Podemos desfazer a privatização. E não nos custará um centavo

A propriedade pública está novamente na moda.
Transferir os ativos públicos da Grã-Bretanha, bloquear, armazenar e barrá-los para a iniciativa privada e confiar apenas na regulação leve para garantir que cumpram amplamente as obrigações de administrar serviços interesse público foi sempre uma aposta arriscada.
E essa aposta não valeu a pena.
Pesquisas recentes mostram surpreendemente que 83% são a favor da nacionalização da água, 77% da eletricidade e do gás e 76% do transporte ferroviário. Não é só isso que representa uma queda geral na confiança nos negócios. As empresas de utilidades privatizadas são sentidas pela população em uma categoria diferente: são serviços públicos e há uma visão generalizada de que as metas de lucro exigidas pelos acionistas anularam obrigações de serviço público.
E o público está certo.
A Thames Water (companhia de abastecimento e tratamento de água que atende a Grande Londres), sob propriedade do capital privado, tem sido o exemplo mais flagrante, acumulando dívidas de alta velocidade, pois distribuiu dividendos excessivos aos seus acionistas através de uma holding no Luxemburgo, um movimento destinado a minimizar as obrigações fiscais do Reino Unido. Segundo dados destacados no relatório Cuttill, com as taxas de investimentos atuais, a Thames levará 357 anos para renovar a rede de água de Londres, enquanto o Japão leva 10 anos.
Do mesmo modo, o investimento da BT na cobertura universal de banda larga de alta velocidade tem sido lento e inadequado, enquanto alguns argumentariam que o primeiro alvo dos operadores ferroviários foi um serviço de passageiros de qualidade —culminando com o escândalo mais recente da Stagecoach e Virgin escapando de seus compromissos contratuais .
A maioria dos viajantes, lotados em trens caros, tornaram-se fãs cada vez maiores da propriedade pública. A popularidade do compromisso de Jeremy Corbyn (atual líder do Labour Party e líder da oposição na Câmara dos Comuns) com a renacionalização foi surpreendente.
O problema na nacionalização é ser cara: pelo menos £ 170 bilhões na maioria das estimativas. É claro que o aumento proposto da dívida pública em cerca de 10% do PIB será acompanhado pelos ativos estatais de 10% do PIB, mas a contabilidade pública britânica não é tão racional. A ênfase será sobre a dívida, não sobre os ativos e, em qualquer caso, há melhores causas —despesas de infraestrutura— para aumentar os níveis da dívida pública. E uma vez que é propriedade pública, as indústrias recém-nacionalizadas voltarão a estar sujeitas aos limites do empréstimo do Tesouro. Se houver cortes de gastos, seus programas de investimento de capital serão cortados.
O que os eleitores querem é o melhor dos dois mundos.
Os serviços públicos são administrados como serviços públicos, mas com todo o dinamismo e autonomia de estar no setor privado, não menos do que isso também para o investimento ser vital. Parece impossível, mas propostas do Big Innovation Centre’s Purposeful Company Taskforce, mostram que existe uma maneira de reter esses objetivos aparentemente inconciliáveis —e sem gastar dinheiro. O governo deve criar uma nova categoria de empresa —a empresa de benefícios públicos (PBC, na sigla em inglês)— que escreveria em sua constituição que seu objetivo é a prestação do benefício público ao qual a lucratividade é subordinada.
Por exemplo, o propósito de uma empresa de água seria entregar a melhor água o mais barato possível e não retirar dividendos excessivos através de um paraíso fiscal.
O próximo passo seria estabelecer uma fundação para cada empresa de utilidade privatizada como condição para obter licença de operação, exigindo que seja incorporada como uma empresa de benefícios públicos. A participação da fundação daria ao governo o direito de nomear administradores não executivos independentes, cujo papel seria verificar se os objetivos de interesse público do PBC estão sendo cumpridos como prometido. Isso incluiria assegurar que a empresa permaneceu domiciliada no Reino Unido para fins fiscais e garante que os consumidores, os interesses sociais e público foram priorizados.
Os diretores não executivos se envolveriam diretamente com os grupos de defesa do consumidor cujo mandato é ser uma caixa ressonante dos interesses dos consumidores, mas, no momento, são pouco mais do que lojas falantes que entregam um relatório independente a um escritório de serviços públicos a cada ano, confirmando que o interesse público está sendo correspondido.
É importante ter um terceiro ator independente: os reguladores, por mais que tenham boas intenções, facilmente vêem o mundo do ponto de vista da indústria regulam. Como as empresas permaneceriam de propriedade de acionistas privados, seus empréstimos não seriam classificados como dívida pública. Portanto, não haveria a necessidade de compensá-los —em suma, de pagar £ 170 bilhões na compra dos ativos de volta.
Na verdade, o escopo de empréstimo poderia ser usado para financiar uma onda de novos investimentos em nossos serviços públicos. Mas a obrigação da nova empresa seria para os seus usuários em primeiro lugar, e seria livre para emprestar sem qualquer restrição do Tesouro.
Nem qualquer secretário de estado seria atraído para o funcionamento operacional das indústrias —uma das principais razões pela qual a nacionalização do estilo Clement Attlee (estadista britânico) falhou.
Inevitavelmente, as decisões se politizam.
O objetivo seria combinar o melhor dos setores público e privado. Se as empresas não entregarem o que prometem, deve haver um sistema bem definido de penas escalonadas, começando com o direito de processar e terminando com a tomada de todos os bens em propriedade pública se negligenciar persistentemente suas obrigações.
Nesse último caso, o custo para o Estado será muito menor, porque o preço da ação cairá, ficando comprovado que estava operando sob condições ilegais. A Grã-Bretanha criaria uma nova classe de empresas.
Na verdade, há a oportunidade de começar agora.
Se Virgin e Stagecoach não puderem cumprir suas obrigações contratuais na linha East Coast, a empresa deve ser reincorporada como uma empresa de benefícios públicos. Os acionistas permaneceriam, mas o conselho recém-constituído tomaria todas as decisões de interesse do público dos usuários de transporte garantido pelos diretores independentes, os grupos de defesa do consumidor e os serviços públicos - para que o contribuinte possa confiar ou gastar seu dinheiro devidamente.
Corbyn e John McDonnell (Labour Party) têm uma maneira de entregar o que o eleitorado quer —e ainda manter as indústrias fora do balanço público.
