James J. Haggerty

Magisterial district judge, James J. Haggerty, 58, of Kingston, Pennsylvania died in the company of his family on Wednesday, March 20th, at Hospice & Palliative Care Buffalo in Cheektowaga, New York. Born in Wilkes-Barre, Jim was the son of the late James and Judy (Treslar) Haggerty. Valedictorian of Wyoming Valley West High School class of 1983, Jim earned a Bachelor of Science degree in Management Science at the Massachusetts Institute of Technology. Having successfully completed the Army ROTC program, Jim was commissioned as Second Lieutenant of Armor, U.S. Army Reserve. He earned a U.S. Army parachutist badge and was tank platoon leader, 1st Battalion, 103d Armor, Pennsylvania National Guard. Jim received his law degree, with distinction, from Georgetown Law School in 1990.  

Owner of his own law firm in Kingston, Jim spent most of his professional life in public service, first as the mayor of Kingston from 1998–2017 and most recently as a magisterial district judge from 2017-2024. Jim loved his hometown. During his 20 years as mayor, he was proud to be integral in restoring and bolstering Kingston’s financial health, rebuilding and modernizing the Hoyt library, constructing Kingston’s Central Fire Station, revitalizing the recreation center and community pool, improving its parks and playgrounds, protecting its shade trees, and generally helping to make Kingston a great place to call home. One of Jim’s proudest moments was when he represented the Edwardsville Hometown Committee on a pro bono basis and saved the Pierogi Festival.

Jim was known for his marked intelligence, his sense of humor, and his loyalty to his friends. His varied interests included politics, travel, delivering food to local families, reading to kids, indulging in a weekend beverage at the Rush Inn, and watching sports – often several games at once.

Jim is survived by his two loving sisters and their husbands, all of Amherst, New York: Kelly (Haggerty) and Kevin Ahuna; and Patricia (Haggerty) and Timothy Lyle. He took good pride in his nephews and nieces: Ethan and Emily Ahuna; and Quinlan and Zoe Lyle. Jim was always surrounded by his many close and cherished friends.

Friends and family may call from 2 to 6 p.m. Sunday, March 24th in the Rotunda at the Luzerne County Courthouse, 200 N. River St., Wilkes-Barre.

A Mass of Christian Burial will be held at 10 a.m. Monday, March 25th at St. Ignatius of Loyola Church, Kingston. Friends and family are asked to go directly to the church. Internment will be at Fern Knoll Burial Park, Dallas.

In lieu of flowers, Jim asked that memorial donations be made to Dinners for Kids or the Kingston Fireman's Community Ambulance.

2 FORMER MARCH OF DIMES OFFICIALS AGREE TO PAY BACK EMBEZZLED FUNDS

Two former top officials of the local March of Dimes chapter pleaded guilty under a deal with Erie County prosecutors to embezzling organization funds and agreed to pay back more than $29,000.

The plea involved Brian R. Poliner, 37, former executive director of the Western New York Chapter of the March of Dimes Birth Defects Foundation. A tearful Poliner told Erie County Judge John V. Rogowski that even before he became head of the organization five years ago he was illegally dipping into its funds at other times in his 10-year career.

Poliner and his former assistant executive director, Kimberly Chiarmonte, 32, told the judge they used March of Dimes funds to operate a flight school and small airport in Le Roy and to pay for an international trip earlier this year.

Poliner, of 4700 Shurr Road, Clarence, pleaded guilty to a single count of felony fourth-degree grand larceny. Ms. Chiarmonte, of 28 Jamaica Lane, Cheektowaga, pleaded guilty to two misdemeanor counts of attempted fourth-degree grand larceny. Rogowski said they might get one-year jail terms.

Rogowski allowed both to remain free on their own recognizance pending sentencing Feb. 18. Poliner could have received a prison term of up to four years on his guilty plea.

Neither he nor Ms. Chiarmonte was indicted or even charged with any criminal offenses before Monday. They could also receive probation in the case.

District Attorney Kevin M. Dillon said in early May, shortly before the organization fired both, that Poliner and Ms. Chiarmonte closed the March of Dimes office on Genesee Street in Cheektowaga for a week, guaranteed all employees they would be paid and took a trip to Pakistan and India.

Dillon said Poliner and Ms. Chiarmonte illegally paid for their trip with March of Dimes funds.

Court officials said both defendants were fired May 11 after the organization found at least $40,000 had been embezzled. Prosecutors were only able to prove Poliner stole $21,561.50 in agency funds and Ms. Chiarmonte personally stole $7,740, court sources said.

Frigid monster storm across US claims at least 34 lives

BUFFALO: Millions of people hunkered down against a deep freeze Sunday to ride out the winter storm that has killed at least 34 people across the United States and is expected to claim more lives after trapping some residents inside houses with heaping snow drifts and knocking out power to tens of thousands of homes and businesses. The scope of the storm has been nearly unprecedented, stretching from the Great Lakes near Canada to the Rio Grande along the border with Mexico. About 60 per cent of the US population faced some sort of winter weather advisory or warning, and temperatures plummeted drastically below normal from east of the Rocky Mountains to the Appalachians, the National Weather Service said. Travellers' weather woes are likely to continue, with hundreds of flight cancellations already and more expected after a bomb cyclone - when atmospheric pressure drops very quickly in a strong storm - developed near the Great Lakes, stirring up blizzard conditions, including heavy winds and snow. Some 1,707 domestic and international flights were cancelled on Sunday, according to the tracking site FlightAware. The storm unleashed its full fury on Buffalo, with hurricane-force winds and snow causing whiteout conditions, paralysing emergency response efforts. New York Gov. Kathy Hochul said almost every fire truck in the city was stranded Saturday and implored people Sunday to respect an ongoing driving ban in the region. Officials said the airport would be shut through Tuesday morning. The National Weather Service said the snow total at the Buffalo Niagara International Airport stood at 109 centimetres Sunday. Daylight revealed cars nearly covered by 6-foot snowdrifts and thousands of houses, some adorned in unlit holiday displays, dark from a lack of power. The Hottest Markets of April 2019: All Fired Up Over Affordability

As home buyers continue to seek out pockets of affordability across the nation, metros in the Midwest and Northeast are luring ever more of them, according to an analysis of realtor.com® data for April.

Markets in those regions outnumbered the previously red-hot metros of California on realtor.com’s monthly ranking of the hottest markets in the U.S. These are identified by how fast homes are selling in each metro and how many views that metro’s listings receive, both of which reflect buyer demand.

And although home price growth has been skyrocketing for years, the outlook for this spring and summer, traditionally the high season for home buying and selling, is more moderate.

“It’s going to be a controlled landing with prices. We should still see [price] growth, though not at the level of last year,” says Javier Vivas, director of economic research for realtor.com.

The Boston metropolitan market, which includes Cambridge as well as suburban Newton, completed its steady climb up the ranks (it was No. 18 in January) to top the hot list. However, like 10 of the 20 hottest markets for April, its properties were taking longer to sell than at the same time last year, reflecting an overall slowdown.

Six Midwestern markets and five Northeastern markets made it into the top 20, compared with five in California. It represents a big turnaround.

While the Midwest has long been known for its affordability, the Northeast has some of the country’s most expensive markets, including Boston and New York City. So why all the activity in that region, now that buyers are more price-conscious? The answer lies in the new tax code, which penalizes buyers of expensive homes in high-tax areas.

“Part of it is tax-related: There are places in the Northeast that are traditionally high-tax areas, but there are also lower-tax areas,” Vivas says. So people are moving around in the area, trying to minimize their tax liability.

As for Boston, it’s just less hemmed in than a market like San Francisco, Vivas says, leaving more options for buyers in smaller suburban towns that fall within the metro area.

“It’s one of those cases where, if you sit still and everyone else slows down, it looks like you’re moving faster,” Vivas says.

Second on the hot list is Lafayette, IN, marking its first time in the top three since the economic team began reporting its hottest markets in 2013. It’s moved up 18 spots in the ranking over the past year. At No. 3 is Spokane, WA, which also cracked the top three for the first time; its ranking improved by 10 spots over the previous year.

The metros seeing the biggest slowdown in selling time were Midland, TX, where homes were taking six more days to move than one year ago; Stockton, CA, and San Francisco (four days each); and Modesto, CA (three days). Yet homes in the metros on this list are still getting more views and selling more quickly than in other cities.

Other markets to watch include Worcester, MA; Fort Wayne, IN; and La Crosse, WI, none of which made the list the month before.
