The US Copyright Office frees the McFlurry
Tumblr media
I'll be in TUCSON, AZ from November 8-10: I'm the GUEST OF HONOR at the TUSCON SCIENCE FICTION CONVENTION.
Tumblr media
I have spent a quarter century obsessed with the weirdest corner of the weirdest section of the worst internet law on the US statute books: Section 1201 of the Digital Millennium Copyright Act, the 1998 law that makes it a felony to help someone change how their own computer works so it serves them, rather than a distant corporation.
Under DMCA 1201, giving someone a tool to "bypass an access control for a copyrighted work" is a felony punishable by a 5-year prison sentence and a $500k fine – for a first offense. This law can refer to access controls for traditional copyrighted works, like movies. Under DMCA 1201, if you help someone with photosensitive epilepsy add a plug-in to the Netflix player in their browser that blocks strobing pictures that can trigger seizures, you're a felon:
https://lists.w3.org/Archives/Public/public-html-media/2017Jul/0005.html
But software is a copyrighted work, and everything from printer cartridges to car-engine parts have software in them. If the manufacturer puts an "access control" on that software, they can send their customers (and competitors) to prison for passing around tools to help them fix their cars or use third-party ink.
Now, even though the DMCA is a copyright law (that's what the "C" in DMCA stands for, after all); and even though blocking video strobes, using third party ink, and fixing your car are not copyright violations, the DMCA can still send you to prison, for a long-ass time for doing these things, provided the manufacturer designs their product so that using it the way that suits you best involves getting around an "access control."
As you might expect, this is quite a tempting proposition for any manufacturer hoping to enshittify their products, because they know you can't legally disenshittify them. These access controls have metastasized into every kind of device imaginable.

And even printer paper:
https://pluralistic.net/2022/02/16/unauthorized-paper/#dymo-550
DMCA 1201 is the brainchild of Bruce Lehmann, Bill Clinton's Copyright Czar, who was repeatedly warned that cancerous proliferation this was the foreseeable, inevitable outcome of his pet policy. As a sop to his critics, Lehman added a largely ornamental safety valve to his law, ordering the US Copyright Office to invite submissions every three years petitioning for "use exemptions" to the blanket ban on circumventing access-controls.
I call this "ornamental" because if the Copyright Office thinks that, say, it should be legal for you to bypass an access control to use third-party ink in your printer, or a third-party app store in your phone, all they can do under DMCA 1201 is grant you the right to use a circumvention tool. But they can't give you the right to acquire that tool.
I know that sounds confusing, but that's only because it's very, very stupid. How stupid? Well, in 2001, the US Trade Representative arm-twisted the EU into adopting its own version of this law (Article 6 of the EUCD), and in 2003, Norway added the law to its lawbooks. On the eve of that addition, I traveled to Oslo to debate the minister involved:
https://pluralistic.net/2021/10/28/clintons-ghost/#felony-contempt-of-business-model
The minister praised his law, explaining that it gave blind people the right to bypass access controls on ebooks so that they could feed them to screen readers, Braille printers, and other assistive tools. OK, I said, but how do they get the software that jailbreaks their ebooks so they can make use of this exemption? Am I allowed to give them that tool?
No, the minister said, you're not allowed to do that, that would be a crime.
Is the Norwegian government allowed to give them that tool? No. How about a blind rights advocacy group? No, not them either. A university computer science department? Nope. A commercial vendor? Certainly not.
No, the minister explained, under his law, a blind person would be expected to personally reverse engineer a program like Adobe E-Reader, in hopes of discovering a defect that they could exploit by writing a program to extract the ebook text.
Oh, I said. But if a blind person did manage to do this, could they supply that tool to other blind people?
Well, no, the minister said. Each and every blind person must personally – without any help from anyone else – figure out how to reverse-engineer the ebook program, and then individually author their own alternative reader program that worked with the text of their ebooks.
That is what is meant by a use exemption without a tools exemption. It's useless. A sick joke, even.
The US Copyright Office has been valiantly holding exemptions proceedings every three years since the start of this century, and they've granted many sensible exemptions, including ones to benefit people with disabilities, or to let you jailbreak your phone, or let media professors extract video clips from DVDs, and so on. Tens of thousands of person-hours have been flushed into this pointless exercise, generating a long list of things you are now technically allowed to do, but only if you are a reverse-engineering specialist type of computer programmer who can manage the process from beginning to end in total isolation and secrecy.
But there is one kind of use exception the Copyright Office can grant that is potentially game-changing: an exemption for decoding diagnostic codes.
You see, DMCA 1201 has been a critical weapon for the corporate anti-repair movement. By scrambling error codes in cars, tractors, appliances, insulin pumps, phones and other devices, manufacturers can wage war on independent repair, depriving third-party technicians of the diagnostic information they need to figure out how to fix your stuff and keep it going.
This is bad enough in normal times, but during the acute phase of the covid pandemic, hospitals found themselves unable to maintain their ventilators because of access controls. Nearly all ventilators come from a single med-tech monopolist, Medtronic, which charges hospitals hundreds of dollars to dispatch their own repair technicians to fix its products. But when covid ended nearly all travel, Medtronic could no longer provide on-site calls. Thankfully, an anonymous hacker started building homemade (illegal) circumvention devices to let hospital technicians fix the ventilators themselves, improvising housings for them from old clock radios, guitar pedals and whatever else was to hand, then mailing them anonymously to hospitals:
https://pluralistic.net/2020/07/10/flintstone-delano-roosevelt/#medtronic-again
Once a manufacturer monopolizes repair in this way, they can force you to use their official service depots, charging you as much as they'd like; requiring you to use their official, expensive replacement parts; and dictating when your gadget is "too broken to fix," forcing you to buy a new one. That's bad enough when we're talking about refusing to fix a phone so you buy a new one – but imagine having a spinal injury and relying on a $100,000 exoskeleton to get from place to place and prevent muscle wasting, clots, and other immobility-related conditions, only to have the manufacturer decide that the gadget is too old to fix and refusing to give you the technical assistance to replace a watch battery so that you can get around again:
https://www.theverge.com/2024/9/26/24255074/former-jockey-michael-straight-exoskeleton-repair-battery
When the US Copyright Office grants a use exemption for extracting diagnostic codes from a busted device, they empower repair advocates to put that gadget up on a workbench and torture it into giving up those codes. The codes can then be integrated into an unofficial diagnostic tool, one that can make sense of the scrambled, obfuscated error codes that a device sends when it breaks – without having to unscramble them. In other words, only the company that makes the diagnostic tool has to bypass an access control, but the people who use that tool later do not violate DMCA 1201.
This is all relevant this month because the US Copyright Office just released the latest batch of 1201 exemptions, and among them is the right to circumvent access controls "allowing for repair of retail-level food preparation equipment":
https://publicknowledge.org/public-knowledge-ifixit-free-the-mcflurry-win-copyright-office-dmca-exemption-for-ice-cream-machines/
While this covers all kinds of food prep gear, the exemption request – filed by Public Knowledge and Ifixit – was inspired by the bizarre war over the tragically fragile McFlurry machine. These machines – which extrude soft-serve frozen desserts – are notoriously failure-prone, with 5-16% of them broken at any given time. Taylor, the giant kitchen tech company that makes the machines, charges franchisees a fortune to repair them, producing a steady stream of profits for the company.
This sleazy business prompted some ice-cream hackers to found a startup called Kytch, a high-powered automation and diagnostic tool that was hugely popular with McDonald's franchisees (the gadget was partially designed by the legendary hardware hacker Andrew "bunnie" Huang!).
In response, Taylor played dirty, making a less-capable clone of the Kytch, trying to buy Kytch out, and teaming up with McDonald's corporate to bombard franchisees with legal scare-stories about the dangers of using a Kytch to keep their soft-serve flowing, thanks to DMCA 1201:
https://pluralistic.net/2021/04/20/euthanize-rentier-enablers/#cold-war
Kytch isn't the only beneficiary of the new exemption: all kinds of industrial kitchen equipment is covered. In upholding the Right to Repair, the Copyright Office overruled objections of some of its closest historical allies, the Entertainment Software Association, Motion Picture Association, and Recording Industry Association of America, who all sided with Taylor and McDonald's and opposed the exemption:
https://arstechnica.com/tech-policy/2024/10/us-copyright-office-frees-the-mcflurry-allowing-repair-of-ice-cream-machines/
This is literally the only useful kind of DMCA 1201 exemption the Copyright Office can grant, and the fact that they granted it (along with a similar exemption for medical devices) is a welcome bright spot. But make no mistake, the fact that we finally found a narrow way in which DMCA 1201 can be made slightly less stupid does not redeem this outrageous law. It should still be repealed and condemned to the scrapheap of history.

Fact: equipment loss numbers are easier verify than KIA/wounded numbers.
Only the Ruzzians could know how many of their own Putin has killed by attempting to conquer Ukraine, but they're probably in denial (hell, the US still hasn't admitted how many soldiers were killed in Vietnam -- and we continue to pad the MIA/POW rolls which just mean "body not recovered/person who could've verified death also dead") ...
Equipment is easier to verify -- it rarely disappears into red mist and almost always leaves some kind of metal skeleton that can be photographed.
That's where it's worth checking in to see how much carnage has accumulated in 365 calendar days -- and bearing in mind that initially Oryx lagged by about a week but it's real numbers.
Compare to all US equipment losses in all the wars on terror and Iraq since 9/11 2001 or -- it's really beyond comparison.
So, it appears Vladimir rasPutin forgot to ask his Delphic seer an important question before 02/22/2022 at 22:22:22 Moscow time regarding launching at the auspicious astrological alignment the holy crusade that will devestate and destroy the Nazis, "Are we the baddies?"
Anyway, queueing this up, it's August 2022 right now but let's see where we're at at the 1-year 2023 mark, if the Ruzzians haven't tried to nuke everything by then. I'm predicting Ukraine will still be kicking butt but war's a slog:
Thinking that once the Ruzzians finish repairing the Kerch bridge, Ukraine will hit it for good this time.
Ukraine will make good progress towards Crimea and Mariupol but strategy will be not to rush in to hold territory. Focus will instead be the same as during the initial (textbook) defense-in-depth, to force Ruzzians to assault meat grinder kill zones. Ukraine won't give up their defense advantage, instead "defending forward" as they receive increasing resources, equipment and training while attriting larger numbers of Ruzzians as Putler gets desperate and throws more and more conscripts.
I expect it'll be interesting to watch.

What are the best games for a newbie hockey fan to watch to see that patented 1386 chemistry
ooh this was a fun one anon, thank you! this is more like, foundational (imo) games of the "this is nico's team now" era more than anything. but this did get. Very Long. so sorry about that lol
20 APR 2021 - NJD @ PIT: to me, really truly the start of a new era, couple games removed from moving zajac and palmieri at the deadline, in the middle of a 15-game (kinda, they had one win so like, is it really a win) losing streak. down 6-0 at the end of the second period they score 6 (!!!) goals in the third period and fall juuuust short of a comeback leading to this moment
29 APR 2021 - PHI @ NJD: the first of 3 games against philly because covid season was a fever dream individually great games from jack and nico but more importantly one of my favourite hughes to hischier power play goals of the season
19 OCT 2021 - SEA @ NJD: cursed jack shoulder injury game so like, maybe don’t watch it, BUT one of many captain games from nico, absolutely killing it once jack went down, played incredible defensively and kept the team afloat in jack’s absence
31 DEC 2021 - EDM @ NJD: honestly this game has everything (except defense)! jack goal! nico goal! dawson goal! jack ot goal! surprise hugs!
02 JAN 2022 - NJD @ WSH: the very first jack to nico overtime goal! against the caps! rejoice! (and sheldon keefe take notes)
22 JAN 2022 - CAR @ NJD: pride night game, jacknico(sevo) pp goal, post-win shenanigans, lots of them!
24 FEB 2022 - NJD @ PIT: 3 point games for both jack and nico, and 2 (!!!) power play goals, fun game, we love wins, we love pp goals, we love wins with pp goals
22 MAR 2022 - NYR @ NJD: of the ‘prom pose across the ice blown up into a mural at the prudential center where people now take couple photos’ fame. historic night for devils nation, and therefore the world. but also just. such a good game, made you believe in the team and the core (and then they lost 5 of the next 6 because they wouldn’t be the devils if they didn’t). top 3 hischier to hughes goals. the perfect game. obligatory fuck the rags.
28 OCT 2022 - COL @ NJD: second game of the 13 game win streak, we didn’t know what to expect and they gave us an absolute defensive masterclass from nico and a jack power play goal as a treat
disclaimer: not gonna put every game of the win streak here but like. you should watch all of them. just for the pure joy.
10 NOV 2022 - OTT @ NJD: another jacknico ot goal! i.e. things you love to see! truly bonkers overtime, if you don’t want to rewatch the full game just watch the overtime because akira subbed in with like 10 minutes left in the third, ice cold, held it down with ottawa pushing and played SO well in ot
17 NOV 2022 - NJD @ TOR: nico goal, jack ot heroics, and a little hurt/comfort, yknow, the good stuff
15 DEC 2022 - PHI @ NJD: my mind retconned this one as a win and turns out they did lose BUT it is a win solely for nico going after tk in jack’s honour, juicy narratives
07 JAN 2023 - NJD @ NYR: jack going nuclear, jacknico power play assists to jesper (big three goal!) +++ jacknico overtime goal which, okay, sevo scored the goal and neither of them got an assist on it but it’s the essence of it all. also burger king jerseys my beloved.
16–24 JAN 2023: the stretch from the sharks game to the vegas game where they were inexplicably red hot on the power play/6v5 and dougie’s shot was automatic and they put us through an absolute roller coaster.
23 FEB 2023 - LAK @ NJD: hughes to hischier! with the net empty! with like 40 seconds to go in the third and then dawson gets the ot winner and it’s beautiful and life is wonderful and everything’s perfect.
25 FEB 2023 - PHI @ NJD: 2003 cup anniversary game! jack goal! nico goal! something something passing the torch, something something looking up at the rafters hoping that’ll be your name up there someday
Tumblr media
22 APR 2023 - NJD @ NYR - GAME 3: jack power play goal pulling them right back into the series what a game what a time <3
28 NOV 2023 - NYI @ NJD: hughes to hughes to hischier power play goal, that’s family baby! also of course “nico is a horse” game because why be normal about your captain when you can do whatever jack’s doing.
09 MAR 2024 - NJD @ CAR: first jack to nico 5v5 goal! put it in the history books! One of the few bright spots from last season that’s hopefully gonna carry forward this season, jack and nico finally starting to click at 5v5.
22 MAR 2024 - WPG @ NJD: unremarkable in the grand scheme of things but so many power play goals, therefore so many jacknico moments, bon appetit <3

Be the change you want to see. By that, I mean start treating these character deaths like the prisoners' victims have been treated all series. Start asking what they did to deserve this. Start accusing them of attacking someone else first and deserving it. Throw some cheating allegations in there.
Just start going wild with it.
It's been like that with every other death mentioned so far. Why not again here?
How did this happen? Well, you see, Mahiru went to talk to Shidou and he saw her walking then realized the poison just wasn't working. She just kept living regardless of how and thriving despite the doses. This was taking too long why wouldn't she just,
"You're in my way... hurry up and die."
Who knows. The writing was on the wall everyone had read it but her.
22/01/17 (Mahiru’s Birthday)
Mahiru: My birthday…… the day I was born…… But was there really any reason for me being born? Lately I’ve started to wonder that. Do you ever think about stuff like that, Yuno-chan?
Yuno: Eh? Not really. I mean, Mahiru-san, you’re really the romantic type, right? Not that I have anything against that. But isn’t it a bit much to think that everything in life has a meaning? If it makes you happy to think like that then go ahead, but if it doesn’t, then isn’t that in itself meaningless?
Mahiru: : ……you might be right. I’ve always just lived my life like this, so I don’t really know.
Yuno: We’ve all just gone through a bunch of things in life that happened to lead us here. It’s nothing more than a coincidence. Definitely not fate or anything. Probably. Even if there isn’t a meaning, you can still be happy that it’s your birthday. That sort of thing’s all you need in life really. So happy birthday, Mahiru-san.
The first allusion to the attacks occuring was on Haruka's birthday in 2022. After that the first allusion to Shidou treating the injured was on Amane's birthday of the same year,
22/06/27 (Amane’s Birthday)
Kazui: What’s up, Shidou-kun? You’re looking pretty down. I guess you must be tired, I’ve been relying on you a lot lately.
Shidou: Yeah, I just remembered…… today is Amane’s birthday. I’m just getting a bit sentimental.
Kazui: Hmm, it’s unfortunate, but at the moment we can’t worry about that. ……you understand, right? There’s something that you need to do right now. And if you tried talking to her your words definitely won’t reach her. Don’t look at me like that. We’ll just wait until the situation changes. Let’s do our best.
Shidou: Yeah. I’ll do what I can. I can’t have a child making a face like that. Even though we’re “murderers”…… we’re also the adults here.
Three months later we saw her again on Yuno's birthday. She stated that she was having difficulties moving but if she didn't move too much she doesn't even feel pain.
22/09/02 (Yuno’s Birthday)
Mahiru: ……no, I’m fine. As long as I don’t move too much I don’t even feel any pain. Sorry for making you worry.
Yuno: Oh, really? That’s good then. Mahiru-san, if there’s anything you want then just ask. It’s not like it’s a huge burden, I can just ask for it along with my own stuff.
Mahiru: Ok…… I’m fine for now. Sorry, for making you worry.
Ah, Yuno-chan…… Today’s your birthday, right? Happy birthday.
Yuno: ………… Haha, thanks. Thank you, but y’know. Is it really ok for you to be saying that to me when you’re in that situation? ……you really aren’t suited for Milgram, huh, Mahiru-san.
This news seems to have travelled around the prison. Because when Amane approaches her on her birthday the following year she asks her how her body is feelings.
It has now in canon been going on seven months of her being in Shidou's care.
She tells Amane that she fine and she can move around if she uses a wheelchair. This is the only time this wheelchair is mentioned after this Mahiru begins to drastically deteriorate.
23/01/17 (Mahiru’s Birthday)
Amane: Happy birthday. Mahiru-san. How is your body feeling?
Mahiru: ……ah, Amane-chan. Thank you. Yeah, I’m fine. Now I can move around if I use a wheelchair…… It’s all thanks to Shidou-san looking after me……
Amane: I’ll give you one warning. The two of you are dabbling in something tabooed. If you continue to go against the way of nature like this, you’ll just bring an early death upon yourself. Think hard about this.
Mahiru: Amane-chan……? Are you really Amane-chan……?
Eleven months into her being under Shidou's care while requesting questions for the second trial written interrogation Jackalope notes that Shidou and Mahiru have completely entered the roles of patient and doctor.
23/05/15 (Interrogation Start: Shidou and Mahiru)
Jackalope: Prisoner 05, Shidou Prisoner 06, Mahiru. The interrogations for these two will now be held. Just leave your questions in the comments here. Ask whatever you want to know. This is where you show off your skills as a prison guard. ……hmmm. These two have now totally slipped into the roles of doctor and patient huh. It probably isn’t a good time to be getting interrogated for them…… but, well, it’s the rule.
Over the course of her second trial written interrogation Mahiru's handwriting declines rapidly.
Despite being interrogated together with her and being asked the exact same questions. Shidou doesn't offer to help Mahiru with writing her answers even though she is now completely under his care.
As well as the fact that there have been no rules stating that such a thing isn't allowed and that all prisoners must write their own answers.
Tumblr media Tumblr media
Such a drastic and consistent decline in writing alludes to something I've been speculating for a while now. That the prisoners are given all their interrogation questions at once and have to fill them all out at the same time.
We know that Mahiru and Shidou were given these questions together because it is the only way she would come to know that he had kids. As he never brought it up in the timeline before she asked.
Note the next conversation occurs sixteen months after Mahiru began being under Shidou's care.
23/10/24 (Shidou’s Birthday)
Mahiru: You have a family right, Shidou-san……? How does it feel, being married, having kids……?
Shidou: ……yeah, it’s a wonderful thing. Children…… yeah. They really are hope for the future. When you have your own, suddenly it becomes fun growing old. Since as you grow older, you get to see them grow up.
Mahiru: Ah…… how lovely. It was always my dream to become a bride. Though maybe that seems a bit out-dated. I wish it could’ve come true……
Shidou: It isn’t too late. I’m going to make sure you live. So let’s get out of here, and you make your wish come true. ……you still have so much to live for.
Then Kazui asks him later if he has kids so this was new information to everyone and the only place she could have seen that information is on the interrogation card he wrote it.
Tumblr media
Q.11 Tell us your family structure.
Shidou: My wife and my 2 kids.
So he could have helped her fill these out and just choose not to despite knowing full and well how servere her injuries were. Which we know he knew because he opens his second voice drama listing them in detail.
Even if they were not made to answer all their interrogation questions at once and Mahiru was given a reasonable amount of time to write her answers. Such as being given one card on the daily basis to fill out that would make the decline in handwriting more odd. Since at that point it would allude to her overall health deteriorating on a daily bases to the point that she can't even write like she used to be able to anymore.
All still while being under Shidou's constant care.
On Amane's birthday Yuno states that Mahiru has finally managed to get to sleep. Implying that Mahiru has not only had pain related issues but sleep ones as well.
23/06/27 (Amane’s Birthday)
Amane: What is it…… Kashiki Yuno. Don’t sit so close to me. Go away.
Yuno: Sorry for barging in when you’re getting into your worldview thing. But Mahiru-san’s finally managed to get to sleep. Humour me with some small talk while I take a break. By the way, Amane. Have you ever wished you were never born? I’ve thankfully lived a pretty fun life so far, so haven’t really. But you seem to be struggling with something. So I kinda wondered if you thought like that.
Amane: ……I don’t think that. Being born into this world is the first miracle any person experiences, and is something to celebrate. Even if after birth I was put through trial after trial, the value of that will never disappear.
Yuno: Hmm. Ok. ……happy birthday, then. It’s good that you were brought into the world, I guess.
This conversation takes place twelve months or one year into Mahiru being under Shidou's care.
At this point her condition has not improved at all. She has rapidly gotten worse she's lost all mobility is implied to be bed ridden and for a time from this point forward will only be approached by others. Her state has declined so much under Shidou's care that she now needs two people to take care of her and is stated to need constant attention/vigilance to make sure nothing happens to further exacerbate her condition.
Meanwhile the second party to get injured during the second trial intermission has only gotten better without any of Shidou's care. So much so that he's walking around checking up on other prisoners. So, it's not a matter of not being able to heal in Milgram, but we'll see that in her last interaction.
On Kazui's birthday that same year Shidou laments that due to him putting all his time into taking care of Mahiru he hasn't been able to help Kazui around the prison.
23/08/05 (Kazui’s Birthday)
Kazui: Hey, it’s been a while since we last talked. You’ve been working hard lately. Are you doing ok? Should I give you a shoulder massage?
Shidou: ……no, there’s no need to worry. You’re surely on edge at the moment too, after all, Mukuhara-san. Since I’ve been devoting my time to Shiina-kun, I haven’t had time to help with the rest of the prison. Sorry for leaving everything to you.
Kazui: No, it’s fine. I haven’t done anything really. ……you take on too much responsibility on your own. Make sure you rest a bit too. Oh, that’s right, today’s my birthday. So how about you join me for a smoke? As a present.
Shidou: ……I guess it’s precisely because we’re in this situation that things like that are necessary too. Happy birthday. I’ll join you. Can you lend me a cigarette?
Presumably it's during this birthday smoke break that Shidou tells Kazui that Yuno has been helping him. His first response is to later go up to Yuno on her birthday and ask why she's doing that.
To which she responds with,
"If there’s someone dying in front of you anyone would do what they could to help."
Further cementing that Mahiru has not moved one step away from deaths door in now fifteen months of being under Shidou's care. Spoiler alert she doesn't die any better than she started trial two.
23/09/02 (Yuno’s Birthday)
Kazui: I heard you’ve been helping Shidou-kun out. ……er, sorry if this comes across as rude, but it’s kind of unexpected. It always seemed like you didn’t care that much about other people.
Yuno: Hmm? What’s with that all of a sudden. I mean, you’re right, I don’t care much. But if there’s someone dying in front of you anyone would do what they could to help, right? And anyway, aren’t you the same? You usually don’t care much either, right?
Kazui: ……I wonder. This old man isn’t as much of a thinker as you are. I mean, until now I’ve been in an environment where it’s all about having physical strength. So I’ve never really thought about stuff like that.
Yuno: Haha, we’re the same in that we’re both liars too. I guess the difference is the reasons we lie. You care about yourself, so lie to protect yourself. I don’t care about anyone at all, including myself.
Now we're in 2024, and her condition is still notably bad. Like still really bad, like at a glance, you can tell something is wrong bad. This timeline takes place twenty-four months after Mahiru was placed under Shidou's care.
It has been two full years.
She has the same injuries from two years ago while Futa is walking around just fine. No wonder he's concerned and going,
"As long as treatment continues, huh. …… I wonder how you’re going to be saved."
Because if the treatment hasn't worked so far and they've all been here witnessing the treatment this whole time. Seeing it not work while Mahiru is just here like but Shidou's a doctor, and he says if I do x, y, and z, I'll be better in no time. Don't worry. The treatment will work. Sure, I've been this way for two years, but it'll work. Shidou is a good and honest person, I trust him. Beyond that, just you showing concern for me has saved me already.
Dr.Malpractice off in his cell wondering what the fuck he can keep getting away with today. At a point they had to have gone yeah we gotta kill him. Like at a point they must have started getting a bit suspicious.
None of these people are unobservant.
24/01/17 (Mahiru’s Birthday)
Futa: ……hey. Oi, Mahiru. You’re in pretty bad shape, right……? Isn’t there anything that can be done?
Mahiru: What’s up, Futa-kun? Yeah, I’m not great…… But Shidou-san’s been looking after me…… And he says if we keep going like this, I’ll get much better……
Futa: ……right. As long as treatment continues, huh. …… I wonder how you’re going to be saved.
Mahiru: Saved……? Are you worried about me? …… You’ve been a lot kinder lately, Futa-kun. …… I feel like I’ve been saved just hearing those words from you.
Then we've got the timeline before the end.
In which Yuno tells the audience and Shidou straight-up she does not know what he's getting at by saying she should become a doctor. Because the only thing she's done is follow his lead. Possibly with the expectation he was doing what he claimed he was going to do- Help Mahiru get better.
Yuno isn't a doctor she wouldn't be able to check him on if he was doing something wrong or not. She just knows that Mahiru's condition has just gotten worse and worse. So more help is needed or she may really die. She doesn't even fully understand the treatment Shidou is giving Mahiru saying she's just helping with whatever he's doing.
24/09/02 (Yuno’s Birthday)
Shidou: Thank you for your assistance with Shiina-kun’s treatment.
It’s been a big help having you here. Both for her and for me. It’s good to know that even if something happens to me, you’ll still be around.
Yuno: No way. I can’t do anything on my own. All I’m doing is helping with whatever you’re doing. It’s just like playing pretend as a nurse.
Shidou: No, you’ve got a good sense for things like this. You’re quick to notice things, calm, and fearless. If you haven’t decided what you want to be in the future, maybe you should consider becoming a doctor yourself.
Yuno: You think so? ……haha, stop it. I don’t want to be thinking about the future right now. And for someone like me to have other people’s lives in my hands…… that’s no laughing matter.
Then we get to the nail in the coffin.
Kotoko's birthday,
24/12/15 (Kotoko’s Birthday)
Mahiru: Kotoko-chan… are you there…? I'm so-rry, for calling out to you. It's a bit… hard, for me to move… I'll need, to also give my thanks, to Shidou-san…
Kotoko: Going out of your way to meet with me. You're such an airhead it's not even funny. Well…. Go on then, if you've got something to say I think I'll hear out the reproach of a dying woman.
Mahiru: The re-proach…? Oh, its nothing like that… [All I want to say is] Happy, Birthday.
Kotoko: ………… You're out of your goddamn mind.
Where even Kotoko could see Mahiru was dying.
She never got a step away from dying. Everyone was always so focused on other things. Could come up with a million and one excuses for why Mahiru's health situation wasn't improving. All because some wanted to put all their faith in the doctor because why would a doctor-
Who openly told us that he committed malpractice. That he couldn't stop himself. That he'd do it again because he couldn't stay away and that's why he wanted this all to end do that same thing again? Why would he do exactly what he warned the audience he'd do if given the opportunity? Which is gain the trust of people due to his credentials as well as the severity of the circumstances then weaponize said credentials to emphasizes his own importance in order to commit the same fucking crime in front of everyone.
While people swear up and down time works differently in Milgram, that's why she's not healing as fast. We don't even know if the prisoners are alive, so maybe they can't heal once they're injured. While Futa is over here like- Man, I listened to the child and stopped relying on Shidou and I've only continued to get better. This shit is ridiculous. Usually, you're told to always listen to your doctor, but what if your doctor weaponizes that blind faith and societal rule against you to cause irreparable harm. Wow, it's always important to get a second opinion and think for yourself at times. Luckily, I got out.
Right now people are emphasizing how Shidou warned us about Amane. Told us something had to be done about Amane. No one is touching on the fact that Shidou and Amane were both voted innocent. How both of their verdicts led to this outcome. How Amane warned the audience about Shidou and his behavior. Warned Mahiru that what she was doing would lead her to an early death.
No one is asking if Shidou was guilty and Amane innocent would he be the only one out of that pair dead right now. Instead we validated both of them seeing full and well how Shidou was caring for Mahiru every step of the way. Feeling the time drag on and seeing her condition worsen not improve. Yet many kept telling themselves no he's actually doing what he said he would do.
He wouldn't do it again.
Milgram is just weird. We don't know enough about the space to say that's not impacting how long it takes for these injuries to heal. So his behavior was validated again and maybe if it wasn't Mahiru might still fucking be here. Because if she was given the space to properly heal instead of being kept at deaths door in immense physical pain and emotional distress for two years.
By this man who can only feel validated in his own existence and as though his life has purpose when he has someone else to take care of then maybe she could have at least spent her last days in less pain than she died in here. Because there is no reason that her injuries should have remained for twenty-nine months.
To the extent that she was still having trouble moving and looking as though she was at death's door to anyone who saw her before she was ever even lost. It sucks but a lot of people including myself have speculated he was committing malpractice again as soon as he was voted innocent and Mahiru was voted innocent but her condition still continued to worsen many suspected that.
It sucks that Mahiru had to suffer due to the audience's and others blind trust in this medical professional. That the work has done everything in its power to display commits malpractice and isn't safe to have around injured or sick people. They literally could not have announced this harder. Maybe he didn't do it. But it's still weird that all the injuries he lists Mahiru having in his second voice drama at most take three to six months to heal and she was still recovering from allegedly the same injuries Kotoko gave her up until she died.
"Head lacerations. Bruising all over her body. A sprained neck. Fractured ribs. Further fracturing of the left arm. And furthermore... This may be outside of my profession, but her mental health is deteriorating as well."
Maybe the number of injuries all together and the inadequate equipment within Milgram made it take longer. Yet she never got better in over two years. She couldn't walk without feeling pain. She started out being able to at least move a little without pain and through the use of a wheelchair but even that stopped.
She just got worse and worse until she died. Then, the one time we saw her up and walking before she died, Shidou was nowhere to be found. Last she said she was gonna go find him to say thank you. Who knows how that went or why she couldn't find him to begin with. Especially since his cell is right next to hers. That would imply he wasn't in it, which maybe.
I just know that if she was given time to heal if Shidou did back off a bit maybe she wouldn't have been in as fragile a state as she was. Well at least she doesn't have to spend another birthday writhing in pain from wounds that seem to never heal.
"This adorable, earnest, sincere ♥ Is bleeding, wailing, this is the end."

The majority of censorship is self-censorship
Tumblr media
I'm on tour with my new novel The Bezzle! Catch me TONIGHT in SAN DIEGO (Feb 22, Mysterious Galaxy). After that, it's LA (Saturday night, with Adam Conover), Seattle (Monday, with Neal Stephenson), then Portland, Phoenix and more!
Tumblr media
I know a lot of polymaths, but Ada Palmer takes the cake: brilliant science fiction writer, brilliant historian, brilliant librettist, brilliant singer, and then some:
https://pluralistic.net/2022/02/10/monopoly-begets-monopoly/#terra-ignota
Palmer is a friend and a colleague. In 2018, she, Adrian Johns and I collaborated on "Censorship, Information Control, & Information Revolutions from Printing Press to Internet," a series of grad seminars at the U Chicago History department (where Ada is a tenured prof, specializing in the Inquisition and Renaissance forbidden knowledge):
https://ifk.uchicago.edu/research/faculty-fellow-projects/censorship-information-control-information-revolutions-from-printing-press/
The project had its origins in a party game that Ada and I used to play at SF conventions: Ada would describe a way that the Inquisitions' censors attacked the printing press, and I'd find an extremely parallel maneuver from governments, the entertainment industry or other entities from the much more recent history of internet censorship battles.
With the seminars, we took it to the next level. Each 3h long session featured a roster of speakers from many disciplines, explaining everything from how encryption works to how white nationalists who were radicalized in Vietnam formed an armored-car robbery gang to finance modems and Apple ][+s to link up neo-Nazis across the USA.
We borrowed the structure of these sessions from science fiction conventions, home to a very specific kind of panel that doesn't always work, but when it does, it's fantastic. It was a natural choice: after all, Ada and I know each other through science fiction.
Even if you're not an sf person, you've probably heard of the Hugo Awards, the most prestigious awards in the field, voted on each year by attendees of the annual World Science Fiction Convention (Worldcon). And even if you're not an sf fan, you might have heard about a scandal involving the Hugo Awards, which were held last year in China, a first:
https://www.nbcnews.com/news/world/science-fiction-authors-excluded-hugo-awards-china-rcna139134
A little background: each year's Worldcon is run by a committee of volunteers. These volunteers put together bids to host the Worldcon, and canvass Worldcon attendees to vote in favor of their bid. For many years, a group of Chinese fans attempted to field a successful bid to host a Worldcon, and, eventually, they won.
At the time, there were many concerns: about traveling to a country with a poor human rights record and a reputation for censorship, and about the logistics of customary Worldcon attendees getting visas. During this debate, many international fans pointed to the poor human rights record in the USA (which has hosted the vast majority of Worldcons since their inception), and the absolute ghastly rigmarole the US government subjects many foreign visitors to when they seek visas to come to the US for conventions.
Whatever side of this debate you came down on, it couldn't be denied that the Chinese Worldcon rang a lot of alarm-bells. Communications were spotty, and then the con was unceremoniously rescheduled for months after the original scheduled date, without any good explanation. Rumors swirled of Chinese petty officials muscling their way into the con's administration.
But the real alarm bells started clanging after the Hugo Award ceremony. Normally, after the Hugos are given out, attendees are given paper handouts tallying the nominations and votes, and those numbers are also simultaneously published online. Technically, the Hugo committee has a grace period of some weeks before this data must be published, but at every Worldcon I've attended over the past 30+ years, I left the Hugos with a data-sheet in my hand.
Then, in early December, at the very last moment, the Hugo committee released its data – and all hell broke loose. Numerous, acclaimed works had been unilaterally "disqualified" from the ballot. Many of these were written by writers from the Chinese diaspora, but some works – like an episode of Neil Gaiman's Sandman – were seemingly unconnected to any national considerations.
Readers and writers erupted in outrage, demanding to know what had happened. The Hugo administrators – Americans and Canadians who'd volunteered in those roles for many years and were widely viewed as being members in good standing of the community – were either silent or responded with rude and insulting remarks. One thing they didn't do was explain themselves.
The absence of facts left a void that rumors and speculation rushed in to fill. Stories of Chinese official censorship swirled online, and along with them, a kind of I-told-you-so: China should never have been home to a Worldcon, the country's authoritarian national politics are fundamentally incompatible with a literary festival.
As the outrage mounted and the scandal breached from the confines of science fiction fans and writers to the wider world, more details kept emerging. A damning set of internal leaks revealed that it was those long-serving American and Canadian volunteers who decided to censor the ballot. They did so out of a vague sense that the Chinese state would visit some unspecified sanction on the con if politically unpalatable works appeared on the Hugo ballot. Incredibly, they even compiled clumsy dossiers on nominees, disqualifying one nominee out of a mistaken belief that he had once visited Tibet (it was actually Nepal).
There's no evidence that the Chinese state asked these people to do this. Likewise, it wasn't pressure from the Chinese state that caused them to throw out hundreds of ballots cast by Chinese fans, whom they believed were voting for a "slate" of works (it's not clear if this is the case, but slate voting is permitted under Hugo rules).
All this has raised many questions about the future of the Hugo Awards, and the status of the awards that were given in China. There's widespread concern that Chinese fans involved with the con may face state retaliation due to the negative press that these shenanigans stirred up.
But there's also a lot of questions about censorship, and the nature of both state and private censorship, and the relationship between the two. These are questions that Ada is extremely well-poised to answer; indeed, they're the subject of her book-in-progress, entitled Why We Censor: from the Inquisition to the Internet.
In a magisterial essay for Reactor, Palmer stakes out her central thesis: "The majority of censorship is self-censorship, but the majority of self-censorship is intentionally cultivated by an outside power":

States – even very powerful states – that wish to censor lack the resources to accomplish totalizing censorship of the sort depicted in Nineteen Eighty-Four. They can't go from house to house, searching every nook and cranny for copies of forbidden literature. The only way to kill an idea is to stop people from expressing it in the first place. Convincing people to censor themselves is, "dollar for dollar and man-hour for man-hour, much cheaper and more impactful than anything else a censorious regime can do."
Ada invokes examples modern and ancient, including from her own area of specialty, the Inquisition and its treatment of Gailileo. The Inquistions didn't set out to silence Galileo. If that had been its objective, it could have just assassinated him. This was cheap, easy and reliable! Instead, the Inquisition persecuted Galileo, in a very high-profile manner, making him and his ideas far more famous.
But this isn't some early example of Inquisitorial Streisand Effect. The point of persecuting Galileo was to convince Descartes to self-censor, which he did. He took his manuscript back from the publisher and cut the sections the Inquisition was likely to find offensive. It wasn't just Descartes: "thousands of other major thinkers of the time wrote differently, spoke differently, chose different projects, and passed different ideas on to the next century because they self-censored after the Galileo trial."
This is direct self-censorship, where people are frightened into silencing themselves. But there's another form of censorship, which Ada calls "middlemen censorship." That's when someone other than the government censors a work because they fear what the government would do if they didn't. Think of Scholastic's cowardly decision to pull inclusive, LGBTQ books out of its book fair selections even though no one had ordered them to do so:

This is a form of censorship outsourcing, and it "multiplies the manpower of a censorship system by the number of individuals within its power." The censoring body doesn't need to hire people to search everyone's houses for offensive books – it can frighten editors, publishers, distributors, booksellers and librarians into suppressing the books in the first place.
This outsourcing blurs the line between state and private surveillance. Think about comics. After a series of high-profile Congressional hearings about the supposed danger of comics to impressionable young minds, the comics industry undertook a regime of self-censorship, through which the private Comics Code Authority would vet comings for "dangerous" content before allowing its seal of approval to appear on the comics' covers. Distributors and retailers refused to carry books without a CCA stamp, so publishers refused to publish books unless they could get a CCA stamp.
The CCA was unaccountable, capricious – and racist. By the 60s and 70s, it became clear that comic about Black characters were subjected to much tighter scrutiny than comics featuring white heroes. The CCA would reject "a drop of sweat on the forehead of a Black astronaut as 'too graphic' since it 'could be mistaken for blood.'" Every comic that got sent back by the CCA meant long, brutal reworkings by writers and illustrators to get them past the censors.
The US government never censored heroes like Black Panther, but the chain of events that created the CCA "middleman censors" made sure that Black Panther appeared in far fewer comics starring Marvel's most prominent Black character. An analysis of censorship that tries to draw a line between private and public censorship would say that the government played no role in Black Panther's banishment to obscurity – but without Congressional action, Black Panther would never have faced censorship.
This is why attempts to cleanly divide public and private censorship always break down. Many people will tell you that when Twitter or Facebook blocks content they disagree with, that's not censorship, since censorship is government action, and these are private actors. What they mean is that Twitter and Facebook censorship doesn't violate the First Amendment, but it's perfectly possible to infringe on free speech without violating the US Constitution. What's more, if the government fails to prevent monopolization of our speech forums – like social media – and also declines to offer its own public speech forums that are bound to respect the First Amendment, we can end up with government choices that produce an environment in which some ideas are suppressed wherever they might find an audience – all without violating the Constitution:

The great censorious regimes of the past – the USSR, the Inquisition – left behind vast troves of bureaucratic records, and these records are full of complaints about the censors' lack of resources. They didn't have the manpower, the office space, the money or the power to erase the ideas they were ordered to suppress. As Ada notes, "In the period that Spain’s Inquisition was wildly out of Rome’s control, the Roman Inquisition even printed manuals to guide its Inquisitors on how to bluff their way through pretending they were on top of what Spain was doing!"
Censors have always done – and still do – their work not by wielding power, but by projecting it. Even the most powerful state actors are not powerful enough to truly censor, in the sense of confiscating every work expressing an idea and punishing everyone who creates such a work. Instead, when they rely on self-censorship, both by individuals and by intermediaries. When censors act to block one work and not another, or when they punish one transgressor while another is free to speak, it's tempting to think that they are following some arcane ruleset that defines when enforcement is strict and when it's weak. But the truth is, they censor erratically because they are too weak to censor comprehensively.
Spectacular acts of censorship and punishment are a performance, "to change the way people act and think." Censors "seek out actions that can cause the maximum number of people to notice and feel their presence, with a minimum of expense and manpower."
The censor can only succeed by convincing us to do their work for them. That's why drawing a line between state censorship and private censorship is such a misleading exercise. Censorship is, and always has been, a public-private partnership.
