You know nobody’s going to want to make stuff anymore if some jackass can just lift it , make money off it and claim it’s theirs . It’s not gonna make a free idea paradise it’s just going to lead to huge company’s robbing the shit out of smaller creators even worse than they do already and driving them out of every single creative industry .
For context, this is regarding an AITA post about a someone resenting someone else for using many element of their fan AU in their own fan creations. My response was fuck that, down with intellectual property.
First, I think it’s hypocritical to write a fanfic derived from someone else’s work and then turn around and resent someone else for deriving something from your work. This is a situation in which no one is making money, it’s just people playing in a sandbox of ideas together. Resenting a smaller artist in this context seems pretty despicable to me. Your feelings about this may vary.
Second, in in my 30 second reply, I did not elaborate on my politics. I think it was fair to assume ïżŒfrom the reply that I was a libertarian shithead. I am, in fact, a c-c-c-communist.
The primary concern you raise here seems to be that artists won’t get paid. Art already isn’t profitable though. You can work for shit wages at an animation studio, you can become an influencer to hock your book, or you can be a good enough poster that people support you on patreon. Stricter copyright laws wouldn’t fix that, it would just make it easier for Disney to go after fan artists. The problem is that the market is oversaturated with art. There are more people out there making art than can get paid a decent living for it.
That sucks! I think artists should get paid more, and I think more people should be artists! It’s depressing that such a large percentage of working artists are the children of rich people, but the flip side of the coin is that when people have financial security and leisure time, they gravitate to the arts. The obvious answer here is to create a society in which everyone has financial security and leisure time.
Finally, copyright laws most benefit people who already have accrued capital. If you’re a working artist, you’re not making enough money to take people to court over them selling merch based on your design. If you’re Anne Rice, you can afford employ lawyers to threaten people who write stories where your vampires bone and burn thousands of dollars on ads decrying a restaurant built in an empty lot featured in one of your books. This is silly, but it’s a logical extension of feeling possessive over your story and being empowered by the law to do something about it.
Copyright law promises that one day you, yes you, will profit off of your creations. Unfortunately, except for a few people who win the lottery, it’s just not gonna happen.
Instead of supporting intellectual property, it would be more meaningful to actually give artists you know money. Support someone’s patreon. Buy someone’s shit on itch.io.

Hi! I've never sent you an ask before, so the layout of this might not be too structured or easy to read, but please bear with me.
So I'm a 15 year old girl and I saw that you had studied a bit of law and said that it was highly useful. Could you please elaborate on that?
I like reading and writing and I've written really nice stuff (essays and all) and my mom also thinks that I'd make a good lawyer because I also argue a lot and have good arguments at times-
But I'm not really sure about it, because it just seems way too.......I'm not sure how to put it. Complicated? A lot of big words used in a complicated legal manner which might be difficult, but I'm not sure. I think 'jargon' is the word I want here.
Sometimes I think I can do it if I try, but other times I feel kind of overwhelmed on seeing everything that you have to memorise and all the complicated kinds of sentences that you have to put together.
Honestly, I never want to go stand up in a court and argue on behalf of a client-not all law sectors do this, but I'm not sure which ones do and which ones don't. I wonder if I could study in a sector where I'll never have to go to a court and speak for a client?
Could you just tell me more about your law courses and what you studied? I'm curious to know and what does it take to be a good lawyer? Also, maybe unrelated, but is it harder to do law if you're a girl? Is there misogyny there? Probably, but I was just curious to know.

I would say that yes, studying law even at a basic level (as a minor) is always useful. There are certain fields of study that are always going to be helpful to know a bit of: if you know a bit of medicine, you can read medical labels, mechanics will be useful when you buy a car, accounting to manage your money, etc. In the specific case of law, legal knowledge (even just knowing how to read legal documents) will ALWAYS be useful because you'll know how to read administrative documents, you'll have some knowledge of your rights as a worker or if you ever find yourself in a situation where you need to file paperwork to obtain some public welfare, etc. etc.
Studying law doesn't necessarily means you'll end up being a lawyer. There are plenty of technical and/or administrative jobs that require being able to read legal texts. I'm neither a lawyer or an accountant but my job requires some legal and accounting knowledge. In college i studied Public Law (mostly constitutional and administrative law) + a bit of Private Law (specifically intellectual property / copyright Law). But there are many, many branches. For example, if you want to be an Urbanist, you'll probably have to study urbanism law. By nature, administrative and management jobs require legal knowledge without requiring you to ever set a foot in a court of law or even speak to another human being, if that's the part that makes you uncomfortable. Public jobs also tend to involve a lot of legal knowledge.
Is it harder to do law if you're a girl: i don't think so because in my experience Law classes tend to have a majority of women or be half/half. Possibly this is the case in graduate studies. Law has a reputation in general of being a tough field because there is a lot of competition and people can sabotage each other in order to "eliminate" said competition, but that's the case in most fields worth studying. It's not a fatality in any case, just something that can unfortunately happen. Things that are worth learning are always challenging, so if the one thing that stops you from learning legal speech is how difficult it sounds, don't let it!

Hi Soup! For a shorter fic, I'd love to see Leo sick at work or because of something stressful at work! We've seen him sick from something that happens at work (damn cake!), but not actually not feeling well at the office - maybe because he ate too much at lunch and it's just not sitting well. Does he hide it because he's got something that needs to get finished? Does he need to go puke quickly so he can keep working? Do people realize and make him leave? Your choice. Only request is that there isn't actually any publicly embarassing throwing up - no puking in court or in the middle of a meeting. Thank you so much!
Leo was over the moon about being a Real Lawyer, as he childishly called himself. It was no secret to his loved ones just how excited he was to be able to defend cases himself, instead of running after another lawyer with all their research and watching them recite a defense thesis that Leo was pretty sure had been partially written by him.
His boss put a lot of trust in him. Sure, Mrs. Mitchell only gave him small cases so far, but she was slowly handing him more and not only were they more frequent, but the difficulty was increasing.
Thus, Leo had easily blamed the uncomfortable churning in his stomach on nerves when it started. Today he had a big court day and no matter how many times he had gone over his notes - and ranted about the case enough that Jonah was probably a liability - he still felt jittery all over.
He was the defense today, to a woman who was being accused of plagiarism by a relatively well established script writer. Normally the Hollywood cases would stay in California and Mitchell's claws, but this one was small and unimportant enough to make it to Maine. The script writer was from the state and probably thought he could play on the local's sympathies, after all he had gone out and made it.
Leo wasn't feeling very sympathetic.
He was feeling almost queasy as he looked at the smug face of the script writer, who was accusing an ex-girlfriend of almost ten years ago of "stealing" his intellectual property.
Had no one learned a thing for Fitzgerald? Or Tolstoy?
Apparently not.
"You know," Dean leaned his way, "we're in court, you might wanna brighten up a little and stop glaring bloody murder to the opposition."
"Sorry," Leo shook his head, trying to physically shake off his frown, "I wasn't glaring at him, I was just frowning, he happened to be in the way."
"Brilliant save," Dean grinned, "they're gonna call break in five."
Leo was aware of that, he was the main defense lawyer and he was actually listening to the prosecutor's flimsy claims that Gwen was a plagiarist only because she happened to use the same first name in one of her published short stories.
Leo almost wished the opposition had a decent defense of their points, so he didn't have so much time to focus on the burbling going inside his belly. The lunch he had forced down wasn't sitting well at all and little sickly belches kept bubbling up his chest and fizzling out in his throat.
He felt like his whole body smelt like the greasy burger he had eaten and like everyone could tell... His mouth was watering.
Forty minutes recess.
"They're fumbling by the seam of their pants," Dean started to tell their client, in a low, collected voice, "they have nothing, you don't need to worry."
Right, Leo thought bitterly. She was a librarian, who published exactly one book with short stories just for fun, being prosecuted by a Hollywood script writer. Sure, the man was far from being a big shot of anything, but compared to the woman's position...
"Ms. Peters, you have a solid defense, please trust us," Leo promised her calmly, "take the recess, get some coffee, it'll be a long day."
His own words were mockery to him. Normally he existed on coffee and today just the thought of drinking a drop of anything made his stomach flip on itself and he hastily got up, muffling a little burp on his fist and excusing himself. No one had heard, although Sandra did throw him a puzzled look.
"Ms. Peters," Sandy stepped in, "let's take a small walk."
Sandra, like Leo, normally was one of the lawyers with the softest touch. Usually Leo didn't have all his coworkers with him, but he had his boss sitting right behind their desk, judging his every move. It was a huge tell of respect and trust that Mrs. Mitchell had only sent his peers today, instead of coming herself. Almost as if saying go and show them how its done.
He couldn't mess this up.
"The man is a misogynistic bully," Dean continued to speak, following Leo into the public bathroom. His coworker could talk with a tree if left to his own devices, "I'm excited for your part, the evid-"
"Shut it," Leo glared at him, handing Dean his suitcase and removing his suit jacket, "hold this, please."
"No one's listening to us."
"Dean," Leo scoffed, "no. Last thing I want is for you to blow the case by lack of decorum or by giving the prosecution a ti-URP-Fuck," the larger belch that slipped into his last word caused Dean to raise his eyebrows. The other man opened his mouth, about to ask about Leo's wellbeing when the blonde turned around and entered a stall, quickly pushing the lid up and planting a hand on his chest to keep his tie in place as a chunky stream of vomit hit the water.
"WhOA! Wagner, what the fuck-"
Leo hung his head in shame, bracing his free arm against the tiled wall in front of him and panting, trying to get his stomach in check. The queasiness had been on the backburner all day, but the face-prickling, hand sweaty, mouth watery nausea had hit him like a brick and out of nowhere.
"Fuck..." He breathed out through his mouth and swallowed some air, forcing up another burp and then coughing when that brought up some more chunks- He gagged and a much more watery, acidic mouthful of vomit fell in the toilet.
"Wagner, oh my-" Dean was fretting behind him, frozen in place and stunned, "shit, are you sick? We can call for a recess-"
"No," Leo's voice was hoarse and he cleared his throat, spitting a mouthful of thick saliva and flushing, as his sudden nausea went back to the mild queasiness, "No, I'm fine."
"Fine?!" Dean was still holding his suitcase and jacket, seemingly unaware Leo had passed the items to him, "You don't seem fine, you look white as a corpse-"
"I'm fine," Leo stumbled to the sink to wash his face and gargle with water, "lunch just wasn't sitting well-"
"Oh... Are you sure...?" Dean was older than Leo by at least five years and yet he sounded like a scared teenager. Leo nodded, meeting his coworker's eyes on the mirror and patting his own pale cheeks until they were a little rosy instead of spoiled milk white.
"Yeah," he cleared his throat, then fixed his tie and reached for his jacket, "I can't go home, I have a case to win."

Well, the possible solutions would either be: only use public domain and free for commercial use material, thus creating a gen ai with limited capabilities, or buying the rights to use the works from all of the artists. A third possibility I think might work for open source or charity drive projects would be to ask artists to donate their works, but that would necessitate ethically built datasets being the standard first
Now, if there were a gen AI project with an ethically sourced dataset that didn't make money (which would include not running ads and unless they received insane amounts of donations could not keep its servers running for long) they would also be able to use free for non-commercial use material, slightly widening the scope of data and thus capabilities of the gen ai
No existing gen ai applications are not creating revenue though. Even ones where all features are free (incredibly rare these days) show you ads, meaning they get money for stealing the art of, primarily, countless independent artists (since they're less likely to have the means to fight back in court) many of whom are significantly struggling financially
I know intellectual property is often associated with big shitty corporations like Disney but they have lawyers and lobbyists and money to spare either way. As usual under capitalism, people who are already in precarious situations are the ones suffering the most. We should change intellectual property laws, but if we get rid of them, we basically tell artists their work is worthless and doom them to poverty, even moreso than many already experience
i don't hate those proposals. but if you post art to the internet, i think anyone with the data storage to spare should be allowed to download it and save it forever if they want to. and if you've downloaded a massive pile of art, i think you should be allowed to train a model on it. and if you train a model, i think you should be allowed to sell that model for money. the neat thing about art is that for it to even count as art, it has to kind of be communication of some sort. it has to come from the vision of an agent that we can empathize with. if it doesn't feel to us like the kind of thing that was made on purpose by at least one individual, then we won't be able to see it as art. and if we like that art, if our lives are improved by it, we're going to naturally want to give something back. to reward the artist who improved our lives. disney can do whatever they want, money will find its way to musker and clements for making moana. reposting someone else's art and saying it's yours isn't theft. it's lying, possibly even fraud if you make money from it, but it's not theft. maybe it's theft legally, but not morally.

Every last one of them more than able to field generative AI all they want since they 'own' all that 'intellectual property'. How they got those 'rights' doesn't matter, the law says that they own every sketch, every model, every frame of every film and comic, every note and chord progression of the songbook of your culture, so it's theirs.
Those corps all get to have that power to replace artists, to reduce staff, to streamline their processes, because they "own" the "rights' to those works. But you, me, and every small studio out there shouldn't be allowed to use the tech to compete on that level.
Isn't that just the best outcome imaginable?</s>
That's what you're really saying when you fall back on the copyright argument regarding generative AI. That is the inevitable result.
Adobe, Disney and the rest of the Copyright Alliance isn't suing the publicly-accessible generative AI systems and supporting lobbying to expand copyright to cover styles for your benefit or the benefit of artists. They're doing it because they see an avenue to regulatory capture of new tech.
Because scraping of public facing published work is fair use. Any human being could study any given work of that sort and take whatever they learned from it to apply to their own creations. The existence of a mechanical apparatus in that process does not change this.
Making scraping not fair use would require moving the point at which infringement happens from the point of publication to any point in the creative process. That basically removes transformation as a fair use concept entirely, since it's no longer about if the final work is insufficiently different from the inspiration, but whether any aspect of the inspiration was involved 'without permission'.
You should also remember: there is nothing in your work that can't be traced to something one of those companies owns. It may not be a legitimate connection, but who are the courts going to believe, you or a pack of highly paid IP lawyers?
