Health care systems do their best to safeguard against breaches. But all of us could be doing more to protect our confidential health data. That starts with understanding when this data is most at risk.
When a patient called to ask if she could email me a CT report and imaging, I wanted to help. But I heard the loud whirring of a smoothie or espresso machine and figured she was at a public café. She confirmed that she was calling from a coffee shop.
I asked her to use our hospital portal from home to protect her privacy. She said she wasn’t sure she remembered her login details and didn’t want to wait. She also didn’t understand why her records wouldn’t be protected under the Health Insurance Portability and Accountability Act of 1996.
“I’m not surprised,” says Nichole Sweeney, general counsel and chief privacy officer for Chesapeake Regional Information System for Patients, a nonprofit health information exchange for several US states.
“The public may not realize that consumer-generated data is not protected. What she does with her own information is not secure. The federal government doesn’t regulate the health data itself. It’s the actual facility, medical office, or hospital—under HIPAA, a covered entity under that designation.”
Many of us also have devices at home that collect and store personal data about our health. I asked Sweeney if that data is covered if my doctor asked me to use the device.
She explains, “If I get my blood pressure taken at a clinic or any medical office, that is covered, and your personal data is protected. But if you take readings at home, this is not HIPAA. It’s not regulated. Those new wearable trackers? Those are not covered either. You’re on your own.”
So what else is not regulated? People. Any person using their own data is not covered under HIPAA.
Matt Fisher worked as a health care corporate and regulatory attorney. He is now general counsel for Carium, a virtual care platform. He believes people need more education about HIPAA and its limitations.
“It works effectively for what it was designed to do within the traditional health care industry. The issue is the assumption that it protects all information regardless of setting,” he says. “The fact is, as an individual who holds their own information HIPAA does not apply at all.”
Beyond hospitals and private medical offices, who is actually covered? Subcontractors. These include third-party associates, health plans, insurance companies, and individual physician providers. Labs, clinics, and any other medical offices that bill for their services are also expected to be HIPAA-compliant. Notably, this does not include social media businesses.
Even doctors, notoriously busy and working long hours, don’t always have the luxury of using patient portals to communicate effectively. They’re more likely to text or email colleagues with potentially sensitive information, all on personal devices that may or may not be locked down. But their goal is fast and efficient patient care, not necessarily data security.
Zubin Damania, who is a doctor and goes by ZDoggMD on social media, uses satire on his YouTube channel to educate viewers and poke fun at the health care system. His more than 488,000 YouTube subscribers no doubt include health care employees, but you don’t have to be one to appreciate parodies like “EHR State of Mind” (EHR is short for electronic health records), which is set to Alicia Keys’ hit “Empire State of Mind,” or “Readmission,” a play on R. Kelly’s “Ignition.” Damania hopes to inspire change in the health care tech sector so, as he puts it, “doctors can just be doctors.” Another target of his satire? Massive health data portals like Epic. He and other physicians believe the design of these systems can actually hinder security if medical personnel find it more restrictive than care-focused.
“Epic and others like it were not designed for use by clinicians on the front line trying to help patients,” he says. “These systems are giant billing platforms. It’s varying fields of data to be walled off.”
Sadly, Epic and others like it are all we have when it comes to storing patient data safely, and despite their flaws, these portals are still the safest available option for doctors and patients. Health care facilities are strictly regulated to receive federal government funding, and they must pass safety certifications, including security protections for patient data. They also seek to maintain industry recognition in order to stay credible and competitive. Want to make a hospital exec nervous? Tell them the Joint Commission is coming by for a visit. They need those gold star approval ratings.
Some patients are under the misconception that these systems are not really that secure. But in the past few years, data breaches have been rare (though they do happen). Hackers frequently target hospitals and health care systems for ransomware attacks, but it doesn’t pay for hackers to demand money when robust backups exist. While the industry has made some progress, the problem of individuals taking personal risks continues.
A former Department of Homeland Security adviser and a doctor, Chris Pierson is CEO of BlackCloak, a company that specializes in personal digital protection from financial fraud, cybercrime, reputational damage, and identity theft. He believes vigilance is key for doctors and patients alike.
Protect Your Entire Family
“I don’t think people realize that once someone is able to get just one piece of information, that can lead to opening others’ private data,” Pierson says. “It’s no longer the original individual on their computer, but additional family members’ identity that can be compromised.”
He explains that even if one organization keeps your data safe, another associated one may not, and that’s where criminals will strike. 
“It’s not just medical offices. It’s your pharmacy, labs, insurance company, anyone who keeps personal information. That has real value, and selling it is the priority.”
Victims of identity theft can be revictimized when personal information gets into multiple hands. A street address and verified phone number can go far, especially if the phone contains many contacts, who then become vulnerable to attack themselves.
“If you get Mom’s info, you can get the child’s as well. An ID card, social security, all of it, and then they have the ability to collect false medical claims or just extortion. It’s a two for one.”
Two-Factor Authentication Is Worth the Effort
Pierson mentions how critically important it is to use a multistep authentication system. Your level of protection goes up considerably just by using secure passwords and one-time authentication codes.
Thankfully, setting all this up is easier than it sounds. Apps on your phone or tablet can help. Google Authenticator, when paired with a service that supports authenticator apps, provides a six-digit number that changes every few seconds and can keep people out of your data even if they have your username and password. Other companies ask users to enter an SMS code as the second authentication factor, in addition to a password, although SMS codes are less secure than authenticator apps. Either approach is better than none—unless a hacker is in physical possession of your phone, they are not getting access.
Social Media and Tracking
Social media is becoming a popular way for health care providers and entrepreneurs to connect with the public—and often to sell them treatments or advice. These Instagram or TikTok accounts may offer tips from someone in the medical industry, which can appeal to those facing rising health care costs and difficulties accessing care. But an internet doctor’s background or popularity does not ensure that they observe strong privacy guidelines or secure their transactions.
My Instagram is flooded with offers promising everything from better sleep to improved sexual health. It’s nice to have options, but that help and any information you receive from those accounts or send to them isn’t covered under HIPAA. Any time you pay out of your own pocket for health-related items or services, or on a direct-to-consumer health app, there is no recourse if someone steals your personal information or shares it.
Along with social media and direct-to-consumer health options comes large-scale data tracking. Outside of official medical practices, you should view surveillance as an expectation, rather than an exception.
Ask Questions
When you sign up for any service, whether through a new doctor’s patient portal or an online supplement shop, ask how your data is stored and where it goes. Read the privacy policies and settings, even briefly, to find out what options you have to restrict the sale or reuse of your data. Check the default settings to make sure you’re not giving away too much information. Find out if the service or platform offers two-factor authentication and set that up if it’s available. Know that it’s rare for anyone to need your social security number, no matter what a customer service agent says. A birth date and address is usually enough.
Pierson and others agree that we all need to consider security from several angles and do our best to protect ourselves and our loved ones. “The sophistication of identity attacks will always evolve and change. Remember, they only have to get it right once, but we have to guess right all of the time.”

Under pressure to compete with Nilfgaard Industries, Meve must hire a social media manager to save her company from bankruptcy. Unfortunately, the only applicant is Gascon.
Meve got into the office later than she'd like, having slept through several alarms after a night's sleep as poor as usual.
If she hadn't been urged home by her well-meaning assistant, she would have stayed up half the night and slept on the horrible sofa in the corner of her office and oken just as sore and grouchy.
But at least on time.
The drive in on her motobike, ordinarily enough to lift her spirits, served only to remind her that summer would be over soon. 
The morning air had taken on a chill, her curled fingers wind-beaten and stiff as she parked in the garage. Every month that passed only served to remind her of the sorry state of her company's finances. She dreaded the next quarterly report.
If they didn't turn it around by the end of the year, then everything she'd worked for could be lost.
She startled Reynard at his desk as she dropped her bag and helmet in a haphazard pile. 
The man had donned his mustard yellow office cardigan that lived draped over the back of his chair. Another sure sign of fall approaching. He looked as exhausted as she felt, eyes bruised beneath the wire frames of his reading glasses.
Must have slept here. The hypocrite. She'd have to remember to urge him home tonight before he could urge her.
"Morning, ma'am," Reynard greeted with his usual grimace of a smile, "your interview is waiting for you in th' board room."
"My what?" 
"The social media manager position, ma'am. Your only applicant."
Meve groaned.
She'd hoped to grab an espresso from the temperamental machine down the hall before even thinking of speaking to anyone. 
Wordlessly, Reynard interrupted her downward spiral by presenting her with a steaming cup he'd had ready. Sixth sense for any small thing she needed, that man.
"I'd crash and burn without you, love," Meve said and did not miss the man's flustered fiddle with the tidy papers on his desk. She hid a smile against the rim of her espresso. A smile that faded as she prepared mentally for the task at hand.
An interview. For a social media position that didn't seem wholly necessary.
The company'd gotten on just fine for years without any accounts and with a bare bones website updated once a year. 
Or maybe not.
They were facing potential bankruptcy after all. Mostly thanks to the looming threat of their main competitor, Nilfgaard Industries. Nilfgaard likely had a whole office dedicated purely to managing their internet presence.
She and Reynard had briefly given it a go themselves, hunched together over Meve's aging laptop, but neither were anything approaching technologically savvy. Or sociable. Meve had last logged into her Facebook years ago after tiring of bigoted relatives, and Reynard's tech knowledge began and ended with a bizarrely intimate relationship with the office fax machine.
In other words, they'd both floundered and given up quickly.
Meve glanced at the portfolio handed over by Reynard, her brow furrowing.
She tipped back her coffee, grimaced, and made for the board roam.

The man who waited for his interview had kicked his feet up on the conference table, wide-brimmed cap sifting askew on his head.
It was maybe a little generous to call him a man. His resume claimed he had a degree in Public Relations from a reputable university, but he looked no older than her own teenaged sons.
He also appeared to be sleeping, his head fallen against his shoulder.
Meve cleared her throat.
A small, shaggy dog suddenly began to bark as it leapt at her from beneath the table, which nearly startled Meve into dropping the dregs of her espresso and prompted the boy to wake.
"Down, boy!" he called, laughing, and the little beast gave up on bouncing against her legs to skitter back under the table.
"Um," said Meve, dumbfounded.
The boy stood to greet her, dimpled grin more charming than it should have been given the circumstances.
"Gascon," he said with a vigorous shake of her hand. "And you've met Knickers. I'm his emotional support dog." 
"Right," she said. "Pardon me a moment."

Reynard grimaced at her in sympathy.
And yet, he'd failed to warn her. The bastard.
"Reynard, there's an imbecile in the board room. Are you certain that–?"
"Yes," said Reynard morosely.
"And do we really need–?"
"Yes, we do."
"And he was truly the only–?"
"Unfortunately."
Meve sighed.

Gascon had returned to his presumptuous lounge, his boots dirtying the conference table. He waggled his fingers at her in greeting.
Intent on getting this over with as quickly as possible, Meve sat across from him, lips pursed. Rarely one for rigid formal office decorum, she sat prim and still with her legs politely crossed for once.
The boy didn't take a hint.
He tipped back his chair onto two legs, clasped hands folded across his chest. He'd deigned to wear a dress shirt at least, but one so wrinkled and buttoned so haphazardly that he may as well have worn a track suit and appeared more put together.
"May we begin?" Meve asked and didn't wait for Gascon's sweeping gesture to go on before cracking open the folder before her. 
On paper, he seemed well-qualified for the position, as far as she could tell. A sizeable following on several platforms Reynard had suggested they target. Several internships and professional references.  
Unfortunately, his list of accolades veered increasingly into the absurd the further down the list she scanned. A successful SoundCloud. Viral TikToks. Under managerial experience, he had listed–
"It says here that for the past five years your only source of employment has been," Meve adjusted her reading glasses, stolen from Reynard's stash of extras, "moderating a Minecraft server."
"Oh yeah, and th' discord," said Gascon. "Hard fuckin' work. Full-time gig."
"Right," said Meve stiffly, regretting every decision she had made in her life up to this point, most chiefly in choosing to take over her late husband's company after his untimely passing rather than doing something more sensible and less likely to leave her most likely forced to hire this idiot.
She flipped through several more pages of the boy's portfolio.
Only to go still as she was greeted with an elaborate drawing of a cartoon dog with truly alarmingly large breasts stretching tight its shirt, its tongue lolling out and eyes crossed.
"Oh, I can design a mascot," said Gascon cheerily. "Figure this boring old joint needs one. Could print somethin' like that on your business cards."
Meve breathed slowly through her nose.
She focused very intently on imagining the fate of the company if something couldn't be done to bring in more revenue. Forget her own income and livelihood, her employees and their families relied on her. Nilfgaard's recent monopoly on the industry meant if this place went under, there'd be no choice but settling for its appalling labor practices and questionable ethics.
She had very little choice.
Unfortunately, this overgrown child of a man with his yappy dog and utter lack of professionalism might be their last hope to break into new markets and turn the company around.
Even worse, as Gascon chattered on happily about his several step plan to build their platforms, she noted that nothing he said sounded overly absurd.  
She had no choice but to hire him.
Much whooping and ridiculous howling followed her announcement. The little dog danced on its hind legs like a circus act, and the boy stopped to film it, cackling.
Meve sighed even more deeply.

Though Meve feared she would regret her decision, some of her reservations were tempered by the amusing sight of Reynard flushed pink as Gascon leaned flirtatiously across his desk to speak with him, mussing carefully organized documents.
Her reservations returned tenfold when Knickers lifted its leg on the edge of the desk.

Anytime a major client asks if we can do something the answer is always "Of course, been doing that for years, piece of cake". Once we get off the phone it then becomes, "How the hell are we going to do this?" Espresso Coffee Cart My wife walked into the office one Monday morning, and picked up an email printed out on my desk. It was the contract for providing an espresso coffee cart to HSBC's headquarters for an event on the Wednesday, two days hence. She looked at me inquiringly and asked "Who is doing that job for us?" "No one, we are doing it ourselves" She raised an eyebrow and replied "We don't have an effing espresso coffee cart!" "Ha", says I, "Not a problem, Ian is out building the cart now, the coffee machine and equipment is being delivered in the morning, and I am on a Barista training course tomorrow evening" On the day the first customer was like, "A cappuccino, two lattes, an espresso and a Machiato please". WTF, help, I can't do this. When I had calmed down, I realised that every drink started with an espresso, you just added different amounts of steamed milk and foam. They wanted 5 drinks, you made 5 espressos, steamed a large jug of milk, then poured to suit. Easy peasy. In fact they were so impressed that they had us back on a number of occasions. The espresso cart is now a firm favourite amongst many of our staff. Sony And Nissan Walk Into A Bar A couple of years later I got a call from a long term client, an events company we worked with quite often. "Jason, do you do mobile bars, we have a massive job on offer from Sony and Nissan, they need a bar to celebrate the end of a worldwide competition they have been running.", basically players on the Sony GT racing game could compete to win a place on the actual Nissan racing driver development program. "Yep, we can do that, when is it?" Lol, "A week today", gulp. "Er yeh no problem". When I told my wife she said that this time I was on my own, she wasn't coming to that event as I was going to fall flat on my face in front of a major corporate client. I spent the day feverishly ordering equipment we would need. Luckily a mate of mine Dean, owned a local pub, and he wrote me a list of what I needed. We sourced a company that supplied portable bar sections and set off the next morning to collect them. I took my staff down to Dean's pub to treat them to a night out, on the condition that Dean let them pull their own pints. And we managed to hire a kid that had worked in a cocktail bar, so we had at least one member of staff who had some idea of what he was doing. Our New Bar On the day everything went off perfectly. Well almost, I had ran water through the Jagermeister dispenser to clean it, and hadn't gotten all of it out, with the result that it froze solid and wouldn't dispense. But apart from that it was a fabulous night. Especially when Sabine Schmitz on a segway managed to run Martin Brundle over lol, what a booze monster she was. By the nights end she was demanding we just pour whatever shots were left into a glass and she would drink that. After that one I think we can safely borrow the S.A.S. motto of "Who Dares Wins". Since then we have successfully acquired various bits of kit at short notice, crepe machines, Dutch Poffertjes and with a couple hours practice managed to provide a professional service, looking like we had done it all of our lives.
