KODAIKANAL TRIP
EXPLORE & INSPIRE
The earliest references to Kodaikanal and the Palani hills are found in Tamil Sangam literature.[3] Tamil composition Kuṟuntokai, the second book of the anthology Ettuthokai, mentions the mountainous geographic region (thinai) of Kurinji. The region is associated with Hindu god Murugan and is described as a forest with lakes, waterfalls and trees like teak, bamboo and sandalwood.[4] The name of the region, Kurinji, derives from the name of the famous flower Kurinji found only in the hills and the occupants of the region were tribal people whose prime occupations were hunting, honey harvesting and millet cultivation.[5][6] The hills were populated by the Palaiyar tribal people.[7]Coakers Walk in 1900
In 1821, a British Lieutenant, B. S. Ward, climbed up from his headquarters in the Kunnavan village to Kodaikanal to survey the area and reported of beautiful hills with a healthy climate with about 4,000 people living in well-structured villages.[8] In 1834, J.C Wroughten, then revenue collector of Madura and C. R. Cotton, a member of the Madras Presidency's board of revenue, climbed up the hills from Devadanapatti.[9] In 1836, botanist Robert Wight visited Kodaikanal and recorded his observations in the 1837 Madras Journal of Literature and Science.[10] In 1852, Major J. M. Partridge of the Bombay Army built a house and was the person to settle there.[9] In 1853, only six to seven houses were there when then Governor of Madras Presidency Charles Trevelyan visited in 1860.[11] In 1862, American missionary David Coit Scudder arrived.[9] In 1863, acting on a suggestion of Vere Levinge, then collector of Madurai, an artificial lake was formed.[11]
In 1867, Major J. M. Partridge imported Australian eucalyptus and wattle trees and in 1872, Lt. Coaker cut a path along the steep south east facing ridge which overlooks the plains below and prepared a descriptive map the region.[12][13] In the later half of the 19th century, it became a regular summer retreat for American missionaries and other European diplomats as a refuge from the high temperatures and tropical diseases of the plains.[14][15] In 1901, the first observations commenced at the Kodaikanal Observatory.[16] In 1909, the area had developed into a small town with 151 houses and a functioning post office, churches, clubs, schools and shops.[14] In 1914, the ghat road was completed.[11] It continued to served as a summer retreat during the British Raj and became a popular hill station later.

Before High Court of Madras at Madurai
Hon’ble Mr. Justice B. Pugalendhi J disposed of the Writ Petition on 19.12.2023 directing the Hindu Religious & Charitable Endowment Department to ensure that all the devotees including the schedule caste people are permitted in the temple festival.
Facts
Petitioner a Scheduled Caste was excommunicated from participating in the temple festival of Arulmighu Chelliyaramman Temple.
The people from Maravar community of the Village were not permitting the Scheduled Caste people to participate in the temple festival and they were preventing them from taking mulaippari and not collecting tax from them for the temple festival.
The Tahsildar had conducted a peace committee meeting on 13.06.2023 with both the groups in the presence of the Deputy Superintendent of Police, Tiruchuli.
A resolution was passed in the said meeting that the village festival has to be performed only as per the advice of the Hindu Religious & Charitable Endowment (HR & CE) Department that no community people is entitled to conduct the festival by collecting tax separately that the parties are restrained from spreading any rumors in the social media.
Submission of the Counsel of the Petitioner
The Hindu caste people were not permitting the scheduled caste people to participate in the Margazhi festival of the above temple.
Wherefore, the present petition was filed to implement the proceedings of the Tahsildar, held on 13.06.2023.
Submission of the Counsel for the Respondents
There was a peace committee meeting held on 13.06.2023 in the presence of the officials, wherein, the parties were advised to conduct the temple festival peacefully.
Observation of the Court
As per the peace committee meeting resolution dt. 13.06.2023, the villagers shall not prevent any body from offering prayers to the deity and from participating in the temple festival.
It was also resolved that the temple festival has to be conducted only by the Hindu Religious & Charitable Endowment (HR & CE) Department.
No person nor any group can restrain a person from performing his religious duties and it is the right guaranteed by the Constitution.
The temple worshipped by the public is a public temple and the HR & CE Department is having every right to interfere with the affairs of the temple.
It was, in fact agreed between the parties in the peace committee meeting that the festival has to be conducted by the Hindu Religious & Charitable Endowment Department.
Order
The Hindu Religious & Charitable Endowment (HR&CE) Department shall conduct the Margazhi festival to Arulmighu Chelliyaramman Temple.
The Tahsildar shall ascertain from the Village Administration Officer and other revenue officials that if any untouchability issue prevails in the Village, he will submit a report to the District Collector and the District Collector shall take appropriate action.
The Hindu Religious & Charitable Endowment (HR & CE) Department has to ensure that all the devotees including the schedule caste people are permitted in the temple festival and also to take appropriate action by appointing a fit person after ascertaining the report of the Tahsildar.

T.N. Seshan, serving as the Chief Election Commissioner of India from 1990 to 1996, implemented crucial reforms that revolutionized the fairness and integrity of Indian elections. His notable achievements during his tenure include the introduction of photo voter I.D. cards, the prohibition of money and alcohol in elections, the establishment of the model code of conduct for political parties, and the reinforcement of the Election Commission’s authority. Despite facing resistance from some politicians, Seshan successfully transformed the electoral landscape of India, contributing to the cleanup of politics and fostering transparency and accountability in the electoral process.

Writ Petition was disposed of by Hon’ble Mr. Justice G S Swaminathan with directions on 20.11.2023
Background
Present Writ Petition is before High Curt of Madras seeking direction to the first respondent – District Collector Tirunelveli to permit the petitioner – S Jamal Mohideen and his family members to execute burial of petitioner's deceased wife – J Habiba Beevi, in the common burial ground belonging to the first respondent (Distric at Malukka Maliyar Sunnathwal Jamath, Pathamadai & Kesavasamuthiram, Pathamadai Taluk, Tirunelveli District. The Petitioner's wife passed away a day before the filing of the WP.
Issue
Dispute is the manner of burial of her body.
Point of dispute has arisen as the petitioner belongs to Tamil Nadu Thowheed Jamaat. The “Kabristhan” is run by Sunnat – ul- Jamaat.
The members of Thowheed Jamaat and Sunnat – ul – Jamaat disagree on the rites and customs to be followed at the time of burial.
Court Activities
Urgency for taking up the matter was mentioned by the Counsel of the Petitioner & the Writ was taken in the post lunch session.
The Notice couldn’t be served on the Tamil Nadu Wakf Board however, local police facilitated conversation on whats app with the Waqf Board.
Considering the urgency Court didn’t went into the merit of the matter.
Court confined itself to burial issue.
Petitioner S Jamal Mohideen wanted Court to direction to the Fifth Respondent – Syed Meeran for allowing burial of his wife in the Kabristhan maintained by him.

Direction can’t be given to the 5th Respondent unless notice upon him is served.
Directing 5th Respondent will amount to allowing the relief prayed for by the Petitioner – S Jamal Mohideen.
It would not be proper on the part of the writ court to ride roughshod over the customs and practices traditionally followed by the fifth respondent.
Court Relegated the matter to the Tamil Nadu Wakf Board.
I am conscious that the Wakf Board had already passed a resolution mandating that the facility of burial should not be denied. The 5th respondent is insisting that the traditional practice should be followed.
More so, the father of the deceased ais also a member of the Sunnat – ul- Jamaat.

I direct the Chief Executive Officer of the Tamil Nadu Wakf Board to take a call in the matter tonight itself. He shall have a virtual conference over Zoom or WhatsApp with the writ petitioner, the fifth respondent and render his decision in writing.
It shall be communicated through e-mail or any other mode.
He can seek the assistance of revenue and police authorities.
Section 50(2) of the Wakf Act, 1995 states that it shall be the duty of every Mutawalli to carry out the directions of the Board.
I am conscious that the Chief Executive Officer cannot be equated with the board.
But in the special facts and circumstances of the case, the Chief Executive Officer of the Board shall take a call in the matter.
