Fact:
Appellant Sarnam Singh, a gunman at Bharti Hotel Ltd. met with an accident with a tempo on 24.11.2013. He underwent treatment but injury being severe his lower limb was amputated leaving him permanently disabled for the job for which he was employed. At the time of accident, he was aged about 50 years and 05 months drawing salary of Rs. 20,774/- pm and Rs. 800/- towards conveyance allowance.
On account of his inability to discharge his duties for which he was employed his services were terminated w.e.f. 31.5.2015.
Motor Accident Claim Tribunal:
The Motor Accident Claims Tribunal, South District, Saket New Delhi, vide its award dated 18.4.2016, awarded a compensation of ₹ 34,29,800/- as the vehicle was insured, the liability was put on the insurance company. The Tribunal awarded a sum of ₹ 1,50,000/- on account of pain and suffering, ₹ 95,000/- on account of diet, conveyance and attendant charges. In addition, a sum of ₹ 1,00,000/- was awarded on account of loss of amenities.
Appeal before Delhi High Court against award of MACT by Insurance Co.
Shriram General Insurance Company filed appeal before the Delhi High Court against the order of the Tribunal. The High Court vide impugned order dated 25.8.2017, while not finding any fault with reference to any of the findings recorded by the Tribunal, reduced the compensation taking loss of earning capacity of the appellant Sarnam Singh at 80%. The amount of compensation was reduced by ₹ 4,92,205/- and finally the amount determined was ₹ 28,43,000/-. The compensation awarded under other heads was not disturbed.
Aggrieved by the order of the Delhi High Court reducing the amount of compensation awarded by the Tribunal instant Civil Appeal was filed.

Argument of the Appellant Counsel before SC
The order of the High Court reducing the loss of earning capacity to 80% is erroneous as the appellant had suffered amputation of his right lower limb. the functional disability could not be taken as 80%. It should be taken as 100%.
Argument of the Respondent Counsel before SC:
There was error in calculation of the compensation by the Tribunal The same has been corrected by the High Court. There is no error in the order passed by the High Court.
Observation of the Apex Court:
The kind of injury the appellant suffered resulted into permanent disability.
Medical Certificate issued by Board of Doctors is showing disability as 85% with no further possibility of improvement.
Any physical disability resulting from an accident has to be judged with reference to the nature of the work being performed by the person who suffered disability.
The same injury suffered by two different persons may affect them in different ways.
Loss of leg by a farmer or a rickshaw puller may be end of the road as far as his earning capacity is concerned.
Whereas, in case of the persons engaged in some kind of desk work in office, loss of leg may have lesser effect.
Appellant suffered functional disability.
The Tribunal was right in assessing the loss of earning capacity of the appellant at 100% and assessing the compensation accordingly.
The High Court was in error in reducing the loss of earning capacity to 80%,
There is another error in order passed by the High Court in calculating the compensation. The compensation awarded by the Tribunal was taken on ₹ 33,34,800/-.  Whereas, total compensation awarded by the Tribunal was ₹ 34,29,800/- and not ₹ 33,34,800/-
Decision:
The appeal filed by the appellant is allowed. The impugned order passed by the High Court is set aside and the award passed by the Tribunal is restored.

KESAVANANDA BHARTI VS STATE OF KERELA AIR 1973 SC 1461
I. Background
Several incidents formed the "backdrop" of the Kesavananda Bharti decision. The ‘backdrop’ or course before Kesavananda is needed to understand the decision. As finely built as the Indian Constitution is, it is ageing like everything else in the world after 70 years. In early 1951, Prime Minister Jawaharlal Nehru wrote to his chief ministers, “It is impossible to hand up urgent social changes because the Constitution comes in the way,We shall have to find a remedy, even though this might involve a Constitutional change This started India's amendments path. Within 1.5 years of its passage, the first constitutional amendment was passed. After intense parliamentary debate, the First Amendment restricted freedom of speech, introduced caste-based reservation, circumscribed the right to property, formalised and legalised the abolition of the zamindari system, and inscribed a new schedule of "contradicting" constitutional laws immune to judicial reviews. Citizens challenged the First Amendment, arguing that it altered fundamental rights. In the cases of Shankar Prasad Deo vs Union of India and Sajjan Singh vs State of Rajasthan, the power of parliament to amend the constitution, including fundamental rights, was upheld without limitations. Justice J.R. Mudholkar dissented in Sajjan Singh v. State of Rajasthan. He raised the intriguing question of whether Article 368 might change a fundamental principle or modify the Constitution. He said, “It is additionally a matter for consideration whether making a change in an extremely basic feature of the Constitution are often regarded merely as an amendment or would it be, in effect, rewriting a section of the Constitution; and if the latter, wouldn’t it be within the purview of Article 368
Parliament was close to supremacy until the I C Golaknath Vs State of Punjab case. Finally, the historic Golaknath v. State of Punjab ruling made fundamental rights ‘transcendental and sacrosanct’. Constitutional lawyer M.K. Nambiar introduced Professor Conrad's "doctrine of implied limitations" in this case. Thus, the Supreme Court reversed its earlier rulings and ruled that no amendment could advance the nation at the expense of citizens' fundamental rights. Kesavananda Bharti Vs. State of Kerala, the country's most referenced constitutional case, was paved here.
II. Facts
The petitioner, His Holiness Sripadavalguru Kesavanand Bharti was chief of a religious sect ‘ Edneer Mutt’ in Kerala. This sect was disappointed by the fact that certain lands ‘property’ was acquired by the state for socio-economic progress. So, a petition was filed by His Holiness on 21 March 1970 under Article 32 for enforcement of his fundamental rights (Art. 25, 14, 19(1) (f), and 31). And while the petition was still in progress, Govt. of Kerala passed Kerala Land Reforms Act, 1971. Simultaneously, 24th, 25th, and 29th Amendments were also passed.
III. Issues

With the passage of the 24th Amendment Act, Parliament was granted the authority to alter any provision of the Constitution, even if doing so would result in the restriction of basic rights. A significant portion of residents' rights to their own property were eliminated by the 25th Amendment Act. It allowed the government to acquire private property for the purpose of putting it to public use in exchange for compensation that was payable. Specifically, the Kerala Land Reforms Amendment Act, 1969 and 1971, which was included in the Constitution's IX schedule, was outlined in the 29th amendment act. Most of these were passed in order to overturn the ruling that the court made in the Golaknath case. An eleven-judge bench made the decision regarding Golaknath.As a result, the case of Kesavanand Bharti was going to be considered by the largest ever bench consisting of thirteen judges.
IV. Contentions of Petitioner and Respondent
The petitioner used the case of Eason vs. State, Supra as an example. This foreign decision made it clear that the Legislature could not change any part of the Bill of Rights, which lists the basic rights protected by the Constitution. At this point, the respondents said that the Sate could change any part of the Constitution and limit basic rights in order to meet the guidelines for state policy and the obligations for socioeconomic progress set out in the preamble.
The people who signed the letter said that Parliament shouldn't have too much power in a democracy. Indian citizens were promised a feeling of freedom. If the Court rules that Article 31 C, which was added by the 25th Constitutional Amendment Act, is valid, then only Parliament and the Legislature will be able to decide how much freedom citizens need. Respondents said that Articles 31 (A), (B), and (C) are very similar and that the point of adding them was to protect them from parliamentary review under the Fundamental Rights. They also said that if this Court agrees that Article 31 (A) is valid, then Article 31 (C) is also valid.
The petitioners said that Art. 368's power to change things is limited. In Indian democracy, the Constitution gave people certain rights and freedoms that will last as long as the Constitution does. As a result, modifying power cannot take away such basic freedoms. The Respondents said that the body making the changes should have unlimited power. They even said that the State has such broad amending power that it can change all the rights in Part III and have unrestricted access to change the Directive Principles of State Policy. This means that the federal system can be drastically altered and the right to judicial review can be taken away. The people who answered said that Art. 368 gives Parliament "omnipotent powers."
The respondents said that the Constitution sets up Parliament. The Constitution gives us the power to change things. The Constitution calls the "State" a Sovereign Democratic Republic. It is the Parliament of the Sovereign Democratic Republic, so the exercise of power should also be done with that in mind. Also, the general points that Alexander Hamilton made about the "Doctrine of Implied Limitations" should be kept safe and can't be changed. Respondents said that Art. 368 gives the government "constituent power," which means it has full power. The steps Parliament took to use Article 368 are exactly the same as the steps the Constituent Assembly took to make the Constitution. To put it another way, Parliament is the same thing as the Constituent Assembly, and it can totally destroy, change, or shorten the Constitution.
V. Judgement
In his perspective, Chief Justice Sikri highlighted that the respondents argue that Parliament has the power to abolish fundamental rights, such as freedom of speech and expression, freedom to organise groups or unions, and freedom of religion. They assert that democracy may be substituted and a one-party regime can be established. Without repealing the Constitution, Parliament can establish any type of government that denies freedom to citizens by utilising its authority under Article 368. Nani Palkhivala presented an intriguing position during the ongoing hearings of the case, stating that even if Article 368 were analysed extensively, the preamble could not be amended. Furthermore, Article 368 should not be interpreted as "expressing the desire for the Constitution's demise or as a provision for its legal self-destruction." While the judges discussed their opinions on the 'Doctrine of Basic Structure', they all interpreted it similarly but with different literary styles. However, Justice Khanna's majority view stands out and is remembered in legal literature for being the one who established the concept of 'basic structure'.
The Court determined that any constitutional principle that is violated could potentially undermine the unity and integrity of the nation, which formed the basis of our freedom struggle. The Court also recognised that the dignity of the individual is an essential aspect of the Basic Structure. Furthermore, it was established that the ability of the legislature to make amendments is limited by a principle known as the "doctrine of basic structure". This means that the parliament cannot utilise its power to amend the constitution, as stated in Article 368, in a way that would harm, weaken, dismantle, abolish, modify, or change the fundamental framework or structure of the Constitution. Justice Sikri noted that the word 'amending the Constitution' does not grant Parliament the power to completely alter its essence, revoke basic rights, or modify its recognised existence. Justices Reddy, Mukherjee, and Hedge elucidated the fundamental attributes that constitute a comprehensive classification term encompassing sovereignty, democratic nature, unity, and essential liberties, all of which are safeguarded for citizens. Justices Grover and Shelat likewise held the belief that the ability of Parliament to change the Constitution had implied limitations and that there were specific fundamental aspects to the Constitution.
However, Justice Ray noted that the ability to amend is extensive and unrestricted. Justice Palekar remarked that, in his opinion, the deprivation of fundamental rights cannot be deemed unjustified. Justice Khanna coined the term 'fundamental framework', which was later embraced by Chief Justice Sikri and incorporated into his majority opinion. In his work, T. R. Andhyarujina stated that the "view of the majority" cannot serve as the legal reasoning behind the decision in the Keshavananda Case. The court fully affirmed the 24th and 25th Constitutional Amendments, however it deemed the first part of the latter to be within the scope of the law and the second part to be beyond the scope of the law. The ruling validated the notion of the 'Basic Structure'.

We often forget that India is the land of Vedas which means a very old country on the world map. India’s Educational system in India is spoken highly about around the world not only for its robust curriculum but also for its quality education it imparts. It was and has maintained an excellent image during the Gurukula system period and continues the legacy in the present-day international school’s era.
Below are few astonishing educational facts about education in India which will surely surprise you.
1. IIT Kanpur has its own Flight Laboratory.
Indian Institute of Technology Kanpur (IIT Kanpur) is a public technical and research university located in Kanpur, Uttar Pradesh. In fact, it has been declared to be an Institute of National Importance by the Government of India under the Institutes of Technology Act.
The most astonishing fact is that IIT Kanpur has its own airstrip/aerodrome located inside the campus. Kalyanpur airport also known as IIT Kanpur airport is a private airport owned by IIT Kanpur. It is utilized by the Aerospace Engineering department of IIT Kanpur for practical study purposes. The airport to used by students to test their models, and they also have a glider flying program.
2. India has the World’s largest school.
City Montessori School (CMS) is a co-educational English medium private school that offers wholesome education from Pre-school up to K-12 (Grade 12) level in Lucknow, India. Founded in 1959 by Drs Jagdish and Bharti Gandhi with the motto Jai Jagat (‘victory to the world’) based on the ancient wisdom of Vasudhaiv Kutumbkam (the whole earth is my family) and inspired by the teachings of Mahatma Gandhi and social reformer Sant Vinobha Bhave. Jai Jagat has been the school’s greeting from the beginning.
This massively spaced and spread school was mentioned as the world’s largest school by the Guinness Book of World Records which reported 64,547 students as of 2020. There are 18 branches of CMS in Lucknow alone. CMS is affiliated to the Council for the Indian School Certificate Examinations and the Cambridge Assessment International Education (CAIE).
3. India has the first and oldest Women’s college in Asia.
Bethune College is a women’s college located on Bidhan Sarani in Kolkata, India, and affiliated with the University of Calcutta. Being the oldest and first women’s college in India, it holds on its roots strongly. It was established as a girls’ school in 1849 and as a college in 1879. Launched in 1849 by John Elliot Drinkwater Bethune they had 21 girls enrolled. The following year, the enrolment numbers rose to 80.
Over and above this, the college also has a stamp designed especially for transporting documents for enrollment to the college. Below is a glimpse of the stamp.
4. India has Asia’s largest residential university.
Banaras Hindu University, established on 4th January 1916 based on the pattern of universities at Taxila and Nalanda is one of Asia’s largest residential universities with more than 35000 students intake per annum.
The university’s main campus spreads over 1,300 acres (5.3 km) was built on land donated by the Kashi Naresh Prabhu Narayan Singh, the hereditary ruler of Banaras. Additionally, they have a campus in the south campus, which spreads over 2,700 acres (11 km) and hosts the most prestigious “Krishi Vigyan Kendra��� (department of Agriculture and Science)
5. Indian government provides free education to all children between the age of 6 to 14 years.
The 86th Constitution Amendment Act, 2002 added Article 21A to the Constitution which requires the State to provide free and compulsory education to all children from the age of 6 to 14 years. This emphasizes the vital importance of free and compulsory education for children between the age of 6 to 14 years. India is one of 135 countries in the world to make education a fundamental right of every child which you must be proud of.

I miss the era when two superstars of the same generation collided on the big screen. Here are my favourite two-hero films of all time-
KARAN ARJUN(1995)

This film had everything a Bollywood movie could ask for. Romance,Action, Comedy, Drama- it had it all. It was a highly hyped release, since the starcast boasted of Salman Khan, Shah Rukh Khan, Raakhee,Amrish Puri,Kajol and Mamta Kulkarni. The storyline of the film focused on a desolate mother and her two sons, who get to know about the truth about their father's death and vow to avenge him, but their greedy uncle kills them instead. 20 years later, they get reincarnated to complete the revenge. While Kajol plays SRK's love interest ( of course!), Mamta Kulkarni plays Salman's girlfriend. Salman was easily the surprise package of the film. His intense, brooding role made my day.

Honestly speaking, a film like this with so many superstars in one frame can't be made today, like can you imagine Dharmendra,Sunil Dutt, Vinod Khanna, Sunny Deol, Sanjay Dutt, Meenakshi Shesadri,Raveena Tandon, Divya Bharti, Raakhee, Puneet Issar and Prem Chopra in one movie in today's time? It was also a rare instance where Sunil Dutt and Dharmendra played father to their real life sons. The film is about an age-old enmity between two Kshatriyan families, over a cow sacrifice. They send their sons to foreign lands to keep them safe from their bloody enmity. Both of them end up becoming friends and a problem ensues when they refuse to continue their enmity. All the lead actors, especially Sunny Deol, acted really powerfully.

This film was another big-ticket one, since it starred a good lead cast of Ajay Devgn, Akshay Kumar, Karisma Kapoor and Nagma. Though it is Ajay who is the main hero, Akshay is more than his sidekick in this film. Karisma and Nagma were more for just romance, though Lolo was the better and the more daring girl. She chased after Ajay's character since she was madly in love with him, and that cinema hall scene was indeed hilarious! The story revolves around Ajay(Devgn)and Raj(Akshay), two best friends who keep on playing pranks on each other and get into trouble regularly. One day, Ajay goes to get his passport made, but he is shocked when he finds out his real name. That night, he sees his mother keeping a Karvachauth and he demands answers. She tells him the whole story of how his father was wrongly framed and was sent to jail. On hearing this, Ajay goes and meets his father in jail and promises to destroy the man who framed him. Raj too joins him in this fight for justice, unaware of the fact that his father too was involved in this.

ANDAZ APNA APNA(1994)

One of the best comedy films of all time. The most shocking fact of this film is that such a great film like this, boasting of a starcast of Aamir Khan, Salman Khan, Raveena Tandon and Karisma Kapoor flopped miserably when it was released. The story revolves around Amar(Aamir)and Prem(Salman), two young jobless slackers who have been a burden on their father's heads. They dream to get rich by wooing and marrying Raveena Bajaj(Raveena), a super-rich heiress who has just returned from England. By doing some drama, Amar and Prem get into her house, but there is a gangster Teja(Paresh Rawal) and his two cronies, Robert and Bhalla, who scheme to kill Raveena and to take away all the wealth. And another problem is Raveena's bumbling secretary Karishma (Karisma Kapoor) who falls in love with Prem.

MUJHSE SHAADI KAROGI(2004)

David Dhawan's two-hero formula has always worked with the audiences, so it's no surprise that this film too did. However, it's way different from his earlier films. It's a story of two men competing to win over a woman. Sameer(Salman) is a short-tempered, God-fearing simpleton who loses his temper at a drop of a hat. That's the reason why he's been unlucky in love. He relocates to Goa as a beach lifeguard. There he comes across a beautiful fashion designer Rani(Priyanka) and instantly falls in love with her. Unfortunately, along with being short-tempered, Sameer is also a ill-fated person, as he unknowingly ends up slapping Rani's father. Adding to the problem is his new roommate Sunny(Akshay) who too develops a liking for her. Rani is faced with a dilemma when she starts liking both Sameer and Sunny. Who will she choose? The songs, acting of the lead cast and the supporting cast, are the things to watch out for in this film.

Sanjay Leela Bhansali's second directorial focuses on love and marriage. It is the story of a musician Sameer(Salman) who comes from Italy to India to learn music from his master and starts living with his family. He constantly flirts, mocks and teases his master's daughter Nandini (Aishwarya) and gets along well with the family members. After some time, Nandini and Sameer become friends and over time, they gradually fall in love with each other. However, when her father finds out about their relationship, he tells Sameer to go away and never return. Sameer refuses to disobey his master and returns to Italy. Nandini gets married to Vanraj(Ajay) who also loves her. However, she still loves Sameer. Vanraj realizes that the love in Nandini's eyes isn't for him, but for Sameer. So, paying no regard to what people will say to him, he decides to sacrifice his love for her and takes her to Italy to reunite her with Sameer. Will he succeed? Watch the film to find out. It's about Suhaan(Salman) an aspiring actor who lands in a fix when his wife Piya(Preity) divorces him and asks him to pay 50 lakh as alimony. As he asks his uncle, midget lawyer Bonny Singh (Anupam Kher) how to pay, he comes across Agastya Rao(Akshay) an astronaut by profession who came by searching for Piya, since he had a crush on her in their college days. So, to avoid paying alimony, Suhaan decides to help Agastya in wooing Piya. And they travel to New York, where Piya is. However, in this quest Suhaan ends up falling in love with her again.
