J&K BJP sarpanch arrested for links with ex-DSP Davinder, Hizb terrorists

The National Investigation Agency (NIA) on Thursday formally arrested the BJP sarpanch from Maldara in Shopian, Tariq Ahmed Mir, for having links with disgraced ex-DSP Davinder Singh and Hizbul Mujahideen terrorists. Mir, who had unsuccessfully contested the J&K assembly election from Wanchi seat on a BJP ticket. The suspect, Tariq Ahmad Mir, 36, was arrested by the NIA on Wednesday. An official said his name cropped up during the interrogation of Naveed Mushtaq Shah, the Hizbul Mujahideen militant. Shah reportedly told interrogators that Mir was involved in providing weapons to other terrorist groups. Gram panchayat elections are not fought on party symbols but candidates do get support from political parties. Mir was elected in 2011. An official said the NIA had raided multiple locations in February and Mir’s house was one of them, but he was not arrested then. Panchayat elections could not be held in the district in 2018 due to prevailing law and order situation. Around 20,000 panchayat seats are vacant mostly in South Kashmir. “Mir is an arms conduit, he was arrested and produced in court which granted six day custody. Further interrogation is on,” a senior NIA official said. Deputy Superintendent of Police (DSP) Singh was arrested with Naveed, Rafi Ahmed Rather, another Hizbul militant and Irfan Shafi, a lawyer, on January 11 in South Kashmir’s Kulgam. The accused were enroute to the residence of Naveed’s younger brother Syed Irfan Ahmad in Jammu. A PhD scholar, Irfan was arrested on January 24 by the J&K police. The case was subsequently transferred to the NIA. Another official said though Mir was not directly involved in Davinder Singh’s case, he played an important role in providing weapons to several terrorist groups active in Kashmir Valley including the Hizbul. Singh’s arrest created a sensation as he was found in the company of Naveed Shah, a former police constable and one of the ‘most wanted terrorists’ in J&K. Police say that Shah was behind the killing of 11 truck drivers, non-local labourers and apple traders in south Kashmir after the August 5 clampdown in the former State after Parliament abrogated Article 370. Hon’ble Mr. Justice Sudhansu Jyoti Mukhopadhaya, Chairperson, National Company Law Appellate Tribunal, Delhi and Former Judge, the Supreme Court of India

Mr. Justice Sudhansu Jyoti Mukhopadhaya born on March 15, 1950, is the son of late Shri Sarojendu Mukherjee who was a leading practitioner especially Constitutional and in Service law in the High Court of Patna. He passed the B.Sc. examination in 1971 from Magadh University and obtained his LL. B Degree in 1979 from the University of Patna. Enrolled as an Advocate on May 18, 1979 and practiced at the Patna and Ranchi Benches of the High Court of Patna in Constitutional, Service, Civil and Criminal matters. He was designated as Senior Advocate in February 1993.

Mr. Justice S J Mukhopadhaya was appointed as a permanent Judge of the High Court of Patna on November 08, 1994. He was transferred on November 15, 2000 as permanent judge of the High Court of Jharkhand on its creation, where he served as the Acting Chief Justice for about a year and three months. On August 31, 2006 he was transferred and joined as the first puisne judge in the High Court of Madras where he also functioned as the Acting Chief Justice for about five months. Thereafter from December 08, 2009 to September 12, 2011, he was the Chief Justice of the High Court of Gujarat.

As a Judge Mr. Justice S J Mukhopadhaya has decided several important civil and Constitutional cases and to name a few- like the vires of the Bihar Panchayat Raj Act, 1993, in which case it was held that the reservation limit of 50% is applicable so far as Article 243D of the Panchayat Raj Act is concerned. The reservation for the seat of “Mukhiya” or “Pramukh” or “Adhyakchh”, the seat being a solitary post would amount to 100% reservation, which is not permissible. Therefore, no reservation could be made for the aforesaid seat.

As a Judge of the Hon’ble High Court of Patna, Sitting in Division Bench Mr. Justice S J Mukhopadhaya decided the ‘Fodder scam’ and ‘Bitumen scam’ cases. He was part of the Bench of the Hon’ble Supreme Court, which held that Section 377 IPC does not suffer from the vice of unconstitutionality.

Mr. Justice S J Mukhopadhaya was also part of the Bench of the Hon’ble Supreme Court which ruled that Section 8(4) of the Representation of the People Act, which allow elected representatives three months to appeal their conviction and not to give effect to the conviction by trial Court, as unconstitutional and further held that any Member of Parliament or Member of the Legislative Assembly or Member of a Legislative Council whoever is convicted of a crime and awarded a minimum of two year imprisonment, loses membership of such House with immediate effect.

After the retirement, Mr. Justice S J Mukhopadhaya has been appointed as the first Chairperson of National Company Law Appellate Tribunal on June 01, 2016. In his capacity as the Chairperson, he has delivered judgements explaining different provisions of newly enacted Insolvency and Bankruptcy Code, 2016 on which there is no precedent.

बिहार पंचायत चुनाव की तारीखों का ऐलान जल्द, सभी पदों के लिए नामांकन शुल्क तय

बिहार में पंचायत चुनाव को लेकर सभी जिलों को तैयार रहने का निर्देश दिया गया है। चुनाव की अधिसूचना कभी भी जारी हो सकती है। राज्य निर्वाचन आयोग ने पंचायत चुनाव में सभी पदों पर नामांकन के लिए शुल्क भी तय कर दिया है।  राज्य निर्वाचन आयोग ने सभी डीएम को निर्देश दिया है कि पंचायत व ग्राम कचहरी चुनाव को लेकर अपनी त���यारी पूरी कर लें। राज्यपाल द्वारा पंचायत चुनाव की अधिसूचना किसी भी दिन जारी की जा सकती है।…
