Subverting the federal government was on the minds of state lawmakers Thursday in an hours-long civics lesson from far-right speakers.
As promised in the 2023 session of the Tennessee General Assembly, the idea of nullification was heard during a summer study session in Nashville. The idea is, basically, for Tennessee to be able to nullify rules from the federal government that it does not like.
(Read our cover story — “Who’s Got the Power?” — from March to get more details on Tennessee, state sovereignty, and nullification.)
Bills to outline a nullification process in Tennessee go back to at least to 1995. A similar resolution passed in 2021 but it was specific to Covid. It condemned the federal government for mandating vaccinations, restrictions, or requirements.
Another came last year when state Rep. Bud Hulsey (R-Kingsport) and state Sen. Janice Bowling (R-Tullahoma) filed the ”Restoring State Sovereignty Through Nullification Act.”
In it, the legislature could decide what federal rules they wanted to follow or not. Also, if a voter scraped together 2,000 signatures, they could submit a petition for a nullification to the Speaker of the Tennessee House.
The bill gained very little traction, if any at all. Neither bill even got enough support to place it on the calendar for a full committee hearing. The idea was slated for a summer study review in 2023. However, that study was interrupted with a special session on school safety, in the wake of the Covenant School shooting that left six dead.
But Bulsey and Bowling’s idea did finally get that summer study review, even if it was actually in the fall of 2024. True to form on these sessions, Thursday’s hearing yielded no votes or promise of any course of action. It was purely for review.
The session was not a town hall. State Sen. Richard Briggs (R-Knoxville), the committee chairman, said he knew the idea was “controversial” but did not allow members of the public to speak, or clap, or boo. That right to speak came only for the experts called upon by the legislature. Those selected for this duty Thursday were roundly (and soundly) conservative.
Jeff Cobble is an attorney and member of the conservative Federalist Society. Joe Wolverton is the inaugural constitutional law scholar for the ultra-conservative John Birch Society. Mark Pulliam is an attorney and writer who, in an August blog post, prayed “… a single juror would vote for President Trump’s acquittal in the circus-like show trial …” in Manhattan.
The hours of their testimony ranged back to the Declaration of Independence, through the 1781 Articles of Confederation, and to 1787 when the U.S. Constitution was proposed. Lots of it dove deep into definitions of the words of the constitution, like “all,” for example.
“I’m going to take you like elementary school students through this so this is plain,” said Wolverton in a detailed section of the Constitution to elected lawmakers. “We’re going to go through it phrase by phrase.”
As for the meat of the separation of powers (and therefore what power Tennessee really does have in nullification), Wolverton presented his ideas wrapped like a click-bait-y YouTube video. “In an hour,” he began, “I can show you how the 14th Amendment is taught wrong.”
“State — capitalized — has a specific meaning,” he said. “It’s got to do with the sovereign. Nations today are nation states. They are sovereign.
“I’m suggesting to you something radical, something I did not learn in [constitutional] law. The states are sovereign over the federal government. Now, take that and chew on it. That’s what this bill’s about.”
Some spice in the meeting came late as state Sen. Jeff Yarbro (D-Nashville) began asking questions of the panel. He asked if the work of the Federal Emergency Management Agency (FEMA) helping out now in East Tennessee was an example of what they were taking about.
Yes, Cobble said, “It’s usurpation, whether it’s used for good or bad,” adding that communities come together in times of tragedy, noting specifically that “the Amish, they build their own barns. They raise their owns houses.”
“You know, good things can happen without a government,” he said. “So, my answer is yes, FEMA is clearly unconstitutional.”

Kolkata Doctor Case: A Wake-up Call on Indian Women's safety at the Workplace and Tumblr Users Community's efforts in improving the Problem
About the “Kolkata Doctor” incident
On 9 August 2024, a 31-year-old female postgraduate trainee doctor at R. G. Kar Medical College and Hospital in Kolkata, India, was murdered in a college building while retired in a seminar hall after a 36-hour shift in the hospital. An autopsy revealed that the victim had been r*ped and s*xually abused before being k*lled. On the next day, a 33-year-old male civic volunteer working for Kolkata Police was arrested under suspicion of committing the murder. Three days later, the enquiry was moved to the Central Bureau of Investigation (CBI) by the Calcutta High Court, claiming that the Kolkata Police's probe lacked credibility. The tragedy has heightened the debate about the safety of women and doctors in India and demands a thorough investigation (Sayantani 2024).
The incident was widely covered in the media, triggering outrage across the country. Within the medical community, student unions and the deceased's colleagues demanded justice and better security measures on campus. Moreover, there are widespread protests and strikes by resident doctors nationwide in response to the crime. Additionally, many celebrities posted on their social media accounts, asking for harsh punishment for the offenders and justice for the victim (HT News Desk 2024).

Indian Women's Safety at the Workplace: A Social Media Discourse
In the wake of the Kolkata Doctor Case, discussions around women's safety in the workplace have arisen across various social media sites such as Twitter, Instagram, and Tumblr. Although India has significant legislative frameworks like the Prevention of Sexual Harassment (POSH) Act, workplace harassment and violence against women remain prevalent. According to research, many Indian women workplace harassment go underreported due to fear of retaliation, disbelief in the justice system, and poor support structures (Ragavan 2021).
Regulations such as the POSH Act, when put into effect, have shown shortcomings, particularly in terms of guaranteeing that businesses follow its guidelines and provide secure, encouraging spaces for women to report such incidents (Bansal 2021). Social media has become a crucial platform for women to not only share their stories but also hold institutions responsible. For example, the #MeToo movement in India resulted in a series of high-profile resignations and a renewed focus on tackling sexual harassment in both formal and informal settings (Ahmad 2023).
Tumblr: a Platform for Social Change
In this context, Tumblr stands out as an essential forum for fostering conversations on women's safety and social justice. While Twitter is commonly used for short, rapid communication, Tumblr's long-form structure allows for more in-depth discussions (Oakley 2017). The network encourages its users to post essays, and discussions, reblog vital information, and even create art or graphics that raise awareness. It serves as a space for grassroots activism, where users from various backgrounds can engage with critical issues free from the often harsh, fast-paced culture of platforms like Twitter or Facebook (Reif, Miller & Taddicken 2022).
Tumblr's community-driven approach allows voices often sidelined in mainstream media to express their perspectives. Feminists, activists, and advocates for women's rights regularly use Tumblr to share their experiences, gather support for petitions, and organize protests or digital campaigns (Hannell 2024). Furthermore, Tumblr's format allows arguments to last longer, as reblogs and ongoing comments from diverse users ensure the topic doesn't fade quickly from public attention (Bourlai 2017).
The Hashtags System
One of Tumblr's primary features is its hashtag system, allowing users community to connect and communicate across various postings and movements (Herron 2018). Several hashtags have emerged in India to raise awareness of women's safety, workplace harassment, and broader campaigning. Some of the key hashtags that have surfaced are:
#MeTooIndia: An extension of the worldwide #MeToo movement, Indian women have been using this hashtag actively to disclose their stories of harassment and abuse in the workplace, at home, and in public places.
#JusticeForWomen: Often used to highlight cases of sexual violence, demand justice for victims, and call for structural reforms and better legislation.
#WomenSafetyIndia: Focusing on the broader topic of safety for women in India, this hashtag covers everything from workplace harassment to public safety issues, rape cases, and the general lack of protection for women in the nation. It is employed to share resources, raise awareness, and promote initiatives for women's protection and empowerment.
By using these hashtags, Tumblr users are not only raising awareness but also educating others about existing legal frameworks, discussing their limitations, and sharing resources that can be vital for women seeking help.

In a recent article for FAIR Substack, David Ferrero argued convincingly that school programs designed to view their subject matter through an “ethnic studies”— rather than an “ethnic histories”— lens can be “reductive, tendentious, divisive, and doctrinaire.” He also pointed out that this narrow approach, which includes indiscriminate references to putative ‘racial’ groups (“black”, “Asian”, “white”, etc.), is antithetical to the ideal of bridging our “ethnic and religious differences in the service of forging a shared civic identity.”
While I am in complete agreement with Ferrero, I would go even further. I believe that there is a fundamental conceptual flaw in using current racial categories in any academic analysis. These categories have become so hopelessly ambiguous that they are virtually meaningless, and they now function as terms of convenience, used only when they serve a political agenda. This is true throughout academia, but is most evident in discussions about academic achievement.
In biology, “race” is a taxonomic term, and like all biological terms, it can be ambiguous. Sometimes it’s used as a synonym for subspecies. Most often, however, it refers to a group of organisms that is biologically or geographically distinguishable from other groups within a species but is still able to reproduce with them.
On the other hand, when referring to humans, most contemporary scientists consider ‘race’ a social construct based on societal definitions without any inherent physical or biological meaning. That point of view is based on the understanding that there is more genetic variability within human racial groups than between them. In other words — to paraphrase the evolutionary biologist Richard Dawkins — whereas human sex is binary (there are only two), race is a spectrum.
Ironically, despite the fact that most academics consider human racial categories to be socially constructed, they continue to use them enthusiastically as if they represented well-defined, homogeneous groups of people. Think of the controversies over college admissions, disparities in academic achievement, or ethnic studies curricula.
The problems with grouping students in terms of contemporary racial categories are most evident — and most instructive — in how we interpret their academic performance, especially on standardized tests like the ACT. I’ve argued (here, here, and here) that racial categories are virtually useless in explaining student performance differences because the categories are largely arbitrary, often contrived, and always confounded by self-reporting biases and socio-economics. Nonetheless, a race-based narrative continues to dominate our discussions despite the fact that thinking in those terms perpetuates a host of inaccurate, deleterious stereotypes.
The ACT is a standardized test that predicts the likelihood of student success in the first year of college. The overall score is based on the results of four, multiple-choice subject tests, English, math, reading, and science. The number of correct answers for each subject test is converted into a scaled score and averaged. Thirty-six is perfect.
In 2022, approximately 1.35 million students took the ACT. Overall, the average score was 20, about one point lower than the average between 1990 and 2021. In terms of the ACT’s racial categories, the highest 2022 scores were earned by students identifying as Asian (25), White (21), and Two or More Races (20). The next three groups were Hispanic/Latino, Prefer Not to Respond/No Response, and Native Hawaiian/Pacific Islander (18). The two lowest-performing groups were American Indians/Alaskan Native, and Black/African-American (16).
This ranking by race has remained virtually unchanged for a decade, and when viewed in terms of these categories, the ranking seems to support the divisive and inaccurate belief that the test is racially discriminatory. However, there are two problems with viewing the scores in this way. First, it’s impossible to know exactly how students sort — or choose not to sort — themselves into racial categories, and there is no way of knowing the ethnicity of those in the Two or More Races (first introduced in 2012), or the Prefer Not to Respond groups.
Second, the categories, themselves, have always been somewhat arbitrary. For instance, in 2012, the ACT separated the so-called, Asian-American/Pacific Islander category into two cohorts that turned out to be completely different in their test performances. In that year, there was a 13% increase in the number of students in the Asian group, and a 12% decrease in the number of Pacific Islanders who met the ACT’s College Readiness Benchmarks compared to 2006. That remarkable divergence has continued. Since 2012, the Asian group’s ACT scores have steadily improved while all other groups have steadily declined. This clearly demonstrates that the original Asian-American/Pacific Islander group was a demographic of convenience with little external validity and which masked dramatic within-group differences. Further, because the two newly created groups are so diverse, it would be virtually impossible to determine precisely why the group performances are so different. Assuredly, the same thing would happen if any of the other racial categories were similarly subdivided.
Then, in 2006, the ACT began analyzing student scores in terms of Postsecondary Educational Aspiration (what students planned to do after graduation). This parameter included seven categories: Vocational-Technical Training, Two-Year College Degree, Bachelor's Degree, Graduate Study, Professional-Level Degree, and two which I won’t consider here, Other and No Response. When the data are considered in terms of these categories rather than race, a very different picture emerges.
In 2006, 2012, and 2022, across all racial groups, ACT scores were 31-51% higher for students aspiring to a professional-level degree compared to students planning on vocational-technical training, and scores were 12-17% higher for those aspiring to a graduate degree compared to a bachelor's degree.
The effects of postgraduate aspirations have been even more dramatic within racial groups every year since 2006. For instance, in 2022, students in every category who aspired to a professional-level degree had ACT scores averaging 47% higher than those planning on vocational-technical training. The largest differences — 53% and 61% — were in the Native Hawaiian/Pacific Islander and Prefer Not to Respond/No Response groups. The smallest (but still significant) difference — 35% — was in the American Indian/Alaska Native group.
More importantly, in 2022, students in the four (overall) lowest-performing racial groups who aspired to graduate study or a professional-level degree earned scores as much as 39% higher than students in the (overall) highest-performing groups who aspired to vocational-technical training or a two-year college degree. In other words, Black, American Native, Hispanic, and Hawaiian/Pacific Islander students with high educational aspirations outscored Asian, White, multiracial, and non-identifying students with lower aspirations.
Unfortunately, no one seems to have noticed that aspirations are more important than race in predicting academic performance on the test. I guess that doesn’t fit the popular narrative.
Over the past 15 years, educational aspirations have consistently had a greater impact on ACT performance than self-reported race. This suggests that by doing what we can to elevate student aspirations, irrespective of their race, we will benefit their academic performance. One way to do this is by teaching students that they can and will succeed if they work hard, rather than telling them that they are at the mercy of uncontrollable external circumstances. This will also give the lie to the worn out, race-based tropes about academic performance that are so psychologically damaging to students.
As a Biological Psychologist — and someone who taught standardized test prep for over a decade — I understand that the factors influencing student performance are complex and often the result of long-term trends that vary within and between groups, regardless of how the groups are defined. However, using anachronistic, ambiguous, or contrived racial categories to interpret educational performance is misleading, unhelpful, and divisive.
Racial categories have external validity only to the extent that each represents a meaningfully homogenous and distinct group of people. However, none of these criteria are met by the colloquial categories currently applied to people. Distinguishing students by, for instance, family or socioeconomic demographics, internalized cultural beliefs, personality traits (such as resilience or aspirations), school district, or ZIP code would all be more informative and useful in improving educational policy than the current crude racial categories. Further, to paraphrase Ferrero, refocusing our conversation on aspirations — rather than on our perceived ethnicity — will help us bridge our imagined racial differences, recognize our shared humanity, and encourage us to pursue our goals together.

House Republicans appear to be barreling toward a government shutdown, unable to agree even to debate a bill to fund the military. That rejection made Republican leadership pull from the floor a continuing resolution to fund the government into October. Extremist members simply refuse to agree to any bill that doesn’t cave to their demands. And, as NBC News reporters note, “The House [Republican] chaos is worse than it may appear.” The bills over which they are currently fighting cannot possibly pass the Senate. Government funding ends on September 30.
And so a small minority of extremists are threatening to shut down our government. Such a shutdown would have global as well as domestic repercussions: the Pentagon warned that a government shutdown would disrupt U.S. military aid to Ukraine, including training for military forces. Hamstringing our ability to help Ukraine stand against Russia, refusing to fund the Pentagon, and Alabama senator Tommy Tuberville’s hold on military promotions that has left more than 300 top military positions vacant all undermine our national security. This is an astonishing position for Republicans, who used to pride themselves on their support for the military.
That such a small number of extremists can shut down our country speaks to the power of voting. Four days ago, Vice President Kamala Harris kicked off a month-long tour of college campuses to mobilize younger voters to “fight for our freedoms.” Today is National Voter Registration Day, and in Reading, Pennsylvania, she noted that young people have spent their whole lives in the climate crisis, have seen the Supreme Court stop recognizing the constitutional right to abortion, and have spent their earlier years practicing active shooter drills. They are now stepping up to lead the country toward solutions.
Harris told a cheering, overflow audience at the Reading Area Community College that voting “determines whether the person who is holding elected office is going to fight for your freedoms and rights or not. Whether that be the freedom that you should have to just be free from attack, free from hate, free from gun violence, free from bias, free to love who you love and be open about it, free to have access to the ballot box without people obstructing your ability to exercise your civic right to vote, in terms of who will be the people holding elected office and leading your country.”
The political power of young voters will be important in determining the outcome of the 2024 elections. In Pennsylvania today, Democratic governor Josh Shapiro announced automatic voter registration when people are getting or renewing a driver’s license. The governor tweeted: “We got traffic moving on I-95 in just 12 days. We delivered universal free breakfast for 1.7 million students. And today, we implemented automatic voter registration. There’s more to do, but we’re getting stuff done in the Commonwealth of Pennsylvania.”
In Congress today, the Democrats, led by Representative Terri Sewell (D-AL) reintroduced the John R. Lewis Voting Rights Advancement Act, which passed the House in 2021 but was stopped by a Republican filibuster in the Senate.
This measure would restore and modernize the 1965 Voting Rights Act after the Supreme Court’s 2013 Shelby County v. Holder decision gutted it. Until that decision, Congress had regularly reauthorized the Voting Rights Act on a bipartisan basis, but as soon as the decision was handed down, Republican-dominated state legislatures passed voter suppression laws, gerrymandered their states, and closed polling sites, measures that made it more difficult for Black Americans, many of whom backed Democrats, to vote. In the decade since the decision, Sewell noted, at least 29 states have passed a total of almost 100 laws restricting voting.
Sewell represents Selma, Alabama, where civil rights activist and, later, Georgia representative John R. Lewis was beaten by law enforcement officers when he crossed the Edmund Pettus Bridge with other civil rights activists marching for the right to vote. She noted, “Generations of Americans—many in my hometown of Selma, Alabama—marched, fought, and even died for the equal right of all Americans to vote. But today, their legacy and our very democracy are under attack as MAGA extremists target voters with new laws to restrict voting access. Ten years after the Supreme Court gutted the Voting Rights Act of 1965, the fight for voting rights has never been more urgent.”
The reason for voter suppression was made clear again today when, in a pattern that has continued since the Supreme Court overturned Roe v. Wade last year, no longer recognizing the constitutional right to abortion, Democrats won two elections. In New Hampshire, Democrat Hal Rafter flipped a state House seat formerly held by a Republican. And in Pennsylvania, Democrat Lindsay Powell won a special election in Pittsburgh, enabling Democrats to hold control of the Pennsylvania House.
