Human [Part 1]

Warnings: gonna be an angsty slow burn, friends. language/cursing, canon-typical violence/gore, mention of guns and knives and all other Frank Castle related things

Word Count: 1,498

Summary: Cassandra Nash met Frank Castle completely by accident, at a little diner in Hell's Kitchen. They see each other frequently over the course of a few months, until he drops off the grid. And when he pops back up, he's moved into the same apartment complex as her. "In the end, we all realize, we're only human."

Note: So eventually I’ll get back around to my Stranger Things fics, but I love my angsty Frank so much.

Cassandra Nash walked slowly behind the counter at the diner in Upper West Side Manhattan, right on the border of where Hell's Kitchen would begin. She looked clearly exhausted, her concealer barely doing any help to mask the bags under her eyes, with her dark blonde hair in a messy bun, several strands falling into her face.

She worked as a part-time waitress to help cover the fees at Columbia, along with a low paying entry level job at a solar panel company, but she was in her last two years of the Robotics PhD program (she was young for a student who was almost done with her PhD, only being twenty-eight, and would be three years younger than when the average PhD student would be done). She had a Masters in Mechanical and Electrical Engineering. She was contemplating turning her Masters in Electrical Engineering into a PhD as well — she did eventually want a job in making green technology. Cassandra knew as soon as she was done, she was potentially looking at working for Tony Stark — she clearly had the smarts and the ambition. He was one of the only people in clean, renewable energy and she knew she could learn a lot from him. To add to it, her mother was a retired S.H.I.E.L.D agent (living comfortably in Orlando), and perhaps Cassandra had a bit of a pull in that area too.

Ace's Diner was quiet, especially during that time of night, but the diner had certainly grown on her, as she had been working there since she was twenty-four (which might be a reason she was still there, patiently waiting to be done with school to leave). Cassandra was alone, other then the one busboy, and the cook, and no one would come to relieve her until the morning shift began. She was relatively used to this — working nights to pay for her books and off-campus apartment. She also tutored younger students and helped manage the on campus library in her off time (which also helped her focus on her projects/homework).

The bell over the door rang, catching Cassandra's attention, her eyes flickering from her Robotics textbook to the patron who had walked in. He was tall, with a dark blue sweatshirt zipped all the way up, along with the hood, but she could see the baseball cap on underneath it. She found him slightly suspicious, but shrugged it off. Her mother had trained her from an early age, briefly wanting her daughter to follow in her footsteps, plus self-defense would never be a bad thing (especially in New York City).

Cassandra walked slowly towards the man who had entered, who took a booth in the back. She barely got a word out when he told her that all he was interested in was black coffee. And a lot of it. She complied, bringing back the coffee pot that had freshly brewed coffee as its contents. She poured it slowly, eyes flickering over him, trying to catch any of his features that he was hiding under the cap.

She returned to her textbook, pouring herself a cup of coffee. There was no way she was going to last the night without it. She was leaning over the counter, her back to the chef's window, and facing the entrance — the mysterious patron was down to her right, and she could see him watching her briefly through the corner of her eye. She paid him no-nevermind, reading through the chapter she was pretty sure she knew by heart at this point. But she has never earned anything less then a B+ during her time at Columbia, and she intended to keep it that way — always aiming for top marks.

The man cleared his throat and her honey colored eyes flickered over to him. He had his coffee cup on the edge of his table, and she could only guess that it was empty. She sauntered back over to him, and that was when she caught sight of the bruising around his left eye socket. Cassandra was only briefly caught off guard, and instead of reacting to it, she only offered a small smile.

She placed the coffee pot down onto the table after pouring him a cup, not even saying a word as she left it at his table. He smirked before she walked back to the counter, turning the page, taking a sip of her coffee (after adding both cream and sugar). She did not really notice what the man was doing, or that he is simply staring out the window, lost in his own head. Nor did she notice that the busboy had fallen asleep in the kitchen, while the chef watched Netflix on his laptop. Weeknights were usually always this dead, weekend nights were where it really depended; sometimes there was a bunch of drunk/hungover civilians coming in for late-night snacks and coffee, or they were as dead as weeknights. Either way, Cassandra went with the flow — even though she did prefer the nights she could study and get paid for it.

A cop car pulled up on the opposite side of the road, both officers needing a caffeine boost. Cassandra smiled as they entered, not even noticing as the mysterious man kept his head down, but with all his focus on the two officers. Both were general regulars during the night, but Cassandra barely remembered their names.

They were both female officers, which had Cassandra's respect the first time she met them. Ortiz was the older of the two, having two children and a husband in accounting, while Blake was newly married to a ballet dancer.

Cassandra was quick to pour them each a cup of coffee from the only remaining pot behind the counter. She did not falter, even if the authority would be intimidating to just about anyone. She supposed it was because she grew up with a mother who was in a similar boat that she reacted easily to the women, trading boring small talk to pass the time.

Ortiz and Blake were discussing the Devil of Hell's Kitchen, which had Cassandra's interest. Vigilante types had always fascinated her; she practically begged her mother to tell her anything and everything she knew about the Avengers. Opinions differed widely when it came to the issue of the Devil of Hell's Kitchen — you either thought he was a vigilante, borderline hero, or you thought he was a criminal. And at the thought of having someone currently roaming the streets, protecting civilians, put Cassandra's mind at ease, even a little. Not many cared too much about the "little guys" or your everyday New Yorker. She, however, did not disclose her opinion to either of the officers, walking the line between both opinions, a tactic she had learned from her mother.

They paid and left, each only having a cup, and she took both mugs back to the kitchen, looking slightly annoyed at D.J., the sleeping busboy. When she returned to the counter, she noticed that the man left, the coffee pot completely empty (she did not see him pour the remaining contents into a thermos), but there was a twenty on the counter beside his cup. Coffee was not nearly that expensive, so she had gotten a decent sized tip.

Cassandra returned the coffee pot to behind the counter, discarding the used cup into the sink, before returning to her textbook. Her cellphone buzzed in her apron, and she placed it on the counter, seeing a text message from her friend Eliza.

Study session tomorrow? it read. Eliza was on the path to a Chemical Engineering PhD, and even though the women would not be studying the same material, it was still nice to have company.

Bring pizza? Cassandra sent back.

Her phone buzzed moments later, Of course!

Cassandra smiled, beginning to filter through her social media. Just another brief distraction from the slow night, and there was nothing of particular interest.

By the time Vera came to relieve Cassandra, along with Nathan, she was just about to pass out. Her trip home was relatively short, either a very quick subway ride and a block to walk, or about a seven minute walk. She only took the subway if she was running late, or if she was particularly exhausted, like she was that day, otherwise the exercise was never a bad thing.

Her apartment was tiny, her dining room and living room smashed together, the couch barely fitting into the space (she did not even own a dining table for this reason, instead eating at her coffee table). Her kitchen was small, but it was really all she needed, as she did not cook often. The bathroom was tiny, but it had the necessities, and that was really all Cassandra required. Her bedroom barely fit her full sized bed (it's smushed into the back, stretching to be touching both walls) and her dresser. It had a tiny closet however, which was nice enough for her.

Cassandra set the alarm on her phone for class and climbed into her bed, falling asleep moments after closing her eyes.

Now that it's approaching it's end, retrospective thoughts on the rebirth/reborn era and its positives and negatives? For me the best part is Jon and the amazing artists-Jorge Jiminez, Patrick Zircher, Ryan Sook, Will Conrad, Patrick Gleason-when was the last time the Super-books had this many great artists at once? Oh, and what should the approaching Bendis era be called?

My feelings on this two-year stretch have been, let’s say, conflicted. Contrary to most, I’d argue it wasn’t a great time to actually be in, but it laid a foundation for the future that’s as stable as Superman’s had in a decade.

At the heart of the problems is the writing on the main books, and, well, that’s a hell of a problem to have. The Tomasi/Gleason team started off as much on the wrong foot as possible by having Superman’s newly introduced son accidentally kill his cat in the first issue - surely the most logical way of introducing the prospective new readers coming with a #1 issue to the kid - only to substantially uptick with a series of charming, imaginative, heartfelt adventures beginning with #7 and continuing into the start of the energizingly ambitious Multiplicity. Which then proceeded to shit the bed in its second and final installments, the run limping from there to whatever half-hearted conclusion it has waiting in the wings (though hopefully Superman Special as a continuation of the Dinosaur Island arc will have something to offer, given that was a tremendous highlight); I’d say maybe if the team had stuck to its strengths with one and two-part adventures it could have worked, but they went back to that well and the magic just didn’t return, whether from burnout or because that brief surge was a fluke and nothing more. And Jurgens…I’m just so tired even thinking about Dan Jurgens getting a 40-issue run on Action Comics in the 2010s. Lazy, uninspired, insipid storytelling on every level that wouldn’t have rightly have passed muster 20 years ago, nevermind on what could reasonably be called DC’s flagship book (the intermittent potshots at the New 52 guy early on didn’t help, though I suppose that could be called a pet peeve rather than a fundamental criticism). Some decent fill-ins by Rob Williams and Keith Champagne can’t override that.

And yet, those stories laid a foundation. First with Jonathan Kent, the most substantial inclusion to Superman’s world in decades and who Tomasi - who for all his authorial sins, has always excelled at writing kids - imbued with real personality and heart for others to build on in years to come. And second, because they worked with what they were handed in a ridiculous cosmic trade-off leaving them writing the ‘old’ Superman and a mid-run reboot, and managed to restore a sense of normalcy and family routine amidst the adventures; when Bendis picks up the books, pending any of his own changes we’ll be regularly getting for the first time since 2008 ongoing Superman books where he’s Clark Kent at the Daily Planet, married to Lois Lane, who secretly fights crime as Superman in Metropolis in his real costume. That shouldn’t be an accomplishment of note, but dammit it was one, and it deserves acknowledgement, especially given that seems to have played such a strong role in the overwhelming fan embrace of this era, to the point where some seriously declared it the best Superman’s been in 20 years.

Moving onto the more straightforwardly positive aspects? As you noted: good lord, the art. Not that there was never weak filler stuff - we got Ed Benes more than once - but Patrick Gleason, Doug Mahnke, Patrick Zircher (I’m not nearly as much a fan of his stuff, but he does decent work), and recently Viktor Bogdanovic have been leading the charge, with additional work by the likes of Jorge Jimenez, Ivan Reis, Will Conrad, Ian Churchill, and Ryan Sook. We got to see Superman treated as an A-list artistic priority again, and with the two suits he had in this period at least scaling back from the excesses of his New 52 getup, it didn’t feel like the work was being wasted on this moment in the same way a lot of material from 2011-2016 did. There will be a significant number of truly iconic illustrations to look back on from this period in years to come.

Perhaps most importantly though? While the main books floundered, the Superman brand throughout the rest of the company has been doing pretty damn well. His assorted ‘family’ books have been at a high point, with Orlando’s Supergirl remaining one of DC’s better books, Super Sons being one of its most fun and continuing Jon’s development, New Super-Man building up a new corner of the world that’s proven a fan-favorite, and Superwoman at least initially lending additional dimension to Metropolis and Lana Lang, as well as capturing the 90s flavor the main books aimed for with a more palatable, contemporary sensibility (and while outside the line proper, Supergirl: Being Super was an incredibly solid mini that didn’t get the attention it deserved). And in supporting and guest roles, this has actually been one of the best periods in his 80 years: while I heard his Aquaman cameo near the start of Rebirth wasn’t great, and I can’t imagine Red Hood and the Outlaws did much better, he had incredibly fun guest spots in Nightwing, Wonder Woman, Green Arrow, Deathstroke, and Supergirl, while his turns in Batman and Cave Carson Has A Cybernetic Eye are easily some of the best Superman work of the decade period, and there’s little reason to doubt whatever his part is in the finale of Milk Wars will be a spectacular one. Not to mention his at this point essentially co-starring role in Dark Nights: Metal, and getting to be in one of DC’s top five or so best ongoings at the moment in Christopher Priest and Pete Woods’ Justice League.

So on the whole? This was the Pepto Bismol of Superman eras: tasted like shit, but it stemmed the tide of explosive diarrhea that for all Morrison and Pak and Kuder and Snyder’s best efforts the New 52 take had become by the end, cleaning the poor guy up and getting him presentable again. Some good moments interspersed in there, some great art, some interesting groundwork laid. As much a pain as it was to spend every month wondering if and when solicits would announce a new creative team to rescue the books, I don’t doubt I’ll turn back to plenty of individual issues, books like Supergirl and Super Sons, and a couple isolated sections such as what’s collected as Superman Vol. 2: Trials of the Super Sons with fondness in years to come.

New from Every Movie Has a Lesson by Don Shanahan: MOVIE REVIEW: True History of the Kelly Gang

TRUE HISTORY OF THE KELLY GANG— 2 STARS

In true western, or in this case, bushranger movie fashion, the edgiest and most intense moments in Justin Kurzel’s True History of the Kelly Gang come in the moments when someone is being held at gunpoint. Drama properly peaks with the potential power released by one little curved metal lever hinging a mechanism of murder and mayhem. The action itself to squeeze that trigger is easy. The decision and ramifications, as we well know, are not.

LESSON #1: CHOOSING WHEN TO PULL A TRIGGER— With that anecdote in mind, there’s not a rushed gunpoint decision in this movie. These suspenseful showdowns of thought and monologue carry just as much risk for the person staring down the sight as the one on the other end of the barrel. There can be a loss of innocence when you pull a trigger. On the other hand, survival, in the most instinctual way, can be taught from it. Likewise, authority, manhood, and reputations can be earned. That is much to risk or gain on the flexing of a few knuckles.

The featured man often holding that pistoled pendulum of power or ruin in his hands is the storied Australian folk hero Ned Kelly. 1917’s George McKay gets lean and mean to follow storied performers like Mick Jagger and Heath Ledger in embodying this historical figure. Kurzel’s movie is quick to telegraph that “nothing about this story is true” while still carrying the title matching the Peter Carey source novel. That creates two things: a challenge of substance and the equivalent of a violent bedtime story that makes “Billy the Kid” seem like Goodnight, Moon.

The child born Edward “Ned” Kelly we meet is a preteen (Orlando Schwerdt in his feature debut) around 1867 incited by the upbringing of squalor and hardscrabble pathos of family loyalty fed by his borderline harlot mother Ellen (the powerful Essie Davis of The Babadook). He’s still too young to become the man of the shanty when his incarcerated father dies and his mother is dominated by the abusive authority of the local lawman Sergeant O’Neill (Charlie Hunnam).

LESSON #2: THE LIFE OF A BUSHRANGER— To toughen the boy up, Ellen “sells” Ned to a veteran bushranger Harry Power (Russell Crowe, making the most of his robust frame and age). He is a suitor and protector with the aim to groom Ned as a new helpful accomplice. The kid may learn the skillful initiatives of hideouts, robberies, getaways, and spoils, but this also puts a gun in the young man’s hands and begins that aforementioned struggle of Lesson #1.

When we fast-forward to Ned as a man (McKay), he is bare knuckle boxing in his skivvies for rich wagerers, including Constable Fitzpatrick (Nicholas Hoult) who takes a liking to his toughness. After a decade away, Ned returns to his homestead to find Ellen with a new beau (singer-songwriter Marlon Williams) his age and his younger brother Danny (Earl Cave) in trouble with Fitzpatrick for stealing horses. When prison is threatened on Ellen and Danny, guns are pointed and shots are fired that turn podunk mongrels into outlaws.

George McKay comports himself quite well in this leading role. The magnitude he shows between his blood-soaked rage and his expressions of loyal caring for family and romance (in the form of a woefully underused Thomasin McKenzie from Jojo Rabbit) build his screen presence. His clean-shaven face switches from dour to deranged with measured ferocity. The same can be said for Essie Davis. When her sandpaper soothing side breaks, hell and vitriol spew forth brilliantly. They are the standouts of this game cast.

Anyone who has seen filmmaker Justin Kurzel since his Michael Fassbender-led treatment of Macbeth knows that he has a penchant for potent atmosphere. Cinematographer Ari Wegner paints a few layers of that with striking overhead angles, moody lighting, and strobes of violent closeups. As always, Justin’s brother Jed Kurzel provides a score of disquiet bowed over strings. The barbs are present to prod and cut, but a bigger sense of sweep is not.

That is where the challenge of substance circles back for True History of the Kelly Gang. Once Ned and his associates go on the lam, this is normally where the national legend of the rebellious and anti-authority Kelly Gang as Australian Robin Hoods takes off and takes over. Unfortunately, that elevation is slowed and squelched. Entire exploits are truncated or ignored, even in a place where fiction is pushed to take the place of fact. Instead, a more internalized story of personal narration and supposedly self-written history is woven before a gallows finish. McKay is the showcase of that route, but not the bigger impact or causes of the truer story.

LESSON #3: HOW LEGENDS REQUIRE EMBELLISHMENT— For whatever reasons, the swelling reverence and the contagious public support, included even in Carey’s fictional source novel, are excised from emphasis by screenwriter Shaun Grant. That’s the sweep and the space where legends reside. That’s the real volume, not the screaming confrontations or the gunfire, that make Ned Kelly and company mythic. Without some of that enveloping weight, all this amounts to is an abridged and radical folk tale without the proper embellishment.

Florida man arrested in Walmart shooting threat called himself white nationalist in Facebook post, cops say

FBI agents waited more than an hour at the Winter Park home of Richard Dean Clayton’s parents before the 26-year-old entered unannounced through the back door.

The agents said Clayton, who had threatened to shoot up a Walmart, was “manic” — erratic, paranoid and profane.

He went from apologizing to his parents in tears to accusing them of setting him up: “You are choosing the State over me!” He told the agents and detectives he “would [expletive] you up” if they hadn’t put him in handcuffs, they said, and demanded to know how they felt about being part of a “discriminatory quota.”

Those details were included in a 77-page report recently filed in Orange County Circuit Court by the Winter Park Police Department. It is seeking to have Clayton banned from owning firearms or ammunition for one year under Florida’s “red flag” law, which allows the government to seize firearms of people deemed dangerous to themselves or others.

Clayton was arrested after agents with the FBI’s Joint Terrorism Task Force and Florida Department of Law Enforcement flagged Facebook posts they said the young man made under a false name, including one that said, “3 more days of probation left then I get my AR-15 back. Don’t go to walmart next week.”

That was Aug. 4, one day after 22 people were killed in a mass shooting at a Walmart in El Paso, Texas.

The new records, filed Aug. 21, also include other posts allegedly made by Clayton, including rants about social media censorship and one in which he describes himself as a white nationalist.

Clayton remains in the Orange County Jail on a charge of making a written threat to kill.

An attorney listed for him in court records did not return a call seeking comment.

Posts: Racist memes, AR-15 photo

The name on the Facebook page was Jared Janota, but the phone number used to create the account — provided by the social media service to the FBI in response to an emergency order — belonged to Clayton, according to investigative records.

The reason for Clayton’s use of aliases was apparent from his posts, in which he ranted about having to impersonate others because of his main account being “zucced” — an apparent reference to Facebook CEO Mark Zuckerberg — meaning taken down repeatedly.

Screen shots of many of the Jared Janota posts, some of which had previously been described in an affidavit for Clayton’s arrest, were included in the documents filed last month.

Many used racist language and stereotypes, while others laid out the user’s white supremacist ideology.

“Everyone [in real life] calls me a ‘Nazi’ despite my countless attempts to correct their assumptions about my political beliefs by claiming that I am simply a white nationalist and registered Republican,” said one post on Oct. 24. “And the only reason I balk at the terminology normies use to describe me is because I don’t fully understand national socialism’s economic principles, and because capitalist, corporate America has done very well for my family, as well as for many other families like mine.”

The post about Walmart wasn’t the only one to suggest violent intentions.

“[Expletive] the internet. I’m committing a hate crime [in real life] tonight,” said a post Feb. 4.

Some posts made reference to an AR-15, the variety of semiautomatic rifle used in many recent mass shootings. In one, a shirtless man agents noted fits Clayton’s description posed with a rifle in front of a Trump banner, while wearing a flag bandanna over his face and holding a bottle of bourbon.

Agents said he also posted racist memes, including one depicting a white woman with the phase “WHITE PEOPLE there’s NO UPGRADE."

“I’d say the worst but also the best part about being white is being selective while dating,” the Nov. 7 post that accompanied the meme said. “Ever since I was a kid I’ve only ever been attracted to my own kind and never found other races appealing.”

Parents: Man shouldn’t have guns

The records show agents interviewed Clayton’s parents, who said he lived alone in a second house they owned in Winter Park. They said he owned guns, including at least one rifle, but had given them to a friend while he was on probation.

Inside the home, detectives said they found “numerous” items related to guns, including a red-dot sight, an empty Smith & Wesson handgun case and accessories for cleaning AR-15 rifles and shotguns.

It’s unclear if Clayton owns an AR-15.

While the Facebook post about Walmart suggested it was among the guns he had given to a friend and expected to get back once his probation was over, during an Aug. 14 hearing, he testified that he “used to” own an AR-15, but it fell into the St. Johns River last year, according to court records.

Investigators also found a black hooded vest that said “security” on the back and front, though Clayton wasn’t known to work for a security company, detectives said.

His mother said she didn’t believe Clayton capable of carrying out the threat against Walmart, instead suggesting the was a product of her son’s “off sense of humor” and social awkwardness, a statement by Winter Park Detective Amy DiCarlo shows.

His mother said Clayton struggled to make friends growing up and “often makes inappropriate jokes.”

Both parents said they were uncomfortable with their son having guns.

His mother said Clayton had years ago been addicted to drugs and alcohol, but was currently attending court ordered counseling for driving under the influence.

Insurance not paying a claim!?

Boy this is a good one & I don't know what to do Next! I went with the Lizard insurance even though they are Snakes and don't want to pay for any Claims! It started in 2010 with my truck, I took it to where they told me and they only paid for cosmetic damage even though there was a lot more including my steering was so bad I had to stop driving it. I wanted to take it to a shop that I had my truck lowered which because of we're I lived and the shop was I couldn't drive it, 65 miles. I had AAA tow it to my new house and from there after 2 years of not driving my truck they agreed to have it towed 7 miles to the shop. Well I told the claims adjuster what was wrong, he told me I needed to write a list and drop it off at the shop so I just got my Chopper back from the shop and went down to where my truck was a wrote a list of what I thought was wrong. Here is where the first of my troubles started, on the way home I am riding on the freeway and a truck to the right of me had a blow out and a Giant tire flew right in front of me, I couldn't do anything other than to run it over. It happened so fast, I hit it and made a brown spot in my shorts, jk. I then noticed smoke coming from my Chopper, it was Bad so I pulled over and noticed that my tail light was knocked off and caused some damage and the bold that holds my tail light on came off and rubbed on my new Avon 250 tire and Melted the side wall. I was able to ride home and once I saw all the damage I knew it was a problem. I called the Lizard and made a claim. The claims adjuster called me and said he will be out that Saturday, so saturday came and I never heard from him, I had his number and left a message, so this went on until Thursday and I called the lizard again and they transferred me to the AH boss and I left him a voicemail. Well I didn't hear from him as a few more days went by so Called back and got his boss's boss. The next day I got a nasty voicemail from the claims adjuster bitching at me. I called customer service and told them he went off on me and they can hear my voicemail too but no one listened to me. So I was told to call his boss, I said then I don't want this claims adjuster to come out, I don't want to speak to him or have anything to do with him. They were so sorry and said they totally understand and later that day the big boss called and I told him I hadn't heard from the adjuster other than a nasty voicemail and I want someone else to come out and not him. The boss said I understand and he will take care of it. So two days later the rude claims adjuster showed up at my house to take care of the claim, I was shocked it was the AHole I didn't want to come out but his bosses boss told him he better get out there and take care of this. Well once he was there, he wasn't as nice as he had been and couldn't be more rude than he was. I told him what had happened and the Damage, all he said was Prove it, Prove it, Over and over with everything I showed him. It caused major damage to my shocks and front forks, he laughed and said they are designed to roll over things and that it couldn't happen from hitting a tire in the road, well it can because that's exactly what happened. He was such a AHole I said, why did you even come out, did you just come here to be a @ss Hole or what!! He didn't say a word and just left. They paid out just a little for damages to the paint, tail light and the tire. The tired was new and cost 500 but they paid me 100 bucks for it. Mean while my truck is at the shop still to get looked over for the damage and they didn't pay a dime and the worst part was when I got the truck back from being towed, I started after the tow truck drive let it down and it sounded funny, then I smelt burning plastic so I opened the hood and my entire air intake system was gone!!! The burning was th vacuum hoses laying on the headers. I called the shop where my truck was and they said they are not sure what's going on but to call back. Well they are no longer in business and I lost all that so I called and opened a claim, now they are investigating me over this. So I have damage from 2010 that has never been fixed, my bike isn't right and someone had stolen my Volant cold air intake that's not being taken care of. What do I do? This is BS, I don't deserve this from my insurance Company and for them to treat me like they have, not pay out the claims. I needed my truck smoged Dec 31st so because all the parts to have it smogged weren't there I couldn't have it down and I have a ton of late fees with the DMV in California. My Volant is smog legal, I have the Ca numbers for it but it doesn't matter, I am getting the run around like no tomorrow. I will Drop GIECO and go with Farmers but not until my truck and bike are fixed. I have called everyone I could at Geico and no help!""

I have a 99' silverado LS 5.3 liter truck. It was hit in the parking lot by some fool at work and now all the body panels on the passenger side are dented. I took it to a dealer to get an estimate (since the guy has insurance) they quoted it at 7500 dollars worth of damage. I know that the truck doesn't actually book for much more than that. The truck still drives fine just that it is beat up on one side and the door won't open. I still owe about 3k on the truck. I have yet to get an adjuster to come look at it from state farm. Do you think the truck will be totalled? What are my options and how much will they sell the truck back for if it is a total? If it is a total what value will they go off of and how much should I expect for my truck which was in fair condition? Will the adjuster make a check out to me or will he send it to my bank or both? Anthem Blue Cross Dental Net I was referred to an oral surgeon by my primary care dentist since I have to have 6 teeth and 2 residual root tips extracted in advance of getting a full upper denture. All the extractions including the root tips have to be done during one visit, which necessitates the use of IV sedation. My general dentist cannot perform any of this work. Anthem Blue Cross Dental Net denied the original pre-authorization request, and subsequent appeal stating that my general dentist can perform the services being referred. Which is absolutely not the case. I even spoke with a customer service rep who indicated that the extraction of residual root tips is definitely a referable service and it clearly states that in their Dental Net Provider Contract. She has no explanation for why the appeal was denied. My primary care dentist has even provided Anthem Blue Cross Dental Net with his specific reasons for referring this work to an oral surgeon and I still can't get anyone at Anthem Blue Cross to re-evaluate the original denial and the appeal and authorize the necessary work. I have filed a complaint with the California Department of Insurance, although I don't hold out much hope for any results from that effort. HELP... what are my options? Who can I contact? Thanks""
