History of Present Illness: Patient is a 28 year old White Male with a history of asthma and anxiety who presents with complaints of rash. He states that he went on vacation to California several days ago. He states he spent much time at the beach. He states he began to develop a rash while there, but did not seek medical care. His plane landed this morning. He came straight here after landing. He denies any fevers, he denies anyone around him having a similar rash. He denies any new soaps or medications. He does not specifically remember any insect bites. He indicates that he only wore sunscreen “sometimes” while at the beach, mainly after the rash began to develop. Skin feels “sore” related to the rash. Denies any change in the shape or lettering of his tattoos.
During course of interview, patient’s girlfriend arrived and revealed that patient obtained a supply of “Britney” while in California and he was snorting it during their vacation.
Past Medical History: Asthma, anxiety. Emergency department visit for overdose of ghost tears in 2022. Appendectomy.
Allergies: None
Medications: None
Social History: Patient smokes cigarettes. He does drink alcohol. He takes medical marijuana. He states he takes cocaine and heroin “sometimes”. He denies use of ghost tears since 2022.
Family History: Diabetes, hypertension in father. Older sister has vampirism.
Review Of Symptoms: As above, otherwise negative
Physical
General: Adult male in no acute distress
HEENT: Pupils equal, moist mucus membranes, no blisters in mouth.
Neck: Supple. No Alexis nodes. Lungs: Clear
Heart: Regular rate and rhythm
Abdomen: Nontender
Extremities: No edema. Pulses intact.
Neuro: Patient alert and oriented x 3. Ambulates stably.
Skin: Areas of skin changes that appear similar to significant sunburn on the face, arms, trunk, legs. There are some scattered areas of blistering. No ulcerations. No pus drainage. Tattoos noted on the left arm and chest. No suspicious runes noted. Patient confirms tattoos appear unchanged from baseline.
Medical Decision Making:
1015: Discussed with poison control. They indicate that “Britney” is a term that describes the combination of heroin and concentrated vampire blood. Report is that if the amount of vampire blood in the ingested mix is too high, or if the user has susceptible skin, the user's skin can become sensitive to light. These effects can last for up to two weeks after the last ingestion. Recommendation would be supportive care, including avoidance of prolonged sun exposure until the skin heals. Per their report, Merlinmax would only be recommended if complications requiring hospitalization were to develop.
1100: Patient has been seen by peer counseling. Patient took information about substance use disorder rehabilitation, but declines rehabilitation at this time.
Patient is hemodynamically stable, rash does not appear acutely infected. Patient does not appear to require lab testing or imaging at this time, can be discharged. Patient advised to avoid prolonged sun exposure until his skin heals. He has also been advised that sunburn does increase the chance of subsequent skin cancer, so he should be diligent about following up any unusual moles. Lotion containing aloe vera recommended to keep skin moisturized. Patient also advised to avoid the use of illegal drugs in general, and to especially avoid taking any remaining Britney he has in his possession, in order to avoid extending the length of time his skin takes to heal. Patient to return if fevers, evidence of infection, change in appearance of tattoos, worsened rash develop. Patient to follow up with primary care provider. Will provide written instructions.

Y/N has always liked to procrastinate, for as long as she can remember. Even though those around her liked to say she was a hard worker and a relentless person, always running around and working, which was partly true, but most because she had to do it. Indeed, the five years of surgical residency were not the easiest and most relaxing. On the contrary, juggling procedures, evaluations, and services meant no sleep, no balanced diet, and no social life. Zero social life was what she had. Her friends were always trying to see her and she did miss the parties where her entire circle of friends would get together, especially when she couldn’t join them because of work. Nevertheless, she knew that it was a blessing in disguise and that the situation would calm down in five years when she would be old and alone… Oh Lord, have mercy.
However, Harry was always there for her and did everything to see her, even if it was only to bring her a real lunch during her break and not what she used to nibble on or when he picked her up after her shift. And that’s exactly what was planned for today. Indeed, she was finishing her shift at 9 pm and Harry had called to tell her that he would pick her up to spend the weekend at his place so that she could have the weekend off and that he wanted to spend some time together while he was still in Los Angeles. Even though they both lived next door to each other, they didn’t see each other as often as they wanted. The thing that broke the tabloid ideal was the fact that Harry was dating a certain brunette supermodel at the time and chose her over you. This broke you at first, and your friendship took a hit, and after a while and several nights of drinking, you managed to get past this episode, pack up your feelings and tell yourself that your friendship was more important than this. At least, that’s what you believed or wanted to believe.
So, it was 9 pm on that Friday night and you were just finishing changing after a long day at work and getting ready to go out when you felt your phone vibrate, having received a message.
“I’m in front of the hospital waiting for you. H”
You replied that you were on your way, finished getting dressed, greeted some of the staff, and wished them a good evening before getting out and spotting Harry’s Range Rover parked not far from the hospital entrance.
“Hey, you.” You said as you climbed into the passenger side before giving him a tight hug. “How are you doin’ H?”
“Fine. Long day at the studio recording.” Harry replies as he holds you close to him. “Missed you lots, love”. He said to you as he pulled back a little to better observe you while maintaining his grip around your shoulders. Those famous green eyes scanning you and his smile only reminded you how attractive Harry was. “What about you?”
"Good. Aside from a patient who asked me to tell you she loved your last song and a successful appendicitis, I had a pretty quiet day. I’m more than happy to have a weekend off to finally relax. These last few weeks have been hard, especially after Tuesday’s traffic accident.”
“You’ve earned some rest babe. I was planning to stay at my place for the week-end so we can both spend some time together and update each other about what’s going on in our lives.” He said as he ran a hand through his hair. “But first, would you like to order at the drive-thru? I think we’re both too tired to cook. Poke and sushi sound good?”
“Only if there are beers involved.” You reply, putting on your seatbelt.
“There wouldn’t be a Friday night without beers, love.”

After a good meal, and a few beers, you decided to lie down on the couch, under the covers to watch a movie. You had always loved Harry’s couch, big, soft and squishy, a rich man’s couch basically.
You were lying with all of Harry’s weight on you, he had his head resting on your chest and his hands holding your thighs and waist tightly, while you ran your hand through his curly hair while scrolling through Netflix looking for a romantic comedy that looked interesting. You finally pressed a random choice, too tired to keep looking. After several minutes, your eyes began to close, and fighting the sleep that was beginning to creep up on you became more and more difficult until Harry’s voice woke you up.
“Why’d you stop?” His voice was groggy with exhaustion, hoarse, and with his British accent coming through, he too must have fallen asleep.
“Hm?” You answered with a broken and tired voice. “Thought you were asleep.”
“Not really. Can you continue to play with my hair? It feels nice.”
You did as he asked and both of you continued to watch the movie even though you didn’t necessarily know what the movie was about, you were both more focused on not sleeping.
“I feel weird that your hair is shorter.” You say, running your hand through her curls. “I was used to your long hair.”
“Me too.” He says, laughing lightly as he tightens his grip on your thigh. “But I had to cut it off for my role in Dunkirk. Besides, it’ll grow back eventually.”
“I like them like this too. It doesn’t change your charm.”
“I thought you had a thing for long hair in guys.” He replied, lifting his head slightly to look you in the eye with a half-smile hanging on his lips.
You felt Harry get up to go to the bathroom and took the opportunity to readjust yourself a little while trying to calm down the beating of your heart which had started to beat strongly. This was not the first time that you and Harry were so intimate, on the contrary, this was a normal situation for both of you, but not since what happened between you two last time. You thought you could do it but now you realized that it was going to be more complicated than you thought. You heard Harry return with two cold beers in his hands. He passed you one and repositioned himself, patting the spot next to him.
“Come here, love.” You walked over to him and felt Harry pulling you into his arms, as you watched the rest of the movie, his head rested on your shoulder, and felt his breath on your ear and the pressure of his fingers on your thigh as he stroked your hair with his other hand and you didn’t remember when you fell asleep.

It was a sunbeam right in your eyes that woke you up the next day, still a bit out of it, it took you several minutes and grunts to open your eyes and realize that you were no longer in the living room but in Harry’s room. Alone. You don’t remember waking up to go upstairs, so you conclude that Harry must have carried you to his room to sleep and that he must have woken up before you. You always used to sleep together in the same bed, a habit that has lasted forever and Harry was always an early riser, unlike you. Not that you didn’t want to, on the contrary, you would have liked to be the kind of person who woke up early in the morning to go for a run before starting the day, but this was more like torture for you. Besides, you liked sleeping and you liked your bed.
After several minutes of tossing and turning in bed thinking you were going to be able to fall back asleep and scrolling through your phone, you finally decided to get up and go downstairs where you heard Harry violently banging the keys of his piano while letting out a grunt.
“You okay?” You asked as you watched him turn back to you.
“Morning. I’m just trying to write.” He answered you while smiling at you, especially because of your morning face.
You hated to see yourself in the morning but Harry always said you looked beautiful, hair in disarray, tired eyes and wondering what was going on around you.
“Morning.” You answered with a slight smile. “How is it going?”
“It fucking sucks. There’s coffee in the kitchen babe.”
“Thank you.”
You shuffled to the kitchen, grabbed a mug and poured the coffee in to take a sip and already you felt your eyes open and your brain start to function. If there were three liquids in your system, they would be coffee, tea and beer, being your fuels. You then walked over to Harry and sat down next to him and rested your head on his shoulder while his arm wrapped around your waist and his other hand continued to play a few piano notes. You put your mug on top of the piano and started to play some notes that Harry recognized and accompanied you on.
“I didn’t know you could play Sign of the times on the piano babe.” He said as he placed a kiss on your head before nuzzling his head into your neck.
"I learned a little at a friend’s house party. The alcohol helped too. Plus, I had a good teacher to show me how to play the piano the first time. I heared he’s pretty good.” You replied wryly, smiling at him as you took another sip of coffee.
“I’ve also heard he’s hot. What was his name again? I think it started with an H?” Does he say to you tactfully.
“Henry? Hector? I think it was Harold but not quit sure, he was so basic.” You said while giggling seeing Harry’s face when he was beaten at his own game.
“He was so basic.” Harry repeats in a mocking voice. “Anyway, enough writing for today. The weather is so good. We should spend the day swimming in the pool. What do you think?”
“Sounds good to me H.”
“Well, that’s a deal. Let’s get change.” He told you before getting up and going to dress himself.

You knew you left some swimsuits at his place. In fact, you had a lot of your stuff at his place, and vice versa, this was easier for both of you when you spent time at each other’s place. After searching, you opted for a yellow bikini, Brazilian and one of Harry’s caps. You headed to the garden where you discovered Harry already inside the pool, bathing.
“Look at you, you’re so gorgeous. Work of art.” He said to you with a sigh while putting his arms on the edge of the pool. You couldn’t help but notice how muscular his arms were. He continued to look at you with a smile on his face and his eyes squinted from the sun as you sat on one of the loungers, book in hand.
“What are you doing? What’s the point of wearing a swimsuit if you’re not going to swim?”
“So you can admire my perfect body for example.”
“For example, but I’d rather admire it with you by my side. Come on, come swim with me.”
You lifted your head to look at him with his dog-eyes, begging you with your eyes to accompany him inside the pool. And you knew deep down that you couldn’t say no to him.
“Okay but just a dip.” You say as you get up and head towards the pool. But that was without knowing Harry who waited until you stepped into the pool to pull you in, pulling you into the pool. And as you struggled to catch your breath, Harry, who was standing next to you, was dying laughing.
“Asshole! Since when do you attack a defenseless woman!” You say as you throw yourself on his shoulders trying to drown him out.
“Defenseless? You? That’s not the impression you’re giving me right now.” He answers you by not moving. He didn’t care about your strength as a little brute. So he grabbed you by the waist and threw you into the pool again.
And so you spent the rest of the morning fighting in the pool.
The middle of the afternoon started and after eating pizza for lunch, Harry decided he wanted something sweet and that’s how you found yourself in front of a banana bread recipe website trying to reproduce the recipe. You were still wearing your bathing suits, Harry was shirtless while you had put on one of his blue shirts leaving it unbuttoned.
So, after several minutes where you had decided to cook in a clean way while Harry was more of a pain in the ass than an assistant, you were waiting for the banana bread to finish cooking, trying to clean up the mess you had just caused. Indeed, the kitchen looked like nothing, all with Dancing in the moonlight by Toploader playing in the background.
“I always wanted to spend an afternoon cooking or baking with a person I love.” He told you while throwing the eggshells and banana peels in the trash.
A person he loves. Nevertheless, you didn’t know how to interpret the meaning of the word “love” that he meant or at least you would hope for a specific meaning.
“Look at the mess you made H.” You say, pointing to the whole kitchen counter, covered with flour, sugar, leftover butter and other things.
“The mess that I made!” He replies with a fake shocked look. “I would point out that I was helping you cook.”
“I can’t say you’re the best assistant ever. At pissing me off mostly.”
“But I can make the best banana breads you’ve ever tasted, plus I’m hot while cooking.”
“You’re doing the business, I guess.”
You saw the outraged look on his face and couldn’t help but laugh as you began to finish cleaning up the kitchen, listening to your spotify playlist in the background and it wasn’t until you felt Harry pull you by the arm towards him that you snapped out of your thoughts.
“What are you doing H?.”
“Come. Let’s dance I love this song.” And so you found yourselves dancing in the middle of the kitchen while maintaining eye contact, neither of you able to take your eyes off each other.
This was a habit you both had as well, dancing in the middle of the kitchen, no matter what time of day, in the morning to wake up, in the evening after a night out, or in the middle of the afternoon after cooking, as long as the mood was there. And that’s how you didn’t see Harry come up to you and lightly dust your face with flour and all while laughing.
“You jerk!” You told him as he continued to laugh.
“I couldn’t help myself love. It was too tempting.” He answered you while wiping a tear from the corner of his eye.
“I couldn’t help myself.” You laughed at him. “Kiss my ass Harold!”

You spent the next few minutes chasing after him, trying to pelt him with flour for revenge, but Harry had long legs, and the son of a bitch was a good runner. The timer went off, signaling the truce and with it the banana bread. It was actually pretty good. So you spent the rest of the afternoon swimming by the pool and drinking beer. You came back from the room upstairs, where you went to get a bag. You sat down on the couch in the garden where Harry was already sitting, drinking his beer, still wet from swimming.
"You want some?” You feel Harry glancing at you as you pack loose marijuana into a wrapper, as you were rolling it.
“I thought you stopped smoking weed?” He asked you.
“I meaan. I also said I would start to go to the gym and here I am still making bad life decisions.” Harry smiled boyishly, opening a beer for you while you were you bring the wrapper to your mouth, licking it lightly before sealing it, putting it on your lips before lighting it up and taking a few drags.
“Can I get a hit?” Asked Harry, looking at you.
You took another puff before passing him the joint. Then you watched, gazing up at him in dumbfounded silence as he carefully rested it between his lips, and took a slow, deep breath. He held it for only a few seconds, then he exhaled steadily, eyebrows furrowed as you both watched the stream of smoke leave his mouth. Something about the way it drifted around his covetable side profile, the concentrated tranquillity in his face, the wisps of hair dancing above his eyebrows… it was all magical.
“You look sexy doing that.” You blurted. Harry almost choked. He turned to look at you properly, to be sure you weren’t just winding him up.
“Are you high?” he asked after a few moments, a hint of amusement in his tone. You giggled, gently shoving his arm.
“Not yet, smartass…Just a bit tipsy but it’s wearing off now.“ You explained coolly. The nonchalance with which you continued the conversation as if nothing had been said before was almost laughable.
“…Right.”
“You’re quiet.” You snickered. “Was that weird? My bad-“
“No, not weird,” He quickly corrected you with a smirk. “I liked it actually. I’m just surprised.” You scoffed with disbelief.
“Shut up. You know damn well you’re attractive.” At that he chuckled, his head falling as he did. Harry, then licked his lips gently, gazing intently at your own.
“I think you’re prettier.” He uttered, hardly above a whisper.
As though there was a gravitational pull between the pair, you both found yourselves gradually turning to face the other, until your faces were inches apart. Harry took in your warmth, eyes darting all over your face. You had a sweet scent, like vanilla, cocoa butter and chlore. The corners of your mouth curled up, as you blessed his vision with a languid smile.
“Wanna try something?” You muttered. He paused like he was pondering over something before nodding as he agreed before you answered:
“Open your mouth for me, handsome.”
Neither you or Harry couldn’t think of anything else as you brought the joint to your mouth again, inhaling as much as you could, then Harry felt your hand grab a firm hold of his face, fingertips digging into his cheeks with the slightest pressure. Your lips parted, and whilst you allowed the smoke to cascade out, he inhaled slowly. You stared down the tip of your nose, enjoying the graceful transition of smoke from your mouth to his. As the stream begun to thin, Harry unknowingly leant into you even further, eyes fluttering.
You blew out what was remaining, then he placed a playful peck on your cheek, before finally releasing his face. The sensation of his lips against your skin, mixed with the feeling of weightlessness that was beginning to creep in, made both of you grin from ear to ear.
“I liked that!” He giggled, blinking repeatedly.
“Yeah?” You responded, with equal amusement. “I’m glad.”
A small smile graced your lips as he gazed down at him, while he hummed in quiet contentment. “This is nice. Really nice.”
You were about to back away when you felt Harry’s grip on you. One of his hands on the back of your neck so you couldn’t pull away while the other rested on your lower back.
"But you know what I’d like more?” He asked you while coming closer to your lips.
You cue the infamous eyeroll. “Please.”
“You haven’t moved away, Y/N.”
Sadly, he was right. You just couldn’t even bring yourself to turn from him, now that you’d had the privilege of his proximity once again.
You know what was happening at this exact moment was bad but deep down you didn’t want it to stop, as you decided to stop listening to the small voice in your head.
“And if I don’t want to move away?” Your voice came a naturally breathy purr. Should you have done that? You decided it was too late to go back.
An unfamiliar sensation hitted your chest when you noticed the way his eyes sinfully travelled down your length. Like he wanted to do things to you that no one had dare done before. His eyes met yours again, and all smiles were gone. Only pure lust painted his irises now. You stood there in front of him, waiting, listening for him to do something. And he did.
Your breath was caught in your throat at the sudden, slight pressure of his hand moving to your thigh, his touch sending tiny shocks throughout your body.
“Then that works for the both of us,” he smirked, and his tongue slid across his lip.
There was silence, as the two stared each other down, your faces comfortable close.
“Let me kiss you.”He wasn’t really asking. And strangely, you didn’t care.You sighed, quietly.
“Fuck it,” were the last words that you would say, before that pull between both of you became overpowering. By the time the shadow of doubt tried to creep in it was too late. Your lips had met in a kiss.There wasn’t time to be shocked.
The mere taste of him was enough to silence your thoughts and your body seemed to dissolved into his. All you could think about was how soft his lips were, how good he smelt, how he invaded all of your senses. You sighed deeply into his mouth, shivers of pleasure and panic rippling through you. He must have sensed this, because you felt his lips curl up into a slight smile, proud of the effect he was having on your body.
A gentle hum of content rose from the back of his throat as his hands slid, as he claimed you, hungry, intense, yet contained by his faltering willpower. Until your hands, with a mind of their own, danced about the back of his neck and your fingertips found home in his damp hair. From that point on, everything seemed to hasten with a fervency that wasn’t there before.His hands slid first, around your waist, arms locking around you so that your body curved perfectly into his. His hands finally reached down to your ass where he lifted you up to lay you on his thighs so that he could have more access to you and your bodies could get closer to each other. Then, he allowed them to explore further, and sunk his fingers into the fleshy muscle of your thighs, encouraging your legs apart.
Your response was immediate, like natural instinct had been awakened in you. You allowed your weight to sink onto him as you sat, straddling his lap as you clung to him.It was a fleeting thought, because every movement, every single new sensation his touch brought reset your mind and you was blank again. His tongue teased you, and gradually you began to deposit light kisses on his neck and his shoulder, marking it in the passage of some sucks before passing your tongue on the top of his chest, up his neck with your tongue where you bit the lobe of his ear. He couldn’t help but moan, while his breathing became shorter. Your lips joined again in a wild kiss where both your tongues played with each other.
He decided to remove your sweatshirt and run his lips and tongue over your neck, shoulder and over your collarbone. He then continued to play with the elastic of your bathing suit top. A look was exchanged between you before you gave him permission to take it off. And so it was, the first time he saw you topless, your boobs visible to him where he spent a few seconds admiring them before taking them in his hands, kneading them and bending over to take one of them into his mouth.
“Fuck Harry…” Was the only thing that came out of your mouth while arching your back, fingers tangling in his hair to pull him closer.
He continued to play with one of your nipples with his tongue while his fingers teased the other one, pulling lightly on the tip. You naturally began to move back and forth on him, and as your private parts rubbed together, you felt the pleasure rising in you and him getting harder on you.
And you… stopped?
He waited for you to continue what you were doing with anticipation, waited to feel that warm, numbing feeling, that rush of exhilaration that came with each of your pecks.
But nothing came.
For a second the pair were frozen there in that position, no movement taking place between the two of you. Then, rather than kissing him again, You got up from his lap and put your sweatshirt back. When he noted your expression, he was baffled.
“What’s wrong?” He muttered. You didn’t react to his voice at all, but you left your palm hand as a sign to stop whatever was happening.
“I can’t do this. We can’t do this and we shouldn’t.” You say, looking him straight in the eye as he runs a hand through his hair, beginning to understand the situation.
“If this is about the last time, we talked-”
“It’s not that Harry! But history is just repeating itself. There’s something between us, some kind of attraction or whatever. You know I like you and I know you like me too but the last time we said that and kissed each other, you were in a relationship and chose her over me. It took me a while to deal with it and I don’t want that to happen again. We’re going to play this game that will be a one night stand or lead to a friends with benefits relationship, until your next girlfriend shows up and you choose her over me again, because that’s what you did in the past and I don’t want to go through that hell again. Our friendship means more to me than that” You said while pointing at both of you before continue. “So unless you tell me you want a serious relationship between us we should call it off.” You say as you finish your monologue.
You didn’t know how Harry would react to this and you didn’t realize how much you needed to get it off your chest but it was done and here you were, waiting for an answer from him that never came.
Deep down, you hoped that he would choose you and that you could come to terms with your feelings for each other, but it didn’t happen. You saw him, still sitting, and processing everything you said and you knew that he was not going to do it. You saw him still sitting there staring at you, as if he was lost in what you had just thrown in his face and you understood. You decided to go upstairs without further ado to one of the guest rooms that his house had because you understood that you would never be his first choice.

Qualia
My latest Locus Magazine column is "Qualia," and it argues that every attempt to make an empirical, quantitative cost-benefit analysis involves making subjective qualitative judgments about what to do with all the nonquantifiable elements of the problem.

Think of contact tracing. When an epidemiologist does contact tracing, they establish personal trust with infected people and use that relationship to unpick the web of social and microbial ties that bind them to their community.
But we don't know how to automate that person-to-person process, so we do what quants have done since time immemorial: we decide that the qualitative elements of the exercise can be safely incinerated, so we can do math on the quantitative residue that's left behind.
We can automate measurements of signal strength and contact duration. We can do math on those measurements.
What we *can't* do is tell whether you had "contact" with someone in the next sealed automobile in slow traffic - or whether you were breathing into each others' faces.
The decision to discard the subjective *is* subjective.
When the University of Illinois hired physicists to design its re-opening model, they promised no more than 100 cases in the semester and made unkind remarks about how easy epidemiology was compared to physics.
Within weeks, the campus shut down amid a 780-person outbreak. The physicists' subjective judgment that their model didn't need to factor in student eyeball-licking parties meant that the model could not predict the reality.
The problems in quants' claims of empiricism aren't just that they get it wrong - it's that they get it wrong, and then claim that it's impossible for anyone to do better.
This is - in Patrick Ball's term - "empirical facewash." Predictive policing apps don't predict where crime will be, but they DO predict where police will look for criminals.
Subjectively discarding the distinction between "arrests" and "crime" makes bias seem objective.
40 years ago, the University of Chicago's Economics Department incubated a radical experiment in false empiricism: the "Law and Economics" movement, which has ruled out legal and political sphere since Reagan.
Law and Econ's premise was that "equality before the law" required that the law be purged of subjective assessments. For example, DoJ review of two similar mergers should result in two similar outcomes - not approval for one and denial for the other.
To this end, they set out to transform the standards for anti-monopoly enforcement from a political judgment ("Will this merger make a company too powerful?") to an economic one ("Will this merger make prices go up?").
It's true that "Is this company too powerful?" is a subjective question - but so is "Will this merger result in higher prices?"
After all, every company that ever raised prices after a merger blamed something else: higher wage- or material-costs, energy prices, etc.
So whenever two companies merge and promise not to raise prices, we have to make a subjective judgment as to whether to trust them. And if they do merge and raise prices, we have to subjectively decide whether they're telling the truth about why the prices went up.
Law and Econ's answer to this lay in its use of incredibly complex mathematical models. Chicago economists were the world's leading experts in these models, the only people who claimed to know how to make and interpret them.
It's quite a coincidence how every time a company hired a Chicago Boy to build a model to predict how a merger would affect consumers, the model predicted it would be great.
A maxim of neoliberal economics is "incentives matter" - and economists have experience to prove it.
The Chicago School became a sorcerous priesthood, its models the sacrificial ox that could be ritually slaughtered so the future could be read in its guts. Their primacy in models meant that they could dismiss anyone who objected as an unqualified dilettante.
And if you had the audacity to insist that the law shouldn't limit itself to these "empirical" questions, they'd say you were "politicizing" the law, demolishing "equality before the law" by making its judgements dependent on subjective evaluations rather than math.
That's how we got into this mess, with two beer companies, two spirits companies, three record companies, five tech companies, one eyeglasses company, one wrestling league, four big accounting firms - they merged and merged, and the models said it would be fine, just fine.
These companies are too powerful. Boeing used its power to eliminate independent oversight of its 737 Max and made flying death-traps, and then got tens of billions in bailouts to keep them flying.
What's more, these companies are raising prices, no matter what the model says. The FTC knows how to clobber two companies that get together to make prices higher, but if those companies merge and the two resulting *divisions* do the same thing, they get away with it.
The only "price-fixing" the FTC and DoJ know how to detect and stop is the action of misclassified gig-economy workers (who are allegedly each an independent business) who get together to demand a living wage. In Law-and-Econ terms, that's a cartel engaged in price-fixing.
That means Lyft and Uber can collude to spend $200m to pass California's Prop 22, so they can pretend their employees are contractors and steal their wages and deny them workplace protection - but if the workers go on strike, *they're* the monopolists.
In Law-and-Econ land, the way those thousands of precarious, overstretched workers should resist their well-capitalised bosses at Uber and Lyft is to form a trade association, raise $200m of their own, and pass their own ballot initiative.
As I wrote in the column: "Discarding the qualitative is a qualitative act. Not all incinerators are created equal: the way you produce your dubious quantitative residue is a choice, a decision, not an equation."
There is room for empiricism in policy-making, of course. When David Nutt was UK Drugs Czar, he had a panel of experts create empirical rankings for how dangerous different drugs were to their users, their families and wider society.
From this, he was able to group drugs into "drugs whose regulation would change a lot based on how you prioritized these harms" and "drugs whose ranking remains stable, no matter what your priorities."
Nutt was then able to go to Parliament and say, "OK, the choice about who we protect is a political, subjective one, not an empirical one. But once you tell me what your subjective choice is, I can empirically tell you how to regulate different drugs."
Nutt isn't UK Drugs Czar anymore. He was fired after he refused to recant remarks that alcohol and tobacco were more dangerous than many banned substances. He was fired by a government that sat back and watched as the booze industry concentrated into four companies.
These companies' profits are wholly dependent on dangerous binge drinking; they admit that if Britons were to stop binge drinking, they'd face steep declines in profitability.
These companies insist they can prevent binge drinking, through "enjoy responsibly" programs.
These programs are empirical failures. The companies insist that this is because it's impossible to prevent binge drinking.
So Nutt made his own program, and performed randomized trials to see how it stacked up against the booze pushers' version.
Nutt's program worked.
It was never implemented.
Instead, he got fired, for saying - truthfully - that alcohol is an incredibly dangerous drug.
The four companies that control the world's booze industry have enormous political power.
