The FTC has Big Pharma’s number

On November 27, I'm appearing at the Toronto Metro Reference Library with Facebook whistleblower Frances Haugen.

On November 29, I'm at NYC's Strand Books with my novel The Lost Cause, a solarpunk tale of hope and danger that Rebecca Solnit called "completely delightful."

The most consistent bright spot in the dark swirl of US politics is the competence of the Biden Administration's progressive enforcers: people like Rohit Chopra, Jonathan Kanter and Lina Khan, who keep demonstrating just how far a good administrator can go. Anyone can have a vision, but knowing how to execute is the difference between hot air and real change:

Take a minute to contrast Biden's administrators with Trump's: Trump's administrators had an ideological vision just as surely as Biden's do, and Trump himself had a much more pronounced and explicit ideology than Biden, whose governance style is much more about balancing the Democratic Party's blocs than bringing about a specific set of policies:

But whatever clarity of vision the Trump administration brought to DC was completely undermined by its incompetence (thankfully!). Apart from one gigantic tax break, Trump couldn't get stuff done. He couldn't deliver, because he'd lose his temper or speak out of turn:

And his administrators followed his lead. Scott Pruitt was appointed to run the EPA after a career spent suing the agency. It could have been the realization of his life's dream to dismantle environmental law in America and open the floodgates for unlimited, wildly profitable corporate pollution and pillaging. But the dream died because he kept getting embroiled in absurd scandals – like the time he sent his staffers out to drive around all night looking for a good deal on a used mattress:

Or his insistence on installing a CIA-style "Sensitive Compartmented Information Facility" (SCIF) so he could play super-spy while reading memos:

Or the time he sent his security detail to the Ritz-Carlton to demand that they supply him lots of little bottles of his favorite hand-cream:

There were other examples in the Trump administration, but Priutt is such a good case-study. He's like a guy who spent his whole life training to compete in the Olympics, and finally got a shot, only to be disqualified for ordering too much room-service in the Olympic Village. Priutt was wildly ambitious, but he was profoundly undisciplined – and wildly incompetent.

Compare that with Biden's progressive enforcers and agency heads, who showed up on the first day of work with an encyclopedic knowledge of their administrative powers, and detailed plans for using them to transform the lives of the American people for the better:

The Biden administration's competence translates into action, getting stuff done. Maybe that shouldn't surprise us, given the difference between the stories that reactionaries and progressives tell about where change comes from.

In reactionary science fiction, we enter the realm of the "Competent Man" story. Think of a Heinlein hero, who is "able to change a diaper, plan an invasion, butcher a hog, conn a ship, design a building, write a sonnet, balance accounts, build a wall, set a bone, comfort the dying, take orders, give orders, cooperate, act alone, solve equations, analyse a new problem, pitch manure, program a computer, cook a tasty meal, fight efficiently, die gallantly."

In Competent Man stories, a unitary hero steps into the breach and solves the problem – if not single-handedly, then as the leader of others, whose lesser competence is a base metal that the Competent Man hammers into a tempered blade:

Contrast this with a progressive tale, like, say, Kim Stanley Robinson's Ministry For the Future, where the Competent Man is replaced by the Competent Administration, in which people of goodwill and technical competence figure out how to join forces to create population-scale architectures of participation that allow every person to contribute their skills and perspective:

The right's whole ideology insists that the world can only be saved by Competent Men. As Corey Robin writes in The Reactionary Mind, the unifying factor that binds together conservative factions from monarchists to racists to Christian Dominionists is the belief that a few of us are born to rule, and the rest to be ruled over:

The Reaganite insistence that governments are, by their very nature, incompetent and malign ("The nine most terrifying words in the English language are, 'I’m from the government, and I’m here to help'"), means that conservatives deny the possibility of a Competent Administration.

When conservatives take office and proceed to bungle the most basic elements of administration, they're fulfilling their own campaign narrative, which starts with "We must dismantle the government because it is bad at everything." Conservatives who govern badly prove their own point, which explains a lot about the UK Tory Party's long run of governmental failure and electoral success:

There's a small mercy in the fact that so many of the most ideologically odious and extreme conservative governments are so technically incompetent in governing, and thus accomplish so little of their agendas.

But the inverse – the incredible competence of the best progressive administrators – is nothing short of a delight to witness. Here's the latest example to cross my path: the FTC has intervened in a lawsuit over generic insulin pricing, on an issue that is incredibly technically specific and also fantastically important:

The underlying case is before the FDA, and it concerns the dirty tricks that pharma giant Sanofi used to keep Mylan from making a generic version of Mylan's Lantus insulin after its patent expired.

There's an explicit bargain in patents: inventors can enlist the government to punish their rivals for copying their ideas, but in exchange, the government demands that the inventor has to describe how the invention works in a detailed patent filing, and when the patent expires, 20 years later, rivals can use the patent application as instructions for freely copying and selling the invention. In other words: you get 20 years of exclusive rights in return for facilitating your competitors' copying and selling your invention when the 20 years are up.

Pharma doesn't like this, naturally: not content with 20 years of exclusivity, they want the government to step in and punish their competitors forever. In service to that end, pharma companies have perfected a process called evergreening, where they dribble out ancillary patents after their initial filing, covering minor reformulations, delivery systems, or new uses.

Evergreening got a moment in the public eye earlier this year, with John Green's viral campaign to shame Johnson & Johnson out of using evergreening to restrict poor countries' access to TB medication:

The story of pharma is that it commands gigantic profits, but it invests those profits into medicines that save our lives. The reality is that most of the key underlying pharma research is publicly funded (by Competent Administrators who apportion funding to promising scientific inquiry). Pharma companies' most inventive genius is devoted to inventing new evergreening tactics:

That's where the FTC comes in, in this Sanofi-Mylan case. To facilitate the production of generic, off-patent drugs, the FDA maintains a database called the "Orange Book," where pharma companies are asked to enumerate all the ancillary patents associated with a product whose patent is expiring. That way, generics manufacturers who make their own version of these public domain drugs and therapeutics don't accidentally stumble over one of those later patents – say, by replicating a delivery system or special coating that is still in patent.

This is where the endless, satanic inventiveness of the pharma sector comes in. You see, US law provides for triple damages for "willful patent infringement." If you are a generics manufacturer eyeing up a drug whose patent is about to expire and you are notified that some other patents might be implicated in your plans, you must ensure that you don't accidentally infringe one of those patents, or face business-destroying statutory damages.

So pharma companies stuff the Orange Book full of irrelevant patent claims they say may be implicated in a generic manufacture program. Each of these claims has to be carefully evaluated, both by a scientific team and a legal team, because patents are deliberately obfuscated in the hopes of tricking an inattentive patent examiner into granting patents for unpatentable "inventions":

What's more, when a pharma giant notifies the FDA that it has ancillary patents that are relevant to the Orange Book, this triggers a 30-month delay before a generic can be marketed – adding 2.5 years to the 20 year patent term. That delay is sometimes enough to cause a manufacturer to abandon plans to market a generic drug – so the delay isn't 2.5 years, it's infinite.

This is a highly technical, highly consequential form of evergreening. It's obscure as hell, and requires a deep understanding of patent obfuscation, ancillary patent filings, generic pharma industry practice, and the FDA's administrative procedures.

Sanofi's Orange Book entry for Lantus insulin listed 50 related patent claims. Of these, 48 were invalidated through "inter partes" review (basically the Patent Office decided they shouldn't have allowed these claims to be included on a patent). Neither of the remaining two claims were found to be relevant to the manufacture of generic Lantus.

This is where the FTC's filing comes in: their amicus brief doesn't take a position whether Sanofi's Orange Book entries were fraudulent, but they do ask the FDA to intervene to prevent Orange Book stuffing because "improper listings can cause significant harm to competition and consumers."

This is the kind of boring, technical, important stuff that excellent administrators can do. The FTC's brief is notice to the FDA that it should amend its procedures to ban (and punish) Orange Book abuse. That will make it possible for you, a person who needs medicine, to get that medicine more cheaply and quickly. In America's pay-for-use privatized healthcare hellscape, this could be a life-or-death matter.

There's plenty of things the Biden administration is getting very, very badly wrong, but we shouldn't lose sight of how its progressive wing is making real, lasting change for the better. Competent Administrations are the true peoples' champions. They beat Competent Men every time.

f1 abba inspired series

hey everyone! i have an abba-song inspired series in the drafts (since i got back from vaca and i'm still in a summery-mood and i love abba songs). hopefully it will be about three-five parts, each part a story for a different driver. each part will also have a minimum of 10K words, so this will be a prose series!

On a summer getaway to Santorini, Greece, Y/N finds herself staying in a charming Airbnb with her family, soaking in the breathtaking views and vibrant atmosphere of the island. However, what was supposed to be a peaceful vacation takes an unexpected turn when she discovers that they’ll be sharing the house with none other than Formula One driver Oscar Piastri, who’s also vacationing with his family.

At first, the arrangement feels awkward, the two worlds of celebrity racing and her relatively normal life as a collegiate student colliding in the most unforeseen way. But as the days go by, the initial surprise gives way to something deeper. As they explore the sun-drenched beaches, dine in quaint tavernas, and experience the lively nightlife of Santorini, Y/N and Oscar find themselves drawn to each other in ways they hadn’t anticipated.

“Max,” Daniel calls to him from the bedroom, just as he is rinsing the shampoo from his hair. Not wanting shampoo in his eyes or his mouth, Max keeps them all firmly shut.

“Baby?” Daniel says again, louder.

The warm water is a gentle relief running over his sweat sticky skin, nowhere near the scalding temperatures Daniel sets their shower to at home. It’s why Max had insisted that they clean off separately, the Austin heat far too much for Max to endure boiling water too, despite Daniel’s pouting and dramatic insistence that Max couldn’t just ‘fuck and flee.”

“Yes,” he calls when all the suds are safely sliding past his shoulders, but he didn’t need to shout. When he opens his eyes he sees Daniel leaning against the doorway with a smirk, still wearing his unbuttoned satin shirt, cowboy hat and nothing else. His wedding ring sits heavy on his finger, and Max thumbs over the matching one on his own hand.

Max’s come is a shiny presence he can still see smeared between Daniel’s thighs.

The sight of him makes Max’s dick twitch. Daniel notices and his grin only widens.

“Baby,” he says again, too sweet. “Baby, why is your most recent Google search is it weird that my husband saying yeehaw makes me come?”

And just like that, Max suddenly longs for a hot shower, an excuse for why his cheeks start to burn red.

“Why are you snooping through my phone?” He demands, forcing himself not to turn away casually and instead keep rubbing the hotel’s own body wash under his armpits.

“I wasn’t snooping,” Daniel says easily, “I was looking to get us some ribs delivered, my phone died at the track, remember?”

Max makes a noncommittal noise because vaguely he does remember Daniel saying he needed to put it on charge. That was before Max started pawing at him the moment the hotel door shut behind them though, and then it had been forgotten by both of them.

There’s just the noise of the extractor fan whirring for a moment, but Daniel doesn’t move. When Max sneaks a glance at him, he’s still leaning against the door frame looking amused.

“Sooo.” He drawls out the word in the stupid Texas accent that Max wishes he didn’t find so strangely sexy. “Are we going to talk about this, little lady, or-“

“Nope,” Max says firmly, turning off the shower.

Daniel nods. It makes the lights of the bathroom catch on his chain and Max- Max really wants to fuck him again.

“What about the one below it?” He asks, “Daniel Ricciardo Austin 2023 photos?”

“Nope,” Max says again, stepping out of the shower and reaching for his towel. He’s smiling now too, because he knows that beneath Daniel’s teasing that one will have made him happy to see.

“Okay,” Daniel says, then he unlocks Max’s phone. “What about how to ask my husband to-“

“Daniel,” Max interrupts, taking the phone from his hand and putting it into the empty sink. “Do you want to read more of my internet history, or do you want to get back on the bed and play good cowboy, bad cowboy again?”

Daniel grins, takes the cowboy hat from his head and puts it onto Max’s. When his arms wind around Max, the silky fabric of his shirt presses cool against Max’s shower-warm skin, his nipples.

“Well, when you put it like that,” Daniel says, leaning in to put his mouth on the skin just beneath Max’s ear. “Yeehaw, baby.”

Max laughs and pinches Daniel’s ass, at the same time as his dick twitches again. Backing him out of the bathroom, towards the bed, his phone is forgotten in the bathroom.

✼. THRU SPACE 'N TIME | PROFILE.

Born in Gold Coast, Australia on December 23, 1999, Michaela Sommers was introduced to the world of motorsports from a early age. Her father, Tobias, and his younger brother, Travis Sommers, were avid Formula racing fans who idolized the likes of Senna, Schumacher, and Lauda. The motorsports bug skipped over Sommers' older sister, Samantha, before biting her at the mere age of six. By her ninth birthday, Michaela was competing in karting championships along the Australian east coast.

Despite her natural aptitude for racing, Michaela recalls facing discrimination for both her race and gender quite early on while karting. Despite the negativity that would swirl around her reputation, the young driver would win her first national championship at the age of twelve with plenty of rumors circling concerning her future in the sport. Sommers would attempt to enter her first international competition, but was barred from entry after her father lost his job in the summer of 2012.

Without much hope, Michaela would step back from racing for nearly six months before eventually deciding to join her uncle who had moved to England after his marriage just years prior. Travis then became Michaela's manager, working endlessly to ensure his niece would be able to continue climbing the karting ladder. Shortly after her move to England, her uncle would connect with Australian F1 driver Mark Webber who would travel to watch her race in a regional competition in 2013. Stunned by her potential, Webber helped the young girl to catch the attention of a racing team competing in the Ginetta Junior Championship alongside future McLaren teammate Lando Norris. Sommers' transition to racing cars would prove successful, securing a junior championship at just 14 years old.

Sommers would continue working through the ranks, receiving extensive media attention and comparisons to Lewis Hamilton as a teenager. Spending one year at the Formula 3 level, Michaela would race for British team Jagonya Ayam in 2015 finishing fifth in the championship and second in the rookie cup, both below Charles Leclerc. Her performance would catch the attention of Italian team Prema Racing who signed her to development for higher formulae alongside Pierre Gasly for the 2016 season.

Despite an average result, ending her rookie season in sixth place, Prema would resign the Australian who would be simultaneously be selected to join the Ferrari driver development program for the 2017 season. That same year, Sommers would wrap up her Formula 2 season in second place, once again behind Charles Leclerc.

Eventually, Michaela would finally secure a Formula 2 championship in 2018 while signing on as a reserve driver for Ferrari. Her official Formula One debut came after Sommers signed on to be Alfa Romeo's second-seat driver for the 2019 season, securing one-point in her debut race before finishing her rookie season in eighth place.

Rosemary Kirstein’s “The Steerswoman”

For decades, scammy "book doctors" and vanity presses spun a tale about how Big Publishing was too conservative and risk-averse for really really adventurous books, and the only way to get your visionary work published was to pay them to fill your garage with badly printed books that you'd spend the rest of your life trying to get other people to read:

Like all successful grifts, this one worked because it wasn't entirely untrue. No, mainstream publishing isn't filled with corporate gatekeepers who relish the idea of keeping your brilliance from reaching its audience.

But.

But editors sometimes make bad calls. They reject books because of quirks of taste, or fleeting inattentiveness, or personal bias. In a healthy publishing industry – one with dozens of equal-sized presses, all commanding roughly comparable market-share, good books would never slip through the cracks. One publisher's misstep would be another's opportunity.

But after decades of mergers, the population of major publishers has dwindled to a mere Big Five (it was almost four, but the DOJ blocked Penguin Random House's acquisition of Simon & Schuster):

This means that some good books definitely can't find a home in Big Publishing. If you miss with five editors, you can exhaust all your chances with the Big Five.

There's a second tier of great publishers, from data-driven juggernauts like Sourcebooks to boutique presses like Verso and Beacon Press, who publish wonderful books and are very good to their authors (I've published with four of the Big Five and half a dozen of the smaller publishers).

But even with these we-try-harder boutique publishers in the mix, there's a lot of space for amazing books that just don't fit with a "trad" publisher's program. These books are often labors of love by their creators, and that love is reciprocated by their readers. Then there's last year's surprise smash hit, Shift Happens, a two-volume, 750-page slipcased book recounting the history of the keyboard. I own one. It's fantastic:

Then there's the whole world of indie Kindle books pitched at incredibly voracious communities of readers, especially the very long tail of very niche sub-sub-genres radiating off the woefully imprecise category of "paranormal romance." These books are landing at precisely the right spot for their readers, despite some genuinely weird behind-the-scenes feuds between their writers:

But as Sturgeon's Law has it: "90% of everything is shit." Having read slush – the pile of unsolicited manuscripts sent to publishers – I can tell you that a vast number of books get rejected from trad publishers because they aren't good books. I say this without intending any disparagement towards their authors and the creative impulses that drive them. But a publisher's job isn't merely to be good to writers – it's to serve readers, by introducing them to works they are apt to enjoy.

The vast majority of books that publishers pass on are not books that you will want to read, so it follows that the vast majority of self-published work that is offered on self-serve platforms like Kindle or pitched by hopeful writers at street fairs and book festivals is just not very good.

But sometimes you find someone's independent book and it's brilliant, and you get the double thrill of falling in love with a book and of fishing a glittering needle out of an unimaginably gigantic haystack.

(If you want to read an author who beautifully expresses the wonder of finding an obscure, self-published book that's full of unsuspected brilliance, try Daniel Pinkwater, whose Alan Mendelsohn, The Boy From Mars is eleven kinds of brilliant, but is also a marvelous tale of the wonders of weird used book stores with titles like KLONG! I also write books, and I am, in fact, presently in the midst of a long book-tour for my novel The Bezzle. Last month, I did an event in Cambridge, Mass with Randall "XKCD" Munroe that went great. We had a full house, and even after the venue caught fire (really!), everyone followed us across the street to another building, up five flights of stairs, and into another auditorium where we wrapped up the gig:

Afterwards, our hosts from Harvard Berkman-Klein took us to a campus pizza joint/tiki bar for dinner and drinks, and we had a great chat about a great many things. Naturally, we talked about books we loved, and Randall said, "Hey, have you ever read Rosemary Kirstein's Steerswoman novels?"

"They're incredible. All these different people kept recommending them to me, and they kept telling me that I would love them, but they wouldn't tell me what they were about because there's this huge riddle in them that's super fun to figure out for yourself:"

How could I resist a pitch like that? So I ordered a copy:

Holy moly is this a good novel! And yeah, there's a super interesting puzzle in it that I won't even hint at, except to say that even the book's genre is a riddle that you'll have enormous great fun solving.

Randall wasn't kidding about the book's package. The type looks to be default Microsoft fonts, the spine is printed slightly off-register, the typesetting has lots of gonks, and it's just got that semi-disposable feel of a print-on-demand title.

Without Randall's recommendation, I never would have even read this book closely enough to notice the glowing cover endorsement from Jo Walton, nor the fact that it was included in Damien Broderick and Paul Di Filippo's "101 Best Science Fiction Novels 1985-2010."

But I finished reading the first volume just a few minutes ago and I instantly ordered the next three in the series (it's planned for seven volumes, and the author says she plans on finishing it – I can't wait).

This book is such an unexpected marvel, a stunner of a novel filled with brilliant world-building, deft characterizations, a hard-driving plot and a bunch of great surprises. The fact that such a remarkable tale comes in such an unremarkable package makes it even more of a treasure, like a geode: unremarkable on the outside, a glittering blaze within.
