[re Trump indictment] The district attorney, Alvin Bragg, is rip-roaring to go: he’s charged Trump with 34 felony counts of falsifying business records in the first degree. (It is sometimes allowed to be said that Alvin Bragg was funded by George Soros, but only when New York mag and Soros want it to be noted in a positive way, but if it’s said with a vaguely negative tone then it’s a Fact Check: False.) Regardless, the case against Trump seems a little weak. The best way to get a sense of its frailty is to read a site that is otherwise thrilled with the arrest, like Vox.com—over there, even #resistance writer Ian Millhiser agrees that the case is, yeah, really weak.

My favorite is Charlie Javice, the 31-year-old wunderkind founder of a company called Frank, which helped students with financial aid applications. Javice was on top of the world (or at least on the 2019 Forbes 30 Under 30 list), and in 2021 she sold Frank to JPMorgan for $175 million. But when JPMorgan started kicking the tires, they realized our girlboss had claimed the company had four million customers—but it only had. . . 300,000. It turns out she basically made up that four million number and a bunch of emails bounced when JPMorgan tried to reach the pool of people. I mean, let them cast the first stone, am I right?
This week, she was arrested on conspiracy to commit wire fraud, wire fraud, bank fraud, securities fraud, you name it fraud.
If you’re like me and enjoy reading complaints, you might enjoy SEC v. Javice for gems like how she paid a data science professor to build her Potemkin village of student users: “In a series of messages, Javice guided the Data Science Professor in creating a list of fake user data, answering questions from him about how the data should look.”
Now she’s out on bail. But I think this arrest is foolish. If I were JPMorgan, I wouldn’t sue her, and here’s why: Javice sold her company for $175 million. But what did she pay the data scientist who made her entire fake company, filling it with fake activity? $18,000. He didn’t even get healthcare. ***At 1:19 p.m. Thursday, [Loveland, Colorado] PD dispatch received a report of a vehicle versus pedestrian accident in the parking lot of the north Walmart location, 250 W. 65th St., according to the release. Police and other emergency personnel responded to the scene and found a 27-year-old man trapped under a 2016 Chevrolet sedan driven by an 83-year-old Loveland woman.
The release added that rescue efforts were “unfortunately unsuccessful” and the man was pronounced dead at the scene. While the man’s identity was not released by the LPD, the department confirmed that he was an employee of the Walmart location and was in the process of returning carts into the store when the crash occurred.
Bob Coleman, the police department’s public information officer, said it is unknown at this time if charges will be filed against the driver.

Tech entrepreneur Bob Lee, who created the mobile payment service Cash App, was stabbed to death in a well-to-do San Francisco neighborhood — in Rep. Nancy Pelosi’s district — on Tuesday morning, authorities and loved ones said.
The 43-year-old dad of two, who formerly served as the chief technology officer of Square, was attacked in the city’s downtown Rincon Hill neighborhood at 2:35 a.m., according to San Francisco police.
Officers arrived to find the victim, later confirmed to be Lee by CBS News, with multiple stab wounds.***
Jake Shields, Lee’s friend, and a mixed martial arts champion, revealed Lee was attacked while he was walking.
“He was in the ‘good’ part of the city and appeared to have been targeted in a random mugging/attack,” Shields tweeted.
He later said Lee had moved out of the Democrat-run city, which has had constant problems with homeless people and drug addicts in recent years, because of how it has been changing for the worse.

19-year-old William Whitworth threatened “to shoot up multiple schools and churches in Colorado Springs, Colorado, according to an affidavit from the 18th Judicial District Attorney’s (DA) Office.”
Whitworth’s sister called the sheriff’s office to their home, reporting multiple threats Whitworth had allegedly made against schools in the area. Deputy Mike Watters asked Whitworth if he intended to shoot up a school, to which Whitworth nodded his head “yes,” according to the affidavit. Whitworth said Timberview Middle School, which he allegedly attended for fifth, sixth and seventh grade, was one of his “main targets,” but that he also intended to shoot up churches, according to the document.***
Whitworth offered to show Watters his manifesto, but in the process of looking for it police found several notebooks with drawings of desk setups and floor plans, including a drawing of a clock apparently to use as a detonation device, according to the affidavit. The notebook also listed the name of conservative Canadian activist Lauren Southern, calling her “pathetic,” and Donald Trump, whom he called a “con-man.” Police also retrieved a copy of “The Communist Manifesto” as evidence, according to the document.

Florida teen murders
MARION COUNTY, Fla. — Two arrests were made after three teenagers were fatally shot and found in various parts of Ocklawaha, a rural Marion County community, last week.
Seventeen-year-old Robert Le'Andrew Robinson and a 12-year-old boy were arrested in connection to the crime and will be charged with first-degree murder, according to Marion County Sheriff Billy Woods. A third suspect who is 16 years old is still on the loose. WESH 2 will not name the younger suspects due to their age.
Woods alleges the group of six teens, including 16-year-old Layla Silvernail, were together in her car when the murders happened. He emphasized, "she was there on her own free will."
“We had out there it was gang-related. We have nothing specific to say that it was a rivalry. However, in some shape or another, each were associated with a gang,” Woods said.***
At some point, the juvenile suspects turned on the three victims in what the sheriff described as a robbery. “These three individuals turned on our victims and murdered them. They fled the scenes and left a lot of evidence in their wake,” Woods said.

VOLUSIA COUNTY, Fla. — The Volusia County Sheriff’s Office announced the arrests of seven men accused of exposing themselves at different public parks.
Daniel Osborn, Ronald Clemens, David Harris, Felix Luna, Scott Downer, Scott Carnathan and Joseph Willems are facing charges for exposure of sexual organ. The men, who range in age from 44 to 80 years old, also received trespass warnings.
Deputies conducted an undercover operation after reports of sexual activity in public spaces. Deputies say they saw each suspect expose himself before beginning a sex act.

AUSTIN, Texas — A jury on Friday found Army Sgt. Daniel Perry guilty of murder for shooting and killing an Air Force veteran three years ago during a Black Lives Matter protest in the city, Perry’s attorney confirmed.
The two-week trial ended after a jury of eight women and four men deliberated for more than 15 hours. They found Perry not guilty on a second charge of aggravated assault with a deadly weapon.
Perry faces up to life in prison. Judge Cliff Brown as of Friday had not yet scheduled a sentencing hearing.
Perry, 35, was assigned to Fort Hood and had been driving the 70 miles south to Austin to work a second job with a rideshare company when he encountered protesters in the city’s downtown at about 9:51 p.m. on July 25, 2020. Garrett Foster, an Air Force veteran, was among the protesters and legally carrying an AK-47-type assault rifle, according to the Austin Police Department. Perry told police that he saw Foster point the weapon at him, so he fired his own gun five times, killing the 28-year-old Foster. ***

Christian Katan Mansoor, 18, of Macomb Township was darting around in a silver BMW with flashing red and blue lights on Monday, the Oakland County Sheriff’s Office said in a press release.
Around 11 p.m., Mansoor allegedly pulled up behind an off-duty Waterford Township police officer in Rochester Hills. Police said he was allegedly attempting to conduct a traffic stop.***
The off-duty officer said that Mansoor previously passed her, and she was suspicious when he pulled her over. After introducing herself, she asked Mansoor what precinct he worked for and his identification.
According to officials, Mansoor claimed that he was a Detroit police officer with the 12th Precinct, and told the off-duty police officer that he needed to retrieve his identification from his vehicle.

***Casie Bock, a 29-year-old woman who lived in the home, was arrested Tuesday night and charged with accessory to homicide.
Haskel Leroy Crawford, a 38-year-old man who was already facing homicide charges in nearby Jefferson County in an unrelated case, was arrested and charged with first-degree murder on Thursday.
Police originally received a tip on Monday that a 36-year-old man who has been missing since last summer was murdered inside a condo in the Denver suburb of Aurora. The caller stated that the victim was buried in a crawl space.
Detectives obtained a search warrant for the home and found the victim entombed in concrete underneath the floor. Outside contractors are working with authorities on excavating the body, which could take through the end of the week.
Bock told police that Crawford, her ex-boyfriend and the mother of her two children, murdered their neighbor, 36-year-old Karl Beaman, some time last summer, according to an arrest affidavit. *** D.C. police Chief Robert Contee recently observed that the average murder suspect in his jurisdiction has 11 prior arrests. This is evidence that the failure to impose salutary consequences on habitual offenders emboldens them and helps them graduate to worse and more violent crimes.
Crime, not incarceration, is the real enemy of public safety and human flourishing. It is true that incarceration is not appropriate for everyone who breaks the law. But for violent and repeat criminals, it is the only tried and true method of preventing all types of crime, ranging from burglary to mass shootings.
As we noted recently, incarceration is working wonders in El Salvador, where the abrupt mass arrest of more than 60,000 gang members and allies has made the world's most violent country safer than most U.S. cities. The United States doesn't need such a drastic measure, but it does need prosecutors and judges to put more violent and repeat criminals away for long periods of time. Prison systems are not good at rehabilitating people, but they are very good at protecting the public from the vicious behavior of their inmates. In the meantime, by imposing serious consequences, not necessarily incarceration, for less serious crimes, local jurisdictions can break the cycle, curbing the creation and emboldening of the next generation of long-term prison inmates.

Louisville police have identified Connor Sturgeon as the man who opened fire at the Old National Bank on East Main Street Monday morning.
The 23-year-old worked at the bank, Louisville Interim Chief Jacquelyn Gwinn-Villaroel said at a 3 p.m. news briefing.
The first reports of shots fired came in at 8:38 a.m., she said. Sturgeon shot at responding officers.
"We then returned fire and stopped that threat," she said.
"The suspect is deceased. This is the only time that I will mention the suspect name in this case: Connor Sturgeon, white male, 23 years of age, who was employed at Old National Bank."***
According to his LinkedIn profile, Sturgeon worked at the bank for about two years as a "syndications associate and portfolio banker" and had three prior summer internships there.
He wrote that he had a master’s degree from the University of Alabama.***

Florida gets real
Florida Senate Bill 1342, if enacted, would authorize D/P for child rape if the perp was 18 or older and the victim was less than 12.
Rape was a capital crime. Coker v. Georgia, 433 U.S. 584 (1977) recognized the long historical tradition of rape as a capital crime, but said "with respect to rape of an adult woman, *** a sentence of death is grossly disproportionate and excessive punishment.” States retained D/P for child rape.
Decades later, J. Anthony Kennedy & four friends said there was a consensus against D/P for child rapists. Patrick Kennedy forcibly raped his 8 y/o step daughter and inflicted, permanent, painful injuries on her reproductive organs. Despite Congress Kennedy v. Louisiana, 554 U. S. 407 (2008)

The mother of a 6-year-old student who shot his first grade teacher in Newport News, Virginia, in January was indicted by a Virginia grand jury on Monday.
Deja Taylor, the mother of the unnamed student, was charged with felony child neglect and a misdemeanor of recklessly leaving a loaded firearm so as to endanger a child, according to Newport News prosecutor Howard Gwynn.***
The firearm legally belonged to Taylor. An attorney for Taylor said both parents were “committed to responsible gun ownership and keeping firearms out of the reach of children.” The attorney said they tried to keep the firearm used in the shooting away from the child, according to the Guardian.
The 6-year-old, who has a severe disability, badly wounded his first grade teacher, 25-year-old Abigail Zwerner, at Richneck Elementary School on Jan. 6. The incident occurred after school administrators were warned that the child possessed a gun and was in a "violent mood" at the school. The boy will not face any criminal charges.
The shooting occurred while Zwerner was sitting at a table. She had gotten into an argument with the student. Zwerner was shot in the hand and chest, and she spent two weeks in a hospital. Dying in Gangster’s Paradise
LOS ANGELES (AP) — “Gangsta’s Paradise” rapper Coolio suffered an accidental death from the effects of fentanyl, heroin and methamphetamine last year, the Los Angeles County coroner’s office reported Thursday.
The county agency also cited cardiomyopathy, a disease that makes it more difficult for the heart to pump blood to the body, as a “significant condition.” Investigators also determined Coolio’s severe asthma and cigarette smoking played a role in his death.
Coolio’s former longtime manager Jarez Posey also confirmed the cause of death Thursday.
Coolio — born Artis Leon Ivey Jr., on Aug. 1, 1963 — died at the Los Angeles home of a friend on Sept. 28, 2022. He was 59.
Coolio won a Grammy for best solo rap performance for “Gangsta’s Paradise,” the 1995 hit from the soundtrack of the Michelle Pfeiffer film “Dangerous Minds” that sampled Stevie Wonder’s 1976 song “Pastime Paradise.”

Harsh order
A Fremont County District Court judge last week threw out a first-degree murder charge to punish prosecutors for failing to turn over information to defense attorneys — part of what the judge said is a pattern of widespread discovery violations by 11th Judicial District Attorney Linda Stanley and her staff.
In a scathing 21-page order, Judge Kaitlin Turner listed 20 cases over the last two years in which prosecutors in Stanley’s office have failed to turn over discovery information to defense attorneys as required by law.
The judge then found a similar violation had occurred in the murder case before her and ordered that the first-degree murder charge against defendant Joseph Tippet be reduced to a second-degree murder charge as a sanction for prosecutors’ misconduct.

*** According to the affidavit, investigators found the manifesto, a dry-erase board with floor plans, and a list of names in a notebook.
Whitworth said the manifesto was four pages long and had "schizophrenic rants" on them. However, the affidavit states when deputies asked if she was schizophrenic, she replied "I hope not."
According to the affidavit, Whitworth was asked how much she knew about school shootings, and she stated, "Too much." When asked what she meant by that, Whitworth stated "There's a page in my manifesto and there's a bunch of mass killers."
On the dry-erase board, investigators noted it looked like a labeled floor plan of a school, with labels identifying the office, bathrooms, classrooms, and the different levels.
In two different notebooks, deputies found more floor plans, a drawing of a clock to use a detonation device stating, "Remove clock intemials and drive a screw into the desired detonation time on the face of the clock, and "Is this what they meant when they said making a mockery of the massacre?"
Whitmore stated she watched a video on YouTube on "how to do it" regarding the picture of a detonator.
Deputies obtained a search warrant of the home and found "The Communist Manifesto" by Karl Marx and Friedrich Engels and more books with notes. Written inside one book had written inside, "Ways I want to die," with a list stating murder, burning alive, freezing, and drowning.

Calling it tantra doesn‘t mean it’s not prostitution
EL PASO COUNTY, Colo. (KRDO) -- An El Paso County businesswoman convicted of pimping out multiple women over several years will not spend time in jail or prison.
In December 2022, 32-year-old Shirley King was convicted of Pimping, Keeping A Place of Prostitution, Prostitution, and Pandering-Arranging Prostitution.
On Wednesday, a judge sentenced the former owner of Sutra Healing Center to four years of supervised probation. The sentence bans King from practicing hands-on massage therapy or "tantra" treatments for healing purposes during those years.
An informant told investigators that King gave massages out of her business located at the 500 block of Marquette Dr. in El Paso County with “happy endings” or sexual acts, but classified the interactions as “tantra.”***
Prosecutors said King would target women struggling with substance abuse and pimp them out. However, two of King’s former ‘employees’ spoke during sentencing in support of the business owner, arguing that they were not pimping victims.

COLORADO SPRINGS, Colo. (KRDO) -- A former attorney with the Public Defenders Office in Colorado Springs has been suspended from practicing law for 90 days after an investigation into his conduct with a former mistress. 41-year-old Christopher Melichar pleaded guilty to posting a private image for harassment, namely sending sexually explicit videos to his mistress's husband, as a form of revenge.
According to the narrative of the investigation into his conduct, Melichar was involved in a relationship with a married woman in August 2020, during his time as a public defender. The report says he received, took, and threatened to share nude pictures of the woman. The woman claimed she did not consent to the pictures being taken because she was too intoxicated to consent at the time.

Police found the cab driver dead after officers responded to a report of a stabbing near Southeast Washington Street and Water Avenue, Oregon Live reported.
The suspect was transgender individual Moses Lopez, 30, of Portland, who was arrested by police at the scene and charged with with second-degree murder and unlawful use of a weapon.
Radio City Cab confirmed the victim was a long-time employee with an impeccable record.***

One man was shot dead and three others injured in a “targeted” attack outside a funeral home in Washington, DC, police said.
The shooting erupted just before 12:30 p.m. after mourners had left a service for a murder victim at the Stewart Funeral Home in Northeast Washington.
“It’s unfortunate that someone would be so brazen to do such an act, let alone at a funeral,” DC Police Chief Robert Contee said at a press conference.***
The funeral service was being held for 24-year-old Stephon Lamont Carroll, according to an online obituary.
Carroll was shot dead in Southeast Washington in the early hours of March 24, cops said. The gunman in that case hasn’t yet been caught.

Lordstown Motors, an electric vehicle start-up that aimed to revive a shuttered General Motors factory in Ohio, said on Tuesday that it did not have enough cash to start commercial production of its electric pickup truck and might have to close its doors.
The company, which was once held up as a savior by former President Donald J. Trump, is now being investigated by the Securities and Exchange Commission. In a regulatory filing, Lordstown said it will not be able to begin “commercial scale production” without raising more money from investors and lenders.
Lordstown, one of about a dozen start-ups in the electric vehicle space that have gone public by merging with special purpose acquisition companies, or SPACs, added that there was “substantial doubt regarding our ability to continue as a going concern” — a legal phrase companies often use to alert investors that they might not survive. The company had $587 million in cash at the end of March, down from more than $629 million at the end of last year.
The filing will likely increase doubt about the viability of businesses that have merged with SPACs, which have been criticized by some investors and analysts for doing a shoddy job of vetting the businesses they acquire. Many of the SPAC deals in the electric vehicle space have been particularly precarious because it takes a lot of expertise, money and time to create an auto company capable of mass-producing cars and trucks.
Lordstown has been on shaky ground for months. On Friday, the company said the Nasdaq stock exchange could delist its shares because it was late in filing its quarterly report with the S.E.C. The company offered no explanation for the delay, but it may have been related to an accounting change that securities regulators issued for companies that have merged with SPACs.
Lordstown’s stock fell sharply on Tuesday, closing down more than 16 percent, to $11.22 a share. It fell a bit more in extended trading.
The S.E.C. said this year that warrants awarded in SPAC deals had to be accounted for as debt or a liability on a company’s balance sheet. A warrant grants an investor the right to buy shares at a preset price. Before the accounting change, most warrants were treated as stock and not debt.
Lordstown, in its quarterly filing, reported a net loss in the value of its warrants of about $19 million. The company also reported $82 million in cash proceeds from the exercise of warrants during the quarter.
Just last month, the company said it was on track to start production in September, although it said it would make only about 1,000 trucks by the end of the year — half as many as it had originally planned — if it was unable to raise more money.
The company said it was considering issuing new stock or borrowing money. “As we seek additional sources of financing, there can be no assurance that such financing would be available to us on favorable terms or at all,” the company’s filing said.
Lordstown also said it was reducing its spending to conserve the cash it had on hand, without saying whether it might cut jobs. Company representatives did not respond to a request for comment.
The company was founded by its chief executive, Steve Burns, who previously headed another electric vehicle business, Workhorse Group. Lordstown was created after G.M. decided in 2018 to shut down a plant that had made the Chevrolet Cruze sedan.
Mr. Trump attacked G.M. for closing the factory and demanded that the automaker sell it to someone else. G.M. sold the plant to Lordstown for just $20 million in 2019 and later lent the start-up $40 million. G.M. still owns 7.5 million shares in Lordstown.
Lordstown became a publicly traded company in October when it merged with Diamond Peak Holdings, a SPAC created by a former Goldman Sachs banker who had no experience in the auto industry. The deal was completed in just two months.
In its Tuesday filing, Lordstown revealed that it had received two subpoenas from the S.E.C. seeking documents and information, including about its deal with Diamond Peak. The company said it was cooperating with regulators.
Lordstown also said it restated a portion of its 2020 annual report after determining it had found “material weaknesses” in its financial reporting. The company said it did not have enough employees with “appropriate technical accounting skills and knowledge.”
The company said it was hiring more skilled employees. But it warned that it might not be “successful in remediating the material weaknesses.”

Ohio’s attorney general, Dave Yost, filed a lawsuit on Tuesday in pursuit of a novel effort to have Google declared a public utility and subject to government regulation.
The lawsuit, which was filed in a Delaware County, Ohio court, seeks to use a law that’s over a century old to regulate Google by applying a legal designation historically used for railroads, electricity and the telephone to the search engine.
“When you own the railroad or the electric company or the cellphone tower, you have to treat everyone the same and give everybody access,” Mr. Yost, a Republican, said in a statement. He added that Ohio was the first state to bring such a lawsuit against Google.
If Google were declared a so-called common carrier like a utility company, it would prevent the company from prioritizing its own products, services and websites in search results.
Google said it had none of the attributes of a common carrier that usually provide a standardized service for a fee using public assets, such as rights of way.
The “lawsuit would make Google Search results worse and make it harder for small businesses to connect directly with customers,” José Castañeda, a Google spokesman, said in a statement. “Ohioans simply don’t want the government to run Google like a gas or electric company. This lawsuit has no basis in fact or law and we’ll defend ourselves against it in court.”
Though the Ohio lawsuit is a stretch, there is a long history of government control of certain kinds of companies, said Andrew Schwartzman, a senior fellow at the nonprofit Benton Institute for Broadband & Society. “Think of ‘The Canterbury Tales.’ Travelers needed a place to stay and eat on long road treks, and innkeepers were not allowed to deny them accommodations or rip them off,” he said.
After a series of federal lawsuits filed against Google last year, Ohio’s lawsuit is part of a next wave of state actions aimed at regulating and curtailing the power of Big Tech. Also on Tuesday, Colorado’s legislature passed a data privacy law that would allow consumers to opt out of data collection.
On Monday, New York’s Senate passed antitrust legislation that would make it easier for plaintiffs to sue dominant platforms for abuse of power. After years of inaction in Congress with tech legislation, states are beginning to fill the regulatory vacuum.
Ohio was also one of 38 states that filed an antitrust lawsuit in December accusing Google of being a monopoly and using its dominant position in internet search to squeeze out smaller rivals.

Last year, a Pennsylvania man amassed thousands of followers on Twitter by impersonating relatives of former President Donald J. Trump. In November, he even duped Mr. Trump, who messaged the man “LOVE!” while thinking he was writing to one of his sisters.
The New York Times later identified the man as Josh Hall, a 21-year-old food-delivery driver and Trump supporter, and showed that he had used the accounts to collect thousands of dollars for a fake political group.
On Tuesday, federal authorities arrested Mr. Hall and charged him with fraud and identity theft.
Mr. Hall pretended to be members of the Trump family “to fraudulently induce hundreds of victims to donate to a political organization that did not exist, and then pocketed those funds for his own use,” Audrey Strauss, the U.S. attorney in Manhattan, said in a news release.

Mr. Hall’s arrest is a rare instance of criminal charges filed against someone for creating fake accounts on social media. Facebook, Instagram, Twitter and other social networks are rife with millions of fake accounts, many of which impersonate politicians, celebrities and soldiers to scam people out of money. But few of the people behind the fakes ever face consequences.
Mr. Hall attracted the attention of the Federal Bureau of Investigation after he posed as five members of Mr. Trump’s family on Twitter, amassing more than 160,000 followers on the site. Over a year, he pretended to be, among others, Robert Trump, the president’s brother; Barron Trump, the president’s teenage son; and Dr. Deborah L. Birx, the White House’s coronavirus coordinator at the time.
He used the accounts to direct people to donate to a political group called Gay Voices for Trump. Mr. Hall later told The Times that the group didn’t exist. He brought in more than $7,300. The Justice Department said on Tuesday that Mr. Hall had kept the money.
Mr. Hall appeared in federal court in Harrisburg, Pa., on Tuesday, the Justice Department said. He could face up to 22 years in prison, the department said.
Mr. Hall could not be immediately reached on Tuesday. He told The Times last year that his fake accounts were clear parodies and that anyone should have known that, including Mr. Trump, by reading a few of their typically juvenile posts.
“There was no nefarious intention behind it,” Mr. Hall said. “I was just trying to rally up MAGA supporters and have fun,” he added, referring to the abbreviation for Mr. Trump’s slogan, “Make America Great Again.”

C.E.O. Details How Hackers Infiltrated Colonial Pipeline Network
Joseph Blount, the chief executive of Colonial Pipeline, told a Senate committee on Tuesday that the company believes cybercriminals accessed its computer systems via a virtual private network that was no longer used.
Just one month ago, we were the victims of a ransomware attack by a cybercriminal group, and that attack encrypted our I.T. systems. Although the investigation is still ongoing, and we believe the attacker exploited the legacy V.P.N. profile that was not intended to be in use, DarkSide demanded a financial payment in exchange for a key to unlock the impacted systems. We had cyberdefenses in place, but the unfortunate reality is that those defenses were compromised. We reached out to federal authorities within hours of the attack, and they have continued to be true allies as we’ve worked to quickly and safely restore our operations. I made the decision to pay, and I made the decision to keep the information about the payment as confidential as possible. It was the hardest decision I’ve made in my 39 years in the energy industry. And I know how critical our pipeline is to the country. And I put the interests of the country first. I kept the information closely held because we were concerned about operational safety and security. And we wanted to stay focused on getting the pipeline back up and running. I believe with all my heart it was the right choice to make.

The top executive of the Colonial Pipeline told a Senate committee on Tuesday that an oversight appears to have allowed hackers into its computer systems and contributed to the paralyzing of the delivery of gasoline and other fuels up and down the East Coast.
Joseph Blount, the chief executive of the pipeline company, said the company believes that the criminal hackers infiltrated Colonial’s computers through an old virtual private network, commonly known as a V.P.N., “that was not intended to be in use.” He added, “We are still trying to determine how the attackers gained the needed credentials to exploit it.”
The V.P.N., a technology often used by companies to allow staff to access internal corporate networks from home, did not require multifactor authentication, a process through which a user is granted access to a computer system or application only after successfully presenting two or more pieces of information — security experts often refer to it as “something you know and something you have.” The first piece of information is often a password; the second can be a code sent to a cellphone, for example. Multifactor authentication has become increasingly common, and even free services like Gmail and Facebook offer it and encourage people to use it.
Democratic and Republican Senators were largely sympathetic in their questioning of Mr. Blount and did not press him aggressively on the glaring vulnerability. Colonial operates a 5,500-mile pipeline network that supplies 100 million gallons of gasoline, diesel and jet fuel daily to gas stations, airports and other customers along the East Coast, supplying nearly half of the region’s transportation energy.
“We are deeply sorry for the impact that this attack had,” Mr. Blount said.
Mr. Blount said the company quickly notified the Federal Bureau of Investigation on the day of the attack and suggested the damage done to the pipeline could have been much worse had the company not paid a ransom to a criminal group called DarkSide that infiltrated its system.
The Justice Department said on Monday that it had seized more than half the ransom, which totaled more than $4 million worth of the digital currency Bitcoin.

The Justice Department said on Monday that it had traced and seized much of the ransom that a major U.S. pipeline operator paid to a Russian hacking collective last month. The ransomware attack shut down the Colonial Pipeline for about a week, prompting fuel shortages and price spikes, until the company paid hackers more than $4 million worth of Bitcoin. But federal officials said that a new F.B.I. task force had recaptured most of the Bitcoins by, in essence, hacking the hackers.
Bitcoin transactions are anonymous but not untraceable. The hackers moved the ransom through dozens of accounts, which can be tracked on the blockchain, the public ledger of all Bitcoin transactions. Eventually, the funds landed in an account that a federal judge allowed the F.B.I. to break into. According to court documents, officials got the account’s “private key,” a crucial password that gives the owner complete control over the funds inside.
Tom Robinson of the blockchain analytics company Elliptic, who has been tracking the ransom payments, wrote in a blog post that the account compromised by the authorities appeared to hold the 85 percent share of the ransom that went to the client of DarkSide, the Russian “ransomware as a service” hacking group whose software was behind the attack. The remaining 15 percent was funneled through accounts presumably controlled by DarkSide developers.
In a way, this could be good for cryptocurrency, the DealBook newsletter reports. A major criticism of crypto is that its anonymity and ease of use make it suitable for crime, like the ransomware attacks that, by some measures, strike every eight minutes. The Justice Department didn’t divulge how it had seized the bulk of the Colonial ransom, but its success shows that it can comb the blockchain and crack into at least some accounts. That’s good for the traceability of cryptocurrency used for crime — but also goes against the decentralized, privacy-focused, anti-establishment benefits that some see as crypto’s greatest assets. (There are other cryptocurrencies with features that make them harder to trace than Bitcoin.)
Federal officials encouraged companies to work with the F.B.I. when attacked, as Colonial did, to help recoup ransom payments, which are thought to run into the billions of dollars (and are legal and even tax-deductible).
Joseph Blount, the chief executive of Colonial, will testify Tuesday before the Senate and Wednesday before House, where more details about the attack, and the response, could be revealed.

Job openings surged to record levels in April, the latest evidence that businesses are struggling to hire workers as the economy reopens.
U.S. employers had 9.3 million jobs available at the end of April, the Labor Department said Tuesday. That is the most in the two decades that records have been kept, and more than two million more than before the pandemic. Openings surged in recreation, food service and other sectors that are ramping up after a year of pandemic-related restrictions.
Hiring rose, too, but not by nearly as much, which is consistent with separate figures showing that net job growth slowed significantly in April. (Job growth picked up in May, but remains below March levels.)
Many businesses have reported in recent weeks that they would like to hire more quickly but cannot find enough workers. The data released Tuesday, the monthly Jobs and Labor Turnover Survey, provided some evidence of that shortage: There was roughly one unemployed worker for every available job in April. That is above the level before the pandemic, when there were fewer jobless workers than available jobs, but it represents a much faster rebound than after the last recession.
With plenty of jobs available, workers are feeling emboldened: Nearly four million people voluntarily quit their jobs in April, the most on record. The number was especially elevated in the leisure and hospitality sector, where many businesses have been offering signing bonuses and other incentives to lure workers.
“More than a year after horrific job losses and wage cuts, job seekers have a strong hand in the labor market again,” Nick Bunker, director of research for the hiring site Indeed, said in a statement. “Demand for workers is surging as the broader economy starts to emerge from the pandemic.”

Southwest Airlines said Tuesday that it would buy more Boeing’s 737 Max jets than it had previously planned, providing an important vote of confidence for the troubled plane that was grounded by regulators for nearly two years.
The airline said in a securities filing that it had agreed to buy 34 more Max jets next year, more than doubling its previous order. That brings Southwest’s total order for those planes through 2031 to 383 planes, with options to buy hundreds more. The new jets will replace older 737’s in the Southwest’s fleet, which is made up of various Boeing 737 models. The airline said it expected to retire at least 30 to 35 older planes each year over the next decade.
The news helped to lift Boeing’s sales for May. The manufacturer reported Tuesday that it had sold a net 20 planes last month, after accounting for cancellations.
Southwest’s order comes as the pandemic recedes in the United States and demand for travel rebounds strongly.
Memorial Day weekend kicked off what airlines hope will be a monthslong travel frenzy spurred by widespread vaccinations and a drop in new infections.
Southwest said Tuesday that it expected June revenue to be down only 20 percent compared with the same month in 2019, at the low end of a previous company estimate. Fares for leisure travel in June and July are in line with 2019 and summer bookings are looking “fairly typical,” the airline said in the filing.
Boeing received several dozen cancellations but it also said that it was now hopeful about more than 70 orders that it had previously removed from its books because they seemed unlikely to be filled. The company’s order backlog now stands at more than 4,100 planes, most of which are for the 737 Max.
That plane started flying passengers late last year after a 20 month global ban following two fatal crashes. Since then, 23 airlines have restarted using the Max, flying nearly 45,000 passenger flights, Boeing said.

Several major websites, including those of the British government, The New York Times, CNN, The Financial Times and The Guardian, were briefly inaccessible for many users on Tuesday morning.
According to Downdetector.com, which tracks internet disruptions, sites including Etsy, Hulu, PayPal, Reddit, Twitch and Twitter also reported problems.
Many of the affected sites appeared to have been restored after a little less than an hour.
The outage was connected to Fastly, a provider of cloud computing services used by scores of companies to improve the speed and reliability of their websites. Fastly later said on its website that the issue had been identified and that a fix was being made.
Fastly works on technology known as a content delivery network, which is a highly distributed network of servers used to reduce the distance between a server and user, and increase the speed at which a website loads.
The technology is thought to improve reliability because it distributes the delivery of a website to many locations, rather than depending on a central data center. Fastly did not immediately respond to a request for comment on Tuesday.
Widespread internet outages are less common today than years ago, as Google and other major tech companies develop interconnected data centers that improve performance, but there have been a number of incidents over the last year.
In December, Google services including Gmail, Maps and YouTube crashed for about an hour. The company attributed the problem to an “authentication system outage.” And in January, Slack, the popular workplace messaging platform used by millions of people worldwide, experienced a major disruption in which users could not send messages, load channels, make calls or log in to the service.
Outages like the one on Tuesday, in which many of the affected sites belonged to news outlets, often hit businesses in the same sector because they rely on the same third-party services, said Marie Vasek, a lecturer in information security at University College London.
“All of these websites really depended on this one third-party service, and the slight disruption in that caused this disproportionate effect,” Dr. Vasek said.
Madeline Carr, the director of the Research Institute for Sociotechnical Cyber Security, which focuses on the security of organizations, said that companies that provide the infrastructure for websites can be slow to provide details when they experience internal failures or are the victims of cyberattacks. That is in part because their main selling point to clients is their reliability, she said.
“There does need to be a level of accountability,” said Dr. Carr, also a professor of cybersecurity at University College London. “In the last generation of cybersecurity, it was about ensuring websites were protected or had adequate security, but when you’re talking about something like Fastly, in a sense it doesn’t matter how secure your own website is,” she said, since so many websites depend on it.

For a company pitching itself as helping improve the reliability and speed of websites, it is hard to imagine a worse turn of events than what Fastly experienced on Tuesday.
Fastly, a cloud-computing company used by businesses around the world to operate their websites, faced an outage that caused popular websites including Reddit, Twitch, Hulu and The New York Times to suddenly crash for about an hour on Tuesday. Websites in North and South America, Europe, Asia and Africa were affected, the company said.
Fastly, based in San Francisco, provides the kind of behind-the-scenes technology that most people do not know exists, but is crucial for making the internet work. The company had been enjoying some success. Its stock skyrocketed last year, benefiting from all the people who were online amid the pandemic, the same wave that helped other tech companies like Zoom before coming back down over the past several months.
Before the system crashed on Tuesday, the stock had more than doubled since the company went public in 2019.
Fastly provides a technology known as a Content Delivery Network, or CDN, a highly distributed network used to reduce the distance between a server and a user, thus accelerating website loading speeds. Fastly says its network improves reliability because it distributes a website to many locations, rather than depending on a central data center.
Everything began going sideways for Fastly on Tuesday morning. At 5:58 a.m. Eastern time, the company posted on its website that it was investigating a problem with its services.
Customers that were experiencing outages included PayPal, The New York Times, The Financial Times and The Guardian. Even the British government’s main webpage was offline.
A spokeswoman for Fastly, whose own website was taken down, attributed the problem to a disruption to Fastly’s systems that send website content from a server to individual users.
Kentik, a network analytics company, said internet traffic volume coming from Fastly’s services fell by 75 percent.
The complexity of the internet means that short-lived outages will always exist, said Doug Madory, Kentik’s director of internet analysis. He noted that Google, Amazon and other large companies have also experienced problems that take services offline.
“There is no error-free internet, it doesn’t exist,” he said. “This is unavoidable because of the complexity.”
But investors seemed to shrug off the worldwide internet outage Fastly had caused. After slumping in premarket trading, its stock price was up about 3 percent Tuesday morning.

The eurozone economy didn’t fare as badly as initially projected at the start of this year, according to a revision of first quarter gross domestic product by the European statistics agency. The region’s economy fell 0.3 percent in the first three months of the year, compared with a previous estimate of a 0.6 percent decline, data published on Tuesday showed.
“While the euro area experienced a technical recession around the start of 2021, this upside surprise” to the first quarter economic data “is another positive development,” analysts at Barclays wrote in a note. The improvement suggests “that the euro area could be experiencing a little less scarring than we thought originally.”
Japan, too, reported an improved figure for first-quarter growth. Its economy shrank at an annual rate of 1 percent from January through March from the previous quarter, the government said Tuesday, an improvement from the initial estimate of a 1.3 contraction.
Tesla’s sales of cars made in China jumped 29 percent in May from the month before, and now represent a third of its total sales, Reuters reported. But Tesla’s Model 3, previously the best-selling electric vehicle in the country, has been overtaken by a cheaper electric car made by the joint venture between General Motors and SAIC Motor. Tesla shares fell 0.3 percent.
MoviePass, the failed subscription service that promised unlimited moviegoing for $10 a month, agreed on Monday to settle Federal Trade Commission accusations that it knowingly deceived customers, making the service difficult to use, and exposed their personal data. In the process, the F.T.C. revealed the elaborate obstacles that MoviePass executives made the most active users overcome, including forcing them to reset their passwords and setting unannounced limits on their accounts. “MoviePass and its executives went to great lengths to deny consumers access to the service they paid for while also failing to secure their personal information,” Daniel Kaufman, the F.T.C.’s acting director of the Bureau of Consumer Protection, said in a statement.

If this persists, YouTube might have achieved something that few internet companies have: a relatively healthy relationship with an established industry that it simultaneously helps and disrupts.
After Black Lives Matter protests last year and an economic crisis that disproportionately sidelined women, corporate America vowed to be more inclusive. It threw its weight behind policies like child care that would foster an equitable recovery from the pandemic, promises that seemed to represent a sea change in what until recently had been an apolitical corporate landscape.
But in corporate boardrooms, little has changed. Boards have been, and continue to be, predominantly male and white, according to a new study that will be released on Tuesday.
The study, by the Alliance for Board Diversity and the consulting firm Deloitte, found that white women gained the most number of seats, increasing their presence at Fortune 100 companies by 15 percent and at Fortune 500 companies by 21 percent. But, in total, they still represent just about a fifth of all board seats. And minority women — which includes Black, Hispanic and Asian women — represent the smallest slice of boardrooms at both Fortune 100 (around 7 percent) and Fortune 500 (around 6 percent) companies. More than half of directors newly appointed to board seats last year were white men.

The report, however, analyzed data only through last June. More recent data from the research firm Institutional Shareholder Services found that since last July, the number of Black directors on boards of S&P 500 companies surged by nearly 200 percent, representing 32 percent of all newly appointed directors, up from 11 percent in 2019. Almost half of them were new to publicly traded company board services.
That report, which didn’t break down the data by gender, attributed the shift to “the widespread racial justice protests last summer.”
Even before the protests, there was growing pressure for boardroom diversity from institutions like Goldman Sachs, BlackRock and Nasdaq, driven in large part by a growing body of evidence showing that diverse leadership correlates with better business performance. And as a result of 2018 legislation in California, almost all of the more than 600 public companies based there now have at least one female board member, according to researchers at Clemson University and the University of Arizona.
Substantial change, though, will still take time, experts said. A typical tenure of a board director is eight years, and adding more seats can be costly, with director pay often reaching hundreds of thousands of dollars.
The report from the Alliance for Board Diversity and Deloitte noted that, at the current rate of change, it would take decades for boardrooms to reach representation proportional to the demographics of the American population. Women of color, for example, make up 20 percent of the U.S. population, but it would take until 2046 for them to make up 20 percent of Fortune 100 board seats.
“The fact remains,” the authors of the report write, “progress has been painfully slow.”

Tesla Unveils the Stoner Truck. Sorry, Cybertruck. It’s as Big as an F-150.
The Tesla Cybertruck is unlike anything you’ve seen before: sharp creases and angles, like something doodled by a (talented) high schooler in that boring history class, or imagined for a science fiction movie. It is also a competitively priced pickup, listed at $40,000 to $70,000 with one to three motors. Speaking of science fiction, CEO Elon Musk said delivery will be in 2021, which is as little 58 weeks away, as much as 109 weeks away. Tesla has a history of missing ship dates, and not by a small margin.
The design is so far outside the pickup truck norm, with an angled bed cover, stainless steel body, and shatterproof windows (which of course shattered during the announcement), that there is considerable belief the design will change significantly between now and the, uh, 2021 launch date. So Cybertruck may be a working name.
The Tesla Cybertruck is about the same size as the best-selling Ford F-150.
Specs on the Tesla Cybertruck
The Tesla Cybertruck is sized like a full-size pickup truck, which can be anywhere from 210 to 250 inches long depending on the cab size and truck bed size. For the Cybertruck, shown above overlaid on a Ford F-150, it’s 231.7 inches long with a 6.5-foot bed, 78.8 inches wide, and 75.0 inches high. So that answers the question of whether it’s a mid-size competitor (Chevrolet Colorado, Ford Ranger, Honda Ridgeline) or full-size competitor (Chevrolet Silverado, F-150, Ram 1500). It’s full-size. The Tesla has a roll-up bed cover and the tailgate drops down to act as a cargo ramp.
Most big pickups are body-on-(ladder) frame, which yields a heavier vehicle than unibody construction where there’s no separate frame. Truckers say it’s sturdier and lasts longer. Tesla is joining Honda in building a truck where the body panels — here, stainless steel — give the truck its rigidity and crash resistance.
According to the introduction presentation by Musk, the cargo bed holds 3,500 pounds. The strongest model tows 14,000 pounds, which is a serious boat or travel trailer. (Also a serious drain on travel distance.)
The entry-level Cybertruck, $39,900, has a single motor, a range of 250-plus miles (these are all Tesla specs), a 0-60 time of 6.5 seconds, and a top speed of 110 mph. It tows 7,500 pounds. The dual-motor Cybtruck, $49,900, does 0-60 in 4.5 seconds, travels 300-plus miles on a single charge, and tows 10,000 pounds.
The top-end Cybertruck, $69,900, has three motors, runs 500-plus miles, does 0-60 in 2.9 seconds, tops out at 130 mph, and has the 14,000-pound tow capacity, more even than Ram 1500. (Which is shipping, and towing.) For this one, Musk says, production “is expected to begin in late 2022.”
Musk says the Cybertruck “is literally bulletproof to a 9mm handgun.” Designer Franz von Holzhausen couldn’t much dent the stainless steel body. He did better on the window glass.

Musk says the stainless steel body is bulletproof, meaning it will stop a 9mm round (“full metal jacket, 115 grain [bullet]”). The intro site being in California, which looks unkindly on ricochets hitting someone in the audience (even if it’s just journalists), a sledgehammer was used and showed a dent but not penetration. Then it was on to proving the windows are armored nicely, too …

… and wouldn’t you know it, designer Franz von Holzhausen managed to crack the driver-side window. So they tried again on the left passenger window …
The second throw took out the rear window. “That was a little too hard,” Musk said, adding, “there’s room for improvement.”
… and took out that window as well. For what it’s worth, a demo dropping the same ball down a tube onto the glass from a stepladder left that glass intact. And the car’s glass cracked but the plasticized layer held the glass pieces together, with no splinters that might hurt passengers in a crash or a gunfight.
Prospects for the Tesla Truck
Tesla will not be the first to deliver an electric pickup. Startup Rivian, with lots of funding (from Ford, Amazon, and others) and a less mercurial — sorry, less colorful — guy at the helm is getting closer to production in the fall of 2020. The R1T’s specs say 750 hp and a range of 400 miles. It will tow 11,000 pounds. There’s also a similar R1S SUV.
Ford says it will spend $11.5 billion on electrification by 2020. It has $500 million in Rivian and will use Rivian technology — the skateboard chassis with the batteries, motor, and controls – on an ePickup.
Bollinger’s B2, unveiled this week at the LA Auto Show, is a rugged looker with a 614 hp engine and a price of $125,000. And General Motors just month announced it’s doing a family of premium pickups and SUVs and may resurrect the Hummer name.

Others have upbeat thoughts on the Tesla Cybertruck.

Assuming this is really the electric pickup Tesla is going to build and not an elaborate prank, it is utterly unlike any of the upcoming electric-truck competition from Ford, General Motors, or even Lordstown [GM factory] or Rivian.

[W]hatever you think about its design, you have to be impressed by the specs. The electric pickup truck blows gas-powered pickup trucks out of the water and compares shockingly well to the Rivian R1T, the only other electric pickup with official specs.
One final piece of humor surrounding the Tesla unveiling: It was held at the same Hawthorne Municipal Airport where Ford on Sunday unveiled the Mustang Mach-E electric SUV. Elon Musk sent a congratulatory tweet to Ford saying how nice it was that Ford supports EVs. Privately, there were many reports that he was ticked that Ford’s unveiling site was within not only on the airport but within 100 yards of both the Tesla Design Studio and Musk’s SpaceX operation.

Chevrolet Colorado has been a favorite amongst people looking to buy a midsize pickup truck. That said, competition is robbing its sales with the likes of the Toyota Tacoma getting more market share. Others like the Nissan Frontier and the Ford Ranger are also in the minds of potential buyers.
But if you do have enough budget to spend on one of the more off-road centric versions of a truck, why hold back? Inevitably you’d have to end up choosing one and it’s quite hard given the number of offerings currently available. The Chevy Colorado ZR2 is more of an off-road specific build than a daily. With an impressive fanbase the Colorado soldiers on whilst its corporate sibling, the GMC Canyon caters to a different clientele.
For 2021, the Chevrolet Colorado ZR2 remains relatively unchanged with a few minor tweaks across the exterior and interior. With prices starting at $41,600, is the midsize Chevrolet pickup all show and no go? Let’s find out.
The 2021 Colorado has retained its engine options as before. The Chevy offers a choice of either a diesel-powered 2.8-liter Duramax engine and an optional 3.6-liter gasoline V6. Power figures are rated at 308 horsepower and 275 lb-ft of torque for the V6 Colorado. The Duramax diesel is good for 186 horsepower and a whopping 369 lb-ft of torque, ideal for someone looking to exploit the road less traveled. In terms of transmission, the Chevy gets a 6-speed auto for the inline-four diesel and an 8-speed automatic for the V6. The Colorado ZR2 gets both front and rear locking diffs plus a switchable four-wheel-drive system making it more versatile across demanding scenarios. Towing capabilities of the 2021 Chevy Colorado remain impressive at 7000 pounds for the V6 and 7700 pounds with the diesel when equipped with the Trailer package.
Although the Duramax diesel has less oomph on paper, the amount of twist it generates surpasses whatever the gasoline engine offers. The choice of which engine should you equip relies on what you expect from the ZR2. For instance, if you’re a serious off-road junkie, the torquey diesel should prove ideal, however, if your commute is more on the pavement, opting for the better-refined gasoline engine should be appropriate. Irrespective of engines, on the road, the Colorado is surprisingly well behaved and handles corners with minimal roll. Further complementing its on-road abilities is the lack of judder or flex usually exhibited by body-on-frame designs.

Notable exterior changes for 2021 include a revised grille for the Colorado ZR2. You get a unique grille design with layered protrusions that give the front fascia a dominating appeal. A similar design can be seen on Chevy’s larger Silverado making the design ethos cohesive across the range. Also new for 2021 is the “Chevrolet” badge spelled out and the “bow-tie” being offset to the side. Instead of a solid design, the logo is actually hollowed out in order to improve airflow, Chevy calls it the “flow tie.” The rest of the design is largely familiar to the outgoing model with similar projector headlamps, which, is more of a sore thumb by 2021 standards.
That said, the contoured front bumper design enhances the overall presence since it exposes a portion of the massive front tires. The side profile is reminiscent of previous Colorados and so is the rear tailgate. Side exit exhaust further adds to the drama along with a fixed spare wheel on top of the bed and adjustable auxiliary lights mounted on the exterior roll cage. Interiors have no noteworthy highlights and carry over the existing design, which is really a shame given most of its competitors offer a slightly better interior ambiance. As standard, the 2021 Chevy Colorado ZR2 gets an 8-inch touchscreen infotainment with Android Auto and Apple CarPlay. Every other function seems rudimentary and the available smartphone integration does improve the infotainment’s user interface. The lack of modern driver-assistance tech is also one of its shortfalls which we hope GM will be addressing in future models.

The 2021 Chevrolet Colorado ZR2 comes at a starting price of $41,600 for the extended cab and $43,200 for the crew cab. In its ZR2 guise, the Chevy Colorado gets a host of accessories as standard. Painted stainless steel tubular rocker protectors and a full suite of skid plates along with off-road spec DSSV dampers are standard equipment. In addition to this, the ZR2 gets a 3.5-inches wider track, increased ride height of two-inches, and an optional snorkel. Wide Goodyear off-road spec tires are available for the ZR2. Couple that with its capable powertrain, the Chevrolet Colorado ZR2 has enough oomph to get you through the gnarliest of terrains without much drama.

BMW Ponders Batteries for 2021 EVs, Says Solid State Isn’t Ready

This week, Colorado company Solid Power announced that it will partner with BMW to develop solid-state battery technology that could bring increased driving range, longer battery life, and better temperature tolerance to electric cars. The German automaker will invest an undisclosed amount in Solid Power, intending “to advance its technology in order to achieve performance levels required for high-performance electric vehicles.”

Although there’s a lot of buzz about solid-state batteries of late—and Toyota might have added to that in recent months—don’t expect BMW to bring the technology to production any time soon. Klaus Fröhlich, the BMW board member in charge of development and R&D activities, said that he doesn’t expect solid-state tech in a production vehicle from the company until at least 2025—partly because the temperature requirements remain too limited.

Mass-market deployment won’t be until at least 2030, Fröhlich anticipates, in part because lithium-ion batteries keep getting better. Energy density is increasing 30 percent every two or three years, he told C/D, while costs fall significantly.

BMW has put a tremendous engineering effort into developing proprietary battery modules that can be packaged into liquid-cooled battery packs of varying size and shape depending on the vehicle. “With the modules, you control the life cycle, the aging of each cell���so you can reduce cost or increase function,” he explained.

“What’s important is that I always use the same module,” Fröhlich explained. “I have a high module for SUVs, and I have a low module for sedans or perhaps sports cars.” The automaker, he said, worked especially hard on the lower-profile battery pack.

Regardless of the shape, the modular strategy better accommodates the nearly continuous improvement of lithium-ion cells. “Every two years, when I have an update on the cell chemistry, I could roll it out, within some months, to the whole portfolio,” Fröhlich said.

A Gen 4 battery will soon be deployed to the refreshed i8 roadster and i8 coupe, less than 12 months after the i3, which reaps those same chemistry changes, hits the market. Looking ahead to Gen 5 and the full modular approach, BMW points to the Vision Dynamics concept, revealed this fall at the Frankfurt auto show as well as at the Los Angeles auto show. It’s an all-electric sports sedan with a 370-mile driving range that goes from zero to 60 mph in less than four seconds and offers a top speed of more than 125 mph.

Instead, it has established a $240 million Battery Cell Competence Center next to its R&D center in Munich, where the aim is to build prototype cells, modules, and battery packs and lay out how they’ll be assembled for vehicles. According to Fröhlich, BMW is looking for an approach that’s a bit like the Apple manufacturing ecosystem. “The battery is not produced by Apple, but all the manufacturing details are defined by Apple,” he said, dodging a question about Chinese supply for North America. “So that’s what we intend to do, because manufacturing has such an impact on function, quality, and cost.”

As for the cell format, BMW is hoping for a good automotive-duty prismatic cell—the rectangular sort used in some personal electronics—because packaging is compact and more easily protected from intrusion. But it also could embrace pouch style batteries—the form used in the Chevrolet Bolt EV and Kia Soul EV, for instance—if the next-generation version becomes the prevalent one. The one battery format BMW simply won’t use is the cylindrical one—as Tesla embraces for all of its models—because cooling and packaging become more challenging. “The active material is only a third [by volume], and we have prismatic at more than 40 percent,” Fröhlich explained. “So if you want the same energy density you have to have an aggressive chemistry, with all the risks.”

Conceived for far higher production volumes—and to be scalable to work with all of BMW’s models, including battery-electric vehicles and plug-in hybrids—this new modular electrification kit incorporates the motor, drive gearing, and power electronics as a single, integrated core component. It draws power from a battery module that isn’t bound to any one model or purpose.

Battery packs remain the most expensive of the major components in electric cars. BMW has put a tremendous engineering effort into developing proprietary battery modules that can be packaged into liquid-cooled battery packs of varying size and shape depending on the vehicle. “With the modules, you control the life cycle, the aging of each cell—so you can reduce cost or increase function,” he explained.

“What’s important is that I always use the same module,” Fröhlich explained. “I have a high module for SUVs, and I have a low module for sedans or perhaps sports cars.” The automaker, he said, worked especially hard on the lower-profile battery pack.

Regardless of the shape, the modular strategy better accommodates the nearly continuous improvement of lithium-ion cells. “Every two years, when I have an update on the cell chemistry, I could roll it out, within some months, to the whole portfolio,” Fröhlich said.

BMW has already been trying this on a smaller scale with its i3 and i8. A Gen 4 battery will soon be deployed to the refreshed i8 roadster and i8 coupe, less than 12 months after the i3, which reaps those same chemistry changes, hits the market. Looking ahead to Gen 5 and the full modular approach, BMW points to the Vision Dynamics concept, revealed this fall at the Frankfurt auto show as well as at the Los Angeles auto show. It’s an all-electric sports sedan with a 370-mile driving range that goes from zero to 60 mph in less than four seconds and offers a top speed of more than 125 mph.

Actually making battery cells, modules, and packs in much higher volumes is another hurdle. “I have to define my format for the next 15 years. Because the architectures, and all the factories—the gigafactories—they can’t move,” said Fröhlich.

Aping Apple -

BMW isn’t going to get directly involved in the battery-cell business. Instead, it has established a $240 million Battery Cell Competence Center next to its R&D center in Munich, where the aim is to build prototype cells, modules, and battery packs and lay out how they’ll be assembled for vehicles. According to Fröhlich, BMW is looking for an approach that’s a bit like the Apple manufacturing ecosystem. “The battery is not produced by Apple, but all the manufacturing details are defined by Apple,” he said, dodging a question about Chinese supply for North America. “So that’s what we intend to do, because manufacturing has such an impact on function, quality, and cost.”

As for the cell format, BMW is hoping for a good automotive-duty prismatic cell—the rectangular sort used in some personal electronics—because packaging is compact and more easily protected from intrusion. But it also could embrace pouch style batteries—the form used in the Chevrolet Bolt EV and Kia Soul EV, for instance—if the next-generation version becomes the prevalent one. The one battery format BMW simply won’t use is the cylindrical one—as Tesla embraces for all of its models—because cooling and packaging become more challenging. “The active material is only a third [by volume], and we have prismatic at more than 40 percent,” Fröhlich explained. “So if you want the same energy density you have to have an aggressive chemistry, with all the risks.”

Battery aside, BMW is looking to innovate in other ways. For instance, the new modular electric powertrain that arrives in 2021 will include a high-efficiency current-excited motor that, unlike permanent-magnet designs, isn’t dependent on rare-earth elements.

Charging remains a wildcard. BMW will start with a 400-volt architecture in 2021 with the modular platform (and likely 150-kW fast charging, which could return about 200 miles of range in a half hour); but switching to 800 volts (to keep up with the upcoming Porsche Mission E) isn’t a big deal, Fröhlich said.

Toyota Turns to Mazda for Help with Tacoma
The Toyota Tacoma is losing market share to the Chevy Colorado and Honda Ridgeline. This isn’t happening because people are losing interest in the venerable Toyota, but because Toyota can’t build them fast enough.
There’s a shortage of Tacomas at dealerships around the country, and buyers are turning to some very worthy competition instead of waiting for Toyota to catch up and deliver more trucks. This is a problem that’s new to Toyota, as decent competition in the midsize truck market hasn’t been a concern since… well… ever.
What’s Toyota’s plan to prevent more buyers from crossing over to competing brands?

The Japanese automaker has struggled to crank out enough of the segment-leading midsize pickup at its Texas and Mexico factories, even with years of overtime. Now, thanks to the partnership announced last week with Mazda, Toyota North America CEO Jim Lentz is prepared to turn on the spigot to fend off midsize pickup challengers.
Toyota will build a $1.6 billion U.S. auto plant at a site to be chosen in a 50-50 partnership with Mazda that nets each of them 150,000 vehicles a year in additional capacity. Production at the plant is to start in 2021.
Toyota has taken a 5 percent stake in Mazda as part of the deal to build the plant. The new U.S. plant, though, won’t build Tacomas. Instead, Toyota will move some Corolla production from Mexico to the new Mazda/Toyota plant and use the freed-up capacity in Mexico to build more Tacoma trucks for import into the United States.
The Tacoma production problem is indicative of a larger trend in which buyers are abandoning compact sedans for trucks and SUVs. Toyota has already had to figure out how to increase production of the Highlander, RAV4, and C-HR to meet demand while decreasing output of sedans.
A higher volume of Tacomas won’t start rolling into dealerships until 2019 or 2020, which is a lot of time for competing trucks to continue making up lost ground.
