By • Olalekan Fagbade Alleged Bribery: APC Chairman threatens lawsuit against Kano State Attorney General Chairman of the All Progressives Congress APC in Kano state, Hon. Abdullahi Abbas has threatened a lawsuit against the state’s Attorney General and Commissioner for Justice, Haruna Isa Dederi for accusing APC leaders of influencing the Kano State Governorship Election Petition Tribunal and the Justices of the Court of Appeal to sack the state Governor, Alhaji Abba Kabir Yusuf of the New Nigeria Peoples Party NNPP. Abbas in a letter dated November 23 and sent to Dederi, also gave him 48 hours to withdraw the defamatory statements or risk being dragged before the Legal Practitioners Disciplinary Committee LPDC. He said Dederi had gone on national television to “maliciously and falsely allege that the decision of the Tribunal to deliver judgment via zoom was because of interference”. Abbas said not done with the tribunal, the Attorney General also went on to malign justices of the appellate court by saying; “According to information available us there was interference by forces that be. There are people who have interest in this country and can go to any extent to jeopardize things because of their political interest and that was what played out in the judgment”. He said Dederi later made a voice recording as the Attorney General of Kano State countering the statement issued by the Chief Registrar of the Court of Appeal in respect of the clerical error in the judgment. “In the said voice note, you made innuendos suggesting that the Justices of the Court of Appeal were indeed compromised. “From the above statements, it is clear for any discerning mind to infer that you were suggesting influence on the judges by our party leaders, which you know is far from the truth”, the APC chairman said in the letter copied President of the Nigerian Bar Association NBA and the Kano state chairman of the association. Consequently, he said since Dederi’s statements, he has received countless phone calls and text messages from family, friends, colleagues and associates demanding explanation from him as to whether it was indeed true that the APC influenced the judgment of the Court of Appeal and the Tribunal. “I also received various threats including attempts to attack my house in Kano. Your careless words have created so much tension casting aspersion on my person by demeaning my reputation in the society. “Consequent upon the above, I therefore demand that you come forward and mention the names of those who had hands in interfering with the judgment of the two courts. This will go a long way in cleansing the society of corruption. It will also clear my name and be protected against unnecessary attacks your comments have subjected me to. But if you have no proof of the serious allegations you made, I demand that you publicly apologize to me and my party for the embarrassment you caused us. Your allegations against the judges and justices are very grievous more so if they turn out to be false. “I, therefore, by this letter, give you an ultimatum of 48 hours to back your allegations against the Judges and Justices that they were influenced to give judgment contrary to the law as you claimed. “Please note that if you fail to meet with my demands as stated above, I shall not hesitate to file a petition against you at the Legal Practitioners Disciplinary Committee as well as institute an action for defamation against you in court, and this we shall do without further recourse to you.

Amotekun Comment: South-West Governors Back Tinubu

Amotekun Comment: South-West Governors Back Tinubu
Tumblr media Tumblr media
(adsbygoogle = window.adsbygoogle || []).push();
• APC national leader takes neutral position on operation • Tinubu ’ s statement lacks substance , says Yoruba umbrella group • Former Lagos governor made objective observations – Akeredolu
South -West governors and the apex Yoruba socio -political group, Afenifere, on Wednesday differed on the All Progressives Congress leader, Asiwaju Bola Tinubu ’ s position on the Western Nigerian Security Network, Operation Amotekun . The governors commended the former Lagos State governor and promised to look into the issues he raised , but Afenifere hit Tinubu hard , saying his statement lacked substance . After almost three weeks of silence on the launching of Amotekun, Tinubu on Wednesday made his position known on the security outfit, which was launched by the South- West governors in Ibadan on January 9. Afenifere chieftains , Chief Ayo Adebanjo and Senator Femi Okurounmu , had , in a report published by Sunday PUNCH on January 19, challenged Tinubu to speak on the security outfit , which the Attorney General of the (adsbygoogle = window.adsbygoogle || []).push(); Federation , Abubakar Malami , on Thursday last week declared illegal . Tinubu takes neutral position on Amotekun But Tinubu , in a statement he personally signed, took a neutral position on Amotekun. His position is at variance with the Nobel laureate , Prof. Wole Soyinka ; Ohanaeze Ndigbo and prominent lawyers, who lauded the initiative . Tinubu blamed both the South -West governors and Malami for the controversy the matter had generated . The APC leader, who is rumoured to be nursing a presidential ambition , said the intentions of the governors were good but the manner with which Amotekun was being set up was wrong. The former governor of Lagos State criticised Malami for issuing a statement condemning the initiative when he could have simply reached out to them and handled it internally and more amicably . He added, “ The governors stated that they consulted regularly with the police and security agencies. This was the right thing to do. However , their failure to include the office of the attorney general in these discussions is the fount of the current public uproar. (adsbygoogle = window.adsbygoogle || []).push(); This was an unfortunate omission the governors should regret and seek to remedy. However , the conceptual merits and positive functional aspects of Amotekun should not be tainted by this procedural defect . “ While the Attorney General is a conscientious public servant, he is also human . Not having been consulted, he was suddenly faced with an unexpected public announcement regarding a matter within his official ambit. He likely feared the failure to consult him meant that federal prerogatives were being encroached. To blame him for this conclusion would be to blame human nature itself . Though his negative reaction was understandable, it was also unhelpful . “ The Attorney General acted hastily in rendering a public statement that was more inaccurate than it should have been . Amotekun was never proposed as a ‘defence ’ agency ; the Attorney General erred in using this description . The use of uniform and brightly coloured vehicles may not be the best ideas, but they do not render Amotekun a defence agency or paramilitary group any more than a designated school van carrying uniformed students constitutes a paramilitary deployment .” The APC chieftain said Amotekun was a laudable initiative, but needed some operational and conceptual modifications or else it would fail. Tinubu wrote , “ As I understand it, Amotekun is to be another set of eyes and ears to assist the police . As such, it is but the second generation of Neighbourhood Watch expanded to a regional scale . Conceptually , there is nothing wrong with this . It does not appear to insult the constitution. “ However , my position regarding Amotekun is not blind or uncritical; there are several organisational and functional aspects of the proposal that could cause some problems if left unresolved .” Tinubu said Amotekun should have been fashioned to the peculiarities of each state rather than having a regional structure . He (adsbygoogle = window.adsbygoogle || []).push(); stated that the regional approach had only limited benefit with regard to the procurement and maintenance of vehicles and communications equipment because this wider approach allows for economies of scale. Why I was silent initially – Tinubu Responding to those who criticised his silence, Tinubu said as the national leader of the APC , he could not make statements without circumspection . He added, “ Until now, I have deliberately maintained a studied silence regarding Amotekun. Many have tried to goad my swift public reaction . Those who have taken this road did so not because they care about Amotekun or even the people it intends to help protect . They did so knowing this had become a delicate and emotional issue for many. These cynics did so with the adversarial hope that , in haste, I might (adsbygoogle = window.adsbygoogle || []).push(); misspeak or misstep in a manner they could twist to their political advantage . “ Such people are possessed of a mercenary aspect that permits them to sacrifice almost anything , even jeopardise the very foundations of our political unity, if they might exact personal gain from the upheaval . ” He said in the coming days , he would meet with the Ondo State Governor, Rotimi Akeredolu ( SAN) , who is also the Chairman, South-West Governors’ Forum, on how best to implement the Amotekun initiative . Tinubu made objective observations – Akeredolu Reacting to Tinubu ’ s statement, the Akeredolu, commended him . The (adsbygoogle = window.adsbygoogle || []).push(); governor , who spoke through his Special Adviser on Security , Alhaji Jimoh Dojumo, said it was commendable for Tinubu to have broken silence on the issue . He said , “ We have to commend our leader, Asiwaju Tinubu , for his comments. As a leader who loves his people, he has made objective observations in his statement . “ In the comment he could see that the Operation Amotekun can never be a threat to the unity of the country and that the people of the South-West needed to be protected by their governors . Also , all other issues he pointed out in the statement would be looked into . Buy he has spoken well.” Ogun agrees with Asiwaju’ s stand on Amotekun Also, the Ogun State Governor, Prince Dapo Abiodun, said he did not disagree with the submission made by the ex -Lagos governor. The Special Adviser to governor on media, Mr Remmy Hassan , in an interview with one of our correspondents, said , “ We in Ogun State support every agenda that promotes peace , security and welfare of the South -West people, including Operation Amotekun.” The Director General of Development Agenda for Western Nigeria, Seye Oyeleye , on his part, said mischief- makers who could not assist the South -West in the wake of security challenges ravaging it, were behind opposition to Amotekun. He allayed fears that Amotekun would be against an ethnic group , saying it would serve the interest of all ethnic groups resident in South -West . Oyeleye said this during a programme aired by a private radio station, Rave FM in Osogbo.
Tinubu’ s comment warmly received – DAWN DAWN (adsbygoogle = window.adsbygoogle || []).push(); ’s Head, Special Projects and Funding, Prince Adetayo Adeleke -Adedoyin, said the comment of Tinubu on Operation Amotekun was well conceived and warmly taken . In a telephone conversation with our correspondent, Adeleke -Adedoyin said , “ Asiwaju ’ s comment on Operation Amotekun is welcomed . He is from the region and he is a national leader also . ” Ekiti State Commissioner for Information , Aare Muyiwa Olumilua , reiterated the state Governor, Kayode Fayemi’ s position that Amotekun was established to enhance security in the South- West . Olumilua said , “ Asiwaju Bola Tinubu is entitled to his opinion just like any other person. But I stand firmly by every single detail of what Governor Kayode Fayemi had said as regards Amotekun. “ Amotekun does not in any way violate the constitution. It is just a way of further strengthening the security architecture in the South -West . Nothing more ” , the commissioner said . Ex -Lagos gov’ s statement lacks substance – Afenifere But the Afenifere dismissed the statement by the former Lagos State governor , saying it lacked substance. It (adsbygoogle = window.adsbygoogle || []).push(); said Tinubu spoke in a forked tongue , adding that his statement failed to defend the decision taken by his kinsmen to defend themselves against marauders . The National Publicity Secretary of Afenifere, Yinka Odumakin, in an interview with The PUNCH, recalled how the President, Major General Muhammadu Buhari ( retd.) , visited the then Oyo State Governor, Lam Adesina , to protest the alleged killing of his kinsmen . He said , “ Maybe , he ( Tinubu ) should have kept quiet. This is not the time to speak in a forked tongue . What is the reason ? You are afraid of Buhari ? “ In 2001 , when there was a crisis between herdsmen and farmers, what did Buhari do ? He went to Ibadan and told Governor Lam Adesina ‘ your people are killing my people . ’ “ In 2013, what did Buhari do? He told President Goodluck Jonathan you can ’t declare amnesty for Niger Delta militants while killing Boko Haram . Attack against Boko Haram is an attack against the North. “ We are being killed for months, our women are being raped . Now, our governors are taking a token measure to secure our people . At this point, if you can’ t speak for the people, it is better to keep quiet. We are not impressed.” Also, an Afenifere leader , Adebanjo , said Tinubu only came out to react because of his aspiration to be President in 2023 . Adebanjo, (adsbygoogle = window.adsbygoogle || []).push(); who obviously disagreed with Tinubu ’ s position , said the APC National Leader would not say anything that would contradict the position of Buhari.

Tinubu Says Supreme Court Verdict on Osun Vindicates Judiciary as unbiased, independent
Tumblr media
The All Progressives Congress (APC) National Leader, Sen. Bola Tinubu, has commended the Supreme Court’s judgment on the Osun Guber Poll, saying it further vindicates the judiciary as unbiased, independent and impartial.     Tinubu gave the commendation in a statement entitled “Supreme Court Verdict on Osun: Testimony that Judiciary is on Course,” on Friday in Lagos.   He said that the judgment which reaffirmed the victory of Gov. Gboyega Oyetola was a testimony that the judiciary was firmly on course and worked in synch with the peoples’ aspiration. According to him, in spite of the intimidation, unnecessary accusations and rumour-mongering, the apex court lived to its billing by dispensing justice without fear or favour. “The court did not rule based on any hearsay but acted on the basis of the merits and demerits of the case before it. “The Supreme Court and the Judiciary, therefore, deserve our commendation for it has further strengthened the democratic process. Tinubu also commended the Independent National Electoral Commission for discharging itself creditably on the Osun election. “On the issue of the Electoral Act, it is only the INEC, as the electoral body, that can apply the law appropriately with respect to elections. “This, the commission did rightly,’’ he said. Tinubu said that the verdict of the apex court laid to rest the tussle over the Osun governorship and removed all encumbrances on the path of the governor. “Now, governance can begin in full swing and the people of Osun can begin to reap the fruits of the government they voted to put in place. “I congratulate Gov. Oyetola for his steadfastness and for remaining calm while the electoral case lasted. “The All Progressives Congress must be commended for standing firmly behind the governor. I also commend the government and people of Osun in allowing the rule of law to run its entire course. “I urge them to continue to assist the security agencies in maintaining and sustaining the peace,’’ he said. Tinubu urged Gov. Oyetola to be magnanimous in victory by extending his hands of fellowship to the Peoples Democratic Party and continue to unite the people. “PDP and its candidate, Sen. Ademola Adeleke, have exercised and exhausted their rights as expected of them. I praise them for their doggedness. “It is now time to rally round and join hands with the government to move Osun to the Next Level,’’ Tinubu said. Read the full article

Newsmen reports that the Peoples Democratic Party (PDP) and its candidate, Sen. Ademola Adeleke, had challenged the victory of the All Progressives Congress (APC) and its candidate, Gov. Gboyega Oyetola at the Osun 2018 Governorship Election Tribunal. The tribunal on March 22 declared Adeleke as the winner of the election, but the judgment was later overturned by the Appeal Court on May 9. Osun tribunal: Appeal Court reserves judgement on Adeleke’s appeal
Tumblr media
The Court of Appeal sitting in Abuja on Monday reserved judgement on the Osun State governorship appeal filled by Governor Ademola Adeleke. The appeal filed by Adeleke of the Peoples Democratic Party is against a judgment of the tribunal which invalidated his election as governor of Osun State. The three-member panel of justices led by Justice M.F. Shuaibu began sitting on the appeal at about 10am.While Adeleke is the appellant, Oyetola and the All Progressives Congress are 1st and 2nd respondents in the appeal marked: CA/AK/EPT/GOV/01/2023. The Independent National Electoral Commission and the PDP are also joined as 3rd respondent and 4th respondents respectively. The News Agency of Nigeria reports that the Osun State Governorship Election Petition Tribunal had on January 27, voided the July 16, 2022, election that produced Adeleke of PDP as the elected governor. INEC had declared Adeleke the winner of the election after polling a total of 403,371 votes. He was said to have won in 17 of the 30 local government areas in the state. But the panel led by Justice Terste Kume, in its judgment, invalidated the election and declared Mr Gboyega Oyetola of APC as the valid winner of the poll. The tribunal directed INEC to withdraw the Certificate of Return issued to Adeleke and his deputy, Kola Adewusi, both of whom had been sworn in. It, however, directed that the Certificate of Return should instead be issued to Oyetola. Justice Kume held that the governorship election was not held in compliance with Nigeria’s Electoral Act. The tribunal also held that the governorship election was characterised by over-voting. It said after deducting the excessive votes, the figure Oyetola polled at the election was 314, 921. The tribunal, thus, ordered that Oyetola should be returned as governor of Osun State. NAN reports that INEC, in its earlier results, said Oyetola won in 13 LGAs with 375,027 votes in the July 16, 2022 governorship election. Fifteen candidates contested for the poll which was keenly contested between Adeleke and Oyetola. In his petition, Oyetola, the immediate-past governor of the state, had alleged that the election was characterised by over-voting in 749 polling units. He also argued that Adeleke forged the academic credentials he submitted to NEC to contest for the election. The tribunal had commenced sitting in August 2022, a few weeks after the governorship election. Oyetola and the APC were petitioners in the case with Lateef Fagbemi, SAN, and Akin Olujimi, SAN, as their lead counsels. INEC was the 1st defendant, Adeleke the 2nd defendant and PDP as 3rd defendant. Read the full article

Osun Guber Poll: Oyetola floors Adeleke at Appeal Court
Tumblr media
The Appeal Court has ruled in favour of Osun state governor, Gboyega Oyetola, in the 2018 governorship election in the state. A five member panel presided by Justice Jummai Sankey on Thursday held that the appeal has merit and upheld 10 out of the 12 issues raised by Governor Adegboyega Oyetola of the APC. Oyetola, the candidate of the All Progressives Congress, APC in the election appealed the judgement of the Osun State Election Petitions Tribunal that favoured the candidate of the Peoples Democratic Party, Senator Ademola Adeleke. Recall that the Osun State Election Petitions Tribunal sitting in Abuja had declared Adeleke as the winner of the Osun governorship election. The tribunal ruled that Ademola Adeleke fulfilled the constitutional requirements to be declared winner of the Osun State governorship election because Adeleke scored the majority of the lawful votes cast in the September 22, 2018, governorship election. In the lead judgment by Justice Peter Chudi Obiarah, the tribunal further held that the re-run in seven polling units on September 27, was null and void and of “no electoral effect.” Therefore, the tribunal ordered that the certificate of return issued to Gov. Gboyega Oyetola of the APC was nullified and withdrawn and ordered INEC to issue a fresh certificate of return to Adeleke as the duly elected governor. Read the full article
