La banque UBS est jugée pour « démarchage bancaire illégal ».
Selon l'accusation, elle aurait permis à 10 milliards d'euros d'échapper au fisc.
Les avocats de la banque avaient déposé des recours, lundi.
Le tribunal les tous rejetés, ce jeudi, permettant la poursuite du procès.
UBS va devoir rendre des comptes. Le tribunal de grande instance de Paris a rejeté, ce jeudi, les trois questions prioritaires de constitutionnalité, permettant ainsi au procès de la banque suisse de se poursuivre. Lundi, ses avocats et ceux de sa filiale française avaient bataillé à la barre, pendant plusieurs heures, afin d'obtenir un renvoi du procès. Mais Catherine Mée, la présidente de la 32e chambre du tribunal a estimé que leurs questions étaient « dépourvues de caractère sérieux » et a donc refusé de les transmettre à la Cour de cassation, comme l’exige la procédure.

Voilà qui ouvre donc la voie à la poursuite de ce procès prévu sur six semaines et où la banque suisse est accusée, avec sa filiale française et six de ses anciens dirigeants, de « démarchage bancaire illicite » et de « blanchiment aggravé de fraude fiscale ».
Parties de chasse et tournoi de golf
Après cinq années d’instruction, les juges Serge Tournaire et Guillaume Daïeff ont acquis la conviction que la banque suisse avait organisé, en France, divers événements (tournoi de golf ou partie de chasse) afin de démarcher illégalement des clients français pour leur proposer des placements nets d’impôts dans leurs succursales suisses.
A l’aide de plusieurs méthodes de calcul, les juges ont estimé que 10 milliards d’euros environ auraient ainsi échappé au fisc. Pour ces faits, la banque – qui est la première en France à être jugée pour des faits similaires — encourt une peine d'amende théorique de cinq milliards d'euros. Les six anciens dirigeants, eux, risquent une peine de dix ans de prison.

Leurs avocats devaient, ce jeudi après-midi, défendre à la barre plusieurs demandes de nullités de procédure, sans toutefois remettre en cause la tenue du procès. Selon le calendrier fourni par le tribunal, celui-ci devrait s’achever le 15 novembre.
