CBI Accuses Kejriwal and AAP of Criminal Conspiracy in Excise Policy Case
The Central Bureau of Investigation (CBI) has filed a supplementary charge sheet accusing Delhi Chief Minister Arvind Kejriwal and his party, the Aam Aadmi Party (AAP), of a criminal conspiracy to privatise the 2021 Delhi Excise Policy for financial gains. The CBI claims that the policy was specifically designed to benefit select liquor businesses in exchange for kickbacks, which were allegedly used to fund AAP’s campaign in the 2022 Goa Assembly elections.
The investigation highlights that Vijay Nair, AAP’s media and communications head, played a pivotal role in the conspiracy. According to the CBI, Nair, without any formal authority to negotiate on excise matters, solicited bribes from liquor business owners under Kejriwal’s direct instructions. These businesses were promised favourable terms under the excise policy in return for their financial contributions. The CBI alleges that these funds were funnelled into AAP’s election expenditures and used to pay for campaign-related activities, including hiring vendors and campaign managers.
Durgesh Pathak, a senior AAP leader, is also named in the charge sheet for managing these funds. The CBI claims that Pathak oversaw the transfer of bribe money through hawala channels, which allowed large sums to be distributed without leaving a clear financial trail. The charge sheet points out that these cash payments were deliberately omitted from AAP’s official election expense reports, raising concerns about the party's financial transparency.
Several other high-profile AAP leaders, including former Delhi Deputy Chief Minister Manish Sisodia, have been implicated. Sisodia, who oversaw the excise department at the time, was previously arrested in connection with the case but has since been released on bail. Kejriwal, who has denied all allegations, has been in custody since March 2024. His bail plea is currently being reviewed by the Supreme Court.
The CBI asserts that it has gathered substantial evidence, including documents and witness testimonies, to support its claims. "Travesty Of Justice": Manish Sisodia Gets Bail, Supreme Court Slams Delay
Manish Sisodia was granted bail by the Supreme Court Friday morning - nearly 18 months after the ex-Delhi Deputy Chief Minister was arrested by the CBI in the alleged liquor policy case. In a powerful verdict the court said he is entitled to a "speedy trial" and that a rejection now would force him to work his way back up the system. "It would be like making him play snakes and ladders," the top court said.
"In a matter pertaining to the life and liberty of a citizen - which is one of the most sacrosanct rights guaranteed by the Constitution - a citizen cannot be made to run from pillar to post," the court said.
Mr Sisodia was arrested by the CBI on February 26, 2023, and by the Enforcement Directorate less than two weeks later. He has now been granted bail in both cases, with an irate Supreme Court stating he cannot stay in jail indefinitely while the prosecution works to an unconfirmed trial date.
A bench of Justice BR Gavai and Justice KV Viswanathan also said keeping the Aam Aadmi Party leader in jailed for an "unlimited time", without a trial, is in violation of his fundamental rights.
"Incarceration of 18 months… Trial not having even commenced and appellant has been deprived of right to speedy trial, " Justice Gavai said as he asked tough questions of the lower courts.
"Keeping appellant behind bars for unlimited time will deny fundamental right. Appellant has deep roots in society… no apprehension of fleeing. Anyway… conditions can be imposed."
Manish Sisodia could not be made to run "from pillar to post" to secure bail, the court said.
In May the Delhi High Court refused bail, reasoning he could influence witnesses and destroy evidence. The following month the Supreme Court also refused a plea, noting, though, that Mr Sisodia could revive his application once the ED and CBI file their final complaints.
Mr Kejriwal has already secured bail for his arrest by the ED. However, since he was re-arrested, by the CBI, days after his bail in the ED case was confirmed by the High Court, he is still behind bars.

After Probe Agency's Big Claim Against BRS Leader K Kavitha, AAP's Retort
Probe agencies CBI and ED have both claimed to made headway into their Delhi liquor policy case investigation. The Central Bureau of Investigation has told the court that they could arrest some "high-profile persons" as they probe alleged money laundering in the now-scrapped Delhi excise policy for 2021-22, which allegedly benefited certain liquor dealers
The Enforcement Directorate also put forth a theory alleging that BRS leader K Kavitha conspired with Delhi Chief Minister Arvind Kejriwal and other AAP leaders in the case. The agency alleges that Kavitha paid ₹ 100 crore to Aam Aadmi Party leaders.
Kavitha, the daughter of former Telangana chief minister K Chandrashekar Rao, was arrested by the agency last week from her Hyderabad home and she is in the ED custody till March 23.
"Probe found that Ms K Kavitha along with others conspired with the top leaders of AAP including Arvind Kejriwal and Manish Sisodia for getting favours in the Delhi excise policy-formulation and implementation," the ED said in a statement.
"In exchange of these favours, she was involved in paying ₹ 100 crore to the leaders of AAP," the agency said.
The agency claimed that by the acts of "corruption and conspiracy" in the formulation and implementation of Delhi excise policy 2021-22, a continuous stream of illegal funds in the form of kickbacks from the wholesalers was generated for the AAP, it said.
The Aam Aadmi Party though, has denied all these charges and alleged that the probe is being used to malign Mr Kejriwal's image ahead of the Lok Sabha elections.
"On earlier occasions too, ED has released such blatantly false and frivolous statements which show that instead of being a neutral investigative agency, it is working like a political wing of BJP," AAP said in a statement.
No immediate reaction was available from the BJP over the AAP's charge.
The AAP said the agency's charges are a "desperate attempt" to malign the image of its Mr Kejriwal and former deputy chief minister Manish Sisodia by "planting falsehoods and creating a media sensation" every day.
"ED's statement, which presents no new fact or evidence, speaks volumes of its frustration since they have not recovered a single rupee or piece of evidence in this case, despite carrying out over 500 raids and questioning thousands of witnesses," the AAP said.
The ED and the CBI had alleged that the Delhi government's excise policy to grant licences to liquor traders allowed cartelisation and favoured certain dealers who had allegedly paid bribes for it, a charge strongly refuted by the AAP.
The policy was scrapped by the Kejriwal government, days after Delhi L-G VK Saxena in July 2022 recommended a CBI probe into alleged irregularities in its formulation and implementation. Later, a case under the Prevention of Money Laundering Act (PMLA) linked to the excise policy case, was registered by the ED.

The most recent summons from the agency was issued in late February, setting March 4 as the date for questioning. Dismissing the summons as “illegal,” the AAP leader expressed readiness to appear before the agency via video-conferencing. However, the ED insisted on a physical appearance, citing the absence of provisions for questioning via video-conferencing.
The ED had previously arrested two prominent AAP leaders, former Deputy Chief Minister of Delhi Manish Sisodia, and Rajya Sabha MP Sanjay Singh, in connection with the money laundering case related to Delhi’s now-abandoned excise policy.

However, the High Court dismissed this plea on October 20, 2023, asserting that the Enforcement Directorate (ED) holds a prominent status as an investigating agency. Singh subsequently approaches the Supreme Court regarding this matter, which is currently handling and reviewing the case.
