The Abuja Federal High Court has confirmed Julius Abure as the substantive Chairman of the Labour Party. In its judgment delivered by Justice Emeka Nwite on Tuesday, it confirmed the Abure-led leadership and the convention in Nnewi, Anambra State, held in March 2024. It ordered INEC to henceforth recognize him as the authentic chairman, overriding the earlier stance of INEC, which had declared Abure's leadership invalid. Read Also: BREAKING: Massive Protest as Thousands of Women in Black March Over Edo Election INEC had argued that the national convention of the Labour Party ran foul of the Constitution of Nigeria as well as the Electoral Act, and that the party failed to meet legal requirements for holding the convention. The Commission had claimed that Julius Abure was no longer the National Chairman of the Labour Party, as his tenure lapsed in June 2024. The commission announced this in a reaction to the suit filed by the Labour Party against their exclusion from INEC's refresher training for uploading party agents ahead of Edo and Ondo governorship election. Paul Biya, Africa’s Longest-Serving President, Dies The commission said the re-election of Abure as chairman at the Labour Party's National Convention in March 2024 ran afoul of the Nigerian Constitution and the Electoral Act, thus arguing such leadership of the party is null and that they only relate with parties with recognized leadership. Counsel to INEC, Tanko Inuwa, SAN, argued that the declaratory reliefs sought by the Labour Party cannot be granted upon admissions, when it has a duty to prove its case. The failure of the Labour Party to comply with the conditions precedent by the law to hold their national convention, INEC insisted, translates to mean that the party no longer has valid leadership. It would be recalled that in September, Labour Party, LP presidential candidate in the last general election, Mr. Peter Obi, and Abia State governor, Mr. Alex Otti, had written the national chairman of INEC, Professor Mahmood Yakubu, to notify the regulatory body of the setting up of a 29-member caretaker committee to organise the party's congresses and national convention within a period not exceeding 180 days. This followed a stakeholders' meeting which resulted in a caretaker committee led by Nenadi Usman to be set up and charged with the responsibility of steering the affairs of the party and conducting a national convention.

2027: Labour Party’s presidential ticket no longer reserved for Peter Obi — Abure
The National Executive Committee (NEC) of the Labour Party (LP), has thrown open the contest for all of its tickets for the 2027 general elections. This was sequel to its decision to nullify a resolution taken at the party’s national convention held in Nnewi, Anambra State, on March 27, 2024. The party had announced that its 2027 Presidential ticket and that of the Abia State Governorship, have been reserved for Mr. Peter Obi, and Alex Otti, respectively. The LP NEC meeting which was chaired by the LP National Chairman, Julius Abure, resolved to jettison the arrangement at a meeting, in Abuja, yesterday. NEC also disowned the Senator Nanedi Usman-led 29 member Interim Committee set up to steer the affairs of the party for 90 days. The NEC resolution read in part: “NEC in session also reviewed the decision of the National Convention to reserve its Presidential and Governorship tickets for Peter Gregory Obi and Alex Otti respectively. “Consequently, all tickets of the party from Presidency to the House of assemblies are open to all qualified Nigerians. “The NEC in session after reviewing the purported Stakeholders meeting held in Umuaiha Abia State condemned the conveners of the meetings and thereafter disassociate itself from the outcome of the so-called stakeholders meeting in Umuaiha Abia State, where the National Working Committee, the National Executive Council, State Council, Local Government and Ward Executives of the party were purportedly dissolved and a so-called Caretaker Committee was set up. “The NEC in session note that the Governor of Abia State His Excellency Alex Otti who convened the meeting do not have the power within the Party’s Constitution as provided in Article 14 (4) (B) gives power to call meetings only to the National Secretary with the approval of National Chairman. “NEC in session further reiterate that Governor of Abia State do not even have the power to call his Ward Executive meeting without the approval and the consent of his Ward Chairman. “The meeting contravenes the provisions of Section 82 (1) (2) (a) of the Electoral Act 2022 which provides as follows: “82 (1) Every registered political party shall give the Commission at least 21 days’ notice of any Convention, Congress, Conference or meeting convened for the purpose of ‘merger’ and electing members of its executive committees, other governing bodies or nominating candidates for any of the elective offices specified under this Act. “(2) The Commission may, with or without prior notice to the political party attend and observe any convention, congress, conference or meeting which is convened by a political party for the purpose of – (a) electing members of its executive committees or other governing bodies “Article 17 of the Labour Party Constitution provides how members of the National Working Committee, State Executive Committee and all other officials of the party can be removed, For the avoidance of doubt, Article 17 of our Party Constitution provides as follows; “I. The National Chairman of the Party may be suspended or removed from office on a vote of No Confidence passed by at last two-thirds majority at a National Convention convened solely for the consideration only of such motion. “II. Any other National officer(s) of the Party may be removed by 2/3 majority of votes cast by members at a Convention or National Executives Council. “III. The State Officer(s) may be removed by 2/3 majority of votes by the State Congress. IV. The Local Government Officer(s) may be removed by 2/3 majority of votes cast by the LGA Congress. The LP NEC equally condemned in strong terms the conveners of the meeting in Abia State whom they alleged dwelt in illegality. It also threatened to take disciplinary action against them. While dissociating itself from the conveners as well as the outcome of the meeting, the NEC in session declared that there is no vacuum in the leadership of the Party. It noted that the national convention held in Nnewi, Anambra State, on March 27, 2024, was convened in accordance with laid down regulations as such the tenure of elected members of the National Working Committee The Party has conducted its National is still valid and that a court of competent jurisdiction has upheld it. The party urged the Chairman of the Independent National Electoral Commission (INEC), Prof. Mahmood Yakubu, to desist from promoting illegality by claiming that Abure’s tenure had expired. The NEC Meeting was attended by members of the National Working Committee, National officers of the party, State Chairmen and Secretaries, Stakeholders of the party and other co-opted members of the National Executive Council provided by Article 13 (A) of the Party Constitution. EFCC accuses Obiano of evading court process
The Economic and Financial Crimes Commission has accused a former governor of Anambra State, Willie Obiano, of evading the service of court process. The counsel for the commission, Sylvanus Tahir, disclosed this to the court on Thursday during proceedings. On January 24, the EFCC arraigned the former governor on nine charges bordering on alleged money laundering to the tune of N4bn. In the charges, the EFCC accused Obiano of diverting Anambra State’s security votes to the tune of N4,008,573,350 while he was governor between 2014 and 2022. The counsel for the prosecution said efforts to serve the defendant’s reply to his motion have been futile. He said, “In compliance with the order of the court made on Monday, we filed a counter affidavit to oppose the bid by Obiano to challenge the territorial jurisdiction of the court to prosecute him but our efforts have been to no avail.” Tahir said his team was on Wednesday at the Chamber of Obaino’s counsel, Onyechi Ikpeazu (SAN) but that the gate to the office was locked. He said he phoned two of the defendant’s lawyers but he was told they were at a Governorship Election Petitions Tribunal. He said as a result, he was only able to serve the counter affidavit on the defendant inside the courtroom on Thursday. He asked the court to proceed to hear the motion of the former governor challenging the territorial jurisdiction of the court along with the counter affidavit. However, Patrick Ikweto (SAN), who represented Obiano at Thursday’s proceedings told the court he was served the counter affidavit in the courtroom. He pleaded for an adjournment to enable him to respond to the EFCC’s counter affidavit. Justice Inyang Ekwo subsequently adjourned the matter till March 13 for a hearing of Obiano’s motion. However, in the motion on notice by the former governor’s counsel, Onyechi Ikpeazu (SAN) dated March 3, he informed the court of an appeal by the Anambra State Government challenging the EFCC’s authority to investigate the funds. Ikpeazu said, “The subject matter of the charge bothers on accountability for security votes funds;The honourable court lacks the requisite jurisdiction to entertain issues on accountability for security votes funds; “There is an appeal filed by the Anambra State Government challenging the powers of the Economic and Financial Crimes Commission to investigate the security vote of the Anambra State Government “The preferment of the entire charge is in bad faith.” Ikepazu stated that there was no testimony from any witness indicating that he issued directives for the disbursement of security votes and other funds belonging to the Anambra state government He said, “No evidence exists from any witness showing that Defendant/Applicant passed down directives on the disbursements of security votes and other funds belonging to Anambra State Government, “The defendant/applicant cannot be made answerable for any purported unlawful actions of officials of Anambra State Government, as there is no vicarious liability in our criminal jurisprudence; “The thinking and conclusion of the prosecution on the counts arose from speculation and suspicion. “This honourable court has inherent judicial powers to grant all the reliefs sought above.” Read the full article

By • Olalekan Fagbade Elections Tribunal Judgements: Anxiety within Labour Party over massive sack of its lawmakers The Labour Party, LP, has emerged as one of the biggest casualties of the ongoing State and National Assembly Election Petition Tribunal. DAILY POST reports that tribunals sitting in different states of the country have sacked many of the elected members of the party in Edo, Abia, Enugu, among others, over the discrepancy surrounding their membership of the party and their mode of nomination. Rising as one of the main opposition political parties in the 2023 general elections, the LP was able to claim some House of Representatives and Senatorial seats in some states. The milestone of the LP in the general elections was unprecedented considering that the party came from obscurity to gain popularity. Many saw this as a revolutionary movement that captured the heart of the youths at a time Nigerians yearned for a change. Before 2023, the Labour Party had existed for over 20 years as a pro-workers political organisation. But it made inroads into mainstream politics within just eight months. The party rode on the fame and acceptance of Peter Obi, its flagbearer during the general elections, by an overwhelming youth majority known as ‘Obidients’. Obi lost the presidential election after having won 12 states, including Lagos and the Federal Capital Territory, Abuja. He shocked many after challenging the two previously dominant parties, the All Progressives Congress, APC, and the Peoples Democratic Party, PDP, to win a total of 6,101,533 votes. APC’s Bola Tinubu won the contest with 8,794,726 votes, while Atiku Abubakar of the Peoples Democratic Party, PDP came second, securing 6,984,520 votes. The Labour Party, however, was able to win one governorship seat, with Alex Otti emerging victorious in Abia State. The Party clinched eight senatorial seats and 34 seats in the House of Representatives. With this number, the Peter Obi-led political party became the third most popular party in the National Assembly. APC won 57 Senate seats; PDP, 29; LP, eight; Social Democratic Party (SDP) two; NNPP two; YPP and APGA got one each. In the House of Representatives, the APC had 162 seats; PDP, 102; LP, 34; NNPP, 18; APGA, four; ADC, two; SDP, two; YPP, one. The Labour Party was successful in states such as Enugu, Abia, Imo, Delta, Anambra, Plateau and even Benue. However, as the National Assembly Election Petition Tribunals sitting in several states end their proceedings this week, the LP has been on the receiving end. About 552 election petitions were filed by aggrieved candidates, and while over 150 of the cases have been decided, some of the cases were withdrawn by the petitioners. The tribunals, across the country, will end their sittings on Saturday, September 16, 2023. The three House of Reps members whose election has been nullified by the Tribunal in Enugu State are: Hon. Engr. Chijioke Stanislaus Okereke, representing Awgu/Aninri/Oji River Federal Constituency. The Independent National Electoral Commission, INEC, declared that Okereke won the election but the Tribunal sacked him, declaring Chief Onwuegbu Anayo of the PDP as winner. The second person is Hon Prof. Paul Sunday Nnamchi elected to represent Enugu East/Isi-Uzo Federal Constituency. The tribunal declared Prince Cornelius Nnaji of the PDP as winner. Also in Enugu, the Tribunal has nullified the election of Rt Hon Barr Sunday Cyriacus Umeha representing Udi/Ezeagu Federal Constituency. The court said that he failed to properly resign his membership of the PDP before picking the ticket of the LP. It declared PDP candidate, Festus Uzor as the winner. In Abia State three House of Representatives members, elected on the platform of the Labour Party, Ibe Okwara Osonwa, Emeka Nnamani and Munachim Alozie, have been sacked from the tribunal sitting in Umuahia. led by Justice Adeyinka Aderebgbe sacked the member representing Arochukwu/Ohafia federal constituency, Osonwa, for non-compliance with the Electoral Act 2022 The petition was filed by the candidate of the All Progressives Congress, APC, in the election, Chief Daniel Okeke. In Lagos State, the Tribunal declared the election that produced Thaddeus Attah as the representative of the Eti-Osa Federal Constituency of Lagos as inconclusive. Attah, Babajide Obanikoro of the APC and singer turned politician Bankole Wellington also known as Banky W of the PDP contested to represent the Eti-Osa constituency in the House of Representatives during the February 25 election. It was, however, a different scenario in Plateau State, where the LP recorded a win as the Tribunal declared Hon. Dandereng Gideon winner of the Jos South/Jos East Federal Constituency. The Tribunal sitting in Jos sacked Bagos of the Peoples Democratic Party, PDP. Also in Edo State, the Tribunal sitting in Benin City, on Thursday, dismissed two petitions challenging the victory of two LP candidates for lacking in merit. Meanwhile, the Labour Party has expressed worries over how its members were being sacked by the National Assembly Election Petition Tribunal in many states across the country. Reacting to the trend, the party, in a statement issued by its National Chairman, Barr. Julius Abure, opined that the issue of “membership is an internal affair of the party beyond the jurisdiction of courts.” Speaking to DAILY POST on the trend, the Labour Party’s National Publicity Secretary, Dr. Aliyu Danko said that the party would do everything within the law to prove that its House of Reps members actually won their elections. According to him, “We have seen the trend and interestingly at the Presidential Election Petition Court, we presented issues. “But the same issues which were dealt with as pre-election matters are being used to discard some of our Reps members and we find it very appalling and unacceptable. “At the moment, most of our members are resorting to going to the Appeal Court to challenge this particular ruling which we find erroneously unacceptable. “Interestingly, these issues they accuse some of our Reps members of, we can say authoritatively that we have proof that these primaries were conducted and our candidates actually won their elections. “But then, if there are orchestrated plans to reduce the number of our members at the National Assembly, it won’t work because we’ll challenge it with proven documents that we won our elections.” Asked if there is the feeling among party members that there is a plot to weaken the party, he added, “exactly. Governorship elections for 28 of Nigeria’s 36 states will be held in 2023.
