In its 2019 judgement, the Supreme Court paved the way for the construction of Ram Temple at the Ram Janmabhoomi-Babri Masjid site. The top court also ordered the allocation of a five-acre plot to the Sunni Waqf Board for a new mosque. The Ram temple construction has been progressing as per the schedule and is likely to meet its December 2023 deadline. However, three years after the top court settled the dispute, construction for the proposed mosque complex at Dhannipur village near Ayodhya was yet to begin.

Among the 32 people facing trial in the case are veteran BJP leaders Lal Krishna Advani, Murli Manohar Joshi, Kalyan Singh and former Union minister Uma Bharti, and sitting MPs Brij Bhushan Singh and Sakshi Maharaj. The Supreme Court Friday extended the deadline for a special CBI court in Lucknow till August 31, 2020 to deliver the verdict in the Babri Masjid demolition case, in which senior leaders of the BJP and VHP are accused. A bench comprising Justices R F Nariman and Surya Kant observed that the trial court judge should use video conferencing facilities to complete the proceedings. The apex court said that the trial judge should ensure that the present deadline is “no longer breached”, Live Law reported. After the demolition of Babri Masjid on December 6, 1992, two cases were filed in Ayodhya — one related to the conspiracy of demolishing of Babri Masjid and another for instigating the crowd to demolish the structure. Around 47 more cases were lodged then that were merged with the case of demolition. The trial in the two cases was held separately. The one in Lucknow court on charges of conspiracy of the demolition of the structure, and the other in Rae Bareli court for instigating the crowd to demolish the structure. Of the 22 persons, who were facing trial in the Lucknow court, one has died. The prominent persons among the remaining 21 accused are Pawan Pandey, Brij Bhushan Singh, R N Srivastava, Lallu Singh and Sakshi Maharaj. R N Srivastava was then District Magistrate of Faizabad. In Rae Bareli court, six were facing trial after the death of two accused — Acharya Giriraj Kishore and Ashok Singhal. VHP leader VH Dalmia, an accused in the Rae Bareli case, died last year, following which five accused were left that include Lal Krishna Advani, Murli Manohar Joshi, Vinay Katiyar, Ritambhara and Uma Bharti. On April 19, 2017, the Supreme Court ordered the clubbing of the two pending cases and set up a Special Court (Ayodhya Prakaran) in Lucknow to conclude the hearing. The top court had also ordered the restoration of charges against 13 accused, who were dropped from the case by the High Court earlier. Seven of the total 13 accused have died, including BJP leader and former MP Baikunth Lal Sharma. Six persons who are now facing trial are Ram Vilas Vedanti, Champat Rai, Mahant Nritya Gopal Das, Mahant Dharam Das, Satish Pradhan and the then UP CM Kalyan Singh. The Supreme Court also ordered adding of criminal conspiracy charge (IPC Section 120B) against the accused facing trial in Rae Bareli. Meanwhile, Kalyan Singh, who had immunity as the Governor of Rajasthan, appeared before the special trial court in September last year after his term ended. He is currently on bail. NEW DELHI: The Central Bureau of Investigation is busy preparing detailed questionnaires to confront all the 32 accused in the Babri Masjid demolition case, even as the recording of their statements may now get delayed due to the nationwide lockdown.
A special court in Lucknow was to record their statements starting Tuesday, when one of the three accused initially summoned by the court was to appear before it. The agency had prepared a list of over 1,000 questions to confront the accused, Vijay Bahadur, said people with direct knowledge of the matter. They indicated that other accused, including top BJP leaders such as LK Advani, Murali Manohar Joshi, Uma Bharti and Vinay Katiyar, would also likely be confronted with thousands of questions.
To ensure that no time is wasted on account of unavailability of an accused on a given date, the agency will submit names of at least three accused to the court for summoning at a time. “It may so happen that on a given date, one accused is unavailable. The court, in that eventuality, will summon the other accused so that the trial is not delayed,” a senior official said, requesting anonymity.
After more than a decade since the Babri Masjid trial commenced, the court was set to record the statements of the accused for the first time under Section 313 of the Criminal Procedure Code.
In a related development, the special CBI court is likely to seek a final extension from the Supreme Court to conclude the trial.

On April 19, 2017, the SC had ordered day-to-day trial to be concluded in two years in the case. On July 19, 2019, it extended the special CBI judge’s tenure till the completion of the trial and delivery of verdict. The apex court had said the extension of the tenure of the special judge, who was to retire on September 30, 2019, would only be for the purpose of concluding the trial and delivering the verdict in the case. The judge was also asked by the top court to deliver the verdict within nine months. That deadline is April 18.
“Given the voluminous record and evidence, it is impossible to conclude the questioning of the accused by then. The entire procedure (of recording statements of the accused) may take around four months. Hence, the court will have to seek an extension from the apex court,” said another official, who also spoke on the condition of anonymity.
