"Ex-Gratia Claim Denied: Delhi High Court Upholds Government Policy in Anganwadi Worker’s Case"

The *Case I am sharing today takes us back to the Covid-19 phase and involves interpreting the "Cabinet Decision dt. May 13, 2020", taken by the "Government of NCT Delhi".⬇️

➡️ Whether duties like distributing ration and participating in immunization camps constituted "COVID-19-related duties" as per the Cabinet Decision. [Definition of "#COVID19duty"]

➡️ Whether the nature of Late Mrs. Seema Khan's work during the pandemic met the criteria for compensation, which required direct involvement in COVID-19 relief efforts such as treatment, facilitation, or care of COVID-19 patients. [Eligibility for #exgratiacompensation]

➡️ The petitioner(daughter), Subata Khan, sought a directive for ex-gratia compensation of ₹1 crore under a **Cabinet Decision of dt. May 13, 2020. The claim arose from the COVID-19-related death of her mother, Late Seema Khan, an #AnganwadiWorker who actively participated in essential services during the pandemic.

◆ The **Cabinet decision approved ₹1 crore ex-gratia compensation for families of employees who died while on COVID-19 duty as defined by the policy, including roles such as patient care and containment zone duties.

➡️Late Seema Khan, an Anganwadi worker since 1982, provided essential services such as distributing nutritional food and participating in immunization camps during the pandemic.

► Contracted COVID-19 after performing these duties, tested positive on 6th April 2021, and succumbed to the virus on 17th April 2021.

➡️ It was contended on behalf of Late Seema Khan that her duties exposed her to infection, qualifying her as performing essential COVID-related services.

→ The denial of #compensation was arbitrary and lacked empathy, given the unprecedented hardships caused by the pandemic.

➡️The Group of Ministers (GoM) denied the claim, concluding that Late Seema Khan’s duties, while essential, did not meet the policy’s criteria of COVID-19-specific duties like patient care or containment zone work.

➡️The #DelhiHighCourt acknowledged the invaluable contributions of Anganwadi workers like Seema Khan but upheld the GoM’s conclusion.

→ It emphasized the distinction between routine essential services and COVID-19-specific duties as per the #CabinetDecision.

→ Seema Khan’s duties, while essential, were not in containment zones, patient care, or other defined COVID-19-specific tasks.

→ The exclusion of the late Seema Khan was based on the clear criteria within the Cabinet policy of the Government of NCT Delhi and was applied uniformly.

→  The government's compensation policy is framed for a specific purpose and applies only to those fulfilling the policy's conditions.

➡️The Delhi High Court dismissed the petition, holding that the GoM’s decision was not arbitrary and fell within the framework of the Cabinet policy.

Naveen Patnaik dismisses his Agriculture minister

Chief Minister of Odisha Naveen Patnaik has dismissed his agriculture minister Damodar Rout for making a remark on Brahman community.

Damodar das former Agriculture minister of Odisha. Naveen Patnaik tweeted that, "I strongly disapprove of anyone who makes derogatory remarks against any caste, creed or religion. I have dismissed Dr. Damodar Rout from the Council of Ministers. A letter has been sent this evening to the Hon’ble Governor to accept this dismissal." On 18th December, while attending a district level festival in Malkangiri district, Dr. Rout said that tribal people never beg even in very adverse condition but Brahmins beg for alms if the condition arises. This remark has drawn the severe critique and protest from the Brahman community during last few days. Dr. Rout is famous for making such remarks which have created trouble for Biju Janta Dal to remain in politics. In past, Dr. Rout has made a casteist remark against senior Dalit Leader of the party and faced a lot of protest against his statement. He has also faced criticism for making a remark on farmer suicides and Anganwadi workers in past.
