Government officials and “prison reform” activists in the United States are backing an effort to block the execution of a convicted child sex offender and murderer who began identifying as transgender while on death row. 

Missouri Democrat Representatives Cori Bush and Emanuel Cleaver have issued a letter to the state’s governor requesting clemency for Amber McLaughlin, a man who is set to become the first transgender inmate executed by the state for his crimes on January 3, 2023.

Formerly known as “Scott,” McLaughlin began transitioning while on death row for the horrific rape and murder of his ex-girlfriend, Beverly Guenther, in 2003.

According to court records, Guenther and McLaughlin met in 2002 and began living with each other shortly into the relationship. But the cohabitation was marred by break-ups that were often so serious that Guenther sometimes had to obtain restraining orders to keep McLaughlin away from her.

In the spring of 2003, Guenther and McLaughlin formally ended their relationship, but McLaughlin continued to pursue the woman, exhibiting stalking behaviors by frequently visiting her place of work and calling her.

On October 27, 2003, McLaughlin was arrested after burglarizing Guenther’s home. He told arresting officers he was trying to reclaim possessions he left behind at the home while living with Guenther, and was arraigned in November. Guenther had filed for a protective order just two days before McLaughlin murdered her.

On the night of November 20, while the protective order was in effect, McLaughlin drove to Guenther’s workplace and waited for her in the parking lot of the office building. He ambushed her as she walked towards her truck, pulled her to the ground, and sexually assaulted her.

After violating the woman, McLaughlin stabbed her to death and shoved her corpse in his hatchback. He drove Guenther’s body to a nearby river, and disposed of it in the underbrush. McLaughlin was arrested the next day at the hospital while attempting to obtain medication for his mental illness.

McLaughlin was ultimately found guilty of first-degree murder and forcible rape. A trial jury was unable to decide whether to impose a sentence of death or life in prison without the possibility of parole, and the presiding judge made the final decision to issue the death penalty. 

McLaughlin has unsuccessfully appealed his sentence multiple times over since it was handed down.

In 2016, McLaughlin was granted a stay of execution, but it was re-instated by a Federal Appeals Court in 2021. On September 29, after years of delays, the state of Missouri announced a date of January 3, 2023, had been set for McLaughlin’s execution.

In addition to the 2003 murder of Beverley Guenther, McLaughlin also had a historical sex offender registrationdue to a 1992 conviction for raping a 14-year-old girl.

On December 12, McLaughlin’s legal counsel filed a clemency petition urging Missouri Governor Mike Parson to intervene and prevent the execution. In the 27-page document, McLaughlin’s lawyers portrayed their client sympathetically, stating that he was “failed by the institutions… that should have protected [him].”

Included in the petition were descriptions of childhood physical and sexual abuse, periods of time spent in foster care, brain damage from fetal alcohol exposure, and mental illness that manifested as depression.

Missourians for Alternatives to the Death Penalty (MADP) took up McLaughlin’s cause and rallied at the Missouri Capitol on Tuesday, December 27, to request that Governor Mike Parson grant clemency to McLaughlin. The organization delivered a petition with over 6,000 signatures to Parson’s office.

The co-director of MADP, Elyse Max, told local news outlet KRCG: “We just implore the Governor to find mercy in his heart. Amber is a gentle human. Everyone who knows her knows that Amber is not of future harm.”

The plea was supported by seven former Missouri judges, according to MADP, and two Democratic state representatives of Congress.

A joint letter signed and issued by both Rep. Bush (D-MO) and Rep. Cleaver (D-MO), delivered alongside MADP’s petition, requested that Governor Parson halt the scheduled execution and commute McLaughlin’s sentence to life in prison, citing “gender dysphoria” and “mental health issues” as mitigating circumstances.

The letter, dated December 27, argues that jurors deliberating McLaughlin’s sentence were deprived of “crucial mental health evidence,” including information regarding his “gender dysphoria,” as his defense lawyers “failed to present it.”

Using feminine pronouns for McLaughlin, the politicians wrote: “Ms. McLaughlin faced a traumatic childhood and mental health issues throughout her life. She experienced horrific abuse and neglect at the hands of various caregivers; court records indicate her adoptive father would frequently strike her with paddles and a night stick, and even tase her. Alongside this horrendous abuse, she was also silently struggling with her identity, grappling with what we now understand is gender dysphoria. The abuse, coupled with the persistent mental turmoil surrounding her identity, led to mild neurological brain damage and multiple suicide attempts both as a child and as an adult.”

The two representatives concluded their appeal by describing McLaughlin as a “woman” and referencing discrimination against “LGBTQ+” people.

“Ms. McLaughlin’s cruel execution would mark the state’s first use of the death penalty on a woman since the U.S. Supreme Court reinstated capital punishment in 1976, and even worse it would not solve any of the systemic problems facing Missourians and people all across America, including antiLGBTQ+ hate and violence, and cycles of violence that target and harm women.”

A spokesperson for Gov. Parson told NBC News that the governor is reviewing the clemency request.

Earlier this month, Oregon Governor Kate Brown commuted the death sentences of 17 men convicted of violent murders, including one male inmate who had begun identifying as a woman while on death row.

According to court documents, in 1994 Karl Anthony Terry killed Jeffrey and Dale Brown with a samurai sword while they slept. The three men belonged to an organization that Terry called the “Order of the Black Dove.” The creed of the Order of the Black Dove, as stated in Terry’s journal entries, “celebrated violence and other anti-social behavior.”

While incarcerated and awaiting the death sentence, Terry began identifying as transgender and adopted the name Tara Ellyssia Zyst. Terry has used nearly a dozen other aliases in addition to Tara Ellyssia, such as Miazni Theidra, Deluria Dinnae, Uujohne Aejetta, and Ula Mitsata. He is being held at Snake River Correctional Facility in Ontario, Oregon, a medium-security mixed custody prison, and is now listed as “female” in prison records.

In December 2021, Biden flew on Air Force One to an event in Kansas City, where he would celebrate the recent passage of the infrastructure bill. With him on the plane was the representative of that district, Emanuel Cleaver. During their discussion, Cleaver said that he also hoped a portion of the money from the new legislation would deliver help to minority communities that had been damaged by past infrastructure projects. Biden replied that he knew exactly what Cleaver was talking about. Back in 1963, when Biden was a student at the University of Delaware, the Delaware Turnpike opened with great fanfare. “You know, when we built the freeway, we destroyed certain parts of the city and divided Black neighborhoods,” Cleaver recalled Biden saying. “We’ve got to start thinking about undoing that.”

In March 2024, a little over two years after their conversation, Cleaver received a notification from the Biden White House. The administration would be providing $3.3 billion “to reconnect communities that have been left behind and divided by transportation infrastructure.”

What then occurred to Cleaver said a lot to him about Joe Biden — including, he would tell me, why the president was so resistant to leaving office after only one term: “He’s had all these ideas over his career. And they’ve been piling up in his head, waiting for the opportunity. And then the opportunity finally hit, and he did not hesitate, and he wanted to keep going.”

Politics is in many ways a feat of memory: an unceasing recognition of where you come from, whom you answer to, what works, who can help, what is expected in return, why you ran for office to begin with. Notwithstanding the public lapses that would ultimately cause fellow Democrats to question his mental acuity and deny him a second term, the prodigious legislative skills derived from 52 years of accumulated knowledge continued to reside in America’s oldest-ever president.

The House of Representatives has approved a deal to allow the US to borrow more money, days before the world’s biggest economy is due to start defaulting on its debt.

The measure easily passed the chamber by a vote of 314-117, despite some defections on both sides of the aisle.

The US Senate must vote on the bill later this week before President Joe Biden can sign it into law.

The government is forecast to hit its borrowing limit on Monday 5 June.

That has left little margin for error as lawmakers race to avoid the US defaulting on its $31.4tn (£25tn) debt, which underpins the global financial system.

On Wednesday evening, 165 Democrats joined 149 Republicans in approving the 99-page bill to raise the debt ceiling, allowing it to pass the House by the required simple majority.

With Republicans in control of the lower chamber of Congress and Democrats holding sway in the upper chamber and White House, a deal had proven elusive for weeks until President Biden and House Speaker Kevin McCarthy inked a bipartisan compromise over the weekend.

In a statement, Mr Biden thanked the Speaker, saying he had negotiated in good faith.

“Neither side got everything it wanted,” said the president. “That’s the responsibility of governing.”

A triumph for Speaker McCarthy

Kevin McCarthy was able to push Joe Biden and reluctant Democrats to the negotiating table by passing a bill that raised the debt limit but included a laundry list of conservative priorities.

Then he was able to hold his party together as he struck a less ambitious deal with the president that modestly trimmed the growth in federal spending and added some new conditions on aid for low-income Americans.

That was not enough for a group of hard-line conservatives, some of whom hinted they would unseat Mr McCarthy and force a new election for Speaker.

But by Wednesday, even the hottest of firebrands were backing away from their rhetoric. And when it came time to vote, a majority of Republicans approved Mr McCarthy’s deal.

While the hard-liners may grumble, it is clear they do not have anywhere near the level of support they would need to replace Mr McCarthy – or even any idea who to replace him with.

The agreement suspends the debt ceiling until 1 January 2025.

The legislation would result in $1.5tn in savings over a decade, the non-partisan Congressional Budget Office said on Tuesday.

But the bill’s passage had been in jeopardy after lawmakers from both parties voiced opposition.

Ultra-conservative Republicans complained they had secured too few concessions in exchange for raising the debt limit.

Democrats objected to provisions raising work requirements for Americans on federal food aid, and restarting student loan repayments.

Emanuel Cleaver, a Missouri Democrat, said he would vote for the bill, even though he viewed it as the “second serving of Satan’s sandwiches”.

The leader of the House Democrats, Hakeem Jeffries, said his party had politically bailed out the Republican Speaker.

“Once again, House Democrats to the rescue to avoid a dangerous default,” said the New York congressman.

Eli Crane, an Arizona Republican who had vowed to stop the bill, tweeted: “More Democrats voted for this ‘historic conservative victory’ than Republicans.

“What a joke.”

Republicans control the House by a narrow 222-213 majority, but Speaker McCarthy was able to push the bill over the line with support from political centrists on both sides of the aisle.

He framed the package as “the biggest cut and savings this Congress has ever voted for”.

The bill is not yet assured of passage. It now heads to the Senate, where some combination of Democratic and Republican votes may again be needed.

One conservative Republican, Mike Lee of Utah, has already threatened to use “every procedural tool” to stall consideration of the deal.

Left-wing Senator Bernie Sanders also came out against the bill on Wednesday, saying he cannot “in good conscience” support it.

Both Democratic and Republican leaders in the Senate are working to ensure that a bill reaches Mr Biden’s desk for his signature this weekend before a default can occur.

The last time the US came this close to overshooting its debt ceiling, in 2011, the credit agency Standard & Poor’s downgraded the country’s rating, a move that has yet to be reversed.

Before Wednesday’s vote, US stock markets ended the day down a little, with the Dow closing 0.4% lower, while the S&P and Nasdaq both dipped by 0.6%.

In a country on edge over crime, the shooting was the latest example of an ordinary interaction—the ringing of a doorbell on a front step in a quiet neighborhood in Missouri—instantly turning into another shocking incident of American gun violence. “I am, I think, sufficiently frightened over how easily we are willing to shoot each other,” said Representative Emanuel Cleaver, a Democrat who previously served as the first Black mayor of Kansas City. Paul Yarl, Ralph’s father, said this week that his son, an athlete who loves music and video games, had surgery over the weekend to remove the bullets and was able to walk out of the hospital on Sunday. He is expected to make a full recovery.

The spyware, known as Pegasus, has since become a global byword for the chilling reach of state surveillance, a tool used by governments from Europe to the Middle East to hack into thousands of cellphones. A New York Times investigation based on interviews, documents and forensic tests of hacked phones reveals that the country grew into the most prolific user of the world’s most infamous spyware. Mexico went on to wield the surveillance tool against civilians who stand up to the state—abuses the country insists it has stopped. But The Times found that Mexico has continued to use Pegasus to spy on people who defend human rights, even in recent months. Many tools can infiltrate your digital life, but Pegasus is exceptionally potent. It can infect your phone without any sign of intrusion and extract everything on it—every email, text message, photo, calendar appointment—while monitoring everything you do with it, in real time. It can record every keystroke, even when you’re using encrypted applications, and watch through your phone’s camera or listen through its microphone, even if your phone appears to be turned off.

Strike to bring German rail travel to standstill on Friday (AP) Commuters in Germany face widespread disruption on Friday after the EVG rail and transport union announced a nationwide strike during the busy morning hours, affecting national operator Deutsche Bahn. The strike, which coincides with a separate walkout at three airports, involves 50 rail companies and will run from 3 a.m. (0100 GMT) until 11 a.m. (0900 GMT), EVG said. “Not a single train will run (in the country),” EVG representative Cosima Ingenschay said.

Russia’s New Conscription Law Brings the Digital Gulag Closer (Moscow Times) New legislation on drafting Russian nationals into military service rushed through the Russian parliament last week dramatically changes the relationship between the state and the people. Under the new law passed at breakneck speed by both chambers of parliament, the authorities can issue call-up papers online and will set up a digital database of all Russians eligible for military service (most Russian men aged eighteen to thirty are expected to perform obligatory national service). Previously, people had to be served their draft papers in person, making it relatively easy to dodge the draft. Now draft notices can also be issued via the state services website Gosuslugi, used by millions of Russians for a plethora of day-to-day administrative tasks such as paying fines and applying for passports. Regardless of whether a person has a Gosuslugi account, or even uses the internet, they will still be penalized for failing to report to the recruitment office once a digital draft notice is issued. Those penalties include a ban on leaving the country, as well as on driving, buying and selling real estate, taking out loans, and registering a small business. The planned digital registry will gather information about potential draftees from every possible source, from medical and electoral records to courts and tax returns.

Proxy war? (Washington Post) Three days before the Feb. 24 anniversary of his Ukraine invasion, Vladimir Putin outlined what he had learned during a year of war. With its ever-increasing supply of sophisticated weapons, Putin said, the West was now using Ukraine as a “testing range” for its plans to destroy Russia. Its goal was “to spark a war in Europe, and to eliminate competitors by using a proxy force,” he said in a presidential address. “They plan to finish us once and for all.” His depiction of a Western-provoked war threatening Russia’s very existence has resonated, particularly in the Global South, where some countries see the United States engaged in what they consider serial interventions around the world, and have declined to take sides. Whether Ukraine has become a “proxy” war between great powers has itself become an intellectual and political battlefield. Scores of images recently leaked online, many with classified U.S. military and intelligence assessments, illustrate how deeply the United States is involved in virtually every aspect of the war, with the exception of U.S. boots on the ground. Maps illustrate troop locations, battle plans and likely outcomes on the battlefield down to the smallest towns, along with the location and strength of Russian defenses. There are lists of weapons systems in use by both sides, casualty estimates, summaries of intercepted conversations and assessments of everything from special forces capabilities to expended ammunition. The leaked documents confirm in detail that the United States is using its vast array of espionage and surveillance tools to keep Kyiv ahead of Moscow’s war plans and help them inflict Russian casualties.

1 city, 2 people—and India’s widening religious divide (AP) Syed Mohammad Munir Abidi says India is a changed country, one he doesn’t recognize anymore. It’s a country, the 68-year-old says, where Muslims are ignored, where rising attacks against them are encouraged, and where an emboldened Hindu majoritarian government is seizing its chance to put the minority community in its place. Swami Ram Das thinks otherwise, echoing a belief system central to Hindu nationalism. The 48-year-old Hindu priest says India is on a quest to redeem its religious past and that the country is fundamentally a Hindu nation where minorities, especially Muslims, must subscribe to Hindu primacy. Abidi and Das are two ordinary citizens living in one city in a country of more than 1.4 billion people that is on the cusp of becoming the world’s most populated nation. Together they embody the opposing sides of a deeply entrenched religious divide that presents India with one of its biggest challenges: to safeguard freedoms for its Muslim minority at a time when a rising tide of Hindu nationalism is eroding the country’s secular underpinnings.

G-7 stresses unity on China following unease over Macron’s comments (Washington Post) The top diplomats from the Group of Seven major industrial democracies stressed the need to unite against China’s economic, military and cyber assertiveness, in a display of solidarity Tuesday after differences emerged recently over the fate of Taiwan. “We recognize the importance of engaging candidly with and expressing our concerns directly to China,” said the communique from the G-7 meeting, representing the views of the United States, Italy, France, Germany, Britain, Canada, Japan and the European Union. “We reiterate our call for China to act as a responsible member of the international community.” The calls for unity followed French President Emmanuel Macron’s recent visit to Beijing, after which he suggested that Europe needed to avoid getting dragged into a confrontation between China and the United States over Taiwan. Macron’s remarks to reporters after his meeting with Chinese leader Xi Jinping prompted transatlantic disquiet. “The question Europeans need to answer … is it in our interest to accelerate [a crisis] on Taiwan? No,” he told reporters. “The worse thing would be to think that we Europeans must become followers on this topic and take our cue from the U.S. agenda and a Chinese overreaction.” U.S. lawmakers, especially Republicans, reacted furiously.

China readies supersonic spy drone unit, leaked document says (Washington Post) The Chinese military could soon deploy a high-altitude spy drone that travels at least three times the speed of sound, according to a leaked U.S. military assessment, a development that would dramatically strengthen China’s ability to conduct surveillance operations. A secret document from the National Geospatial-Intelligence Agency, which has not previously been reported, shows the Chinese military is making technological advances that could help it target American warships around Taiwan and military bases in the region. The document features satellite imagery dated Aug. 9 that shows two WZ-8 rocket-propelled reconnaissance drones at an air base in eastern China, about 350 miles inland from Shanghai. The drones are a cutting-edge surveillance system that could help China gather real-time mapping data to inform strategy or carry out missile strikes in a future conflict.

Akiya (NYT) According to government data, as of 2018 there were 8.5 million abandoned vacant homes in Japan, which has experienced both a population decline as well as depopulation in many rural areas. That’s something like 14 percent of the entire country’s housing stock. The Nomura Research Institute estimates the number is even higher, at 11 million such vacant homes—called akiya—and forecasts that by 2033 they could account for 30 percent of all houses in Japan. Municipalities and companies are trying to get them in the hands of younger buyers with cash to upgrade and renovate them.

In grim drought, Tunisians ration water in state-ordered ban (AP) It’s a feeble drip, drip, drip from the taps every night in Tunisia for six months. Spigots are cut off for seven hours from 9 p.m. to 4 a.m. in a state-ordered water rationing in most regions across the country, including Tunis, the capital city. Tunisians are on the front lines of a battle against an increasingly severe drought, now in its fifth year in the north African country, with the government issuing a sudden order to its population to ration their water usage from April to September—or risk fines or jail. Households now need a supply of bottled water to wash, use toilets and prepare meals during late night hours. Authorities have also forbidden the use of potable water for irrigation of farmlands, watering green areas in cities and for cleaning streets and cars. Water levels at almost all of Tunisia’s 30-plus dams have fallen drastically, some as low as 17% of their storage capacity.

Trapped by fighting, Sudanese look for ways to survive (AP) For the last three days, Howeida al-Hassan and her family have been hunkered down in the first floor of her home in the Sudanese capital, sleeping on the floor as sounds of airstrikes and gunfire surround them. This is the life of millions of Sudanese trapped in their homes since violence suddenly erupted over the weekend between forces loyal to the country’s top two generals. Civilian life has come to a standstill as tens of thousands of heavily armed fighters from the military and its rival, the Rapid Support Forces, battle it out in densely populated residential areas. For many, food supplies are already dwindling as going out to restock has become too dangerous. So sharing among neighbors has become essential. On social media, posts are appearing giving information on pharmacies and grocery stores that are still open and able to deliver essential goods to those trapped. Others post phone numbers or addresses for their homes, offering to take in anyone caught outside and scrambling for shelter when shooting comes close. Residents have been desperate for at least a temporary cease-fire so they can stock up on supplies or move to safer areas.
