दिल्ली पुलिस द्वारा मंगलवार को दायर 6,000 पन्नों की चार्जशीट के अनुसार, इसके कारण दंपति के बीच झगड़ा हुआ और पूनावाला ने 'गुस्से में' उसकी हत्या कर दी। '

नई दिल्ली: आफताब पूनावाला ने अपनी प्रेमिका श्रद्धा वाकर की हत्या कर दी क्योंकि वह एक ऐसे व्यक्ति से मिलने से नाराज थी जिससे वह डेटिंग प्लेटफॉर्म पर जुड़ी थी।

दिल्ली पुलिस द्वारा मंगलवार को दायर 6,000 पन्नों की चार्जशीट के मुताबिक, इसी वजह से दंपति के बीच लड़ाई हुई और पूनावाला ने 'गुस्से में' उसकी हत्या कर दी। '

दिल्ली पुलिस के सूत्रों ने द प्रिंट को बताया कि श्रद्धा उस दोस्त से मिलने गई थी जिससे वह गुड़गांव में एक डेटिंग प्लेटफॉर्म पर मिली थी। सूत्र ने कहा, 'लड़ाई करीब 30 मिनट तक चली क्योंकि आफताब गुस्से में था कि वह उस दूसरे लड़के से मिली थी।'

दिल्ली पुलिस के सूत्रों के मुताबिक

श्रद्धा 27 साल के एक अन्य व्यक्ति से मिलने गई थी, जिस दोस्त से वह उस दिन डेटिंग प्लेटफॉर्म पर मिली थी और जब वह वापस लौटी तो दंपति ने लड़ाई शुरू कर दी।

सूत्र ने कहा, 'जब वह वापस आई तो उनके बीच झगड़ा हो गया और आफताब ने सूर्यास्त के समय उसकी हत्या कर दी।'

'आफताब को यह पसंद नहीं था कि वह एक दोस्त से मिलने गई थी। उसी को लेकर उनके बीच झगड़ा हो गया, 'संयुक्त पुलिस आयुक्त (दक्षिण) मीनू चौधरी ने मंगलवार को एक संवाददाता सम्मेलन को संबोधित करते हुए कहा।

चौधरी ने कहा कि मंगलवार को दायर 6,000 पन्नों के आरोप पत्र में मामले के 150 से अधिक गवाहों की गवाही है।

आरोपी के कहने पर सभी शरीर के अवशेष एकत्र किए गए

दिल्ली पुलिस के सूत्रों ने द प्रिंट को बताया कि कुल 16 (लगभग) शरीर के अंग श्रद्धा के पिता से एकत्र किए गए डीएनए से मेल खाते हैं। 'कुछ अन्य टुकड़े ��ी एकत्र किए गए थे, लेकिन उनकी स्थिति के कारण डीएनए नहीं निकाला जा सका।' एक अन्य सूत्र ने कहा, 'आरोपी के कहने पर सभी शरीर के अवशेष एकत्र किए गए थे।'

सूत्रों ने बताया कि 16 शवों में हड्डियां, जबड़ा, श्रोणि और श्रद्धा के बाल शामिल हैं।

पुलिस ने कहा है कि श्रद्धा के शरीर को काटने के लिए कई हथियारों का इस्तेमाल किया गया था, जो अपराध स्थल से बरामद किए गए थे, हालांकि यह फोरेंसिक रूप से स्थापित नहीं किया गया है कि इनका इस्तेमाल शरीर को क्षत-विक्षत करने के लिए किया गया था। 'उसने पूछताछ के दौरान खुलासा किया कि उसने शरीर को क���टने के लिए कई हथियारों का इस्तेमाल किया। कुछ कैंची, चाकू और एक हथौड़ा मिला है। हालांकि चॉपर और आरा नहीं मिला है।'.....

Live-In Relationship A "Dangerous Disease", Bring Law Against It: BJP MP In Parliament

A BJP MP from Haryana today termed live-in relationships a “dangerous disease” that needs to be eradicated from society and urged the government to make a law against it.

Raising the issue in the Lok Sabha during ‘zero hour’, Dharambir Singh also said divorce rates in love marriages were high and the consent of the parents of the bride and groom should therefore be made mandatory for such alliances.

“I want to bring to the notice of the government and Parliament a very serious issue. Indian culture is known for its philosophy of ‘Vasudhaiva Kutumbakam (world is one family) and brotherhood. Our social fabric is different from others in the world. The whole world is impressed by our unity in diversity,” the MP from Bhiwani-Mahendragarh said.

Noting that India has a long tradition of arranged marriages, Mr Singh said a large section of society even to this day gives priority to marriages arranged by parents or relatives.

This has the consent of the bride and groom and arranged marriages are based on a match of several common factors such as social and individual values and likes as well as family backgrounds, he said.

“Marriage is considered a sacred relationship that continues for seven generations…Divorce rate is about 1.1 per cent in India as compared with America which has a rate of about 40 per cent. It has been observed that the rate of divorce in arranged marriages is very less. However, there is a lot of increase in divorce rate recently and the main reason for it is love marriages,” Mr Singh said.

“Therefore, it is my suggestion that the consent of mother and father of the bride and groom be made mandatory in love marriages because in large parts of the country marriage does not happen in the same ‘gotra’ and due to love marriages there are a lot of conflicts in the villages. Scores of families are destroyed in these conflicts, therefore the consent of both the families is important,” he said.

Mr Singh said a “new disease” has emerged and this social evil is called “live-in relationship”.

Under this, two persons, man or woman, live together without marriage, the BJP MP said.

“Such relationships are very common in western nations but this evil is fast spreading in our society also and the consequences are horrible. Recently, the case of Shraddha (Walkar) and Aftab (Poonawala) had come to light in which both were in a live-in relationship,” Mr Singh said.

Such cases keep coming to the fore almost daily, he added while referring to the gruesome case in Delhi of a man allegedly killing his live-in partner and chopping her body to pieces.

“Not only this is ruining our culture but also hatred and evils are spreading in the society. If this continues our culture will die and there will be no difference between us and others,” he said.

“I request the minister that a law be made against live-in relationships so that this dangerous disease can be eradicated from society,” Mr Singh said.

Legal scenario around Narco analysis and polygraph tests in India

The most sensational news at present is of Shradha Walker murder, Aftab Poonawalla who is prime accused in that case is now about to take the polygraph and narco analysis test to dig out the truths in the miser case.

The Delhi Police took the polygraph test and narco analysis for the prime accused Aftab Poonawala to know about the entire details of murder and timeline of the murder to crack up the case

Generally these tests are not considered genuine as it involves inhumane practices and reducing the quality of investigation process but if the accused is not cooperating to the investigation then police take these tests as the last option to know the facts in the case. These Nacro analysis and polygraph tests are commonly known as DDT’s Deception Detection Tests to crack up the inch to inch information

Few months back in another sensational murder of case of 19 year old Dalit Woman in Uttar Pradesh who died in Delhi hospital while undergoing with medical care; the government of Uttar Pradesh went to conduct the polygraph and nacro test.

These tests are done for the purpose of knowing the facts of the issue so they present the physical body in the test so many systems of the body react and are involved in this process when the test is going on.

The physical body should maintain the balance with mental condition of the body in order that if the person is telling the truth, If the person is lying then the physical body and mental state of body goes in different directions and the lie can be dexter easily

Narco Analysis Test

This test was started during world war 2. At that time it became a widespread topic among all the countries.

While performing this test the accused takes the chemical Sodium Pentothal which is commonly called truth serum. When the accused takes this serum he goes to a drowsy state of mind and the complete vision and thinking becomes normal with a certain point of truth telling.

Generally it’s a common fact that when someone is in sedated dosing his mind works complete neutral so that the person reveals the facts

Brain Mapping Test or P-300 Test

Brain mapping test reads if the person's state of mind of thinking is normal or abnormal in condition if it’s normal then the mapping is with equal state if person lies or trying to hide the truth it gets changed and becomes highs and lows of mapping.  After the test got done the report of test gives clear idea for investigating officers about the revealed facts of accused are true or not

Critical analysis 

As of now the status of these tests can’t be completely taken into the consideration as there is lack of scientific evidence that these are accurate.

These tests are still in debate. It can not be concluded as proper information. 

For finding some facts and truth findings the agencies which do investigations ar opting this type of investigation as an alternative to general investigation methods so that time can consumed and also the level of torturing the accused gets reduced.

Normally in our country the illiteracy is high. These tests can show adverse effects on the common people who lack legal knowledge.

Legal scenario around these tests: 

As per the legal system of our country conducting these tests are currently in legal status. Cops have to give reasoning as to why this test is conducted and can proceed further for the investigation. But the acceptance of the accused is compulsory for performing this test

In the case of Selvi & Ors vs State of Karnataka & Anr case 2010, the Top Court noted that no lie detector tests must be monitored or moved “except on the basis of the consent of the accused”. The court continued and strongly said that the accused or person undergoing this type of test must have access to an advocate. 

Before undergoing these tests the consequences of the test must be informed to the accused and the legal implications must also be informed then only this test can be performed. The apex court in earlier verdicts strongly noted that the police should perform this test without violating human rights. Police must follow the NHRC guidelines.

Police must take the permission of the judicial magistrate before conducting these tests.

The answer of these tests can’t be considered as confessions. Because the accused takes the drugs and his condition cannot be completely normal and the accused has the choice to answer or not. Harsh investigation for getting answers is a violation of rule.

During the test any material information given by the suspect cannot be considered as the statement. For suppose if the suspect says that something is at someplace and after that cops found it on that place then in court it is considered as piece of evidence not a statement.

It is clearly mentioned in the Indian constitution article 20(3) that a person cannot be made as witnesses against the ownself.

In 1997 apex court’s case of D.K. Basu vs. The State of West Bengal case, it was noted that if these tests are performed against the will of the accused then it is considered as the cruelty act of police; the top court strongly said such acts are against right to life and personal liberty.

As per the Indian Evidence Act of 1871 findings of these tests can not be considered as evidence. 

Some sensational investigations through these tests in our country:

Rape case of Unnao: 

Central Bureau of Investigation asked the court to perform DDT’s on both of the accused who took part in driving the vehicle which was carrying the victim of Unnao rape in the state of UP. 

2008 Noida double murder case: 

Both of the accused in this case were parents of the victim Arushi Talwar. Police conducted the polygraph test during the investigation.

As of now, no proper scientific proof is there to accept complete accuracy of these tests. But these are opted by the investigative agencies to crack the case easy and for understanding the case in an effective manner.

Conclusion

These tests cannot be considered as proper findings of the evidence as they lack the scientific proof.But, these tests can play a crucial role in finding the truth and to crack the case with less difficulty because some sort of clues will be known to the investigation agencies. Nowadays our country must bring and develop the methods of technology in fact finding otherwise lengthy investigation processes goes on and the intensity of the crime gets reduced day by day and justice cannot be served in a speedy manner.
