Lahore High Court Judge Recuses Himself from Hearing Firewall and WMS Case.
Lahore, September 6, 2024 — Justice Faisal Zaman of Lahore High Court (LHC) has withdrawn himself from the case relating to the implementation of the firewall and WMS (web management system). It has now taken this decision to refer the case to the Chief Justice for a further step to be taken. The promotion of such a system has been subject to a more general legal and public discussion about the relationship of these systems with fundamental rights and the digital economy.

LAHORE, June 8: A Pakistani court on Friday adjourned the hearing of a petition seeking contempt proceedings against the government for not complying with the court’s order regarding renaming a chowk in Lahore after Independence war hero Bhagat Singh for three months.Bhagat Singh was hanged at Lahore’s Shadman Chowk by colonial British rulers on March 23, 1931, after being tried under charges of hatching a conspiracy against the regime. The freedom fighter is respected in the subcontinent not only by Sikhs and Hindus but also by Muslims.Lahore High Court Justice Shams Mahmood Mirza on Friday adjourned the further hearing of the case till September 13, on the request of one of the respondents.During the hearing, Assistant Advocate General Punjab Asghar Laghari told the court that Deputy Commissioner, Lahore, Rafia Haider (one of the respondents) requested for an adjournment as she has been abroad for a couple of months.The petitioner’s counsel, advocate Khalid Zaman Khan Kakar, told the court that there had already been a lot of delay in the matter, therefore, it should decide forthwith.“After hearing the arguments from both sides, the LHC adjourned the proceedings till September 13,” a court official said.Earlier, the LHC had issued notices to Punjab Chief Secretary Zahid Akhtar Zaman and Deputy Commissioner Lahore.Rafia Haider and the administrator of the City District Government sought a reply to the petition of the Bhagat Singh Memorial Foundation Pakistan in this regard.The foundation chairman, Imtiaz Rasheed Qureshi, had filed the contempt petition for their failure to name the Shadman Chowk after Bhagat Singh.Qureshi said that the LHC in 2018 had ordered the government to name the Shadman Chowk after Bhagat Singh where he was hanged in 1931.“But both the provincial and district governments deliberately did not comply with the LHC’s order thus committing contempt,” he said.Bhagat Singh fought for the independence of the subcontinent. Singh was hanged by British rulers on March 23, 1931, along with Raj Guru and Sukhdev after being tried under charges of hatching a conspiracy against the regime. Singh was initially jailed for life but later awarded the death sentence in another “fabricated case”.Founder of Pakistan Qauid-e-Azam Muhammad Ali Jinnah had reportedly twice paid him tribute during his speech in the central assembly saying there had never been any brave person in the subcontinent like Bhagat Singh.Qureshi stated that Bhagat Singh was a freedom fighter of the subcontinent and gave his life along with his companions for the cause of freedom.“It will be in the interest of justice to name Shadman Chowk after Bhagat Singh and also install his statue at the square to inspire the people of Pakistan and the world,” he said. At least four judges of the SC, eight of the Islamabad High Court and six of the Lahore High Court received letters, creating fear in the judiciary.The latest judge to receive the threatening letter was LHC's Justice Ali Baqar Najafi.The CTD lodged two FIRs against unknown people and launched an inquiry into the matter.The sources disclosed that arsenic mixed in white powder was found in the letters. They further revealed that the powder contained 10% arsenic, adding that a higher ratio of the material can be "very poisonous" and harmful to the human body and can affect the nervous system upon inhalation.The investigators have obtained the videos of the CCTV cameras installed near the letterboxes in the sub-divisional post office Satellite Town, Rawalpindi.The sources shared that the suspects in the videos are being identified with the help of Nadra.Earlier, the judges of the IHC including the chief justice received the letters containing the white powder which was believed to be anthrax. Chief Justice of Pakistan Justice Gulzar Ahmed on Saturday said that no one ever interfered in his work nor he was pressurized and guided to announce a specific verdict.
Addressing a ceremony in Lahore, the chief justice said that people should not be mistaken and the impression that courts are not independent is wrong as he always gave verdicts in light of constitution and law.
CJP Gulzar Ahmed said that he neither took dictation from anyone nor any institution pressurized him to pass certain verdicts.
Earlier, Lahore High Court (LHC) Chief Justice Muhammad Ameer Bhatti said that judiciary is the guardian of citizens’ rights.
Speaking in Asma Jahangir conference, the LHC CJ said that judiciary has significant role in the society. The Constitution gives importance to the fundamental rights of the people, he added.
The LHC CJ said that citizens’ rights are basis of democratic society.

LHC instructs Punjab judges to keep out of social communications
The High Court of Lahore instructed judges in the subordinate courts to stay away from social media
After clearance by LHC Chief Justice Muhammad Ameer Bhati and session judges and judicial off cashiers deployed to the former cadres in Punjab have received a letter outlining a code of conduct requesting them to stop using the social media platforms.
It was also prohibited, according to a letter, from joining all non-governmental WhatsApp groups.
The new regulations come days following the new LHC Chief Justice of Justice Muhammad Ameer Bhatti.
The LHC further suggested that disciplinary action against judges who do not comply with the instructions will disturb the image of the judges by some members of the district courts.
Justice officers should restrict their social life and district judges should only utilize WhatsApp official groups, the letter from the LHC stated.
According to the letter the judges who exchange information about unauthorized WhatsApp groups should be brought to justice. District judges are asked by the appropriate judge and High Court Registrar to transmit communication.
