okay just to clear this up since people are spreading misinfo even though the truth is way funnier. SHERLOCK HOLMES HAS BEEN IN THE PUBLIC DOMAIN FOR AGES. a few stories haven't, sure, but the doyle estate doesn't give a fuck what you do with him either way. he was already gay in 1970 (private life of sh) and was a jolly & emotional guy in 1979 (murder by decree).
when you see people/articles saying the ""doyle estate"" threatened to sue people for things, such as guy ritchie for making him too gay in his 2009&2011 movies, that is NOT THE DOYLE ESTATE!!!!!! all those stories are about one single woman, Andrea Plunket. her claim to Holmes is that she married someone who owned US copyrights to some Holmes stories but the thing is. they got divorced in the NINETIES and she has Zero claims to Holmes. she's literally going insane about Holmes possibly being gay thirty years after her husband owned the rights to him, she literally never has and never will, and people have been doing whatever they wanted to Holmes for decades now. it's obviously all a play to squeeze some money out of anyone she can, the entire story is so insane i suggest you guys look it up and read about it more but tldr:

being a hobbyist artist and a professional in STEM is making me go utterly insane bc as an artist i have a visceral hatred of all things AI generated and it's so blatantly clear the danger it poses and cases where it already has been used to cause harm are extremely well known from day one but then you clock in to your job and a good chunk of your coworkers are like "yaaaay hooray yippee AI art i love it im going to use it to make figures for my upcoming paper yaaaay" and then i suffer an aneurysm and die

I really really hate how the whole "show don't tell" rule for writing has just become "be extra descriptive for everything" instead of "don't just say the character is smart, show that they are through their thoughts/actions in the story", because DAMN I've seen so many characters that don't live up to their descriptions AT ALL and it's so jarring lmao

Holy CRAP the UN Cybercrime Treaty is a nightmare

If there's one thing I learned from all my years as an NGO delegate to UN specialized agencies, it's that UN treaties are dangerous, liable to capture by unholy alliances of authoritarian states and rapacious global capitalists.
Most of my UN work was on copyright and "paracopyright," and my track record was 2:0; I helped kill a terrible treaty (the WIPO Broadcast Treaty) and helped pass a great one (the Marrakesh Treaty on the rights of people with disabilities to access copyrighted works):

It's been many years since I had to shave and stuff myself into a suit and tie and go to Geneva, and I don't miss it – and thankfully, I have colleagues who do that work, better than I ever did. Yesterday, I heard from one such EFF colleague, Katitza Rodriguez, about the Cybercrime Treaty, which is about to pass, and which is, to put it mildly, terrifying:

Look, cybercrime is a real thing, from pig butchering to ransomware, and there's real, global harms that can be attributed to it. Cybercrime is transnational, making it hard for cops in any one jurisdiction to handle it. So there's a reason to think about formal international standards for fighting cybercrime.
But that's not what's in the Cybercrime Treaty.
Here's a quick sketch of the significant defects in the Cybercrime Treaty.
The treaty has an extremely loose definition of cybercrime, and that looseness is deliberate. In authoritarian states like China and Russia (whose delegations are the driving force behind this treaty), "cybercrime" has come to mean "anything the government disfavors, if you do it with a computer." "Cybercrime" can mean online criticism of the government, or professions of religious belief, or material supporting LGBTQ rights.
Nations that sign up to the Cybercrime Treaty will be obliged to help other nations fight "cybercrime" – however those nations define it. They'll be required to provide surveillance data – for example, by forcing online services within their borders to cough up their users' private data, or even to pressure employees to install back-doors in their systems for ongoing monitoring.
These obligations to aid in surveillance are mandatory, but much of the Cybercrime Treaty is optional. What's optional? The human rights safeguards. Member states "should" or "may" create standards for legality, necessity, proportionality, non-discrimination, and legitimate purpose. But even if they do, the treaty can oblige them to assist in surveillance orders that originate with other states that decided not to create these standards.
When that happens, the citizens of the affected states may never find out about it. There are eight articles in the treaty that establish obligations for indefinite secrecy regarding surveillance undertaken on behalf of other signatories. That means that your government may be asked to spy on you and the people you love, they may order employees of tech companies to backdoor your account and devices, and that fact will remain secret forever. Forget challenging these sneak-and-peek orders in court – you won't even know about them:

Now here's the kicker: while this treaty creates broad powers to fight things governments dislike, simply by branding them "cybercrime," it actually undermines the fight against cybercrime itself. Most cybercrime involves exploiting security defects in devices and services – think of ransomware attacks – and the Cybercrime Treaty endangers the security researchers who point out these defects, creating grave criminal liability for the people we rely on to warn us when the tech vendors we rely upon have put us at risk.
This is the granddaddy of tech free speech fights. Since the paper tape days, researchers who discovered defects in critical systems have been intimidated, threatened, sued and even imprisoned for blowing the whistle. Tech giants insist that they should have a veto over who can publish true facts about the defects in their products, and dress up this demand as concern over security. "If you tell bad guys about the mistakes we made, they will exploit those bugs and harm our users. You should tell us about those bugs, sure, but only we can decide when it's the right time for our users and customers to find out about them."
When it comes to warnings about the defects in their own products, corporations have an irreconcilable conflict of interest. Time and again, we've seen corporations rationalize their way into suppressing or ignoring bug reports. Sometimes, they simply delay the warning until they've concluded a merger or secured a board vote on executive compensation.
Sometimes, they decide that a bug is really a feature – like when Facebook decided not to do anything about the fact that anyone could enumerate the full membership of any Facebook group (including, for example, members of a support group for people with cancer). This group enumeration bug was actually a part of the company's advertising targeting system, so they decided to let it stand, rather than re-engineer their surveillance advertising business.
The idea that users are safer when bugs are kept secret is called "security through obscurity" and no one believes in it – except corporate executives. As Bruce Schneier says, "Anyone can design a system that is so secure that they themselves can't break it. That doesn't mean it's secure – it just means that it's secure against people stupider than the system's designer":

But despite this, the idea that some bugs should be kept secret and allowed to fester has powerful champions: a public-private partnership of corporate execs, government spy agencies and cyber-arms dealers. Agencies like the NSA and CIA have huge teams toiling away to discover defects in widely used products. These defects put the populations of their home countries in grave danger, but rather than reporting them, the spy agencies hoard these defects.
The spy agencies have an official doctrine defending this reckless practice: they call it "NOBUS," which stands for "No One But Us." As in: "No one but us is smart enough to find these bugs, so we can keep them secret and use them attack our adversaries, without worrying about those adversaries using them to attack the people we are sworn to protect."
NOBUS is empirically wrong. In the 2010s, we saw a string of leaked NSA and CIA cyberweapons. One of these, "Eternalblue" was incorporated into off-the-shelf ransomware, leading to the ransomware epidemic that rages even today. You can thank the NSA's decision to hoard – rather than disclose and patch – the Eternalblue exploit for the ransoming of cities like Baltimore, hospitals up and down the country, and an oil pipeline:

The leak of these cyberweapons didn't just provide raw material for the world's cybercriminals, it also provided data for researchers. A study of CIA and NSA NOBUS defects found that there was a one-in-five chance of a bug that had been hoarded by a spy agency being independently discovered by a criminal, weaponized, and released into the wild.
Not every government has the wherewithal to staff its own defect-mining operation, but that's where the private sector steps in. Cyber-arms dealers like the NSO Group find or buy security defects in widely used products and services and turn them into products – military-grade cyberweapons that are used to attack human rights groups, opposition figures, and journalists:

A good Cybercrime Treaty would recognize the perverse incentives that create the coalition to keep us from knowing which products we can trust and which ones we should avoid. It would shut down companies like the NSO Group, ban spy agencies from hoarding defects, and establish an absolute defense for security researchers who reveal true facts about defects.
Instead, the Cybercrime Treaty creates new obligations on signatories to help other countries' cops and courts silence and punish security researchers who make these true disclosures, ensuring that spies and criminals will know which products aren't safe to use, but we won't (until it's too late):

saying this on anon so i dont doxx myself but my mom, who is normally a very milquetoast white usamerican liberal, is very against ip/copyright law simply because she used to work as a paralegal specializing in ip law and knows how awful it is. i remember her talking about how her company represented mccormick specifically and how a major thing with trademarks is that if you dont defend them against every single person infringing on them then theres a possibility that you will lose the trademark altogether. so like, they found that a random, poor dude in latin america was selling his own spices but using mccormick bottles/labels for it, so they had to send a letter to this random dude who posed 0 threat whatsoever to mccormicks global trade saying he had to stop using mccormick bottles for his product. according to her, nobody she worked with even wanted to do that, but the ip law mandates it. anyway whenever i see random freelance artists or whatever talking about strengthening ip law thats what i think of

A billion dollar media company just placed a copyright claim on a recent video I posted on FB/IG. I pay to license every clip and song I use. I make $0 from any of these platforms. I make videos at a loss because I love telling stories. But a giant media company is claiming ownership over a free video that i paid a giant media company for the right to make. Meta's notification was beyond unhelpful. It doesn't say which video was claimed. Doesn't say which song or clip in that video was the basis of the claim so I can replace it. It doesn't say how to appeal the claim, only that I have 7 days to do so. It doesn't say what will happen if the claim is successful. Presumably they'll just claim ad revenue from it, which would be unfair, but also meaningless because THE PLATFORM ALREADY DOESN'T PAY ME. They can't steal what they already weren't giving me. But there's something profoundly insulting about me paying a company money so I can make something I don't get paid for, that they'll lie about to another company that isn't paying me, so they can take the money I would have been paid if anyone involved in this process cared at all. And the process is automated to give the illusion that I have any say in it at all. The truth is that I do not matter to these companies. The giant media company doesn't know I exist. An unsupervised AI was installed to print them free money by filing auto-generated content claims that have zero repercussions for false positives. Meta already isn't paying me, and I'll eat my hat if they reply to my message with any meaningful solution. I am lucky that my followers do care. I am lucky that when the system is reminding me how little I matter, I get comments and DMs and emails from people who believe in the value of what I do. That's why I haven't left this platform, and why I'll probably keep making videos for the benefit of giant companies who don't know I exist but are still making money from it. So I guess this is me saying thank you for treating my stories like they matter. Most days I believe that they do, and it's because of you.

All or Nothing and lowave records
Strap in because this is gonna be a long one. This post will try to shed some light on how the whole lowave records thing works, how you can use this music, how it is being distributed, and what all a contract with lowave would include. All this and more below the cut!
Let us start with the basics: What is lowave records?
Quite succinctly summed up on their website as follows:

They make and distribute royalty-free music for content creators - specifically video-format content creators like Youtubers and streamers - they share some streaming revenue (30%, we'll get into that) with the creators who are labelled 'co-artists' and get promotion of their music through the content creators.
So, that brings us to the next big question: What is royalty-free music?
This is music that is free to use. Yes, by anyone, by Dan and Phil, by other creators, by you and me, any of us. This is by no means a new thing of course, anyone who has created content online would have come across other such services. just as an example, bensound.com hosts a large library of royalty-free music which you can use in any video by simply crediting the site in your description. Lowave works in a similar fashion. The music is not copyrighted. However, the rights to the music are held by lowave records and there are limitations on its use, which we will get into ahead.
How is the money working (preliminary edition)?
I will add details to this later when I discuss the contract, but let's see the info we get straight away from the FAQs: You do not have to pay them anything to make music for you

The money is coming in from the streaming platforms, depends completely on amount of streams, and is shared between lowave and the creators

Also from the FAQs: how can this music be used?
Anyone can freely use any of the music from lowave records, which means that yes, you can use any music from All or Nothing for your purposes with credit, it will not be taken down

Is this the only music we will hear on dapg now? Will there be more albums?
Not necessarily! This isn't an exclusive deal, DnP can use any music they want on the channel. As for new albums, seems like it depends on how this one does (and it seems to be doing quite well!) which will unlock future avenues for more collabs with lowave

Okay BASICS DONE if you're still reading you're probably here for the real meat so let us get into it
How is the money working (director's cut)?
Let us start with the terms on the partner agreement:

Content Creators get 30% of the 'remaining income'. This basically means any costs that streaming platforms are deducting, any processing fees, taxes etc will be deducted before the 30% share is calculated. The second point there basically means that the deductions here do not include business expenses of the label itself, ie when the label calculates its own profit production costs and various other expenses are deducted from the income, but these costs will not affect the revenue received by the content creators (You are probably already thinking 'how is this company earning enough to keep going?' and I will touch on that later as well)
Payment installments are simple enough but here we see a third party enter the chat: DistroKid. Who is DistroKid and why are payments going through them, Hazel? I hear you ask. Well I'll tell you dear readers:

It is basically a service that takes a yearly fee for putting your music on streaming platforms efficiently and then pockets 0% of the royalties. The royalties go from the streaming services (eg Spotify) to DistroKid who then send it to the rights-holders (in this case, lowave records). lowave records is using this service for a yearly fee to upload all their music through.
But wait! If DistroKid is working with lowave, and lowave owns all the rights, why is DistroKid making direct payments to the content creators?
Well, over the years they have offered a bunch of services:

I am guessing lowave is making use of the teams feature to send royalties owed to content creators ("collaborators") directly from Diskworld, which makes sense, the less people money goes through the less chances of mishandling.
People have of course been talking about what percentage Spotify even pays for many many years. The short answer: we don't know for sure because it is confidential, Spotify won't tell and artists aren't allowed to. The longer answer: people have estimated from a bunch of publically available data that the share seems to be 70-30 (rights-holders- spotify).

However spotify is not paying per stream anymore so that makes these figures harder to pin down. they are using a 'streamshare' system which is much more convoluted:

That was all about the money, now let's talk Licensing
Creators can use this music in any capacity, and do not have to share any of the revenue from their own content with lowave. They have put a stipulation that it may not be used in a way that is "illegal, immoral, discriminatory or derogatory to [lowave]" but what constitutes 'immoral' and 'discriminatory' is not really defined.
The other limitation applies to the contracted Content Creators only as far as I can tell: they are not allowed to remix, sample, or edit these songs without prior permission. This probably only applies to altering the songs and playing under the same name, so fan remixes should not run into issues here, as long as they are not monetised. (thanks kate @goldenpinof for making me think about this part a bit more, I think it should be safe, but even royalty free music cannot be transformed without permission at least in a commercial capacity)

They will also make more music free of cost if the streaming targets they set are being met by the albums produced. The process:

Other services they provide will be handling the creator's account which they set up (DanAndPhilBeats in this case) on streaming platforms and making changes as required, so the Cheeky Banter -> Project X thing was probably done from their end, possibly an older change that they forgot to update?

The promotion wasn't a one-time thing, it is expected to be ongoing, so we will probably be hearing about this in future videos as well. However, later in the partner agreement it is added that this has to be done as often as possible in a way that is "natural and appealing to their audience" which again, is pretty vague wording

Also the licensing goes both ways, so lowave can also use segments of the content DnP make that has the music in the background to promote their music:

Additional stuff from the contract:
lowave takes the guarantee of creating original works that it has the rights to and which do not infringe on copyrights, and the creators likewise take the guarantee not use the songs in content which infringes copyright. If there are any disputes regarding such infringement in the future the record and the creators have to back each other up (including sharing legal fees)

I mentioned before some parts of the agreement being written in vague language. There is also a clause that says if any provision ends up being illegal/not possible to enforce by a court (eg if a court were to it's impossible to say whether content featuring the songs was 'immoral') then only that provision will be removed, the rest of the contract stands.
The waiver part basically means that if any of the parties decide to not sue or forgo a complaint about breach of contract, that does not mean that those provisions are now unavailable, they can still sue later on or for some other breach if they wish.

That's the contracts done. Some of the framing there makes it seem to me like it's a pretty small company. The revenue they hope to generate does not seem to be very sustainable, especially since the revenue is being shared with content creators but the cost is not and they are additionally paying for other services like DistroKid.
So I looked more into this record label: they started business in 2022. If you go to their socials though, twitter and instagram they have followers in double digits and post very sparsely. Their tiktok seems to have nothing on it at all (thanks @lesbiandanhowell for the screenshot) and you may have noticed, Dan did not tag the lowave account at all when he announced the album on twitter

The agreement never mentions creators promoting lowave's social channels or tagging them either (and it is quite odd, I have worked with a bunch of organisations in their infancy and this is, now more than ever, a common requirement from collaborators). lowave records does not seem to be actively working towards promoting themselves on social media or building an online presence, even though they have been operational two years producing music throughout.

Benjamin Johnson listed as 'Head of Production' is probably the 'Ben' Dan has been talking about who made the songs. Seems like their scale of operations is not very big and possibly not a lot of producers in the records at all (despite the spotify page saying they have 'producers' plural, but that doesn't have to mean a lot many lol). Anyway, that would solve the mystery of 'how are they playing their employees?' if there aren't many employees to begin with (not even an intern to manage their social media it seems).
Look at the last person in the screenshots though: Robin. I looked at what other companies Robin is associated with and several of them - yeah several different operations that he's involved in - have the same correspondence address of '60 Thorpe Road...', so probably operating out of a ghost office (just to have a registered address and receive mail at etc). And one of these businesses that Robin is associated with is RWD, the business that made lowave records' website for them:

The no-cost production of royalty-free music, little attention to social media presence, vaguely written contract, seemingly small scale of operations with technical assistance like website design coming from an affiliated organisation makes me think that lowave records might be a side project. A labour of love, possibly, hoping to sustain itself enough to keep putting out royalty-free music in a time of extreme crackdown on copyrighted music use.
It makes sense to use content creators for promotion, gets you way more streaming than making your own music and putting it out. And the incentive of unique but guaranteed royalty free music at no cost is great for content creators of all sizes. It is far from sustainable on its own though, especially with streaming revenue being basically peanuts, and I do not think there's much interest in gaining a following or putting in that effort either, so it's probably a very small business by a few people. How long it manages to sustain itself as a project I am not sure, but it certainly isn't looking like something particularly geared towards profit and growth in its current state.

How do I commission you?
Simply message me here or on discord! We can discuss what you want, and afterwards you can pay for your commission! Once I start on your fic, you’ll receive a google docs link so you can check on your fic whenever you’d like!
How will we receive our fic?
Google docs! And I’ll post it here and/or on AO3 if you want to read it somewhere else!
What information do you need?
It all depends on what you want! Be prepared to answer my questions. Usually I ask for a basic appearance and body shape, personality, what kind of scenes you want in the story and the tone. I may need more info though, so again be ready to answer questions.
How long will it take?
Right now I have 2 commissions left that will probably take me a month to finish. That’s the beginning of the backlog, so depending on how long your fic is and what place you are in the line, you could be waiting a while. I will update you once I start working on your fic then give you regular updates afterwards.
What do you specialize in?
I prefer writing monster x chubby!fem!reader, but I’ll write for whatever you want, as long as it follows my boundaries below.
Do you post our commissions?
Yes, unless I’ve been asked not to. Any monster x reader commissions I’d prefer to post. If it’s a monster x oc, I’ll make a version where the oc is a reader insert for posting purposes.

Refunds
I will gladly give you a refund if I haven’t started on your fic yet or haven’t written enough for it to cost anything.
For example, if you’ve asked for a 2k commission and I’ve only written 100 words, you can receive a refund, anything over that, I’ll at least have to charge you for the amount of words I’ve already written for you.
You will NOT receive a refund for a full story after it’s been written. If you aren’t satisfied I can edit it, but once it’s finished there are no refunds.
Story options
-You can ask for a series with a set word count for chapter. Say you want a 10k word fic but want it in 2k word chapters. This makes it easier for me to get you updated on the story.
-You can request that I keep your story a complete surprise. I’ll only ask you questions and won’t share details!
