Get hired, but as an IT Analyst with a verbal guarantee that I'll be a developer after 6 months (first mistake)
I get hired, 3 days in I get offered a web developer project which I accept
Upon accepting I was told behind closed doors (second mistake) that I would be given an informal promotion to developer and that I would have my pay bumped to reflect this. This was all verbal (third mistake)
Start project, and because I'm working with the German office from the US office, i start coming in from 6-3 which I was told by my trainer on day 1 would be fine. So long as we're in the office from 9 to 3, no one cares what your hours are were his exact words.
Do project; do REALLY well on it, all things considered. I had to learn C# ASP.NET and their new homebrew framework all at once, all while still working through their structures for PLSQL packages
Project ends, I learn that me and a coworker were basically set up to fail because the German office asked for senior devs and were given two juniors
Put on new project; told I will be going to a new site in MS with a coworker for a week for on-site training. Cool!
Get sent down for a week. It sucks. So. Much. When we get down there, we learn the site isn't even ready for us yet, so there isn't even work for the senior devs, let alone us juniors. We spend the whole week doing jack shit.
3 days in we're told we're coming back the next week, where we'll be working a 10 day on 4 day off schedule. 4 days in I realize that I was never switched over to a dev; I've been an analyst doing dev work this whole time, and my manager has told me that I need to be doing analyst work. Reminder: I have been following the senior devs for 4 days at this point, with no indication that I was supposed to be following anyone else. In fact, before the trip I was told I was SUPPOSED to be following one of the senior devs.
Later that day, I learn that not only have I been marked as an analyst this whole time, but I've been paid 5k less than every analyst hired after me, the most recent hire being all of a month after I was brought on. This was eventually fixed, but only after MONTHS.
The 10-4 starts. For almost all of it, we do nothing again. I remembered to bring a coding textbook with me this time at least, but eventually I just started following one of the mechanical engineers around helping him do stuff so I wouldn't die of boredom.
Get back to the main office, thoroughly pissed about this whole ordeal. I still come in from 6-3 because that makes the traffic bearable. On the 8-5 schedule (hour unpaid lunch) we started on, the commute was easily an hour both ways due to traffic. The analyst hired after me follows the same pattern, but he comes in that early because of distance. The job was in Arlington heights, and he lived near Milwaukee. Neither of us are told this is an issue, and some of our coworkers start doing it as well so they can still enjoy the last half of the day (important for later).
At this point, people stop giving me work. It's not for lack of trying to find any; I was pestering senior devs for anything I could do, because my managers wouldn't give me shit. So, because I basically have nothing else to do, I either follow my lil coding textbook or just dick around on my phone or in visual studio, because there's literally nothing else for me to do.
Eventually I'm given something to do, but i encounter some roadblocks with it in the form of progressing with it would require me to break company policy. Like, REALLY break company policy. I finally learned my lesson about getting shit in writing after the whole "yeah you were never a dev" thing, so I gathered my evidence and sent it to manager saying (paraphrased) "hey here's what's wrong, here's what proves that's the issue, here's the solution which requires breaking policy. I am not going to do that without explicit permission; please advise" and waited for a few days. When he finally got back to me work was basically halted because his message was just "I'll get back to you on this" and he never did despite my pestering.
One of the managers offers a training trip to Germany for analysts. First come first serve, and I manage to snipe a spot. Cool, I'll take a free trip to Germany even though I'm upset.
After this, I'm back to pretty much no work. Eventually HR pulls me aside, and says they want to move me to help desk. "It's not a demotion, you won't lose pay" they assure, "we're just moving you over because there's no analyst work for you" but in all ways this is very much a fucking demotion. They hired 3 analysts after me. I'm going from a role where I at least kinda get to program to answering calls all day along the lines of "no it's not broken, you're just using it wrong." It's humiliating. It's demoralizing. I'm as good as, if not BETTER than the recent new hires when it comes to programming. I'm not saying that to put the guy hired with me down; he's a good programmer, but he struggled learning the SQL concepts as fast as I did, with both of us having comparable backgrounds with it. Being told, essentially, that I'm not good enough to do that full time and they want me in the back office answering calls was crushing. This is the straw that finally broke me, and I was ready to leave then and there.
Managed to convince myself to stay, because free trip to Germany. I inform HR that no, I will not be switching to help desk. The very next day I'm called to a meeting where they give me the dreaded PIP.
If anyone is curious I'll send a pic through DMs, but the short version was I was no longer allowed in the office before 7. When I asked if this was company wide, I was told not to worry about it. My trip to Germany was safe, but starting the week of my return, I would be heading north to Wisconsin for a 4:30 AM to 3:30 PM shift. It's an hour ride without traffic; 2 hours with. Assuming I get 8 hours of sleep and get perfect conditions both ways on my commute (EXTREMELY unlikely, it's fucking chicago), that gives me a 14 hour shift BEFORE overtime. This site has a very poor reputation; overtime is expected, if not mandatory. I'm looking at anywhere from 15-18 hours of my day being taken up by this job, which I've already grown to hate, and with this schedule it's going to be about 3 days before I'm in an actually dangerous situation thanks to sleep deprived driving.
I am supposed to be on this schedule for 3 weeks.
I take my trip to Germany. Like I said, lots of fun, the German office treated me like a person and our trainer for the trip was super cool. I put in my notice the Monday after I get back, bring my laptop and such in on Tuesday, and don't go back.
I didn't have any of the stuff in this post back then. I was in free fall for 4 months and some change, and I only just got a job this week after months of searching with an average of 50-100 applications per week. It was stressful as fuck and I encourage anyone in a similar situation to take all the advice above to heart.
“They’re trying to discharge her constructively. Do you know what Constructive Discharge means?” She asked.
As soon as I heard the term ‘Constructive Discharge,’ I knew I’d never seen it on a vocabulary quiz.
“No. What does it mean?” I asked.
She explained.
“Constructive discharge is a fancy way of saying “being forced out.” It’s not good. And if you’re not a lawyer or in human resources, you’ll probably learn what it means when it’s happening to you.”
“Oh my God. I’ve seen this my entire career and never knew it even had a name.” I thought.
You’ve seen constructive Discharge too. You may have experienced it. We’ve all made choices to avoid it.
Constructive discharge defined
“We can’t fire you, but we’ll make you so miserable you’ll quit, and then we won’t have to pay your unemployment.”
Then there’s the textbook definition:
“A constructive discharge occurs when your employer has made working conditions unbearable, forcing you to resign.”
Or as one person put it.
“I didn’t get handed a pink slip, but when you’re not wanted, people have a way of letting you know.”
HR isn’t always the secret police.
Employees aren’t always victims of evil-doers.
However, employers push employees out all the time to maintain and protect the, “We didn’t do anything wrong, YOU did,” power structure.
Constructive Discharge looks like this:
— Meeting invitations slow to a trickle, and you’re excluded from emails and generally looped out of what’s going on.
— People stop talking to you or stop talking when you walk in.
— Your emails don’t get answers, or they arrive too late to be of value.
— Suddenly, your work is not good enough, though nothing about your work has changed.
— Reviews, once good or even glowing, are now mediocre or bad.
— Instead of a bonus, you get a Performance Improvement Plan.
— Warnings and write-ups start so they can justify your eventual termination with documentation of your “poor performance”
— Your work, clients, assignments go away, or they overwhelm you with work.
— The words “Set up to fail” were practically invented to describe this scenario.
Constructive Discharge is illegal
It isn’t easy to prove you’re a target, and it’s even more challenging if you don’t even know constructive discharge is a real thing.
If you’ve ever experienced this and don’t fully understand what’s happening to you beyond knowing you’re in the process of being excommunicated, it can be hell. It’s not uncommon for the experience to leave long-lasting scars.
Talk to anyone who’s ever been through it. They’ll tell you.
Knowing constructive discharge exists and how it’s used gives you power to predict what’s coming and to protect yourself.
Seeing the endgame helps you in two ways.
You know what to expect. Having a sense of what’s coming next is enormously empowering. You can go on the offensive and protect yourself. Constructive discharge works to crush your ego, making you feel you did something wrong and deserve this treatment.
Without strategy, you end up being a miserable pawn in your employer’s endgame.
Remember, they’re almost certainly building a case to fire you in the event the hellscape they create for you doesn’t persuade you to quit.
If you’re getting pushed out, and you know what to look for you can prove constructive discharge and you can get unemployment benefits, be released from payback obligations on a signing bonus, and protect your mental health.
You’re not crazy, incompetent, or a failure. This is real and it’s carefully executed to leave you holding the bag and feeling like you did something wrong.
If they force you out, in addition to feeling horrible, you lose your paycheck, benefits health insurance, and possibly owe them money.
