Tikal in Guatemala: One Of The Most Powerful Kingdoms Of The Ancient Maya

Tikal is one of the largest archaeological sites and urban centers of the pre-Colombian Mayan civilization. It is our 8th stop in the series Journeys to Discovery.

Located in the archaeological region of the Peten Basin in northern Guatemala, this thriving cosmopolitan city, would be rediscovered in the mid 19th century. It had been completely covered by the jungle for centuries.

Tikal is situated in the department of El Peten. Today, the site is part of Guatemala’s Tikal National Park and as of 1979, was declared a UNESCO World Heritage Site.

Tikal was the capital city of one of the most powerful kingdoms of the ancient Mayan civilization.

Although there is impressive architectural structures that can be dated as far back as the 4th century BCE, Tikal would reach the height of its power and influence, during the centuries stretching from 200 to 900 CE.

During this era known as the Classical Period, Tikal would come to dominate the region of the Maya. Economically, politically and militarily, Tikal had become the head of a conquest state.

The number of inhabitants would swell to as high as 90,000 by some estimates. If one includes the surrounding hinterland, the population reached well into the hundreds of thousands.

The rise in population is quite impressive, considering the area surrounding the city is covered in swamp lands.

Interactions between Tikal and the rest of Mesoamerica became more commonplace, as the power of the Mayan reached its zenith.

Regular contacts were maintained with the valley of Mexico as far north as Teotihuacan. In fact, there is evidence, the latter would actually conquer Tikal in the 4th century CE.

After the late Classical Period, no new major monuments would be constructed at Tikal.

Around this epoch, it is likely that a number of the aristocratic palaces and temples would be desecrated and later burned. By this time, the population was already gradually diminishing, with final abandonment taking place by the end of the 10th century.

In the modern era, the city has been completely mapped and it has been determined that it once covered an area of 6.2 square miles (16 square kilometers). Within the main city about 3,000 buildings were constructed, over hundreds of years.

The structures were built on a series of limestone ridges rising above numerous swampy lowlands. These built up areas remained connected, by a series of causeways that spanned over the wetlands.

Major construction at Tikal was already underway, in the Late Pre-classic period during 400-300 BCE. The first leading pyramids and platforms would be built at this time. Although Tikal was still far smaller, than El Mirador and Nakbe. These northern neighbors, would decline in the 1st century CE.

It is interesting to note, that Tikal had no real water supply, other than what was collected from rainwater and then stored in a total of 10 reservoirs.

In the 20th century, archaeologists working in the area, were forced to restore one of the reservoirs for this very reason.

The dynastic line of Tikal, that may have been founded as early as the 1st century CE, lasted for a total of 800 years and included at least 33 different rulers. According to legend, it was founded by Yax Ehb Xook.

There were even a couple of occasions, when the male line was broken and women became queens of the city.

At the beginning of the Early Classical Period, power in the Mayan culture was centered in Tikal and Calakmul. The area was plagued with war, as competition between the city states would be ongoing matter.

Tikal remained often at war with neighboring Mayan states including Calakmul, Caracol, Naranjo and Uaxactun. In fact, by the end of the Early Classical period, Caracol would replace Tikal and take its place, as the leading center in the southern Mayan lowlands.

Today in Tikal, there are many different buildings to visit, with many more still waiting for a full excavation before they can be opened to the public. To date, only about 30% have been fully rehabilitated.

The North Acropolis at Tikal

At the center of Tikal lies the Great Plaza that is bordered by two massive temple pyramids, the North Acropolis and the Central Acropolis.

There are 6 Temples, that most in the tourist industry will agree are the most important constructions at Tikal.

Temple I located in the middle of the Park is known as the Temple of the Great Jaguar. It was built during 682 and 734 CE. It rises some 154 feet (47 meters). It was excavated between the years 1955 and 1964.

Ah Cacao (Lord Chocolate) also known as Jasaw Chan K’awiil I, known as one of the greatest rulers of Tikal is associated with this temple. He is buried here.

Temple II known as the Temple of the Masks is one of the best restored in the park. It was also built by Jasaw, in honor of his wife Lady Kalajuun Une’ Mo’. It stands at just over 124 feet (38 meters).

Temple III known as the Temple of the Jaguar Priest was built around 810 CE. It stands about 180 feet or 55 meters. It is most likely the burial place of King Dark Sun.

Temple IV is thought to be the tallest structure erected by the ancient Maya. At over 213 feet (65 meters), a traveler is rewarded with an incredible view of the complex.

One used to have to make the ascent, by holding onto various roots and branches on the pyramid’s slippery slopes. Today, new wooden stairs make the ascent more amenable.

Temple V stands at 187 feet (57 meters) and is the second highest edifice in Tikal and in pre-Colombian America. From the top of this pyramid, one can see the other temples over the top of the tree canopy.

Temple VI known as the Temple of Inscriptions was discovered as late as 1951.

The top of the structure is visible for just over 39 feet or 12 meters. Further excavation will be needed, for this temple to be fully accessible.

How To Get There

Most tourists to Tikal come from three different starting points. The closet airport is the Guatemalan town of Flores, which is just 90 minutes away by bus.

A similar ride from the capital of Guatemala City, will take at least 8 hours. Tikal is located 333 miles or 536 kilometers north of the city.

The other entry point is Belize City, located 3 hours by bus from Tikal.

Upon arrival in Flores, you can then contact a tour company. The cost will average 100 GTQ, the equivalent of $13.63 USD (United States Dollar). The cost without a guided tour, will be around 70 GTQ ($9.54 USD).

Tour buses arrive late in the morning and leave by mid afternoon. This leaves the most reminiscent time of the day which is early morning and late afternoon/early evening to those tourists who remain.

Hours of Operation

The park is open every day of the week from 6:00 AM to 5:00 PM local time.

It is advised not to go on Sundays. The day permits free admission for Guatemalan citizens and will likely be crowded.

There are two museums located in Tikal National Park, one is the Stelae Museum and the other is the Sylvannus G. Morely Museum.

They are open from 8:00 AM to 6:00 PM daily with the exception of national holidays.

Admission And Entrance Fees

Adult tickets for foreigners cost 150 GTQ ($20.46 USD).

There is no entry fee for children under 12.

If you decide on a sunrise tour and enter the park before 6:00 AM, the price of the ticket will be 250 GTQ ($34.10 USD). The extra cost is well worth it for the marvelous views that you will see, the lower air temperatures and the far fewer visitors, you will encounter throughout the park.

All tickets purchased after 3:00 PM, are valid for the following day.

If a traveler wishes to visit Uaxactun located 12 miles (20 kilometers) to the north, it will cost an additional 50 GTQ ($6.82 USD).

To gain entrance to the Stelae Museum, a fee of 10 GTQ ($1.36 USD) will be charged.

Unfortunately to date, no tickets are not available for purchase on line.

Helpful Hints For All Travelers

There are no Automatic Teller Machines (ATM) at Tikal so you will need to bring extra hard currency (cash) with you.

Most tourists from northern climates visit during the dry season. This runs from October to May. The reduced humidity at this time of the year, makes the trip far more pleasant.

Tikal has a tropical climate, similar to that a traveler would experience in Yucatan Mexico. This reality will necessitate an ample supply of sunscreen, that will need to be reapplied throughout the day.

A visitor will also need to bring a generous supply of bottled water. It is important to stay hydrated during your visit of Tikal.

Dungeon Siege III

I bought Dungeon Siege III with its DLC and the prior two DS games for $10 about five years ago. I gave it a little bit of a start back then but decided to just sit down and finish it this time. A little more than 24 hours later and I finished both the game and its DLC. I played as Anjali and maxed out Influence with Lucas and got halfway there with Katarina, and barely used Reinhart. I used an Xbox 360 controller for the whole game, playing in Fire Form and shooting people from afar and using her area-of-effect abilities when crowded. I'll explain that in a bit.

First, yes, Dungeon Siege III isn't really a good Dungeon Siege game. To me, DS games were about fielding a rather large array of characters and playing Diablo with them, as opposed to the "player and AI helper and summons" that's been the norm since at least Diablo II. Everyone had personality! And instead of hitting an arbitrary experience level and being given points to allocate, you had a 'gain by doing' system typical of some MMOs. If you swing a melee weapon a bunch, you'd gain ranks in the Melee class; if you used Combat Magic, you'd gain in Combat Magic. It did things kinda differently even though its goal of being a "Diablo killer" didn't quite take. So is Dungeon Siege III a bad game? No. It's just not really good as far as DS games of past, at least in terms of gameplay. It's pretty different.

Banter aside, you can call up these golden orbs to show you the way. You’ll be using them a lot.

Things are pretty bad for the 10th Legion in Ehb. Supposedly they murdered the king three decades ago and some fanatic from the church is hell-bent on killing every single Legionnaire, going as far as turning pretty much the entire country against them. How lucky that you're one of the last few descendants of the Legion. Join with your old friend Odo at the old Montbarron Estate and plot a counterattack! I'm sure nothing bad will happen before you get there...

This is your enemy. Have fun!

Dungeon Siege III is an action RPG like previous entries in the series, but combat is a bit different and there's an even bigger focus on story than even DS2. Instead of creating a character from scratch, you instead have your pick between the sword-and-board knight Lucas, the spear and fireballs archon Anjali, the handguns and rifle witch Katarina, and the magic and more magic Reinhart. The story changes slightly based on who you pick, and you're able to meet the other three characters as you play and have them join you. DS3's 'gimmick' with combat revolves around the two stances. One stance is designed to deal with multiple targets close-by, like when you get mob rushed. The other is meant to handle single targets and for everyone but Lucas, you're able to attack at a great range with this. The idea is to swap modes as combat progresses but I didn't really do that. I can't remember any situation where you explicitly needed a ranged attack, so it's largely down to the stance's attacks and how comfortable you are with using them.

When you level up, you slowly unlock additional attacks for your two offensive stances and enable options for your third defensive stance. Each stance has three attacks and there are three options for defense, so you have nine total moves for each character. Each move can then be enhanced five times each from a pool of two mods--for example, one of Anjali's Fire Form special attacks creates a burning field under her. Your choice of enhancements are to simply boost the damage output of the attack or have it slowly heal any allies standing in its area of effect. You are able to mix the effects, but you're limited to a max of five no matter what. And you're also given points to provide unique passive boosts to your character, such as a percent chance to start regenerating health when damaged, a greater chance to crit a target at full health, or to simply boost one stat. Though you cannot take control of your allies, you can still equip them and allocate skill points and so on as if you could, so there's still some customizing potential. The Treasures of the Sun DLC adds the ability to completely respec your characters for 20,000 gold each--a little pricey but it's the only way to undo mistakes you've made in your build during the game.

And these are the passive bonuses you can buy.

DS3 has completely done away with potions. Small orbs drop from containers or enemies during combat--green ones restore health, blue ones restore Focus, and purple ones with yellow outlines restore Power. Focus takes the place of traditional MP in this game. You only ever have a max of 100 of it, and every special attack drains a set amount of it. It's restored by using your regular attack on enemies. Power is used to fuel your defensive stance's moves as well as the 'empowered' versions of every move, and that's restored by using your special attacks on enemies or taking damage. Empowered basic attacks generally deal more damage or hit a wider area, but empowered special attacks have effects like much more damage, a wider range, or being able to affect your ally as well as yourself. Empowered basic attacks are enabled as soon as you get the first Power orb, but getting it for special attacks requires you to use them quite a bit during your journey. The game at least lists the empowered benefit even before you purchase the special attack for use, so that's very handy.

There's still randomly-enchanted gear to find like in any ARPG. You have a pretty spacious inventory of I think a bit over 80 slots, but it can fill up especially if you forget to dump your trash at the local merchant. You can Transmute unwanted gear to get a fraction of its value in gold immediately and with the DLC, you can break down some gear to get reagents to apply to other gear with Enchantment, but I never really made use of it. Everyone has eight equipment slots and navigating it wasn't too bad with a controller. Each slot is a category and only the relevant gear shows up. You're given a window where what you have on is compared to what you have selected along with green and red arrows showing the changes in stats. Takes out some of the guesswork when you've figured out how to read it at least. This is the first game like this in a long time if ever where NPCs sold unique-class equipment. They still drop, but it didn't feel like it was at random. There's no player stash so holding onto them isn't really useful. They kept the "pick up everything nearby" button from the first two games though! So looting won't be tedious at all.

Appropriately enough, the final store in the game sells nothing but uniques.

There's a pretty heavy focus on story this time around. DS1 started with "help the Krugs are attacking blegh dead" and you wind up running across the kingdom eventually saving it from an ancient evil you were completely unaware of when you set out from your humble farmstead. DS2 started with "I wanna go home" and then "I want revenge" and still the story was kinda left in the background. Here, it's pretty front-and-center. Conversations were already voiced in prior games but there's just so much dialog this time. There are up to four dialog options and you're not pressed for time to select like with Alpha Protocol, and a lot of them are questions--who are you, why are you doing this, where are we, etc etc. You gain influence with your current ally based on some things you say, though the only bonus that provides is a stat boost. There are some decisions to make, like what to do with one of the early bosses or unruly workers in Stonebridge, but as opposed to a karma meter, your major choices instead get a "still images that move" cutscene and others are mentioned at the epilogue, Fallout-style. There are several Lore books and entries to find and I thought it was a nice touch that you're able to review anything you found from the menu at any time. There aren't quizzes or anything, but it's great for the lore buffs. There are likely slight differences in the story based on who you picked to play as, but I only went through with one character.

I have the feeling Anjali was meant to be a second-run kinda character given what she is and how her people factor into the story.

Music is orchestrated ambient stuff and there's a lot of professional voice acting here (not that I looked up who did the work in prior games I mean). Nothing about the audio got annoying or bothersome and I didn't run into the 'Bethesda syndrome' of having one actor voice several characters in close proximity. Controls weren't bad. The controller doesn't allow you to mouse-over who you want to attack, so using the sticks to select a target is a little tedious, but every button wound up having a use. Difficulty was pretty standard. I only game overed once...on a non-story boss. There aren't KO and Dead states in this game, just you or your ally needs to interact with the downed body for a couple of seconds without getting hurt and they're back up at 50% health. I wound up dropping probably close to 40-some times total due to me playing aggressively, so your mileage may vary. You can manually block in this game, so it would be smart to use it!

I think I know why there are no mules in this game. I wouldn’t be surprised if they went extinct by now!

One problem I had with the game was that it took me a good while to really get into it. I don't know how much of it was "ugh this isn't Dungeon Siege of old" wearing off, but it did finally endear itself to me. It's too bad that point was roughly past halfway, though. I didn't do multiplayer but it has a pretty weird setup. You join someone's game and you play as one of their characters...and you take nothing back with you. Anything that drops stays with the host. You don't even get experience points or progress through the story. One minor thing I didn't like was that in conversations, you never see your character or your ally's faces. There are very few sections where your faces are shown and they're actually animated for speaking, but it seems like a waste given how much you both actually speak and you just never see it. The conversations focus on the person you're speaking to almost the entire time otherwise. I didn't like the lack of fast-travel options. No Town Portal, no warping between save points, just you and having to hoof it at a plodding max speed. And...there's no way to save anywhere like the prior games. There are several save points, but I ran into "you cannot save until combat has ended" more than a few times, even if enemies weren't in the immediate area. Pretty annoying.

Would it have been too disorienting to have the camera switch back and forth?

Overall, Dungeon Siege III isn't a bad action RPG. It's likely not going to be fondly remembered and some would argue it was what killed the franchise, if it'll be remembered at all. To me, it didn't really do anything terribly unique, nothing that was memorable other than having a lot of polish, especially for an Obsidian game. I had maybe two bugs and zero crashes the entire game, and that's pretty notable. But yeah. You won't have to or need to pause the game and swap spells or get everyone to drink potions and you can't build a diverse team intending to play as them anytime you wish, but it's not bad otherwise. Just it's not a good Dungeon Siege.

As for Treasures of the Sun as a whole, it adds some things. The level cap is increased to 35, there are three ultimate abilities added that drain your Power orbs to fuel their effects (an instant heal, a wide damage blast, and a party-wide shield) you can find and only use one of at a time, you can break down equipment and Enchant it into other gear as I mentioned above, you can respec, and the story content isn't particularly long but it takes place in an entirely new area. It's not necessarily what I'd call essential, but it's the only DLC for the game and you may as well get it with the base game just because.

The Delaware Riverkeeper Suddenly Favors State Rights?

Throwing consistency out the door, the Delaware Riverkeeper has suddenly decided it likes state rights as long as they produce the results it desires.

The Delaware Riverkeeper has just filed an appeal with the Supreme Court that threatens to completely undo the authority of FERC to regulate pipeline construction. It does so by arguing states themselves get to determine when the times up on a strict one year limit given to states under the Natural Gas Act to decide on Water Quality Certifications under the Act. If the Supremes should take the case and agree with the Delaware Riverkeeper, it would turn that one year deadline into an endless series of challenges designed to kill any project by delay.

Before getting into the appeal itself, the threat of which is easy to understand once you think about it a bit, it’s worth reflecting on the absurdity of the whole thing.

First, of all, it’s about the Atlantic sunrise pipeline that is already built and operating. What the Delaware Riverkeeper is attempting to do here has nothing to do with the Atlantic Sunrise, which is merely a chess piece—a rook—to move around the board with right and left turns intended to confuse the enemy. It’s really about the Constitution Pipeline, the PennEast Pipeline, the Northeast Supply Enhancement project and any other Northeast pipeline that might allow natural gas development in the region; development that frustrates the NRDC gang and friends’ plans to make wilderness playgrounds while they pursue their special financial interests.

Secondly, note who filed the lawsuit:

Lancaster Against Pipelines is merely a bunch of true believers sucked into the cause. They’re not important. The other three are the same people. Maya van Rossum is the Delaware Riverkeeper, an appointed representative who serves as the Chief Executive Officer of the Delaware Riverkeeper Network, Inc., a private non-profit corporation. Once you’ve listed the corporation as a petitioner, there is, in other words, no point whatsoever in adding the “Delaware Riverkeeper” and the person of Maya van Rossum except to massage someone’s oversized ego, which, of course, is the point. We’re talking pure hubris.

Then, as we get into the case itself, we see what it’s all about, as stated in the opening “Questions Presented” summary offered by the Delaware Riverkeeper (emphasis added):

May a federal court preempt a state’s administrative review process by substituting a federal finality standard for a state finality standard, where the state finality standard is clearly defined by state law?

See the subtle attempt to turn things upside down? It is the federal Natural Gas Act that sets the standard:

If the State, interstate agency, or Administrator, as the case may be, fails or refuses to act on a request for certification, within a reasonable period of time (which shall not exceed one year) after receipt of such request, the certification requirements of this subsection shall be waived with respect to such Federal application.

But, the Delaware Riverkeeper (DRN) would have everyone believe the state can extend the one year ad infinitum by taking the time to hear challenges from the likes of themselves as long as they can muster up the money from their William Penn Foundation and company enablers to file frivolous lawsuits. The DRN, you see, wants to substitute a state finality standard for a Federal finality standard, the exact opposite of what it argues. This, of course, the nature of all Alinskyites: always accuse your enemies of whatever it is you are doing.

Later on in the filing we find this DRN assertion:

The federal government does not have the power to issue a direct order to the government of a state thereby “conscript state governments as its agents” and may not dictate “what a state legislature may and may not do.” This is exactly what the Third Circuit has done … by commandeering Pennsylvania’s legislative and administrative processes.

In usurping Pennsylvania law, the Third Circuit is, in effect, forcing the Commonwealth to legislate its administrative scheme to conform to the structure preferred by the Third Circuit. If the Commonwealth wants its preferred scheme for review of Department actions and its definition of finality to be respected, the Commonwealth will be required to dissolve the Board and move its functions back within the Department.

The word play here is rather amazing, although not so much considering it’s DRN we’re talking about.

First, it is Congress, not the Third Circuit, that limited states to a maximum of one-year to do their work, which is far more than enough. Secondly, it is, therefore, the duty of the states to get their work done in a time that allows for internal appeals within that one year. It could dissolve the Environmental Hearing Board but that’s not necessary and would be an over-the-top reaction. All that is necessary is for the state to do its work in, say, six months, so as to allow an appeal the EHB could then schedule to be heard and decided in the next six months so as to meet the one-year rule. It’s as simple asa that.

But. it’s the shear chutzpah of DRN that rankles. Since when has the Delaware Riverkeeper, the Queen of Obstruction, favored state rights? Certainly not in the case of the proposed DRBC fracking ban, which would disrespect state sovereignty to the nth degree. Pennsylvania allows fracking everywhere it’s viable. It isn’t DEP regulations that prevent it in Wayne County where I live. Rather, it’s a DRBC moratorium the agency now wants to turn into a ban. The DRBC has been doing DRN bidding on this issue for a decade, telling the Commonwealth it cannot allow fracking despite there being no DRBC authority or standards to justify that position.

And, now the Queen wants the feds to back off so the states can stop pipelines? Give us all break, Maya. This is ridiculous. You don’t don’t give a damn about state rights unless they happen to deliver what you desire and that is to please your funders and assist their plan to make a wilderness playground of the Upper Delaware.

Medicaid Waivers Should Backstop The Exchanges

During the summer of 2017, there were 82 counties at risk of not being covered for the 2018 policy year. State regulators have managed to attract at least one insurer in every county in the United States at this time. The recent Health Affairs Blog post by Anderson, Hacker, and Starr, which advocates for a persistent Medicare-derived public option that is triggered by insufficient competition on the Affordable Care Act (ACA) exchanges, is an interesting example of harnessing the power of Medicare and repurposing it to compete in the private market. Bare counties and the lack of meaningful choice on the exchanges are significant policy concerns.

If we are to use a pre-existing structure to guarantee that every county will have at least one insurer, Medicare and Medicare Advantage is not the optimal choice. The benefit structure is too complex. The covered population is significantly different than the individual market populations: Medicare beneficiaries have more comorbidities and are older than the individual market beneficiaries. They also change plans far less often. Finally, the Centers for Medicare and Medicaid Services (CMS) is too removed from local conditions to design a plan that meets the local needs.

Instead, Medicaid is better suited as a reserve parachute for bare counties. Temporary Medicaid buy-in would be a useful tool for state regulators to improve the quality of plans offered in counties that otherwise would have been bare.

Medicaid Has More Flexibility than Medicare

Medicaid’s programmatic flexibility is much more suited to adaptation for emergency coverage than Medicare and Medicare Advantage. Its core benefit design structure is more similar to current Exchange requirements. Medicaid is required to offer all 10 Essential Health Benefits (EHBs) as well as other benefits such as non-emergency medical transportation. Medicaid has out-of-pocket limits on cost sharing. Medicare is not required to offer all EHBs nor is total out-of-pocket limited in traditional Medicare.

States have incredible flexibility to use the Section 1115 waiver authority to craft their Medicaid plans to suit local needs and emergencies. There is an existing history of enhanced federal flexibility for Medicaid demonstration waivers that can be activated on short notice for localized needs. Michigan has a current 1115 waiver that covers Flint residents from birth to 21 and all pregnant women who live in Flint due to the city’s water emergency. New York used 1115 waivers for the 9/11 responders. Louisiana used 1115 waivers after Hurricanes Katrina and Rita.

These waivers address an unanticipated public health crisis. Counties without a functional individual market can also be deemed to be limited, transitory potential public health crises. Medicaid can step in to bridge a region and its population to a more stable, long-term solution.

Taking Advantage of Medicaid’s Existing Infrastructure

Unlike Medicare and Medicare Advantage, Medicaid programs already cover a birth to 64 year old population. Medicaid provider networks already have an adequate number of pediatricians, gynecologists, and other specialists who are more frequently used by the population covered by the individual market than that of the Medicare and Medicare Advantage markets. Medicaid networks are also similar to the prevalent mid-size and narrow networks on the Exchanges. There may be inadequate networks in some rural counties but an inadequate network in Medicaid is superior to no available network.

The non-disabled, non-dual eligible Medicaid population is a population with relatively high churn. This subpopulation has its own unique care and utilization management needs. The exchange population is also a high-churn population where even high-cost utilizers have a short length of stay in a single carrier. Short lengths of stay by exchange and Medicaid beneficiaries means few long-term care investments with significant initial costs are wise business decisions for carriers as they cannot internalize the needed gains before people change insurers. The Medicare population is older and has increased comorbidities. This Medicare beneficiaries are less likely to change insurers every year as they value their current provider relationships. Longer enrollment spans changes the calculations insurers make when deciding to invest in preventative care as well as chronic disease management.

The Mechanics of a Medicaid Backup Option

States would need to make a series of decisions at least a year before Medicaid could cover bare counties. The three most critical are: exit conditions for emergency Medicaid coverage in a bare county, designing the benefit structure, and financing the program. Additional challenges such as drafting new contract language with managed care organizations and reworking elements of the eligibility verification and claims payment systems for all paying entities would also need to be resolved.

Anderson, Hacker, and Starr and Hacker argued that Medicare as a backstop to lightly competitive or bare regions should be a permanent, one-way ratchet. Once a county is deemed to need the backstop, the Medicare option would never leave. In the case of Medicaid, this would distort the market.

Medicaid Needs an Exit Strategy

Medicaid as a backstop for the Exchanges is not a permanent solution. If it was a permanent solution, these counties would have an incredibly difficult time attracting new, private insurers to the market. Medicaid has significant per unit cost pricing advantages over Medicare while Medicare tends to pay less per unit of service than most commercial plans.

The combination of narrow networks, low premiums, and the ACA’s current risk adjustment formula will lead to an unstable equilibrium. Medicaid would attract a relatively healthier population. Private insurers offering Medicaid-like Exchange products may be able to compete against Medicaid. However private insurers that offer broad and expensive networks at a higher premium would likely attract a disproportionally sicker population who use more services at a higher per unit cost. The risk adjustment formula is based on the average premium in the state. The low premiums of Medicaid would decrease the average state-wide premium. This would result in net flows to the insurers with relatively sicker populations to decrease and those insurers would incur losses. This would likely deter many private insurers from entering a region with a permanent Medicaid competitor.

Benefit Design

Designing the benefit structure for a Medicaid backstop plan is the second significant challenge. Currently, most Medicaid programs offer nearly 100 percent actuarial value policies to beneficiaries. The ACA exchanges offer plans between 57 percent actuarial value and 92 percent actuarial value with additional cost-sharing reduction (CSR) increments. Several Medicaid expansion waivers such as Indiana’s HIP 2.0 and Pennsylvania’s defunct Healthy PA created separate products and rate cells for non-traditional Medicaid populations. Those plans were then designed to encompass a distinct set of cost sharing and deductibles. Emergency Medicaid plans could be crafted to fit the ACA’s metal band plan designs. The alternative is to offer Emergency Medicaid at 98 to 100 percent actuarial value. This alternative would raise the political cost of transitioning a region back to normal operations on the exchange because people would be moving from plans with nominal deductibles to plans with large deductibles.

Financing

The financing of an emergency Medicaid waiver is the third challenge. Currently, states pay a proportion of the cost of coverage for Medicaid. Individuals who purchase coverage on the ACA exchanges receive subsidies paid for entirely by the federal government. Emergency Medicaid should continue this pattern. Premiums would be charged on an actuarially fair basis to beneficiaries. Premium and CSR subsidies would flow from the federal government to the state’s Medicaid account and then to either fee-for-service expenses or to managed care organizations. The state would be held harmless.

All of these are significant challenges but Medicaid has proven to be a flexible program that is adaptive to local circumstances and needs in the past. Medicaid can be a good tool to solve the problem of bare counties in the future.

Adding Insult to Injury: The AHCA and Opioid Addiction

Opioid addiction has become a crisis nationwide and in cities and counties across Virginia. In the U.S., the number of opioid related deaths has nearly quadrupled in less than two decades, and more than 1,400 Virginians lost their lives to opioids in 2016.

But while the epidemic has been worsening, Republicans in Congress have been busy working on legislation that will prevent those with substance use disorders or mental illness in general from being able to get life-saving medical help. The American Health Care Act (AHCA) could limit insurance coverage for substance use disorder treatments or cause exorbitant premium increases for those benefits, leaving tens of thousands of Virginians without meaningful access to treatment. The House has already passed its version of the AHCA, and the Senate may vote on its bill as early as next week.

Here are the facts:

People needing substance use disorder and mental health care treatments were generally underserved prior to the Affordable Care Act (ACA). Health insurance plans often did not provide coverage for Substance Use Disorder (SUD) treatments, or offered only very limited benefits.

The ACA established a federal minimum for what private insurers must cover for 10 “Essential Health Benefits” (EHBs) including substance use disorder and mental health treatment, providing millions with access to SUD treatments.

The efforts to repeal and replace the ACA from both the House and the Senate will put all of these gains on the chopping block. Like the House version of the AHCA, the Senate bill will likely allow states to strip away EHBs. The Congressional Budget Office (CBO) determined that, when EHB standards aren’t required, mental health and SUD treatments are one of the most likely to be dropped. Yet, mental health conditions and substance use disorders are among the most common pre-existing conditions, affecting more than 1.3 million adults in Virginia between 18 and 64.

U.S. Senate Republicans are touting that their legislation would not allow insurers to deny coverage to people with pre-existing conditions. But saying that people would not be denied coverage is not the same as saying people would be able to receive needed treatment. Costs for plans without EHBs might be lower, but plans that continue to cover them would have extremely high premiums as well as higher out-of-pocket expenses (since mostly individuals with pre-existing conditions would be likely to enroll in them).

Removing the protections of the EHB coverages is not all that the AHCA bills would do to limit access and coverage for treatment for opioid addiction and other substance use disorders. The AHCA proposals would also weaken the structure and financing of Medicaid. It’s not just the sharp projected cuts in funding; under a per-capita cap Virginia would receive only a fixed amount of federal funds for Medicaid, even if medical expenses increased sharply (due to an addiction-related public health crisis, for example). Medicaid and the Children's Health Insurance Program are particularly important because these programs cover 3 in 10 people with opioid addiction.

At least 40,000 people in our state’s Medicaid program have a substance use disorder. And for these Virginians, access to life-saving opioid treatments is a matter of life and death. The U.S. Senate should reject the AHCA or any piece of legislation that reduces coverage and critical substance use disorder treatments.
