anyway dont take this too seriously please but ive been watching an unhealthy amount of american legal dramas so im starting a list of things about the us legal system that either fascinate me or freak me the fuck out. or both.

plea bargaining. seriously? you scare someone enough and they'll plead guilty out of fear of an even harsher sentence

jury duty. nothing wrong with it per se (at least not in theory) but judging by the "ugh, mom, do i have to?" culture that surrounds it i cant help but wonder if how much the lack of motivation and interest affects a jury's decision. sure, the verdict has to be unanimous but sometimes people just wanna go home

but yeah, jury trials in general. long list of pros and cons for this one. great when you're guilty and have a good strategy, maybe sometimes not so great when you're innocent but things just dont look great

grand juries. this concept just seems utterly insane to me and tbh the more i read about it the less i understand it

police chiefs, sheriffs, judges, prosecutors, etc. being ELECTED. call me crazy but some jobs are too important. these people should not be preoccupied with the whims of voters and their own popularity

pre-trial detention. this should be a last resort

cash bail. very wild west (yay) but also very discriminatory (boo)

polygraph tests. absolute red nose clown shoes ridiculousness

civil asset forfeiture, i.e. the pigs can take your stuff

young people being tried as adults (especially since this often seems to depend on skin color)

many states having no minimum age of criminal responsibility at all

fruit of the poisonous tree doctrine. this one's fascinating because it seems so very radical at first glance, but it does make sense when considered in the context of an adversarial legal system

three strikes laws and mandatory minimum sentencing. as far as i can tell these things are universally loathed across the political spectrum yet somehow still a thing

publicly accessible sex offender registries. how is that not considered cruel and unusual punishment? especially when relatively harmless things can constitute registerable offenses

prison sentences that exceed the lifespan of an average human, especially for crimes that aren't literally murder. like sorry but that's just silly.

A question regarding TWST copyright? What exactly does it mean? Since I’ve seen people use sprites and official art in banners, icons etc. Can they not do that anymore?

Hello! Technically you can use those images as pfp, banners, etc since nobody's coming from disney japan to sue you for it (it would be too much trouble, they would have to take legal actions against thousands of people lmao) but if you want to make a project like a game using the twst's assets you could face legal consequences.

So with all that being said, it's impossible that someone takes legal actions against you for making a certain character your pfp or banner, because of one main reason: The fact that the clause literally just refers as Creation of fanfiction.

Now, there are three types of ways you can use those assets: Personal, non-commercial and commercial.

Commercial, as the name suggest, is making profit from certain product. Like, for example, making a game and selling it. If you use the assets for making a fangame and then you sell that game to others you are like...super screwed. They can (and will) take legal actions for sure.

Non-commercial on the other hand, refers to the case in which you make certain thing and don't charge anything for it. Here you can put all the works made by fans for other fans (like fangames, fanfic, etc). This is what aniplex is asking not to use the assets for. And I believe the reason behind it is the fact that those works could be mistaken by the actual game if you use the actual assets.

But in the case of banners, pfp, custom handmade merch, etc it falls under the "personal" type of use. The main difference between non-commercial and personal is the presence of distribution. As long as there's no distribution of any material, it can be considered personal and, therefore, allowed to use as you please!

(Twst disclosed that commercial and non-commercial use is forbidden, but they didn't say anything about personal use. So it is fine)

since Thailand has copyright law being Author Life+50 Years for Know Author & Date of Publication+50 years for legal entity & anonymous author and I know that most of DC & Marvel Character & Arifact from early one to 1972 is currently public domain due they are legal entity as well as Walt Disney film before 1950s ? I'm no legal expert so id suggest just reading more into your local law on the matter.

I'm from Europe so my general understanding of copyright comes from that. However i dont think you're right about dc and marvel characters from before 1972 being public domain, mainly because the legal entity in question didnt make them. The copyright came from the authors of the characters, then transfered over to the corporation.

I think the legal entity thing is like, for example how sometimes government departments put out films, those would be under the publication + 50 date.
