeatedly requested immediate funding. Where did you get the figure of ₹214 crore for immediate assistance? How can we claim that no funds have been received from the central government if you cannot provide details of expenditure?” Following the court’s stern remarks, BJP leader Prakash Javadekar criticized Kerala Chief Minister Pinarayi Vijayan. In a post on X (formerly Twitter), Javadekar stated that the LDF-UDF alliance had been exposed for their lies about Wayanad relief. Javadekar further wrote, “The LDF-UDF coalition has been exposed in the High Court due to their lies about Wayanad relief. The Modi government at the Centre has provided adequate funds to Kerala through SDRF, NDRF, and regulatory packages. Further assistance will be provided. The Pinarayi government is sitting on the available funds and blaming the Centre for not receiving aid. The Centre has already provided over ₹500 crore through SDRF for the victims, and there is approximately ₹700 crore in the state’s disaster fund. The state government has failed to use the ₹700 crore in the fund. Donations for the CM Relief Fund have been collected from across the globe but are not being utilized. Basically u said Johnny wears a dhoti. Dhoti is a South Indian clothing for guys like in Kerala or Tamil Nadu or some other places in south India. I think u meant a loongi. Loongi is what guys wear in Bangladesh, it’s pretty similar to a dhoti. I t think some folds r different and it’s not white like a dhoti it usually has some checkered patterns.
