nct 2018 reacts | s/o flinching during a fight
requested: Hello! Can I request nct 2018 reacting to their s/o flinching during a fight? Sorry for the angst 😬😬 genre: angst, fluff warnings: no one gets hit but it does mention possibly getting hit and there is a lot of fighting a/n: Im sorry if this is bad! I had finished it when my computer crashed and turned off. I forgot to save so only a few of the reactions were done and I practically had t start all over. Sorry if its bad!
taeil
“im doing my best here Taeil, why cant you see that?’ you asked feeling hurt and betrayed. taeil sighed, taking a step towards you “Y/N” he said reaching his hand out to cup your face. Without hesitation you flinched and stared at the ground. Taeil eyes winded, he reached his hand out once more and gently lifted your head to look at him. “Babe, I would never hurt you,” he aid with tears brimming his eyes, he gave you a soft smile to try and make you relax. “I know, I was just being stupid,” you mumbled before pulling him into your warm embrace
taeyong
“Why arent you being understanding? Im going through a lot and im trying to be there for everyone, why cant you be there for me?” Taeyong asked, running his fingers through his hair. You held back the tears, his words were like a knife right through the heart. “Am I not there for you T? So when I wait until 2am for you to come home, when I bring you and the boys food at all hours of the day, when I patently wait for a text back, im not there for you?’ you asked, huffing your chest. Taeyong raised his hand causing you to flinch and yelp. “Oh my god, Y/N did you think I was going to hit you?’ he asked, obviously hurt. “Im sorry,” you said feeling bad, you knew Taeyong would never hit you but you still flinched. “Come here,” he said opening his arms for you
yuta
It felt like hours had passed while you two were arguing, you couldn't even remember what started it. Yuta raised his hand to rub his temples when you flinched. Yuta widened his eyes when he saw you flinch. He started to take many steps backward while staring at you. “I,,I need to leave,,,id never do that,” he said, clearly angry. Yuta put on his shoes and slammed the door shut as he left the apartment to get some fresh air. You started to cry even harder, you didn't mean to flinch it just happened.
johnny
Johnny paced back and forth in the living room while listening to your words. Once you were finished talking Johnny sighed and started to walk towards you. Without thinking you backed up and hid yourself behind the cushions of the couch. Johnny stopped what he was doing “Did you think,” he started to say before you cut him off “I know you would never,, I just,” you tried to explain yourself but Johnny understood what you were trying to say. He took a few steps forward and opened his arms for you. You pulled him onto the couch “Can we forget this ever happened?” you asked feeling hopeful. He nodded “Let's pretend today never happened.”
ten
“Im a grown man, Y/N. You dont need to worry about me or baby me,” Ten yelled while looking you up and down. He was tired of you constantly worrying about his health or his body from dancing. You furrowed your eyebrows together, not knowing how to respond. You couldn't form a proper sentence in your head you were so upset. “or so now you just aren't going to say anything?” Ten asked scoffing. He raised his hand to fix the hat on his head when you flinched and backed up into the counter behind you “Im sorry,” you squealed making Ten gasp. He stared at you with wide eyes before speaking up ‘Why?” he asked in a low tone. “Im sorry,” you repeated once more. “Y/N I would never,” he voice and face softened. “Come here, im sorry,” he said while holding you close to him
doyoung
“I just need you to shut up and listen,” Doyoung yelled, slamming his hand down on the kitchen counter. You jumped back and started crying hysterically, you hated when people continuously yelled ta you and all the pressure from today's fight was getting to you. Doyoung realized what he did, he started crying with you. “Baby i'm sorry, I didn't mean to scare you, I was just upset,’ he said through his tears. You nodded your head and watched him with careful eyes. “Im going to get some fresh air, let me know when you cool down,” you said while wiping your tears and walking towards the door. Doyoung nodded his head, he fell onto his knees and cried while he watched you leave
kun
You fell into Kuns arms while crying after a simple action made you think he was going to hit you. He raised his hand to push his sleeve back when you flinched because you thought he was going to hit you. When you realized he wasnt and you saw the look of hurt on his face you started crying even harder and fell into his arms. “I'm sorry baby, I don't know why I flinched,” you cried out while holding him. Kun sniffled back his tears before putting on a smile “Its okay, I see how much you regret it and i'm sorry for making you feel afraid,” he said. You calmed down while in his arms
jaehyun
Jaehyun was very stressed, a stupid dating rumor had spread about him and another idol, of course you confronted him about it. He grew angry and started to yell at you “You're no different than anyone else’ he said said while pushing a chair out of his way. You yelped and bent down as you attempted to stop the chair from hitting you. When you realized that he wasn't trying to kick the chair at you you started to cry and let yourself fall to the floor. Jaehyun stopped what he was doing and watched you. “I am so sorry, I didn't mean that,” he said while crouching down and helping you stand. You nodded your head and looked into his eyes “Im sorry for ever doubting you. I was just upset and when I saw the articles and photo I got even more angry. I trust you,” you said while hugging him
winwin
Winwin hatred fighting, he hated having to raise his voice at you. So when this morning started out with a fight he was beyond upset. He finally snapped, slamming his hands on the bed as he stood up “Ive had enough,” he said while sending you a ivy glare. You jumped back in fear and hit your head really hard on the headboard. “Oh my gosh Y/n, im sorry,” he said, completely throwing away his previs angry persona. You started to cry, not form pain but out of fear. “its,,its okay,” you whimpered out. Winwin rushed to your side and pulled you into his chest.
jungwoo
Jungwoo don't know what was happening. he saw you slwoly slide down the hallway wall, your hand clutching your heart and your cheeks covered in tears. “babe?” he called out softly. He sighed and slid down on the wall right next to you and pulled you into his side. “I wasn't going to hit you,” he said after he realized why you were so shaken up. You nodded your head and leaned into him. No words were exchanged as he held you closely and stopped the tears from pouring
lucas
You breathing was shaky as you listen to him yell about so many things. it had all started when you said that he never helped out around the house enough. he was walking away when he suddenly turned around “And you know what,” he started to say but he stopped when he watched you throw yourself into a wall to avoid being near him. He looked around before looking back at you “Did,,did you think i was going to hit you?” he asked confused. When you hesitantly nodded he sighed. “Babe, I wouldn't even dare,’ he said with a heavy sigh. When you didn't reply and continued crying he thought for a moment before adding “I'm gonna stay at the dorms tonight if you don't mind.”
mark
Mark was taken back by your sudden change. You went from red faced and yelling at him to crying and playing with your fingers while staring at the ground. At first he was confused as to why you suddenly changed but then he realized that you are afraid, afraid of him, all because he raised his hand. Your eyes were so focused on your hands that you dint realize Mark was approaching you. It wasn't until his hands placed them self on your shoulders that you noticed him. “Im sorry,” he said while kissing your tear stained cheeks. You started to giggle at his actions before you both were smiling, the fight and actions long forgotten.
renjun
You and Renjun had been arguing over something so small and insignificant that you had completely forgotten about it and weren't mad about it anymore, you were mad that he was yelling at you. “Enough,” he yelled while smacking his hand against the wall. You screamed out in fear, your knees went weak below you and you fell onto the ground in a ball. You started crying while repeatedly muttering variations of “Im sorry,” “I didnt mean it,” “Don't hit me.” Renjun fell onto the ground right in front of you. He looked at you with gentle eyes. “I really didn't mean that, I don't know why I hit the wall or why we are fighting. Please please please, forgive me,” he begged while holding your hand in is and rubbing circles onto the back of your palm
jeno
Jeno froze in place when he saw your hands over your face in an action of defense. He had raised his hand to grab a glass of water because this fight was getting him hot, he didn't intend to scare you in any way. “Y/n,” he started to say but his voice cracked as the tears built up. “I would never, hurt you,” eh managed to squeak out through the tears. You looked and saw your boyfriend a crying mess, just like you. “I should have known, i'm sorry,” you said while starting to calm down. Jeno mailed “Me too, I'm sorry I ever made you think that I might hit you,” he said with a said look. You stepped forward and hugged him, “You're the best boyfriend ever, I was just being stupid.”
haechan
“it wasnt funny Haechan! I was seriously worried, do you think this relationship is a joke?” you asked thinking back to the rude ‘break up’ prank that haechan had pulled earlier that day. “Stop being so sensitive, it was obviously a prank,” Haechan scoffed while looking away with his arms crossed. You couldn't hold back at this point, all the stress from when you thought he was breaking up with you and now this fight was really getting to you. You burst into tears, crying extremely loud. Haechans eyes widened when he looked at you “No,,babe,,don't cry, Im sorry. It was a stupid prank, if you had done it to me I would probably be just as mad,” he said stepping towards you to pull you into a hug. You flinched once he took a step near you. “Oh gosh, Y/N no, I wouldnt hit you, you know that,” he said stepping back. Tears threatened to spill. Once you saw him crying you stepped forward and pulled him into your arms and you two cried together
jaemin
“Stop,” Jaemins voice was deeper than normal. He wasn't smiling or giggly, not today. Jaemin turned around and started to walk towards you. Your breath picked up and you took quick steps back until you were pressed against the wall. You stared at him with wide, fearful eyes. Jaemin stopped walking, his gaze softened as he looked at you. “I love you and you know that, so why are we even fighting?” he asked, trying his best to not cry right then and there. You shrugged your shoulders, still feeling scared at your boyfriends change in demeanor. “I'm sorry, I would never hit you,” he said while backing up in order to make you feel safe. You ran forward and wrapped your arms around his waist “I'm sorry for even thinking you'd hit me,” you apologized, burying your face into his chest
chenle
“I didn't mean it,” Chenle whined while holding you tight. You sighed and gently shook him off of you. You were still made and didnt want Chenle to hug you. “Im sorry,” he said, arms dropping at his sides. you nodded your head. “Im jut not in the mood Chenle,” you replied with a heavy sigh. Chenle raised his hand as he spoke “Cant you tell that I was just playing around and I didnt mean it,” he yelled. You had never once heard Chenle yell or get angry. You flinched at his raised hand “Im sorry, Chenle. I forgive you,” you hid behind your hands. “I,,Y/n,,im sorry,” he said, realizing that you were afraid. You looked up at Chenle with sorry eyes. “No, im sorry. I knew that you would never hit me.” Chenle nodded “Can we just forget this fight ever happened?” he asked stepping towards you. “Id love that,” you said while holding him tight
jisung
It had been tense it the room since the minute Jisung walked in. Things between you hadn't been the best and you didn't even know why. You confronted him, begging him to tell you why things were going south. Jisung sighed, he raised his hand to run his fingers through his hair when you flinched backwards and immediately said “You don't have to tell me.” Jisung looked at you, cowering away from him. “Babe, I wasn't going to,,” Jisung trailed off, bursting into tears. “Im sorry,” he said walking forward with open arms. You gladly accepted and walked into them, giving hima much needed hug

Letter To Taylor
Hai, quick intro first.
I’ve made this blog so that i could post and write letters to Tay on what is really personal stuff in my life, cause i feel like posting it on my actual blog is just to personal cause people know me on there and some of my friends don’t know what i’m gonna put in these letters. Normally i message Taylor on tumblr but being realistic i don’t think Taylor will ever see it, so this blog is to tell Taylor what id normally would or have messaged her, i do this in hopes she might see it one day but she probably wont. but oh well, its worth a try!
so a little info about me that isn’t too personal or gives away my personal blog, i’m 16 this year, i was born in 2001 and became a swiftie in 2014 just before 1989 was released, i’m Australian and i’m still in High school. I’ve listened to Tay since a young age, with my fav songs being our song and love story but as i said dint become a swiftie until 2014. Ever since I've became a swiftie Tay has helped me through a lot. now for the actual letter:
Dear Taylor
Life is going okay, its not too bad at the moment although it is a bit stressful. I have an exam and assignment next week at school, a drama performance the week after, the full day drama rehearsal on Tuesday. I’m in grade 11 and other than school being a bit stressful it’s pretty fun. My life is pretty simple and normal, i have a few quite close friends and even a bf (hes good but its complicated that’s a story for another day). But although life is overall not to bad I've been struggling with one particular aspect of my life... Family
Don’t get me wrong i love my family and they love me but just over a year ago it’s gotten complicated. A bit over a year ago on September 1st me, my dad and my mum went to a friends (mainly their friends) wedding, it was nice, that day before the wedding we went shopping and i got to pick out a nice outfit for it, but that afternoon during the reception my mum snuck off for a bit, i at first didn’t really notice her leave and when i did i assumed she went to the toilet, but then 10 minutes turned to 15 to 20 and i started getting worried, i decided not to worry too much cause she can handle her own. Sure enough she came back after what was probably 30 minutes. She didn’t actually come back into the venue but sat outside of it, being the person i am i went out to ask where she had been and tell her about all the yummy for that went around that she missed, but before i can talk i noticed she was crying. Now it’s been awhile and i cant remember exactly what she said but she basically told me that she knew she shouldn't of come to this wedding cause it was too much, and that her and my dad had separated for about a month and were waiting to tell me. Apparently they were going to tell me another time (obviously i don’t think they planned it to happen at the wedding) it was a massive shock to hear that and was a lot to take in. i don’t really remember what happened after that, i think we just stayed on the bench for a little before going back inside. i remember that we left shortly and the rest on the night i was trying not to cry, we were staying at my parents friends place who also attended the wedding and my mum and i shared a bed in one of the rooms while my dad had a bed to himself, i remember crying that night after mum had fallen asleep. After that night it was a bit hard, since i now knew (cause like apparently everyone else knew, aka my sister, my parents friends, etc. all but me) my mum was now sleeping on a mattress on the floor in the lounge room. i think she could have stayed in her bed with dad but didn’t want to, idk, i never asked or if i did i cant remember. after about a month i had caught up with my closest friend and told her the news that night, apparently she knew before me though so yeah. after that i didn’t tell anyone for a while. A little bit after that night my mum moved in with her mum (so my grandma) and dad stayed in this house. Towards the end of school holidays i told my other closest friend about my parents, which explained why my mum wasn’t around (she thought there was something wrong with my grandma because i said my mum was always there) she was surprised but understanding. other than that i still haven’t told anyone else, i guess i don’t really plan on it. My mum is still at her mums place and i go and visit her on weekends and holidays, and i’m still living in my house with my dad (note my sister is older than me and had moved out like 2 years before this all happened). its been a bit hard and still doesn’t quite seem real. its weird being in this house with just me and dad (well also with the cats but you get the point) it feels weird not having mum here but I've gotten use to it a bit. one thing that makes this harder is that seeing i don’t look forward to seeing my mum. don’t get me wrong i love her, but grandmas place is always busy and packed (cause my grandma, her bf, my mum, my uncle and my uncles friend all live there, my mums room is in the garage cause that’s the only space left, there’s no more rooms) don’t get me wrong all of them there are family but there is also nothing to do at that place, in the house or town, and that would be too bad but its not like i even can talk or hang out with my family there, my grandma will make time for me, shes retired and has plenty of time too but she also naps a fair bit (i mean fair enough she deserves it) but the worst thing about going up there is that my mum drinks, and a fair bit at that, i swear every time i go up to visit her shes either already had drinks or is going to that night. she drinks way too much, she doesn't even have a job, she lives off of centerlink, she has a provider which helps get her a job but she isn’t actually working towards getting a job that much. and because she drinks so much when i’m up there that i just don’t see her much, i mean she drinks at home mostly but shes normally out the back with my uncle and their friends who lives there or they also have more friends over so i’m mostly alone and this is really annoying me and it upsets me so much, cause i don’t come up a lot cause i’m busy with school and when i do she doesn’t even make time for me!!! one incident that really annoyed me was that this year on the night before mothers day she went out drinking at her mates place in town and didn’t come back until like 11 am the next day, and the next day was mothers day, and when she did get back she went to sleep cause she was tired and hungover!!! i mean i know its technically her day but its also meant to be a day to celebrate with your family and considering my sister didn't even come up to visit her that day you’d think she would at least try and make more of an effort! so it’s been one heck of a year but i’m dealing with it and it isn’t too bad.
i’m sorry for the long letter and the rant but i just really need to tell Taylor this, i know she probably won’t see this but i’m gonna post it anyway. i really hope Tay see’s this.

Harley x reader
Note: I’d like to make this one into a series so feel free to suggest things to me. Tell me what you think as well :) Warnings: Some heavy and soft kissing and swearing.
Today you were meant to be going to see a movie with your friends. You didn’t have the most normal bunch of friends to say the least, your best friend was tall and skinny she had bleached white hair with coloured tips one side blue and the other pink, yes your best friend was Harley Quinn, crazy, right? Anyway, your other friends were cat woman an poison ivy. You were going to go and see the movie fifty shades darker because Harley was obviously a big fan of the novels. You all met up outside the cinema at 7:30 pm so you had enough time to get snacks and drinks for the movie. Before you walk in there is someone by the door to check IDs in case anyone underage tried to sneak in. It was a man at the door and it would be an understate meant to say he was attractive.
“IDs please ladies?” He look at yours a little longer to catch your name. “(Y/N), hey that’s a pretty name. Im chris by the way nice to meet you.” He went out to shake your hand but harley stood in the way.
“Sorry, chris but we need to go and find our seats” she grabbed your arm and dragged you into the theater not letting go of your arm until you gt to your seats.
“What was that for!?” You questioned Harley
“What he was being to flirty and i dint think he was good enough for you.” Harley said a clear tone of annoyance in her voice. What has gotten into her she’s never usually like this, you wandered but didn’t really think about it too much. The movie started to be honest it wasn’t really your thing watching people do freaky shit with a load of moms surrounding you. When you looked to the side of you you could see Harley completely engrossed in the movie her eyes were staring at the screen, she didn’t even notice you looking at her.
It got about 45 minutes into the movie and harley was slurping what remained of her drink up causing it to make an incredibly loud noise but she wasn’t bothered about disturbing other people.
“Hey, (Y/N) come with me to get a refill would ya” harley whispered to you, you nodded because you just needed to stretch your legs. You set off down the stairs going quickly to avoid disturbing too many people. In this cinema it ad a long dark corridor which you had to walk down before you got to the door. You were both walking down the corridor when harley grabs your hand.
“Sorry, im just kinda scared” she admitted, this was unusual for Harley but you played along anyway. When all of a sudden harley slammed you up against the wall placing your hands above your head she began to kiss you your lips moving in sync she then broke the kiss and attacked your neck with her mouth, it was sure to leave a mark but you didn’t care all you wanted right then and there was harley.
She then stopped her head going up to your ear “if i don’t stop now ill have to fuck you right here right now” she bite your earlobe lightly before running off down the corridor and out of the door. You followed her hoping for more. You got out of the door to harley leaned up against the wall signaling you with one finger to come closer, you obeyed and harley pulled you in for a kiss this time it was a lot a softer and had more emotion there was no roughness at all you both just stood there with your lips locked severing each other. When all of a sudden cat woman and ivy came out of the movie to see if you two were okay, apparently being slammed into a wall makes rather a lot of noise. They walk out the door and stand completely frozen staring at the two of you, connected at the lips. They both looked back to each other and receded back into the movie pretending like they hadn’t seen what they clearly just had. You and Harley completely oblivious to being caught. “Hey, lets get outa here.” Harley said music to your ears. “but what about the others-” you began but were cut off by Harley placing her fore finger over your lips. “fuck the others they’ll be ok, you just need to worry about me…”

ROOM 409 (FULL)
It all started last april 7, 2017 at 6 am. I was nervous but excited at the same time. Nervousenss was brought up to my spine due to the next 80 hours being away from my family and being independent as practice for my college life. And excited because i would have the chance to see HIM again. I’ll admit the fact that i actually fell for a not-good-looking-smart-guy-that-is-pabebe-at-most-times. I actually didn’t know how, when and why but I was THE SECRET STALKER for months.
Travel time was approximately 2 hours but the views and sights were astonishingly beautiful as ever. Those valleys and hills as well as the taal volcano took my breath away. I wasn’t able to take pictures because my camera is not in good terms. The lens was scratched from the impact brought in the entire gadget when it fell weeks ago.
Arriving a the venue and stepping out of the car, the cool tagaytay breeze embraced me. Walking up the stairs was thrilling. Being a newbie, i dont know what to do. I was one of the few people that didn’t bring suitcases which made me feel like an outcast. I was asked to submit my barcode then got my ID and SHIRT. By the way, our shirt was lime-green which is obviously not a match on my skin-tone. After being registered, we went outside to get our bags or gym-bags to be exact. But then a mixture of shyness, fear and nervousness took over me the moment i saw HIM coming up the stairs. I went the other way so that our pathways won’t intersect but i was trapped by the parked cars. I had no choice but to go the other way around. We had eye contact for like 3 seconds then his parents were right behind him so I broke it right away. Too shy to look back, i continued my way to our vehicle.
Once inside the venue, i went stright to our room. Walking on the corridors, i have no one to talk to so i began by observing mannerism. I tend to observe people around me whenever i have nothing to do. ‘One of them can be my roommate’ that thought hit me when i saw people near the assigned room. Then time came when the room was opend. Shocked to see 18 bunks in one room. There were 6 beds and all are triple deck. It was actually a big space. After placing my things, i decided to observe shits again. 2 of us from the same school, 1 from CA, 4 from LS and 11 from SPC. Then 2 more from SPC transfered in our room bec they were separated then the people fom CA and LS went out maybe because it was too noisy to handle. ‘I MADE FRIENDS VIA CARDS’ thas what i tweeted. Why? Our first conversation from the people from SPC were about cards. They invited me to play with them. I learned a lot of new games btw.
The clock was at 9 and Session 1 came. 2 hours of listening to Circles and its properties made me feel sleppy. After the first sesion was lunch which led us to being members of 'the loner table’ these table were the ones at the corners which prevent 'loners’ from socializing. After eating, 1 hour was still left for us to relax and be comfortable. Then i realized, i attended the wrong class. We were then scolded which scared me so much. Being myself at school, i wasn’t scolded that much so it was a new feeling. Then session 2 came, i was at my original class and being punctual, i went in 15 mins before the schedule. Our classes would start at 1 pm up until 7 :15 pm with a fifteen-minute- brak between the 3rd and 4th session. IT WAS MIND BLOWING. Literally. It feels like i was overdosed with mathematics. My head aches and it was dizzy all of a sudden. Dinner came fast and study hour was up and slepping time at 9. Our room mates from SPC were really friendly and aproachable. Learning their names, NOT EASY. Their nicnames were: BURGER, FIRE, ANDREA, REGINA, IRENE, the twins BEA AND BIANCA, STEPH, ERIKA, JASMINE, SHAE, THERESA and CARISSA. The twins were absolutely adorable.
Day 2 was absolute HORROR. We had a quiz on about 7 am. It was a pain in the head. Then same schedule until 7 pm. We were having classes on plane geometry with sir kerish then an earthquake occured. TWICE. At first I thought my seatmate was just erasing her answer but i was wrong. It was really an earthquake. We were told to go outside the building due to the natural phenomenon. Our fifteen minute break was taken away from us. Dinner came and I saw HIM again. He looked for the third time and unable to focus, i did not notice that they were serving me already.
Third day was exam day or more likely HELL DAY. Quiz 2, fial exam part 1, final exam part 2 contest questions. My mind was literally abou to explode. We studied at 11 pm until 1 am. The twins studied until 2. After the exam was over, it was dnner time then awarding ceremony. The ceremony was conducted faster than common ceremonies. I seriously did not expect that i would be awarded with a medal. It was my first time to experiance this kind of lecture-contest thing. The first to be awarded were the Qualifiers. HE was a qualifier. Being good in reasoning and all, he was once called as 'MTG-BABY’. Then, Challengers were being called batch by batch. My heart jumped and i was shocked when my school and name was called. I was really happy. I never thought i would be above average. I literally thought i was at the bottom. My roommates from SPC were shocked and they also congratulated me.
While waiting in line for the registration of the challengers, my schoolmate took a picture with her crush. HE is a close friend of her crush. We were asked to take a picture together. Both parties took pictures with their phones. Cheeks flashing red, ears heating up and body literally frozen, those were felt in the past 2 minutes of taking pictures. Unable to control my smile, i hid my face away so he won’t see it. It was still a cover. If ever he asked why we took a picture together, we would say its just for fun so that it was a pairing dare.
The night came and one of my roommates also like him. She is so cute and all. I dint tell them that i too did. We played cards: speed, pusoy dos, tongits, uno, heart attack and egyptian hammer. We also played never have i ever, paranoia and truth or dare. We oredered yellowcab pizza and soa for dinks. It was indeed a fun night. I slept at 1 am. Others slept at 3 and 3 of them did not sleep at all.
Morning came and it was time to say goodbye. It was indeed a fun and memorabl experience. I made new friends, i was able to learn and enjoy at the same time. Mathematics has indeed opened new doors for me. New opportunities and first time experiences. It was all a blast. We were all friends now espcially in social networking sites. i hope that the short time we spent together would not be forgotten and cherished until te end.
Goodluck on your summer training. i hope that you would compete and win the international competition. i’ll be signing off for now.
'til we meet again, Roommates

Short Circuit: A roundup of recent federal court decisions
(Here is the latest edition of the Institute for Justice’s weekly Short Circuit newsletter, written by John Ross.)
It’s one of the most vexed questions in originalist constitutional interpretation: What’s a judge to do when inquiry into original meaning doesn’t yield a clear answer? In their new paper, “The Letter and the Spirit: The Judicial Duty of Good-Faith Constitutional Construction,” Professor Randy Barnett and Assistant Director of the Center for Judicial Engagement Evan Bernick undertake to answer it. Download the first of a projected three-paper series (and projected book) on Good Faith Constitutionalism “while it’s hot”!
Today, the Supreme Court considers whether a federal agent who shot and killed a teenager across the Mexican border gets qualified immunity. We discussed the Fifth Circuit’s en banc ruling on the podcast (starting at 5:10).
Inmate slips away from Armstrong County, Penn. jail, holes up at home of acquaintance who lives nearby (and who doesn’t know he’s an escapee), and then murders the acquaintance’s girlfriend. Third Circuit: County officials, who had placed the inmate under light supervision, could not have foreseen a specific threat to the victim; her estate can’t sue.
Two Moncks Corner, S.C. detectives disapprove of superior officer’s rough treatment of suspects, urge man (who allegedly took a knee strike to the groin from the officer) to file a complaint, lawsuit. The detectives are forced to resign. Unconstitutional retaliation for protected speech? The police chief is entitled to qualified immunity, says the Fourth Circuit.
Former employees of South Carolina nursing homes sue, alleging, based on statistical sample of patient records, that the nursing homes defrauded Medicare. The DOJ declines to join the suit, but vetoes a proposed settlement. Fourth Circuit: Which DOJ has unreviewable authority to do, so keep litigating. As for the statistical sampling data, we won’t review whether that is okay to use until after trial.
Fifth Circuit: Henceforth, it is clearly established that the First Amendment protects the right to film the police, subject to reasonable time, place, and manner restrictions. That not having been the case in 2015, the officers in the instant case are entitled to qualified immunity for handcuffing man who was filming a Fort Worth, Texas police station and declined to show ID — at least on the man’s First Amendment claims. His Fourth Amendment claims go to a jury.
Van Buren County, Mich. officials foreclose on tax-delinquent properties, sell them at auction for considerably more than what’s owed, and decline to turn the surplus (nearly $200k in one instance) over to the former owners. Takings sans just compensation? Sixth Circuit: The suit should have been brought in state court. Dissent: And Michigan law says it should go in federal court; “we have lost our constitutional bearings.”
Federal mine-safety inspectors inspect mining-equipment repair shop, issue violations for a dirty bathroom, among other things. Company: Our shop is not a mine; the inspectors don’t have jurisdiction. Secretary of Labor: The shop has mining stuff in it, so they do. Sixth Circuit: That is not a reasonable interpretation of the relevant statute.
At board meetings, Jackson County, Mich. commissioners direct attendees to rise, bow their heads, and listen as a commissioner gives a Christian prayer. A non-Christian files suit; commissioners call him a nitwit and his suit “an attack on Christianity and Jesus Christ, period.” Sixth Circuit (over a dissent): What we have here is a violation of the Establishment Clause.
To lower their tax burden, owners of family business transfer money to their sons’ Roth IRAs by dint of transactions that are specifically authorized in the tax code. IRS: Congress may have authorized it, but it’s improper avoidance of IRA contribution limits all the same. The family needs to pay up. Sixth Circuit: They do not.
Man calls 911, rants, threatens to kill his family. Bowling Green, Ky. police locate him walking along train tracks. He does not threaten the officers, but neither does he obey their commands. He urges the officers to shoot him. One does; he dies. Sixth Circuit: No qualified immunity.
Iowa State University officials typically allow student groups to use the school’s trademarks on T-shirts with minimal fuss but, after complaints from the governor’s office, reject multiple T-shirt designs proposed by group that advocates for marijuana legalization. Eighth Circuit: Which is unconstitutional viewpoint discrimination.
Federal agents raid family home of suspected antiquities traffickers in southern Utah. (One suspect kills himself the following day. The feds’ informant expresses remorse for his role in the sting and kills himself months later.) Does the sheer number of agents who participated in the raid by itself constitute excessive force? That might be a viable claim in some other case, says the Tenth Circuit, but not this one. (Click here for some long-form journalism on the case.)
In a blog post, doctor strongly suggests another doctor’s method for treating Alzheimer’s and other ailments (injecting a drug used to treat arthritis along patients’ spines) is quackery. Libel? Eleventh Circuit: No, the purported quack’s suit is a Strategic Lawsuit Against Public Participation.
In 2014 and 2015, an Eleventh Circuit panel issued three decisions upholding a Florida law that made it a crime for doctors to ask patients whether they own firearms (popularly called Docs v. Glocks). The full Eleventh Circuit has now reversed (as we urged it to do via an amicus and a New York Times op-ed).
And in en banc news: The Second Circuit will not revisit a ruling that, in the eyes of the dissent, enables prosecutors to say, “Show me the man and I’ll find you the crime. Neither will the Fifth Circuit, despite six dissents, reconsider its dismissal of a challenge to the feds’ designation of 1,500 acres of private land as critical habitat for the dusky gopher frog. The Fifth Circuit will, however, reexamine its denial of qualified immunity to an officer whose report led to an innocent man with the same name as a suspect spending 16 days in jail. Likewise, the D.C. Circuit will reevaluate its holding that the CFPB’s single-director structure is unconstitutional (we discussed the CFPB case on the podcast) and, separately, reassess its holding that the SEC’s administrative law judges need not be appointed by the president. (Click here and here for the D.C. Circuit orders.)
Charlestown, Ind. officials want to bulldoze Pleasant Ridge, a neighborhood of 350 homes, so a private developer can build upscale housing. To that end, officials blanketed the neighborhood with citations for trivial code violations like chipped paint and torn window screens. At $50 per violation, per day, the fines quickly ran into the thousands of dollars — in many cases before owners had even received notice in the mail. Officials offered to waive the fines, however, if property owners sold to the city’s preferred developer — for far below the tax-assessed value of their homes. Last week, Pleasant Ridge residents joined forces with IJ to put a stop to the city’s illegal plan. Read more here.
