Despite the Covid-19 pandemic, many schools plan on reopening in the fall. There is still no vaccine or cure for Coronavirus. In the result of an outbreak at a certain school district, would that district be liable for the damages caused by the virus?

In some cases, schools can be sued for negligence. Negligence is a tort in personal injury law where somebody is sued for not taking the proper precautions which results in somebody getting injured[3]. In negligence cases, the plaintiff has to prove that the defendant had a duty to protect them from injury and that they breached this duty. The defendant would have to claim that the fault belonged to the plaintiff or that there was an assumption of risk associated with the activity[5]. When it comes to school, most negligence cases involve improper supervision when a child gets injured. Schools could also be in legal trouble if a teacher purposefully inflicts emotional distress on their students.[6]Schools could also be found liable if students get sick due to the food that a school serves. For example, if a student gets E.Coli from something that was served for lunch at school, the school would be liable[4]. But, in most cases, common sicknesses like a cold or the flu would not be grounds to sue the school because there is always a risk, no matter where you go, that you could catch a cold or the flu. There is an assumption of risk in these situations. What makes the Coronavirus different is that it can have long-lasting and deadly effects[1]. Most schools are trying to make as many precautions as possible when reopening. But, schools may have to do more in order to be protected from a lawsuit. Even with all of the precautions that they take, they are still bringing kids into a closed environment and expecting them to be safe and socially distanced and wear masks. If schools do not have a better way of enforcing these rules, they may be susceptible to a lawsuit. If an outbreak does occur, the school would be liable because they did not take enough of a precaution to keep this from happening. Even if a child chooses not to wear a mask in the hallways, parents could argue that a teacher should have told the student to keep their masks on. If schools do not have some way of enforcing Covid-19 guidelines, then they should be sued.

Some schools are aware of this and are looking to get protection from the state. They want to be protected from lawsuits as long as they make a good attempt at preventing an outbreak[2]If the state was to approve this, schools would not be liable for any damages because they would be protected by the state. If this were the case, the state would have to prove that the schools did as much as they could to protect students from an outbreak.

If public schools do not get protection from the state, the threat of litigation may coerce schools into staying online. If these schools were to be sued, they would most likely lose more money than they would if they were to stay online.

The incident happened at around 1:30 p.m. August 15, near the Black Diamond bridge. The train belonged to Norfolk Southern Corp and was traveling north to Binghamton, N.Y.

The unidentified man suffered major injuries and was rushed to Geisinger Wyoming Valley Medical Center in Plains Township.

The man, however, was conscious when he was found by the emergency crew. The man denied that he was hit by the train, but the train engineer confirmed the incident. The company’s spokesperson reported that the crew applied emergency brakes but was unable to stop the train before it struck the man.

The victim was identified only as a white male in his 20’s.

His medical condition was not immediately available.
