Reducing your Australian tax bill through a fancy offshore tax haven is appealing. And, the idea that up to half of your wealth will be taxed on income to the Australian government is not appealing to many business-minded families in Perth and across Australia.
In this blog we will consider how income in tax havens is taxed, what people when they have a tax haven, and alternative options to people who are looking at tax havens.
What is a tax haven?
A tax haven is a country with either no or very little tax.  Some countries have a higher tax rate, but if you do something, they will lower their headline tax rate to attract you to invest in that country.
Sometimes they offer no tax if you employ a minimum number of people in their country.
What is not a tax haven?
Australia has different tax laws with different countries.  However, if you have money and assets invested in the following countries, your Australian tax risk is reduced:
Germany
France
Canada
Japan
New Zealand
United Kingdon
United States of America.
Who deals with tax havens?
Many countries and their tax advisors will strongly suggest that they are not tax havens but lower-tax countries.  Luxemburg has previously been considered a tax haven. Still, they are now part of the European Union – so they cannot act as a tax haven under their membership requirements for the European Union.
So, who deals with a “tax haven” is not restricted to a country or a person. The simple act of dealing with a tax haven, or a country with lower taxes, does not make a person a good taxpayer or a bad taxpayer—they are simply dealing with a country that is not Australia.
If you run a boat charter business in the Cayman Islands, you might simply be leveraging their beautiful coastline and growing tourism business.
What is the best way to deal with a tax haven?
Suppose you want to use a tax haven. In that case, the best way is to leave Australia forever and not be an Australian tax resident – think Novak Djokovic, a tax resident of Monaco, and Sean Connery, a tax resident of Switzerland.
So, the ideal solution is to leave the country, sever your ties to Australia, and make the tax haven your home. This solution works for globally mobile families.
If you have no money in Australia, and no connection to Australia, Australia cannot tax you.
If you leave Australia and become a non-resident of Australia, the Australian tax regime will still tax your Australian assets.  So, if you have an Australian rental property, the income from that property will still be taxed in Australia.  Suppose you have Australian shares on the ASX. In that case, you can pay capital gains tax when you become a non-resident at the market value of the shares, or you can keep those shares within the Australian tax net, so they continue to be taxed within the Australian tax system.
So, to use a tax haven properly, you would also sell all taxable Australian assets, such as real estate and privately held shares, and not generate income from those assets.
What happens if you have income generated from a tax haven?
Suppose you’re an Australian tax resident with investment income generated in a tax haven. In that case, that income will likely be deemed your Australian income – using the tax haven to quarantine taxable income away from Australia will not work.  The income will be attributed to you, through the tax haven, and you will pay tax in Australia.
If, after you have paid Australian tax on the income, the tax haven transfers the taxed income to you, the cash payment of that money transferred will not be taxed again.  Australia won’t tax your income twice.
If the tax haven applied some minor tax rate (say 2%) on the monies sent back to you, you might enjoy a reduction on your Australian tax payable.
How do some people hide their income in a tax haven?
They don’t. The ATO is very sophisticated at detecting hidden money, and a range of smart people who have hidden money now look silly—think Project Wickenby.
If you engage a stranger as your front person, you commit a criminal act. Sadly, the world is full of stories where the stranger either steals your money or, when asked by the ATO to reveal who they are acting for, gives them your name.
What is the best tax haven I can consider from Perth?
The best tax haven is your superannuation fund. As a couple, you can have $3.8m invested, and when you are over 60, the entire income generated on your superannuation fund monies is entirely tax-free. The income and capital the superannuation fund pays to you are also tax-free.
Further, any underlying tax companies pay (think franking credits) is also fully returned to you.
So, if your $3.8m superannuation fund generated a franked dividend of 4%, you will enjoy an income stream of $152,000 from your investments. The government will then refund you $65,142 as a refund of your franking credits.
Your tax rate, when appropriately structured, is negative 42.8%. This compares to a personal income tax rate of positive 2.5% in Liechtenstein.
You could also own another $1m personally outside the super fund earning, say 5%, as a couple and not pay tax.
So, you can earn $192k and enjoy a negative tax rate of 42.8%.
What other Australian tax havens exist?
The sale of the family home as your main residence is also tax-free.  This tax-free gain you make is not capped, so if you sell the family home with a profit of $10,000 or $10m, you will not pay tax on the profit.
If we compare the generous Australian tax position to the USA, the ability to enjoy tax-free profits on the sale of the family home is capped at USD 500,000 a couple.
Using the family home to shelter wealth from taxes is a significant tax haven that is only sometimes available in other countries.
Comparing countries and tax regimes
Many find the Australian headline tax rate of 47% intimidating. However, it is also worth noting that our tax rate is final. Australia does not have a state income tax system, and we are often quoted the Federal tax rate of other countries but not the differing state income tax rate.
For example, the highest US tax rate is 37%, so it looks like people are getting a better deal. However, California’s highest state tax rate is 13.3%, so the combined tax rate for a person in California is 50.3%.  This rate should be compared to the Australian rate of 47%.
Further, Australia does not have death taxes. In comparison, the UK has a death tax of 40% of the estate value over 500,00 pounds if the estate is left to a child.  Admittedly, we can have a hidden death tax in a superannuation fund, but this can be managed with smart tax advice from your Perth tax accountant.
Australia also does not have a social security tax.  French residents’ social security tax rate is roughly 13% to 40%, depending on their income.  So, comparing the French Federal tax rate is not appropriate.
It is also worth knowing that nothing is for nothing.  Many tax havens apply no taxes at all to attract investment; however, to qualify for a zero-tax outcome, you are committed to spending a minimum amount of money in that country.  So if you have a team of people working for you in another country, you might need to consider the tax impacts before hiring staff internationally.
How to generate taxable income in a tax haven safely
If you run a business in another country through a permanent establishment, prepare sound business records, and keep the business profits in that country, Australia typically won’t tax them until they are sent to you as a dividend.
So, if you have a coffee shop in Monaco selling coffee to local people, the profits from your coffee shop are legitimate trading profits, and Australia won’t tax them. However, if the Monaco business is somehow connected to Australia, such as buying Australian coffee beans for free, then you will have significant tax problems. 
Managing your taxes
The tax rates of countries where it is easier to generate income are generally higher. The infrastructure of countries like the USA, Australia, Germany, and the UK makes it easier to make profits in those countries, and those countries generally have a higher tax rate.
The infrastructure support of, say, the Cayman Islands generally makes it harder (not always) to generate income. Those countries use lower tax rates to attract foreign investment.

How About A Caribbean Vacation?
Let us day dream for a while, shall we? Close your eyes for a moment and just imagine… white sand beaches, beautiful blue translucent waters and the sun brightly shining on the horizon, and a breeze going through your hair.
Can you hear the wonderful dance of the waves? How peaceful! There are no worries or cares in the world to disturb you. It is a perfect environment for relaxation and gives you a great sense of well-being.
The Caribbean is the number one destination for travelers around the world. Whether you are escaping just to be alone with your better half or taking your whole family there, the bright sun, warm waters, breathtaking landscapes of the islands make the ideal setting for a vacation that can be as luxurious, adventurous, peaceful or wild as you wish.
Let me give you an idea of what you may encounter in at least ten of those islands and what makes them so desirable:
Anguilla is a British oversees territory. It is known for its coral reefs. It has a quiet atmosphere and offers excellent snorkeling, horseback riding and bird watching (136 species).
Aruba is a favorite port for cruise ships. It has a Dutch feel. It offers many water sports activities Cayman boat rentals, including some of the best windsurfing in the world. Belize, formerly called British Honduras, has excellent fishing, safe waters for boating, scuba diving, and snorkeling, numerous rivers for rafting, and kayaking, various jungle and wildlife reserves of fauna and flora, for hiking, bird watching, and helicopter touring, as well as many Maya ruins. It also has the largest cave system in Central America.
Grand Cayman is the best known of the Cayman Islands and it is home to the blue iguanas. Its capital city is George Town which is a shopping paradise. In addition to its shops, there are many local vendors and craftsmen throughout the districts who work from their homes. An amazing variety of local treasures await you, including shell jewelry, thatch work, wood carvings, crocheted items, pepper sauces, tropical fruit jams, honey and special figurines made out of Cayman's semi-precious stones.
Jamaica's scenery is a blend of fish-filled coral reefs, white-sand beaches, breathtaking waterfalls and thick rain forests. It is another destination for water sports lovers, including sailing, scuba diving, jet skiing, para sailing, sport fishing, and glass-bottom boat excursions. The music is simply contagious. The Jamaican people represent one of the most diverse populations in the Caribbean, coming from African, Chinese, Indian, British and German heritage.
Martinique is a French island. Its cuisine is a blend of French and Creole cooking that is well worth trying. The northern part of the island attracts tourists who are looking to hike the mountains around Mt. Pelee, an active volcano, and explore the rain forests, while the southern portion offers shopping, white sand beaches, and nightlife which takes on many forms including nightclubs, piano bars, lounges, hotel events/parties and casinos.
Tobago is home to over 6000 species of plants and animals, including one of the highest densities of bird species in the world, on just 116 square miles of land. So, it is a must for bird watchers. Ahhhh, what a lovely warm thought, yesssss gimme gimme I wanna talk about Daddy James!
The first thing that comes to mind is taking time off of work, going on a trip of sorts. That’s so so rare for James but Steve would want to ensure it happens. They’re sitting at dinner, things are quiet. James has taken a few calls, Steve being incredibly understanding, such a sweet baby. They’re tucking into their meal when Steve hums.
“Your birthday is in a month.”
“No shit, doll? You’re right aren’t you? Damn.”
“I’d like to go somewhere, plan something. You never take off work. Let’s celebrate.”
It’s so simple and direct and James immediately wants to put up a fight but what is James supposed to say? He’s sitting across from his baby who has shown him so much grace and has been so patient tonight and is looking at him with those vibrant puppy dog eyes and what? He’s supposed to say no?
And then Steve tacks on a—
“Please, Daddy...?” and James is done for.
Steve goes bananas. Daddy gives him free reign to do whatever he’d like to do, money not a concern, which...makes Steve go hella sweet but that’s not the focus of this answer. He has Sam help him reason through different destination options, has 46 tabs open on his laptop as he scours reviews and experiences. After they narrow it down to three, he makes an Executive Baby Decision and chooses the Cayman Islands. He wants to wear tiny trunks, wants to watch others fawn over his burly buff boyfriend (shirtless or draped in linen) and wants to drink Rum until it’s part of his bloodstream. A vacation to Switzerland can wait.
James isn’t surprised by the choice. He figured Steve wanted to go somewhere warm and sunny, has been hinting at it for months, has been purchasing these tiny and questionable Speedos and floral button-up shirts for weeks now.
“That sounds like a great idea, baby. You gonna surprise me, huh?”
“Gonna plan it all out. Don’t need to worry about a thing, Daddy...”
Steve. Plans. Everything. He reserves the hotel, the cabana, the excursions, the flights, a few dinners. He is a godsend and plans some major things but leaves their schedule open because that isn’t the point of their vacation. The point is to relax and enjoy themselves and each other.
Steve has never ever seen his Daddy so relaxed in the entire time he’s known him. There are no harsh line to his shoulders, no tension in his jaw. There is a point where Steve has to be clear with James, honest, and tell him that Steve spent a lot of time planning this out and that it would mean so much to Steve if Daddy could not focus on his phone or work. After a profuse apology, cheek kisses and a promise it is done, no questions asked. Steve has never had James like this. In fact, they’ve never even spent this much time together at one time.
Stevie Baby is in heaven.
They spend the first day on the beach and fucking in the hotel room. What is Daddy supposed to do when Steve has been teasing him relentlessly, both inadvertently and purposefully? Seeing damn near every inch of Steve’s creamy skin on full display as he stretches under the sun and in the sand makes James unbearably hard under the trunks Steve chose for him to wear.
“Should’a just fucked you and this tight little body right there in fron’a God and everybody on that beach, shouldn’t I have? Bet your little dick gets so hard just thinking about people seein’ you get fucked by your Daddy. Words, baby use your words.”
But words are hard when Daddy has you laying on the floor of your hotel room as his fingers press between your lips, stroking your tongue as you drool.
The boat rental is James’ favorite. They take it out to snorkel around and go sightseeing, hopping from place to place all day, drinking and snacking. Steve looks like absolute perfection in the water, natural swimmers body and all, boyish charm, pretty tits. The more liquor that enters James’ system the more handsy and territorial he gets, grabbing for Steve and sucking kisses onto his jaw, squeezing at handfuls of ass. James gags for the way his baby feigns embarrassment, for the way he gasps and giggles and tells Daddy no. Steve already included a stupid amount of money for a tip for the few workers who are accompanying them so James doesn’t feel too bad when he has Steve crawl on top of him and ride Daddy into the sunset, has him fulfill his little exhibitionist dream.
It rains on James’ birthday. It’s a bummer but the two of them are a bit relieved to have a day they do nothing. They draw the curtains and sleep in late, well passed 9 AM, which for James is late. It’s goddamn impossible to not wake up hard and achy when you wake up next to one Steve Rogers, curvy and muscly and running warm all over. Steve is slipping down Daddy’s thick form, sloppy kisses down his tummy, and his lips are wrapped around Daddy’s cock before he even properly wakes up.
“Happy Birthday, Daddy,” Steve whispers into James’ neck after he’s swallowed his mouthful like a good boy, snuggles in tight for another round of slumber.
James is in heaven.
They order room service, a ridiculous amount of food, munch all day. The room is cold and they’re warm under covers, TV on. Steve brings a little something special for the occasion, a little silky number that’s made up of intricate strings that come together and barely cover up Steve’s prick, his bitty hole. It snatched his waist and makes his shoulders looks delicate and don’t get Daddy started on his perky tits and how he looks like a dame. It’s navy blue and hugs him like sin all over and it’s such a damn shame that Daddy ruins it when he rips at pieces of it, tugs, pulls and wraps said pieces around Steve’s neck.
Steve comes gasping and choking, Daddy murmuring in his ear about how much he loves Steve, how thankful he is to Steve for setting this up for him. He comes with Daddy telling him he’ll buy Steve a thousand more lacy numbers and he’ll shred the others with his bare hands in the same manner. He’ll do anything for and everything he wants with Steve.
The rain has passed by the time their dinner reservation comes around. It’s a little breezy and smells of rain and Steve gets to eat from James’ hands and the two of them have never been so happy.
It the best birthday James has ever had.
