Steps In Resolving Your Divorce
What is the First Step If You Get Served With Divorce Papers?
Whether you have been served with divorce papers or not, you should take the following steps to ensure you can resolve your divorce issues successfully. The first step is to file the divorce papers in the appropriate court.
Filing First
Getting served with divorce papers is a significant step in the divorce process. You'll have to respond in writing to the petition. You'll need a lawyer if you need help with how to respond. It's a good idea to consult with a lawyer before you serve the papers.
When you receive divorce papers, you have about 35 days to respond. The court may issue a default judgment if you cannot respond within this time frame.
You will need to file an Affidavit of Defendant (Form UD-7). This must be served with the Summons and Notice. You must then return the Affidavit within 40 days.
Being served with divorce papers gives you a few benefits. For example, you get the first choice of lawyers in your area. You also have more time to prepare the suit. If you're involved in a high-value divorce case, you may need to hire forensic accountants, financial planners, and psychologists.
Another advantage of filing first is that you'll be in a better position with the judge. If you file first, you will have the opportunity to present your case.
Responding To Initial Divorce Papers
Getting served with divorce papers can be a shock. They can leave a spouse feeling angry and confused. But there are some steps you can take to make sure your divorce is handled properly.
First, you should read through the complaint and understand the other party's request. You can make notes of what you agree with and what you disagree with. You will also have to fill out the forms.
Second, you should respond to specific claims in the complaint. For example, if you believe that the other party is not disclosing all assets or that you are owed child support, you can make a statement supporting your position.
You can also file a counterclaim. A counterclaim outlines the issues you and your spouse disagree about in the divorce. You can state your case in terms of custody, visitation schedules for your children, the division of property, and the need for alimony.
You should also fill out a proof of service form. This form proves that you served the divorce papers. The court will stamp the form, and you will need to keep it.
Changing the Type of Divorce From No-Fault to Fault
Changing the type of divorce from no-fault to fault can make divorce more manageable and cheaper. However, it would help if you weighed the pros and cons of a no-fault divorce before deciding. You should also consult with an experienced divorce attorney if you have questions about the legal process.
In order to file for a no-fault divorce in New York, one spouse must allege that the marriage has irretrievably broken down for six months. The reason for the breakup can be anything from adultery to abandonment.
One spouse must allege that the other has acted irresponsibly to prove fault. These can include behavior that includes adultery, substance abuse, domestic abuse, or cruel treatment.
Proving fault can be expensive, especially when there are multiple issues, such as child custody or the equitable distribution of marital property. However, if you can show that your spouse has behaved in a way that has caused you to abandon your relationship, you may be awarded more of the marital property and alimony.
Dividing Property and Debts
During a divorce, you and your former spouse must work out how to divide property and debts. You can talk to a lawyer or draft a settlement agreement. Once the agreement is finalized, you must fill out a Final Decree of Divorce form.
The court will divide your assets and debts according to state law. Generally, marital property is split 50/50. This is referred to as equitable distribution. The court will consider many factors when deciding the division. Among other things, the judge will consider which party contributed more to the marriage.
Debts accumulated during the marriage are generally shared. The court will then assign each spouse a certain percentage of the total value of the marital property. Debts incurred after the date of separation are not considered marital debts. However, the creditor can still seek payment from the spouse who does not pay.
The best approach is to work with an attorney to determine how to divide property and debts during a divorce. A clear picture of your finances will help you determine how to split assets. You will want to keep records of your spouse's debts and collect documentary evidence.

Successor Trustee In An Estate
What sorts of trouble do successor trustees often have when dealing with the estate of the recently deceased?
The estate is distributed through a probate court or a trust when someone dies. A successor trustee fills the role of the recently deceased person and distributes the assets according to what is laid out in the will (or if there is no will, then state law determines how the assets are distributed).
Estate In A Probate
One of the most common issues is that a deceased person's estate is essentially in limbo until a court of law can formally administer it. Depending on when the individual passed and how quickly their affairs were in order, this might not be resolved for months after they've died.
In the meantime, any financial transactions within an estate are handled by a probate judge and the estate's successor trustees—a small group of individuals responsible for overseeing it until it's resolved.
The most common problem with successor trustees is that they usually need to prepare for their responsibilities. This shouldn't be surprising: they're usually family members or close friends in mourning, so they're more concerned with tending to their affairs than formalizing their loved one's legacy. Because of this, they often need to fully understand what their role entails and gain experience managing an estate or taking care of its financial needs. As such, they might make mistakes that could cause problems for everyone involved.

   “Dear Dorothy                       July 9
I will have two dozen eggs for you Saturday to satisfy those two motherly-inclined hens you have. The old German I spoke to you about had none suitable for that purpose. We have a fellow working in our department who lives on a farm near Grantsville, and he said he would bring me two dozen Friday. They have Plymouth Rock and Rhode Island Reds.
The first half of this week at the Strand [theater] they are showing the pictures taken by the Byrd Expedition into the Antarctica. Today is the last day. They should be very interesting, so I think I shall go down at noon to see them. I wish they would have continues them until Saturday night.
[ok, my eyes are having trouble with this . . I’ll skip to the end]
Will look for you Saturday evening and will gladly meet you at the train before your shopping expedition. I don’t object to going along.
Lovingly, Lester”
This doesn’t say what year, and there were three different “Byrd Expeditions”, but it’s almost certainly in the 1930s. My grandfather Lester (1891 - 1955) and my grandmother Dorothy (1901 - 1969) married in the early thirties but lived apart for nearly a decade. They didn’t live in the same house until around 1940, and had my mother in 1941 - when he was 50 and she was 40!

“There are the Ratajczyk babies now!”
Peter and I were both watching grainy security footage as police officers crawled all over the Chuck E Cheeses location. We watched as Governor Paul Thomas Grantsville came into frame, picking up Baby Noah before turning to walk off. Little girl latched onto his leg and wouldn’t let go until he reached down to pull her off, rewarding him with a strong bite on his hand. Baby Tommy zipped of, probably to go find his daddy as the governor shook his hand, gritting his teeth as he finally threw off the child, hurling her into a wall. He then turned on his heel and disappeared around the corner. Little girl picked herself up, clearly dazed as she wobbled about on her two feet before promptly breaking down into messy tears.
“That’s my girl!” Peter chuckled, fond pride on his face.
“Peter,” I grounded him with a stern voice before turning to the chuckling police officer in the room. “What happens now?”
“We’re looking for the governor’s properties and we will dispatch officers to go pay him a visit.”
“Oh,” I whimpered out from my place on Peter’s lap, tucking my face into his manly chest. “My love, do you think we can try for a restraining order?”
“If I may interject myself here, any judge would be a fool to turn away your request for legal protection.”
“Thanks,” Peter grunted, pressing a whiskery kiss to my temple before standing and exiting the cramped back room with me cradled lovingly in his muscular arms. “I’m taking you and the kids home now- it’s best to allow the professionals to work now.”
The only thing that left my lips was a choked cry before tears began to freely flow down my face as I pressed myself in deeper into his chest.
After we all had been tucked away in the car, I thought to call James- he and his husband had both been whisked away to Mercy Memorial in an ambulance, Ryley having been called and on standby to tend to her uncle’s goddaughter.
“Yeah, she suffered a concussion, and she’s been ordered to take it easy for the next six weeks,” James told me, his voice a mixture of worry and pride. “A police officer swabbed her month- she bit the sonofabitch so hard that she drew blood. The DNA evidence will be used to help identify the perpetrator.”
“We’re bringing little girl’s presents with us to our house,” I told him as Peter began to approach the car with his arms full of presents. Little Christopher trotted off at his side, helping with packing the gifts into the back of the Doom Buggy 3.0. “You or Aaron can come by and grab them whenever is best.”
“Thank you, Mary Claire.” I could only picture him slumping in a chair in an exam room with Ryley working her doctor witchcraft on little girl. “What would I ever do without you?”
“You’d be single and childless,” I told him bluntly, barking out a laugh at the look I felt him shooting me. “Well, you did ask me!”
“Mommy, is liddle gurl okay?” Baby Tommy meeped out, chewing on his little baby fist.
“Little girl’s head suffered a booboo,” I told him as Peter climbed into the driver’s seat and strapped on his seatbelt. “Hihi my love.”
“Hihi sweetheart,” he greeted me in a gentle rumble. “Are you on the phone with Aaron?”
“I’m actually on the phone with James,” I gently corrected him.
“Daddy, liddle girl got a booboo on her head!” Baby Tommy spilled the tea as Peter pulled out from his parking spot, being careful not to run over any of the kids.
“A booboo?” Peter gasped, coming to a halt at a red light. “Poor little girl.”
“She’ll be alright, my love,” I told him, retucking my cell phone back into my bra and reaching across to settle my hand onto his tense knee. “Kids always bounce back- they’re resilient that way.”
“I know they are sweetheart,” he chuckled, taking off when the light turned from red to green. “Bitty when she suffered that knot on the side of her head, Katie after CPS stepped in and took her away from her parents, little girl after that despicable excuse of a human being broke in and threatened to harm her, little girl after that racoon attacked her, little girl after she was born on the toilet…”
“Alright my love, I get it, I get it!” I told him, wrinkling my nose up at him as he turned onto the freeway to take his family home once more.
My babies are so strong and loving, I thought as I glanced behind me, seeing Baby Tommy sandwiched between Baby Mattie and Baby Teddy and Elizabeth and Elle, Baby Jojo and Katie and Jing in the very back. Please don’t grow up so quickly. Can you please remain as mommy’s sweet babies for just a little bit longer?

Chapter Fifty Nine
Masterlist
Edith and Bob took a break from sitting with Chloe and went to eat.
“I’ll sit here for a while.” Beth told them. “You’ve been here all day.”
“Okay dear, but call us if something should change while we’re gone.” Edith said.
“I will now get something to eat.” Beth told her.
Beth sat reading in the corner of the room, when she noticed a rather tall man, whom she didn’t know, enter the room and sit by the bed.
“Hi, are you a friend of Chloe’s?” Beth asked him.
“Oh hi. I didn’t notice anyone here. I’m a friend of Michael and Chloe’s. I heard she was in the hospital and brought some roses for her. I’ll leave and not bother you. I’ll come back another time.” He said.
“Can I tell her who sent the roses if she wakes before your next visit?” Beth asked.
“Oh yes, Alan, tell her Alan Porter sent them. Can you tell me what happened to her?”
“Yeah, her damn husband almost killed her by throwing her over a stair railing.” Beth said.
“Yeah he’s a real gem. I’m sorry she is going through this.” Alan said, “Bye for now.”
Beth was curious about this Alan character. She got the feeling he liked Chloe and had no respect for Michael at all. She decided to look into him. He seemed nice enough though.
Beth went and sat by Chloe and talked to her. Talked about the fun times, how she is missed and how much she is needed by them all but mostly about Emma.
As she held her hand she finally moved a little bit.
Was she trying to wake up? Beth wondered.
Chloe’s fingers moved and her eyes fluttered but didn’t open yet. She seemed agitated. Beth went and got the nurse, who contacted the Dr.
The Dr came in to examine Chloe. He noticed that she was showing signs of waking up.
He took an instrument and ran it down her foot to get a reaction. She immediately pulled away.
“She’s slowly coming around.” The Dr said. “Give her some time. I’ll come back after a few hours and check on her again. If anything changes please call me.” He said.
Beth called Edith and Bob to tell them the news. They were done eating but they had a stop to make.
Bob drove to the sheriff's office today to find out what was being done about what happened to Chloe.
“Tom, are you going to arrest Michael or not? Everyone knows he did it for god's sake.” Bob said.
“Now Bob, I have to have evidence. Emma is telling me the same story he is. Chloe is still unable to tell me anything. I can’t arrest him with no proof, Bob. You know that. Look, I know you're frustrated, just give me time.” Tom said.
“What about Emma? She’s still living there with him. Can we get custody of her?” Edith asked.
“You’ll have to talk to a lawyer about that. I don't know about that.” Tom told her.
“Well I’ll fight to my dying breath to get that child from him!” Edith said as they left the sheriff’s office.
Bob and Edith drove over to the hospital to check on Chloe. They prayed she would come around and tell them what really happened. The sooner she could the sooner they could lock Michael up.
“Beth, has she woke up yet?” Edith asked, looking at a sleeping Chloe.
“She seems to be trying to, but slowly. She hasn’t completely woken up yet.” Beth informed them. “It may take a while for her to fully come around, the Dr said.”
“All we can do is keep praying. I think Edith and I will drive to Grantsville tomorrow to meet with a lawyer there, about getting custody of Emma.” Bob said. “And there’s no need for you to sit around Beth and wait for her to wake. Go to work, they’ll call when she does.” He told her.
“Yeah I guess you’re right, but I hate to have her be alone when she wakes up.” Beth replied.
“Now honey, she has the nurses and everyone, she’s not alone. And you’re just a couple blocks away. You can come if they call.” Edith told her. “Let’s all go home and try to get some rest in our beds for a change. It’s been several nights that we have slept up here. We all need some rest.”
Beth had to admit, it felt good to take a hot bath and sleep in her nice soft bed, not a hard chair. She fell asleep as soon as her head hit the pillow. She was more tired than she thought.
They all woke up a lot more refreshed than they had been as of late. Sleeping in your own bed does wonders for a person. Edith called the hospital after she started the coffee.
“Yes, I’m call to check and see how Chloe Conrad’s night was. Did she wake at all, by chance?” Edith asked. “Okay. Yes. Yes. I see. Okay. I understand. We’ll, thank you. Goodbye.” She said and hung up.
“Well? Has she woke up?” Beth asked impatiently.
“No, she hasn’t but she’s doing more moving and some mumbling in her sleep. She did seem to rest okay though.” Edith told them. “We can all go up later.”
Beth got ready for work and left. Bob called the lawyer in Grantsville to see if he could meet with them today.
“Mr. Abrams has time this morning at 9:15.” His secretary said.
“That’s great. Put us down.” Bob said and hung up.
They had just enough time to grab some coffee and run. They didn’t want to be late. It’s a 40 minute drive and it was already 8:25. They managed to get there early, which is how Bob liked it.
“Mr. Abrams can see you now.” His secretary told them as she directed them to his office.
As they walked in they were met by a tall man in maybe his 50’s, very stocky large man. Looking at him Bob was reminded of the actor Brian Dennehy, he had the same build. He was very pleasant.
“Please, have a seat and tell me how I can help you today.” He said.
“We’ll, Mr. Abrams, we..”
“Just call me Andrew, please.” He said cutting Bob off.
“Okay Andrew, we have a girl who we raised as our own after her parents died. She’s been in an abusive marriage and she was thrown over her banister several nights ago and still hasn’t come around. She and husband have a 6 yr old daughter, Emma, whom we’d like to get custody of. The father is being investigated for the attempted murder of the mother. They just have to get enough evidence. Little Emma is scared to say anything because he hurts her too. She needs to be removed. What do we do?”
“Okay, first of all I’m sorry for all that you’re going through. The first thing is we need to get Social Services to investigate and interview people. Someone will talk. Then they will pull her and we’ll push the courts to have her placed in your care. Hopefully by then the mother has woken up and she can testify to it all. Now if she goes back, so does the little girl. You lose rights then.” Andrew told them.
“There’s no way she’d go back this time, I know it,” said Edith.
“You would be surprised ma’am how many I have seen worse off, go back. It happens everyday.” He replied. “Let’s start with Social Services and getting the school involved. They have to have noticed things going on. I’ll send an investigator out. Then we’ll go from there. Okay?”
“Thank you so much Andrew.” Bob said.
“I’ll be in touch soon,” Andrew promised them as they left his office.
He wasted no time in calling Social Services and getting an investigator out to the school.

Casselman Bridge, also known as Casselmans Bridge, was completed in 1811 and opened for traffic in 1813 to carry the National Road across the Casselman River near Grantsville in western Maryland. The bridge was built to aid in the westward movement through the wilderness west of Cumberland. When the 80-foot span was erected, it was the longest single span stone arch bridge in the United States. Skeptics predicted that the bridge would collapse once the supporting timbers were removed - yet the bridge stood, serving as an important link on the National Road from 1813 to 1933. Although the bridge no longer carries vehicular traffic, it is open to pedestrians.
Today the Casselman River Bridge stands as a picturesque relic of Maryland's early transportation history, and a tribute to those who designed and built the National Road.

I was in a practice audit and confirming a supplier in Grantsville, UT, and when I said it out loud I couldn't say the fucking state of Utah because my tired brain could only think undertale. Like I could picture Utah. But I could not define it with those initials. This is my career.
