NHRC issues SOP on collection & processing of scientific/forensic evidences in case of sexual assault on women to ensure effective prosecution leading to conviction
New Delhi, 16th December, 2020
The National Human Rights Commission, NHRC, India, in order to ensure effective prosecution leading to conviction in cases of sexual assault on women, has prepared a ‘Standard Operating Procedure (SOP) on Collection & Processing of scientific/forensic evidences.’ The SOP, prepared in consultation with medical experts, has been sent to the States/UTs for issuing instructions to all the concerned officers for implementation.
The SOP has been divided into seven sections of key operating procedures. These are: victim care, promptness and examination, collection of samples, collection of blood and urine samples, genital and anal evidence, handing over samples to FSL and general. The Commission has come out with this SOP after it observed that in many cases of alleged rape and sexual assault, there is substantial delay in medical examination, collection & processing of scientific/forensic evidences of the victim of sexual assault. The exhibits are forwarded to the Forensic Science Laboratory, FSL after much delay and by that time, the samples deteriorate/autolyse and become unsuitable for examination. This delay adversely affects the investigation for effective prosecution leading to conviction.

Indian Patent Office invites Applications for National IP Awards 2020
The Office of the Controller General of Patents, Designs and Trademarks has invited the submission of Applications for its annual National IP Awards ceremony to be held later this year. The awards will be presented to top achievers comprising of individual persons, institutions, organizations and enterprises for their contributions in the field of Patents, Designs, Trademarks and Geographical Indications, Startups, MSME’s and Enforcement of IPR’s. In addition to this, three WIPO Awards will be presented by the Organization under the WIPO Awards Program, on the same day. The National IP Awards ceremony will be held in New Delhi, on the occasion of World IP Day, on 26th April 2020.
The ten categories under which the awards shall be presented include:
1. Top Individual for Patents & Commercialization
2. Top Indian Academic institution for Patents & Commercialization
3. Top R & D institution/organisation for Patents & Commercialization
4. Top Public Limited Company / Private Limited Company for Patents & Commercialization in India
5. Top Indian Private Company (MSME) for Patents & Commercialization
6. Top Start-up for IP and Commercialization
7. Top Indian Company /Organization for Designs
8. Top Indian Company for creating Brand in India and abroad
9. Top Individual / organization for Best facilitation of Registration of GI and Promotion of Registered GI in India
10. Best Police Unit (District / zone in a commissionarate) for enforcement of IP in the Country

RGNIIPM concludes Training Program of 181 newly recruited Examiners of Patents and Designs
The Rajiv Gandhi National Institute of Intellectual Property Management (RGNIIPM) recently concluded the training program for 181 newly recruited Examiners of Patents and Designs, at Nagpur. The six-month training program was exclusively held for Group ‘A’ officers who are now expected to begin discharging their respective duties as Examiners in the Indian Patent Offices located in Delhi, Mumbai, Chennai and Kolkata. Mr. Hoshiar Singh, ITS, Registrar of Copyright & Head, Indian Patent Office Delhi attended the Valedictory program as the Chief Guest. Dr. Pankaj Borkar, Head of RGNIIPM, delivered the welcome address and also congratulated all the Trainee Examiners on completing the program.

Hindustan Unilever scores a victory in water wars with Tata
It appears that Hindustan Unilever had a great start to the New Year after the Indian Patent Office, on January 2nd 2020, rejected a patent application filed by the Tata group relating to water purifying technology. The patent application numbered 1572/MUM/2008 and titled “A Water Purifier” was jointly filed by TATA CHEMICALS LTD. and TATA CONSULTANCY SERVICES LTD. in 2008 and was opposed by HUL way back in 2011. After hearing both the parties in the matter, the Controller in his decision of 2nd January held that the Claims laid down in the specification lacked inventive step and the invention was obvious to a person skilled in the art.
In 2012, Tata Chemicals was successful at the Intellectual Property Appellate Board (IPAB) in revoking one of HUL’s patents related to water purifiers and purification technology.
Volterra LLC files patent infringement suit against Monolithic Power Systems
Volterra Semiconductor LLC, a subsidiary of Maxim Integrated Products, Inc. has instituted a lawsuit against Monolithic Power Systems in the U.S. District Court for the District of Delaware. According to suit, the MPS DC-to-DC Power Converter products of Monolithic infringe three of Volterra’s patents, namely – U.S.6,362,986, U.S 7,525,408 and U.S 7,772,955. The company is seeking damages and has also requested the court to grant an injunction.
Sonos files lawsuit against Google Inc. for patent infringement
Audio speaker manufacturer, Sonos has instituted a suit in the United States District Court, District of California, against Google Inc. for alleged patent infringement. According to Sonos, Google has infringed about one hundred patents however the company has only instituted a lawsuit concerning five of its patents. The suit was instituted by Sonos on 7th January 2020. The company has asked for a trial by jury and is seeking damages as well as an injunction. According to Reports, the company also intends to sue Amazon for infringement, however, the company could only afford to institute a lawsuit against only one tech giant due to economic concerns.
Illumina files patent infringement suit against BGI in Sweden and U.K
Illumina Inc., an American company engaged in offering sequencing and array-based solutions of genetic variation in the fields of cancer research and agriculture, has instituted a suit for patent infringement against MGI Tech Co. Ltd., and Latvia MGI Tech SIA, a subsidiary of BGI Group. Illumina has instituted the lawsuit in two jurisdictions, namely, Sweden and U.K. In the U.K, the suit has been filed in the High Court of Justice, Chancery Division, Patents Court and in Sweden, the company has instituted the suit in the Patent and Market Court. The four patents at issue, i.e., EP 1 530 578 B1, EP 1 828 412 B2, EP 2 021 415 B1, and EP 3 002 289 B1, protect Illumina’s proprietary sequencing-by-synthesis chemistry. Similar lawsuits are pending in Demark, Turkey, U.S.A, Germany and Switzerland.

Alibaba tightens anti-counterfeiting and IPR protection
According to a recent Anti-Counterfeiting Report released by Alibaba, China’s e-commerce giant, the company has been making efforts to tighten its anti-counterfeiting and IPR protection. Alibaba has reportedly developed over 10 anti-counterfeiting technology like sampling and fake product screening models to combat the problem. The Report says that in 2017, Alibaba established an Anti-Counterfeiting Alliance, currently, a total of 170 brands from over 17 different countries have joined the alliance.
The Anti-Counterfeiting Report is published by the company every year and this is the company’s 5th Report.
CNIPA publishes revised Patent Examiners Guidelines
The China National Intellectual Property Administration (CNIPA), formerly known as State Intellectual Property Office (SIPO), recently published the revised Patent Examiners Guidelines. The Guidelines will come into effect from 1st February 2020. The Guidelines throw light on emerging areas like Blockchain, Big Data, AI and Internet +. The method of application, analysis of claims and content are available in Chinese language only. According to the analysis of the Guidelines by the European Patent Office (EPO), the rules characterize the exact opposite of what is currently followed in the U.S.A.
European Commission publishes report on Protection and Enforcement of IPR in third countries
As a part of the efforts of the European Commission to strengthen the protection and enforcement of IPR in third countries, the European Commission has published a Report on Protection and Enforcement of IPR in third countries. The Report, which is published biennially, was published on 8th January 2020, this year.The objective of the Report is to essentially identify third countries in which the state of IPR protection and enforcement is expected to generate a high level of economic harm to EU interests. The Report also consists of an updated list of “priority countries” that have been recognized as a cause of concern. According to the latest Report, the list of priority countries are as follows –
Priority 1: China Priority 2: India, Indonesia, Russia, Turkey and Ukraine Priority 3: Argentina, Brazil, Ecuador, Malaysia, Nigeria, Saudi Arabia and Thailand
While China continues to maintain its position as Priority 1 country, Nigeria and Saudi Arabia are this year’s new entrants as Priority 3 countries. Additionally, the Report places India as a Priority 2 country due to systematic problems in the area of IP protection and enforcement. The Report also says that Priority 2 Countries have made no progress or only limited progress in addressing issues especially relating to enforcement when compared to the previous report.

EPO and other representatives hold meeting to implement Unitary Patent package
The President of the European Patent Office (EPO), António Campinos, the Chair and members of the executive group of the Unified Patent Court (UPC) Preparatory Committee and the Chair of the Unitary Patent Select Committee met on 10th January 2020 to make preparations for the implementation of the Unitary Patent package. The meeting was held after a complaint was lodged with the German Federal Constitutional Court by an individual against German ratification of the UPC Agreement where the Judge had indicated that Court would render its decision in the first quarter of 2020. According the official notification on the EPO website, the EPO is prepared to register its first Unitary Patent. The notification also adds that until the Phase of Provisional Applications begins, some essential steps cannot be taken to establish the UPC.
A Unitary Patent is a patent granted by the EPO for which a unitary effect can be obtained from the EPO for the territory of the participating EU Member States. The UPC will be an international court with jurisdiction for patents granted by the EPO.

USITC launches investigation against Fitbit and Garmin for suspected patent violation
The U.S International Trade Commission (USITC) has announced that the Commission is in the process of launching an investigation into wearable monitoring device manufacturers, Fitbit and Garmin after being prompted by Philips. The complaint was filed by Philips on 10th December 2019 with the USITC. In the complaint, the company has asserted the infringement of four patents – U.S. Patent No. 7,845,228; U.S. Patent No. 9,820,698; U.S. Patent No. 9,717,464; and U.S. Patent No. 9,961,186. Philips had asked the agency to conduct an investigation and issue a limited exclusion order as well as cease and desist orders.

Then she paid the price. A snippet of her gyrating to a Bollywood song against the backdrop of a prison cell went viral and, days later, Chaudhary was suspended from her job. She had danced inside the police station while on duty.
The short video app wildly popular with lip-syncing teenagers around the world has taken India by storm. Police officers, city workers and physicians looking to escape the humdrum of their work lives are finding its lure irresistible. They are regaling their countrymen with at-times cringe-worthy videos, shot inside police stations, public offices and government hospitals.
In a recent TikTok video, two women officials of the Delhi Police groove to a movie song, and local media speculated that it appeared to have been shot while they were guarding VIPs in the capital.
“Indians are bitten by the TikTok bug as the app makes it easy to create content using nothing more than a phone,” said Prasant Naidu, founder and CEO of the Bangalore-based digital technology consultancy Lighthouse Insights. “But it’s raising apprehensions because it’s Chinese-owned, stores Indian user data overseas and its mass base makes it easy to spread propaganda and porn.”
More than 200 million users in India devour and share videos mimicking Bollywood dancing, movie dialogue and comedy, making India TikTok’s biggest global market. ByteDance, the Chinese internet giant behind TikTok, has a separate app called Douyin with similar features in China, where TikTok doesn’t operate. Videos of cavorting public officials highlight the lack of control over its use among government and law enforcement agencies and is lending strength to a backlash in India against the app. Some even say it’s a security risk.
Shashi Tharoor last summer told Parliament that apps like TikTok are a “national security” threat and Indians are vulnerable to spying through the app because of the country’s lax data protection regulations. He is concerned that like other apps from China, TikTok has too close a relationship with China’s government. Tharoor said ByteDance’s paid influence could affect India’s democratic processes.
Economic groups aligned with the ruling BJP have called for banning the app, saying it’s being used for “anti-national” content including videos advocating religious violence, inciting sentiments against particular social groups and poor treatment of women.
A Southern court temporarily banned downloads of the app amid complaints that its content was degrading culture and encouraging pornography. In a Mumbai court, a litigant alleged that “unfiltered sexual content” from the app was harming young Indians and leading to crime.
Security experts and lawmakers are more worried that TikTok seeks to access user information such as location, phone contacts, call records and audio. While other apps seek similar consent, “TikTok is from China with whom we have history and it becomes strategic and sensitive,” said Nikhil Pahwa, founder and editor of Medianama, which tracks the growth of India’s digital ecosystem.
India is still working on a privacy and data protection framework, with the Personal Data Protection bill that regulates collection and transfer of data being considered. As long as rules and regulations regarding data are not robust, “these kind of apps can easily use the loopholes in law to collect user data,” said Tarun Pathak, associate director at consultancy Counterpoint Research.
The world’s most downloaded app is controversial elsewhere. Indonesia had banned TikTok, saying it failed to block pornography and blasphemy. In the UK, it is being investigated for collecting personal data of young users. The US government has fined the app $5.7 million (roughly Rs. 40.6 crores) for collecting data of users under 13 without parental consent and is targeting the app for a national security review.
Yet in no other country has the app taken hold as it has in India, with police officers and others risking their jobs to produce short videos. In one viral TikTok post set to a high-voltage movie song, five gun-wielding officers of a police SWAT team returning from an encounter in Uttar Pradesh are shown strutting across a field in slow motion, action movie style. Their chief unlocks his gun’s safety catch and pretend-fires at invisible bad guys.

“We do not sanction unprofessional display of weapons and grotesque caricaturing of police,” the Uttar Pradesh police said in a statement.
In another TikTok video shot in Hyderabad, two physiotherapy students re-enact romantic movie scenes inside a government hospital and in another, four security guards prance about in the hospital’s emergency ward.
The videos have continued to go viral, propelling ByteDance to the No. 1 spot among the world’s most valuable private companies. India, where millions of users continue to come online each month, is vital to its global ambitions. When the local court prohibited new downloads, ByteDance said the weeks-long ban caused “financial losses” of about to $500,000 (roughly Rs. 3.6 crores) a day.
To stave criticism, TikTok has begun #WaitASecToReflect digital literacy workshops to encourage users to pause before posting or sharing. TikTok implored users to “Bura na post karo, Bura na share karo, Bura na comment karo” [Post no evil, share no evil, comment no evil] and removed about 6 million videos since its India launch in early 2017.
Meanwhile, the videos have even entered the political realm. In a regional election earlier this year, BJP nominated as its candidate a TikTok star whose sole qualification was her massive following on the app, where she lipsyncs to Bollywood songs. She lost the election narrowly.
Police constable Chaudhary, still suspended from duty, has been luckier in parlaying her TikTok fame to success. Her music video TikTok ni Diwani (TikTok Crazy) scored over 2 million views within days of its release.

Cabinet okays Central Educational Institutions (Reservation in Teachers’ Cadre) Bill
NEW DELHI: The Union Cabinet Wednesday approved the introduction of the Central Educational Institutions (Reservation in Teachers' Cadre) Bill in the upcoming session of Parliament, which will allow filling up of more than 7,000 existing vacancies by direct recruitment in accordance with a new quota system, the HRD Ministry said. According to the Human Resource Development (HRD) Ministry, the move is aimed at giving a major push to reforms in the education sector, making it inclusive and keeping in mind the aspirations of the people from different categories. The Bill will replace the Central Educational Institutions (Reservation in Teachers' Cadre) Ordinance, 2019. The Cabinet decision will address the long standing demands of persons belonging to Scheduled Castes/Scheduled Tribes/ Socially and Economically Backward Classes and ensure their rights envisaged under the Constitution, the ministry said, adding it will also ensure providing of 10 per cent reservation to the Economically Weaker Section. The ministry said the introduction of the Bill will allow filling up of more than 7,000 existing vacancies in teachers' cadre by direct recruitment. The ministry also said that the Bill is expected to improve the teaching standards in the higher educational institutions by attracting all eligible talented candidates belonging to SCs/STs/SEBCs/EWS. The bill will consider the university/college as one unit restoring earlier reservation system based on a 200-point roster. The unit for reservation of posts in direct recruitment in teachers' cadre will be the university/educational institutions, and not the department. In March, the Cabinet had cleared an ordinance on reservation mechanism for appointment of faculties in universities. The University Grants Commission had announced in March last year that an individual department should be considered as the base unit to calculate the number of teaching posts to be reserved for the Scheduled Caste and Scheduled Tribe candidates, following an order by the Allahabad High Court in April 2017. The Supreme Court had in February dismissed a review petition filed by the HRD Ministry after its special leave petition against the court order was rejected by the apex court. Which Are The Litigation Law Firms And Senior Advocates In Delhi That Pay The Most?

The recent move by the Kerala Govt. mandating a stipend of INR 5,000 for the junior advocates with less than three years of practice and an annual income lesser than 1 lakh, makes us wonder; Is surviving in the world of litigation really that financially stressful? Is litigation worth the struggle in the long run?
I would be honest with you, I was a practising lawyer at the Supreme Court of India prior to joining iPleaders. It is a stressful job. Litigation is not financially rewarding in the initial years for the majority, and a lot of lawyers are exhausted by the long working hours or days. However, on the flip side, it teaches you more than you might have bargained for. You learn how the courts function, how to handle the office clerks – always keep them in your good books, there’s no two-way about it – how to manage multiple cases in multiple courts simultaneously, how to analyse the judges and present your case to their liking and, not to mention, you learn the art of dealing with stress.
Your approach towards dealing with the cases is directly proportional to the amount of experience you gain. It’s definitely a learning experience. However, would you opt for litigation immediately after you have graduated? What is it that is in for you in terms of financial stability in the long run? I did a quick survey of the best paymasters in the litigation world of Delhi.
Most law students that opt for litigation are paid anywhere between INR 10,000 to INR 25,000 per month in the first couple of years. There are some famous lawyers, like Harish Salve, who do not believe in paying entry level juniors at all and expect them to work for free. However, if young lawyers stick to the profession there are chances that they may earn ten times their current salary in the next four years. We, at iPleaders, have prepared an exhaustive list of litigation law firms and Senior Advocates of the Supreme Court that pay you handsomely.

The firm has two Advocates on Record – Sameer Parekh and Sonali Basu Parekh. While a majority of their work is specific to the Supreme Court, they represent major giants such as Hindustan Unilever, Larsen and Toubro, ICICI Bank and Bluedart at the High Court and various other tribunals.
As per sources, in 2017 Parekh & Co., paid INR 22,000 as joining salary to its freshers. It is important to note that the salary does not remain constant throughout the year. It increases every three to six months. A freshers salary by the end of the first year is likely to be double their joining salary.

With approximately four hundred Supreme Court filings in 2017, Agarwal Law Associates (ALA) has been performing phenomenally in the past couple of years. The Supreme Court filings of the firm take place through the firms’ partner – E.C. Agrawala. The litigation practice of the firm is overlooked by Mr. Mahesh Agarwal, the Managing Partner.
The firm boasts of some of the major giants such as the Essar Group, ADA Reliance Group, GMR and Tata Teleservices amongst others.

Having formerly been the Minister of Education in India, Mr. Kapil Sibal is a name known to all. Mr. Sibal regularly appears in the Supreme Court for various high profile matters along with his battalion of juniors.
Most of his juniors have over five years of work experience and are paid approximately INR 2,00,000 per month and INR 20,000 per case.
While litigation, in the long run, may seem very lucrative as an option, it is important to understand the requirements that Senior Advocates and law firms alike have from freshers as well as practising advocates. Every year, thousands of law graduates choose litigation as their career option and then digress. For law students and lawyers to survive this grind and make it big, you require a lot of patience and need to acquire knowledge.
Not every law student who may have applied for the job at Karanjawala or at Mr. Khurshid’s may have gotten it. They must have received hundreds of applications from which they would have had to choose. To make it to these places you need to be cut out for the work and gain practical knowledge.

"Getting a degree is an event for a student but it has really become a torture," Justice Prathiba M Singh said. The high court was unhappy that despite its earlier order, the varsity was not issuing digital degrees to pass out students and was demanding physical copy of proofs attached in the email requesting issuance of the document. The judge also observed that there was lack of coordination between the Delhi University and its lawyers who were not being given proper instructions by the varsity. Justice Singh directed the university to place before it separately, the timeline by when digital degrees will be issued on urgent and non-urgent requests. The high court said the students who have already made urgent requests for a digital degree on DU's website, shall again send an email to the varsity and attach any document stating the urgency, including admission in foreign university or employment purpose. "For such students, digital degree certificates be issued within seven working days. Requirement for physical copy of the documents be removed with immediate effect," Justice Singh said. The high court was informed that till now 30,000 students have given requests on the varsity's portal for digital degree certificates. It noted that earlier it was informed by the Dean (Examinations) Professor Vinay Gupta and Joint Director of Delhi University Computer Centre (DUCC) Dr Sanjeev Singh, that all the data of students up till November 2019 was available with the varsity. However, on Monday, it was informed that the university only has data of students till 2017. "This is a completely messed up situation. There is no data of 2018 and 2019," the high court remarked. Earlier on August 7, the high court had passed an order on a bunch of petitions, putting in place a proper procedure for issuance of degree certificates through an online mechanism to ensure that delay in printing of degree certificates does not become an impediment to students who need it. It had then recorded satisfaction in respect of the digital certificate that was filed by DU and noted that an online platform www.digicerti.du.ac.in was also created for enabling students to apply for issuance of such certificates. It had directed that DU shall ensure that students' digital degree certificates are issued within a period of one week from registration. However, on September 2, the high court was informed by final year law student Shubham Kumar Jain that he had graduated from Shri Ram College of Commerce, DU in 2017 and was seeking a digital degree for the bachelors course which has still not been issued. He submitted that despite the online submission of the application for issuance of digital degree certificate and completion of all formalities, the university was insisting on physical submission of a hard copy of the application. He said he has applied for the digital degree on August 14, but it has not been issued. On Monday, the court was informed that data of 28,000 students which constitute half of the students who graduated in 2017 have been uploaded on 'DigiLocker', an initiative by the Ministry of Electronics and Information Technology (MEITY). However, to access it, students' date of birth is required and DU is yet to obtain it from respective colleges, the court noted. A DU official told the court that he had a meeting with the principals of all the colleges and they will give the data of students of 2018 and 2019 batches in next 4 and 10 days respectively. When DU's counsel said it was not possible to issue digital degrees to all the students in one stretch and for now, they can do it for the urgent ones, the court remarked "This happens when you don't issue degrees to students on time annually." HRD plans decree to revive university-wise faculty recruitment
Latest Updates - CA Mitesh NEW DELHI: The government may introduce an ordinance soon to revive the university-wise recruitment system for faculty, an official from the Ministry of Human Resource Development (HRD) said on Monday.It was changed to department-wise in 2017 by an Allahabad High Court order, the official added. A review petition filed by the HRD Ministry to revive the university-wise recruitment system was rejected by the Supreme Court on February 27. "We have proposed to the cabinet to issue an ordinance in this regard. The government will take a decision on it," R. Subrahmanyam, Higher Education Secretary, HRD Ministry, told IANS. He said the meeting is likely to take place in "two-three days" before the election model code of conduct comes into force. The HRD Ministry was under duress from academic groups to have the Supreme Court revoke the Allahabad High Court decision and restore the university-as-a-unit method for faculty recruitment, applicable earlier. Several groups of academics feel the department-wise recruitment will lead to undermining the hiring chances for SC/ST and OBC groups. While the central universities are beset with large vacancies, the government, facing protests from several quarters against the change in the recruitment method, had last year put on hold any recruitment till the resolution of the issue. According to the data IANS obtained from the HRD Ministry, the Delhi University and the Jawaharlal Nehru University have 47 per cent and 34 per cent vacancies, respectively. The situation is worse at the central universities in Haryana, Allahabad and Himachal Pradesh where the vacancy is stated to be 76 per cent, 67 per cent and 60 per cent of the sanctioned strength, respectively. Del HC | En masse cancellation of candidature not desirable; petitioner directed to be appointed as ‘Chowkidar’
Delhi High Court: The Division Bench of S. Muralidhar and Sanjeev Narula, JJ. addressed a petition concerning the aggrieved not being offered appointment in spite of clearing the required stages of the selection process.
In the present case, a recruitment notification was issued for various posts including that of ‘Chowkidar’ for which the petitioner had applied. Petitioner had cleared the examination successfully and on clearing the same he was asked to produce the relevant documents for verification. Petitioner after a long wait had sent out a legal notice on not receiving the appointment letter. Later, the petitioner was informed that fresh recruitment process would be initiated shortly due to ‘procedural anomalies’. All of the stated facts and circumstances led the petitioner to file the present petition.
Learned counsel for the petitioner, Abhishek K. Choudhary stated that petitioner is on the top of the merit list and had successfully qualified for the post of ‘Chowkidar’ and in respect of respondent’s reasoning for the cancellation of the entire selection process which also included non-holding of a typing test was of no relevance in the petitioner’s case.
Therefore, the High Court on considering the submissions of both the parties concluded by a reasoned order, stating that, “none of the discrepancies as noted from the internal communication appear to justify cancelling petitioner’s candidature.” In fact, the petitioner had provided required certificates/documents and he was not one of those candidates who misled in regard to the eligibility and number of vacancies.
Further, the Bench also relied on and cited two of the Supreme Court’s decision relevant to the present case, i.e. – Onkar Lal Bajaj v. Union of India, (2003) 2 SCC 673 in which it was held that “en masse cancellation was worse than the problem.” The other decision was of Joginder Pal v. State of Punjab, (2014) 6 SCC 644, where it was stated by the Apex Court that “importance of segregating the tainted candidates from the untainted ones and not en masse cancel the entire selection.”
Therefore, the High Court while setting aside the respondent’s decision of cancelling the petitioner’s candidature gave direction for the appointment of the petitioner as the ‘Chowkidar’.
