Taylor Swift's Trial
David Mueller's attorney, McFarland told the jury: "If you look at that photograph, his hand is not underneath Miss Swift's skirt, and her skirt is not rumpled in any fashion." I want to point some things out... I want to ask him how should THAT particular skirt be ruffled if moved? Because It depends on MANY factors: * Type of material: was Taylor's skirt made up synthetic or man-made fibers? Were those fibers blended, woven, and or applied with finishes? * If Taylor Swift's garment was made from blended materials what kind of blend? 1. Polyester and Cotton 2. Linen and Silk 3. Spandex and Cotton 4. Cotton, Polyester and Rayon * Which one or more of these common fabrics was her skirt made from? 1. Batiste 2. Boucle 3. Brocade 4. Calico 5. Cashmere 6. Chantilly Lace 7. Velvet 8. Corduroy 9. Duck 10. Dobby 11. Faille 12. Gingham 13. Microfiber 14. Spandex 15. Gabardine 16. Chiffon 17. Crepe 18. Denim 19. Flannel 20. Fleece 21. Interlock 22. Jersey 23. Sweatshirt Jersey 24. Organza 25. Satin 26. Taffeta 27. Tweed 28. Voile * What was the history of wear and or maintenance of this garment? Was it pre-shrunk, chemically treated to be 'wrinkle-free' or 'permanent press?' Was the fabric ironed, starched, steamed, washed via washing machine, (front load or top load machine? Were there other garments, with zippers or other abrasive attachments, washed along with the skirt? Was it hand washed, dry cleaned? * What chemicals were used in the laundering process? Did the laundry detergent contain benzoyl peroxide or alpha hydroxy acids? Was powder or liquid used? * What was the staple length of the fabric involved? * If the fabric was part linen was there a worn down crease creating a weakness in the garment? * If Taylor's skirt was wool blend do we know what kind of animal it was created from and do we know said animal's diet, stress levels or how the wool was handled during the complete manufacturing process? * If the dress is denim how were the seams and the stitching? Were the seams double-stitched or chain-stitched? * If the skirt in question was made of leather (which is a material not a fabric) was it full, top, or split grain? Was glue or hand-stitching involved? * Was the skirt made from vegan leather? If so was it supple, soft, shiny and or thick? * Who designed the garment? Were they experienced at picking the right kind of fabric for the type of garment? Did the fabric aid or stand in the way of the garment draping correctly? Was the fabric chosen for breathability, movement, and durability or was this garment made just to look nice on a hanger so it lacked quality materials? * Were any chemicals used to make the fabric feel soft, sateen, or wrinkle resistant? And what process, hand-woven or machine was used during the weaving of the fabric? Was the fabric hand measured and cut? Were all pieces of the fabric of the skirt from the very same factory? * Was this garment of Taylor Swift's made from synthetic fabric that aided in wicking sweat? If it was a natural fabric was Taylor Swift sweating at the time causing her skirt to stick to her buttocks? If it was sticking to her skin then fabric movement would be minimal even if only one part of the skirt was raised. * What kind of seams were created by the manufacturer of this garment? Straight, flat and neat seams, without pickering? Was the correct sized needle used to make sure that the garment is sturdy and to ensure the article of clothing would maintain its shape and structure? * Are the seams reinforced? * When this dress was created were the seams serged at all? Or were they only serged on finishing edges but not the "load bearing" seams? * What type of seams were used: French, zigzag, bound seamed, or what most quality skirts require -- "invisible finish?" * If this skirt in question was created from a non-stretchy fabric were there adequate darts to pull the bottom of the fabric so that the skirt portion of the dress would drape evenly over Taylor's waist? Was the back of the dress made with a seam down the middle to create a quality draping from the back on down? * Was there a yoke (an extra piece of material underneath connecting the front piece of the garment to the back of the garment) added to the dress for draping reasons and to keep the shape of the garment? * Was the dress lined? Lining a garment will radiate a neatly finished appearance and keep the finished look longer than garments without lining. Lining a garment protects seams from friction as well as protecting the fabric from damage due to sweat, the natural oils on one's skin and unnecessary tension from one's skin catching on delicate seams whilst dressing or undressing. * If this dress was unlined or lined with natural materials or fabric it would cause sweat to build up on Taylor Swift's thighs and buttock making her skirt cling to her thighs and buttock. If her dress had a static cling as well, it would be easy to have one area of the skirt lifted without movement from the fabric clinging to her skin. * If the dress was lined, were the raw edges and seams covered with fabric (facing) on top of inter-facing? Inter-facing is when there is fabric added to the outside layer of fabric sewn to the lining which makes sure that the garment is structured and designed to maintain its shape and durability so that the garment will not easily stretch out of its set shape. * Was the dress properly tailored to Ms. Swift? Could Ms. Swift move around, raise her arms, walk or pose without the dress's skirt part riding up? * Was material (not fabric) used to create this dress? If so, what was the weight of material, and if the dress was lined was it lined with the same material or a different kind that has a different weight and movement? Was the material(s) cut on or against the bias? If there was lining was the lining sewed together or not? * Was Ms. Swift wearing a slip? Did she have double-sided tape to maintain her desired modesty? This isn't even a complete list of everything that affects how garments move. It is, however, proof that we cannot take one picture as proof of no wrongdoing. Mueller's attorney's simple explanation of how an article of clothing should or should not move is an excellent example of a weak defense.
