I also recently edited an introduction by Vaisesika Prabhu to the forthcoming book compiled by Vijaya Prabhu, called Treasures of the Brhat Mrdanga, an anthology of stories about the distribution of Srila Prabhupada’s books. Here’s Vaisesika’s introduction:
I love pistachios. I can’t eat them fast enough, and I get impatient, because it takes time to shell them. So I am glad that Treasures of the Brhat Mrdanga is like a big bowl of shelled pistachios. What a joy it is to read.
And what are these shelled pistachios? A lot of people awakening to Krsna consciousness by hearing. In fact, these are the only actually interesting events in the world. When devotees of Krsna go out of their way to give people transcendental literature, and people respond by taking shelter of Krsna, something substantial has happened: A soul has used his or her free will to do the right thing. This is the greatest show on earth. Nothing compares. Nothing else is as consequential.
Reading Treasures of the Brhat Mrdanga, therefore, is not only spiritual nourishment, it’s pure enjoyment.
In the Gita, Krsna declares the material world to be a place of suffering and strongly recommends that we not try to stay here. He wants us to join Him in the spiritual world in blissful loving service. Why, then, does He make a material world in the first place? The answer is that out of kindness the Lord gives us a viable option to forget Him if we choose to. Without this option, what would be the question of free will? And without free will, true love for God could not exist.
Even though Krsna restrains Himself and remains neutral as He sets the stage for us to voluntarily serve Him, and even though He advises His devotees not to waste time with people uninterested in Him, He nevertheless does have His preference. He wants every soul to be happy by taking shelter of Him. Thus He is pleased when devotees intervene in the lives of sleeping souls and awaken them to a relationship with Him.
In the purport to Bhagavad-gita 3.29, Srila Prabhupada explains this apparent enigma:
“Men who are ignorant cannot appreciate activities in Krsna consciousness, and therefore Lord Krsna advises us not to disturb them and simply waste valuable time. But the devotees of the Lord are more kind than the Lord because they understand the purpose of the Lord. Consequently, they undertake all kinds of risks, even to the point of approaching ignorant men to try to engage them in the acts of Krsna consciousness, which are absolutely necessary for the human being.”
This is why ISKCON devotees take on the burdens of going out in public, knocking on people’s doors, or meeting them on college campuses and street corners to offer them Srila Prabhupada’s books. These devotees know how pleasing such distribution is to both Srila Prabhupada and Krsna. What’s more, most of these distributors have their own realizations, for they, too, were rescued from the burden of materialistic life after receiving a transcendental book. And that experience will always be the most important event in their lives.
We know that Srila Prabhupada considered book distribution vital in spreading Lord Caitanya’s sankirtana movement. He wrote: “These books and magazines are our most important propaganda weapons to defeat the ignorance of Maya’s army, and the more we produce such literature and sell it profusely all over the world, the more we shall deliver the world from its suicide course.” Srila Prabhupada offered his followers profuse blessings for distributing his books: “I am so much grateful to you, and I am sure Krsna will bless you a million times over for doing this work.”
Kaviraja Gosvami also clarifies in Sri Caitanya-caritamrta 20.122 that Lord Caitanya considered book distribution essential for mercifully extracting conditioned souls from the material world: “The conditioned soul cannot revive his Krsna consciousness by his own effort. But out of causeless mercy, Lord Krsna compiled the Vedic literature and its supplements, the Puranas.”
Srila Prabhupada elaborates: “Out of His causeless mercy and compassion, Krsna has compiled various Vedic literatures in His incarnation as Vyasadeva. Vyasadeva is a saktyavesa-avatara of Lord Krsna. He has very kindly presented this literature to awaken the conditioned soul to his senses.”
But what really happens when we distribute one of Srila Prabhupada’s books?
Krsna, of course, knows where each book goes after we distribute it, how each individual soul who receives a book is eternally benefitted, as well as what the global effect of book distribution will be. As limited beings, how can we accurately know the circuitous route the books take; how they change the lives of those who read them; or even how book distribution uplifts the world? I promise you that by reading Treasures of the Brhat Mrdanga many of these questions will be answered and your confidence in distributing Srila Prabhupada’s books will soar.
The stories selected for this book are but a few of the millions that are out there. They will remind readers of the profound ways human lives are being touched when people receive Srila Prabhupada’s books. Any thoughtful person can see how increasing transcendental book distribution has a systemic, uplifting effect on the world — leading to the “respiritualization of the entire human society” that Srila Prabhupada evokes in Srimad-Bhagavatam.

I contend that every educated person should be conversant with the sacred texts, rituals, and symbol systems of the great world religions — Hinduism, Buddhism, Judeo-Christianity, and Islam — and that true global understanding is impossible without such knowledge. Not least, the juxtaposition of historically evolving spiritual codes tutors the young in ethical reasoning and the creation of meaning.”

Leaving
“Kakak, pack your bags. We’re leaving.”
My eyes widened at my mom’s commands. The words that I had wanted her to utter for what seemed like forever shocked me to the bone. My mom was actually leaving my dad? I mean, I’ve fantasized about this for so long, but it’s always remained as fantasy in my mind. Now, it was starting to become frighteningly real.
To say that my parents’ marriage rocky was an understatement.
One of my earliest memories was of them arguing about something when I was in pre-school, still an only at that point. I remember my mom crying, saying that I didn’t need to go to pre-school that day and my dad pulling on my arm, sending me to school anyway. It must have been quite traumatic for the younger me because the next thing I remember, I was breaking down and crying at school, telling my preschool teachers what I saw at home. Well, as coherently as I could as a 3-year-old anyway.
Ever since I could remember, things always seemed so volatile at home. My dad was at risk of lying into a rage at any time, so the rest of us tried to be cautious but it was pretty inevitable. Whenever my parents argued, my mom would protest by ignoring him for 3 days, sleeping in the kid’s room, refuse to cook or do any chores, and generally just avoid him in our small 500 square foot house. Then, he’d cave in and apologize to her and the cycle would repeat, over and over again.
It was in my home that I learned about the realities of neutrality and that of playing both sides. You couldn’t risk picking only one side or you’ll risk alienating the other. I tried my best to keep the peace by pretending on both of my parents’ side, listening to them rant about the other during one of their tirades and agreeing with both of them to their faces. As an 8-year-old, I didn’t know that what they were putting me through was wrong, that a child shouldn’t be subjected to having to choose between their parents or have to learn to lie and listen at such a young age. I just wanted the fighting to stop.
The fights used to be about their personal arguments and issues. We were never really in the line of fire because we were too young to understand, Sarah and me. But then I started to get dragged into the fray of things.
One day, when I was 10 years old, my dad made to decision to personally groom me and taught me everything he knew. He taught me about computers and domain hosting, how to do PowerPoint animation, how to manage a website etc. My dad told me he was teaching me all this because it would be my responsibility to handle all this one day, once he’s old and starts to become forgetful. I was still a kid at that point and now that I’m offered a way to please my dad, I listened to his instructions eagerly and learned as much as I could.
Fast forward 12 years later and I am now 22 years old, a university student pursuing my Bachelor’s degree and my relationship for my dad has hit an all-time low. Things were pretty much the same as it was back then, only this time we were all older and made more mistakes, which gives my dad more ammunition to use against us during his temperamental rages. And this time, I was directly in the line of fire when it came to arguments.
I was pretty much his unpaid tech intern, the person he considered responsibilities for handling all kinds of technology and website-related matters ever since I started learning about them years ago. My knowledge was still pretty unofficial and was rudimentary, especially considering I didn’t major in IT in college, but he expected me to have all the answers and to solve all his problems no matter the situation. I would get yelled at over the phone when I was in university for not solving a problem or finishing his assigned work fast enough, despite my heavy course workload. At home, he’d undermine me constantly saying that my college education was irrelevant, threatened to not pay my school fees even though it was my mother who paid them as well as saying that he would expose my ‘unsavoury’ behaviour to everyone I knew to shame me.
It was later that I found out that I had now become a big topic in their arguments, and how my dad seemed to blame my mom for me ignoring him and not following his every order. How every time I messed up or forgot to do something, my mom would also be inevitably dragged into the argument and he’d then fan the flames of his own anger further by bringing up every single mistake my made has made since before they were married.
It was in my home that I learned that everything you say can always be used against you. Every single accomplishment I’ve told him about, every little thing school-related that I talked about with my family would always be used against me during one of his tirades against the rest of my family. He would belittle any accomplishment that we felt proud of, taking the credit for himself as he claimed that he was the one who taught us and taunts us about how pathetic we were for being satisfied with our small-time victories and achievements. It took me a while to learn my lesson, but eventually, I stopped telling them about the comings and goings of my life. I couldn’t risk telling my mom either in case she told my dad anything during one of his good days so I just… stopped.
Home became a living hell for all of us as it was constantly filled with tension. It felt like there was a ticking time bomb, just waiting to explode at any time. ‘What would get mad about next?’ was a game that I constantly played in my head. For some reason, he’s starting to become more and more dissatisfied with everything in life it seemed, and he was taking his anger out on us constantly. He bitterly complained about how he made us his heartsick for not listening to him, dredging up our all old faults once again that dated back from when we were primary school age even and even undermining his wife and her family to his children.
Despite all his faults, he was always a pious man and constantly preached about the word of god. He never missed a prayer and always did a lot of sunat prayers. He reads the Quran constantly, and always encourages us to do prayer together. He’s never cheated on my mom, never did drugs, doesn’t even smoke and he never physically beat us.
People always preached that by maintaining your relationship with God, that by being religious, you would also find it easier to preserve and maintain your relationship with other humans.
So why did it feel like his relationship with us for fraying every single day as time goes by?
The day it all came to ahead initially started great. It was Father’s Day and my mom had made my sister buy a cake earlier that morning because our cousins and auntie and uncle were coming to visit. I remember thinking that it was going a good day because we haven’t seen one another in so long, and it would be a real treat to chat with one another again.
Both families celebrated the occasion together once they reached our house, taking pictures and eating the spread that my mom stayed up all night to make. Sarah’s friends also made an unexpected visit that day, so they joined in the celebration as well. Because they had come all the way from Perlis to Cyberjaya to visit her, she decided to go out to spend the evening with them.
It was after we said our farewells to our cousins that things really started to fall apart.
I was in my room taking care of our baby sister Khadeeja, but I could already hear his angry mutterings and complaints starting, signalling the start of another of his infamous temper tantrums.
He was complaining about how we were always doing things he didn’t tell us to do, and we somehow only always tried to please others. He even called to yell at Sarah about leaving the house, which resulted in her having to come home early instead of going out with her friends even though we’ve all been cooped up in the house for weeks.
Nervous, I went upstairs to ask my mom what was going on when I saw her crying angrily in her office. It was only later that I knew that he had gotten mad at her for posting a picture of their celebration on the family’s Whatsapp group. That he began accusing her of only trying to please others, but that she was showing off.
I could see that my mom’s patience and resolution starting to break. He had forgotten all about Mother’s Day and also barely acknowledged her birthday months prior, and despite all that, she still took the time out of her busy day to prepare a celebration for him. But of course, he could never appreciate his family’s efforts. Nothing we do was ever enough.
And then all hell broke loose.
The next thing I knew, they were arguing heatedly and then mom went downstairs to my room and told my sister and me to pack up all our things. It all happened so fast that it feels like a blur. Sarah and I began to half-heartedly pack up or things into suitcases, not thinking that she was seriously going through with this. But just in case, we tried our best to keep things light and only carried our most prized possessions and other necessary items like clothing and certificates.
“Once the kids and I leave this house, we’re never coming back.” My mom had declared before picking up the rest of her things and walking out the door.
I remember the betrayed expression on his face when we walked out of the house with our suitcases and my baby sister in hand. I remember him holding onto my mother’s arm, indignantly asking her why she had to go.
But I also remember him saying that we didn’t need to leave, that he’d go back to his hometown to visit his sick parents of he was the source of stress in his house in an emotional voice. And then suddenly all my sympathy faded just like that. He had never bothered about his parents or mentioned wanting to go back before this, had always considered them an afterthought but now out of the blue hr brings them up? It was at that moment that I realized that he was manipulating us. I should know. I learnt from the best, after all.
I could see my mom wavering and my usually brash sister hesitating at his words. I was in tears at this point, but I also knew that bridges were already burned and that nothing would ever be the same after that. He’d try to weasel his way back somehow; I was sure of that. I also knew that he wouldn’t leave without a fight and I really didn’t want to hear his constant bitching as he packed up his stuff, if he even packed up at all.
“This proves that you don’t get it. This situation isn’t something that can be fixed just by you leaving for a few days!”
I’m pretty sure those words weren’t verbatim as I was still sobbing when I choked them out. But it was clear enough that it got the point across.
“Then why are you leaving then?” He countered.
What happened next was a mixture of tears, incoherent words as I tried to tell him exactly what I thought of him. I remember being angry at myself for not being to form words coherently, for not being able to think straight and for not being able to tell him exactly how much he’d hurt us all this time.
Eventually, he gave up and we quickly made our way to the car park and got the hell out of the building. Mom didn’t want to go to grandma’s house as she originally said and risk my father finding where we were, so we spent a week in Melaka moving from one Airbnb to another.
It’s been weeks since then, and my mom has been teetering on the edge of whether to go through the divorce or not. My sister, on the other hand, was rejoicing her newfound freedom from our dad’s oppression and was encouraging their separation. We’ve avoided all communication with my dad and haven’t talked to him since.
However, things aren’t so simple on my end. I’ll admit that since then, I’ve started to come to terms with his actions and behaviour, and how wrong he actually was to treat us that way. I’ve come to terms that what he was doing was irrational, that it was born out of a place of deep-seated insecurity that then encouraged this egotistical personality to form which seemed absolved him of consequence in his own home.
Unfortunately, the feelings that I have towards my dad isn’t so easily resolved. I‘ve often heard from my friends and family about how similar the two of us are both in appearance and personality ever since I was a kid. How my attitude and disposition was exactly like his. I also knew that I was secretly hoping that my mom wouldn’t go through with an official divorce and would agree to separation instead, because despite the emotional and verbal abuse, I still loved him and I can’t help but remembering his ‘good’ days and the rare moments where he was actually a good dad to us.
It left me wondering if I could ever truly free myself from his influence, if cutting him out of my life would also be like cutting out a part of my own self.

Students Can Benefit From Religion Classes As Long As Public Schools Teach Rather Than Preach

One of the best ways to build religious tolerance in this country is by educating children about various perspectives on both belief and non-belief. But as an experienced educator reminds us, any public school that offers a course on religion must be mindful to stay focused on teaching, not preaching.
Linda K. Wertheimer, a journalism professor at Boston University and former education editor for the BostonGlobe, wrote recently that even well-intentioned public schools don’t always get this stuff right. She noted in a Washington Post column that Wellesley Middle School outside Boston got into trouble in 2010 when it brought students to a local mosque to learn about Islam.
One of the parent chaperones ended up shooting some video. The footage showed some sixth-grade students who seemed to kneel and pray as part of a religious service. It was unclear what happened, and the students may have done it on their own as a gesture of respect. Critics were quick to latch on to the incident, and it became fodder for the Fox News crowd.
This is a great example of why off-site visits to houses of worship, while they may be well intentioned efforts at teaching tolerance, can be problematic. When students leave campus administrators can no longer be totally in control of the messages children receive. School officials may have never intended for Wellesley students to engage in prayer, but some of them got the idea that they should do so.
It’s also unrealistic to expect that some members of the clergy (fundamentalist Christians, for example) won’t start preaching in their own house of worship.
Beyond that, some faith groups are actually forbidden from entering houses of worship belonging to other religions. Orthodox Jews, for example, are typically expected not to go inside any religious building that is not a synagogue or otherwise linked to Judaism.
Of course, most schools that get into trouble when it comes to teaching religion usually run afoul of the U.S. Constitution because a teacher is forcing his or her faith on students inside the classroom. Wertheimer said as a fourth grader attending a new public school in rural Ohio in 1974, she was exposed to a proselytizing lesson on Christianity.
“I was the new kid, and all I wanted was to fit in,” she wrote. “But one afternoon that first week, a woman hired by local churches walked into my public-school classroom and my regular teacher left. She stuck figures of Jesus Christ and his disciples on a flannel board, told us how Jesus could solve people’s problems and, a little while later, asked us all to sing the hymn, ‘Jesus Loves Me.’”
Wertheimer, who is Jewish, was in a bind. She wanted to fit in, but she didn’t believe in Jesus. She said that she ended up complaining to her parents, who then complained to the school. How did administrators handle this situation? Rather than stopping this obviously unconstitutional proselytizing, the school instead removed Wertheimer and her brother (the only Jews in that entire district) from their classrooms whenever it was time for a Christian lesson – an approach guaranteed to ostracize them.
It’s no secret that many public schools have difficulty preparing a world religions curriculum that is viewpoint neutral. As a result, Americans United always urges schools to be cautious when wading into lessons on belief. Schools must ensure that they do not advance (or disparage) any one set of ideas over all others. Teachers should be well versed on church-state law before they start these lessons.
But, as Wertheimer demonstrated, there can be great value in teaching students about faith – particularly minority viewpoints. While researching her new book, Faith Ed.: Teaching About Religion in an Age of Intolerance, Wertheimer said she spoke with a 24-yeard-old Sikh who remembered being mocked as a 5-year old for wearing a patka, which is a traditional Sikh head covering. And a Muslim sixth grader told Wertheimer that not long ago, a classmate jokingly asked: “Do you have a bomb in your locker?”
Kids can be cruel, and there is no single solution to end religion-based bullying. But a broad program of objectively teaching about religion can go a long way to building understanding, even among children.
Public schools are supposed to be places where all children feel welcome. The more kids learn that the world includes people of many faiths and none (and that our government is not supposed to endorse any religion over others), the more prepared they will be to live in a society that is becoming more diverse by the day.

Different religions have similarities and dissimilarities. Dissimilarities can lead to misunderstanding if a person is not taught and unaware of that specific religion’s practices and beliefs, and that is why teaching different religions in school is important because our world is getting even diverse as other religions strongly believe what their religion taught them to believe and school is a way for us to understand and respect each other despite of the discrepancies.
Teaching does not mean to force someone to believe what the other religion believe, teaching is to make them understand and respect what other religion does and does not. It is better for us to be united with different faith than being torn apart because we simply do not respect other’s faith.
Embrace the dissimilarities so that others can also embrace yours. Remember to be good always and to be good should be always and will always be taught at school.

May a college expel a student for ‘unprofessional speech’ in Facebook posts?
Say a student is in a professional education program at a college — law school, medical school, nursing school, business school, school of education or the like. May the college expel him from the program, on the grounds that certain speech of his is “unprofessional” and therefore casts doubt on his professional temperament and likely future behavior?
We’re not talking here about speech within a curricular assignment — a thesis, a term paper, a practicum client counseling session or even a seminar discussion in which participation is graded. Colleges have to evaluate the content of such curricular speech, though even there they may be constrained. (If I grade class participation at UCLA, for instance, I can only count it as part of the final grade, and I’m supposed to grade it in a way that’s as ideologically neutral as possible.) Rather, we’re talking about speech outside such graded discussions, often outside class and sometimes even outside school.
In Keefe v. Adams, a split 2-1 8th Circuit panel upheld such an expulsion; the Supreme Court will on Friday consider the petition for certiorari, filed by Robert Corn-Revere, Ronald London and Lisa Zycherman of Davis Wright Tremaine. And just today, I filed an amicus brief (written by my students Jenna Mersereau, Jennifer Milazzo and Joshua Ostrer, and me) supporting the petition, on behalf of the Cato Institute, the Electronic Frontier Foundation, the National Coalition Against Censorship and the Student Press Law Center. We’re hoping that the court will call for a response from the state defendants (the next step in the process, if the court is to grant review), and then ultimately agree to hear the case.
I quote the brief below so you can see the heart of our argument (though for the full text, including the footnotes, see the PDF). Note that the student’s speech in this case was pretty rude, angry and insulting, as well as basically unideological:

But, as we argue below, the logic of the opinion below — and the cases on which it relies — would extend to supposedly “unprofessional” speech far beyond this. (Also, to the extent that a school thinks that off-campus speech constitutes a “true threat” of violence, it could punish a student for that; but the panel’s rationale extends far more broadly, to a potentially wide range of “unprofessional speech.”)
Summary of Argument
The opinion below authorizes college administrators to expel students for their speech, whenever that speech — including speech entirely outside any curricular project — supposedly fails to comply with professional norms.
This principle could easily apply to, for instance, speech about educational policies, proper rules governing sexual relationships, and “social justice.” Indeed, it has already been applied to such speech in a precedent on which the opinion below relied.
And this principle could easily apply to law schools, business schools, medical schools, and other programs. Armed with this opinion and other circuit court opinions that it endorses, colleges can revive and broaden campus speech codes under the pretext of applying professional standards.
The opinion below is inconsistent with past circuit and district court cases that have uniformly struck down such speech codes. (The petition helpfully canvasses the split between this case and other circuit precedents.) It is also inconsistent with this Court’s precedents. See Papish v. Bd. of Curators of Univ. of Missouri, 410 U.S. 667, 671 (1973) (per curiam); Healy v. James, 408 U.S. 169, 180 (1972). And it is profoundly damaging to free speech at colleges and universities, on which free speech throughout American society depends.
Argument
First Amendment protection is critical at universities, “one of the vital centers for the Nation’s intellectual life.” Rosenberger v. Rector & Visitors of Univ. of Va., 515 U.S. 819, 835-36 (1995). If uncorrected, the opinion below, and other recent circuit decisions like it, will set a dangerous precedent: Colleges will be able to punish students for expressing their views, based simply on administrators’ judgments that certain speech is inconsistent with their subjective understanding of professionalism.
I. The Logic of the Decision Below Would Let Colleges Punish Views That Administrators See as Contrary to Professional Norms
A. The Code of Ethics for Nurses Embodies Ideological Commitments
Central Lakes College expelled Craig Keefe from its nursing program under the program’s student code of conduct, which permits such expulsion for “behavior unbecoming of the Nursing Profession” or a “transgression of professional boundaries.” The court below upheld that decision, on the theory that the First Amendment does not protect “unprofessional speech” such as speech that violates the Nursing Code of Ethics.
But this rationale would cover a vast range of speech. The same “professionalism” policy in the Nursing Program handbook also says, for example, “Integral to the profession of nursing is a concern … for social justice” — right before stating that “students who fail to meet the moral, ethical, or professional behavioral standards of the nursing program are not eligible to progress in the nursing program.” If a student can be expelled for speech “unbecoming of the Nursing Profession,” he can thus be expelled for lack of “concern … for social justice” as well.
Indeed, the Code of Ethics for Nurses expressly endorses many controversial ideological positions. It takes the view that “health is a universal human right.” It states, “Nurses must address … social determinants of health such as poverty, … human rights violations, education, … and healthcare disparities.”
It states, “All nurses … must firmly anchor in nursing’s professional responsibility to address unjust systems and structures.” It states, “Nurses collaborate with others to change unjust structures and processes,” and “should collaborate to create a moral milieu that is sensitive to diverse cultural values and practices” ([section] titled “Obligation to Advance Health and Human Rights and Reduce Disparities”). Likewise, it states, “Nursing must … advocate for policies, programs, and practices within the healthcare environment that maintain, sustain, and repair the natural world” ([section] titled “Social Justice in Nursing and Health Policy”).
Presumably students whose political views are inconsistent with these beliefs would be subject to expulsion for “fail[ing] to meet the moral, ethical, or professional behavioral standards of the nursing program.” After all, administrators can equally say in such cases that they are merely treating “a graduate student’s unprofessional speech” as “lead[ing] to academic disadvantage,” because the speech constitutes “non-compliance” with “professional ethical standards.”
B. The Opinion Below Cannot Be Defended as Authorizing Only Viewpoint-Neutral Restrictions
The opinion below defends its reasoning by saying that “teaching and enforcing viewpoint-neutral professional codes of ethics are a legitimate part of a professional school’s curriculum that do not, at least on their face, run afoul of the First Amendment.” (emphasis added). But one of the main precedents that the opinion heavily relied on — and cited seven times — involved expulsion precisely for the expression of certain views.
In that case, Oyama v. University of Hawaii, 813 F.3d 850 (9th Cir. 2015), a student training to be a teacher was expelled for expressing his ideological views regarding the age of consent and education of students with disabilities. Though Oyama itself was explicitly restricted to speech inside a classroom, the opinion below expands Oyama’s reach to any student speech, not just curricular speech.
The opinion below also heavily relies on Keeton v. Anderson-Wiley, 664 F.3d 865 (11th Cir. 2011), which it cites six times. Keeton likewise involved a student being disciplined for ideological speech — statements disapproving of homosexuality.
Keeton, if it is sound, must be limited to speech that expresses an intent to violate specific rules of conduct within a college-operated practicum: The Eleventh Circuit held in Keeton that a university could discipline a counseling student because “she expressed an intent to impose her personal religious views on her clients” in her upcoming practicum. But the opinion below in this case relies on Keeton far outside any such expressions of intent. And the opinion’s reliance on Keeton shows that the logic of the opinion extends to ideological positions (as in Keeton) and not just to personal gripes.
The speech restriction in this case also cannot be justified as merely embodying a private professional organization’s code of conduct. A private association can adopt whatever views of professionalism it chooses; but the First Amendment prevents a public university from embodying such private associations’ views into officially enforced speech restrictions.
Nor can the speech restriction upheld by the opinion below be justified on the theory that licensing boards could later reject the student for the views he expressed: Licensing boards cannot exclude applicants based on the applicants’ views, either. “The First Amendment’s protection of association prohibits a State from excluding a person from a profession or punishing him solely … because he holds certain beliefs.” Baird v. State Bar of Ariz., 401 U.S. 1, 4-6, 8 (1971) (plurality opinion); see also id. at 10 (Stewart, J., concurring in the judgment) (likewise concluding that a licensing body may not “recommend denial of admission solely because of an applicant’s beliefs that [it] found objectionable”).
C. The Opinion Below Cannot Be Defended as Simply Restricting Speech “at the Wrong Place and Time”
The decision below authorizes colleges to regulate their students’ speech any time, any place, and on any subject, so long as the college can later justify that regulation by referring to a vague professional conduct code. Keefe’s expulsion was not simply an “adverse consequence on the student for exercising his right to speak at the wrong place and time, like the student who receives a failing grade for submitting a paper on the wrong subject.” Keefe posted his Facebook comments at home, on his own time, and not as part of any school assignment. If he was speaking at the wrong place and time when he was at home after school, there will never be a proper place and time for him to speak.
Indeed, the opinion below in this respect directly conflicts with this Court’s opinion in Papish v. Board of Curators of University of Missouri, 410 U.S. 667 (1973) (per curiam), which rejected the notion that such content-based discipline could be justified as mere “time, place, or manner” restrictions. The graduate student in Papish distributed a newspaper containing a political cartoon of policemen raping the Statue of Liberty and the Goddess of Justice, with the caption “With Liberty and Justice for All.” The school attempted to expel the student for violating a student conduct code bylaw which prohibited “indecent conduct or speech.” and the lower courts agreed.
Yet this Court expressly disapproved of the “language in the opinions below which suggests that the University’s action … could be viewed as … enforc[ing] reasonable regulations as to the time, place, and manner of speech.” Instead, this Court held, punishing a student because of “the disapproved content” of his speech — there, allegedly indecent content — could not be justified as a restriction on the mere “time, place, or manner of [the] distribution” of speech. The same is true in this case: The language in the opinion below which suggests that the University’s action could be viewed as enforcing reasonable regulations as to the time and place of speech is inconsistent with Papish.
D. University Student Speech Is Protected Against Content-Based Restrictions Even If They Are Viewpoint-Neutral
Papish also makes clear that college student speech is protected even against viewpoint-neutral but content-based speech restrictions, and not just against viewpoint-based ones.
In Papish, university officials claimed that the student’s speech was punishable because of its lack of “decency,” not because it expressed an anti-police viewpoint. Nonetheless, this Court made clear that even restrictions on vulgar and crude expression are unconstitutional. “[T]he mere dissemination of ideas — no matter how offensive to good taste — on a state university campus may not be shut off in the name alone of ‘conventions of decency.’” The assertion in the opinion below that student speech restrictions are permissible so long as they are viewpoint-neutral cannot be reconciled with Papish. And the holding of Papish must equally apply when speech is being shut off in the name of professionalism rather than of decency.
Letting colleges expel students for their speech based on administrators’ subjective interpretation of “professionalism” is especially inappropriate because standards of “professionalism” are often so subjective. This Court has recognized that matters of “taste and style” are not for the government to determine. Cohen v. California, 403 U.S. 15, 25 (1971). The same is true of distasteful speech such as Keefe’s.
If administrators can show that a student’s speech fits within a narrow exception to First Amendment protection, such as for “true threats,” they can indeed punish the students on those grounds. But they should not be free to create a new exception for “unprofessional speech” (at least when the speech is outside the curriculum and outside any interactions with specific patients).
II. The Decision Below Jeopardizes Speech in Law Schools, Business Schools, and Many Other University Programs
What the College’s nursing program is doing, other colleges can do as well. That is clear for other nursing schools, which similarly rely on the Code of Ethics for Nurses to forbid “[b]ehaviors unbecoming of the Nursing Profession,” “[i]nappropriate” or “[u]nprofessional behaviors,” or behaviors that show “lack of professional compatibility.”
But the decision below will also authorize punishing speech in law schools, business schools, and other schools that recognize similarly vague national standards of professional conduct. A medical school administrator might conclude that a student who supports mercy killing (indeed, considers it a moral imperative) is violating professional norms. See, e.g., Hippocratic Oath, Yale Book of Quotations 360 (Fred R. Shapiro ed. 2006) (“Neither will I administer a poison to anybody when asked to do so, nor will I suggest such a course.”). Or a business school administrator might conclude that a student who condemns the free-market system is likely to betray the interests of stockholders, or to misunderstand economics.
A law school administrator might conclude that a student who argues that the attorney-client privilege is immoral might violate professional norms. After all, the administrator might argue, “The First Amendment did not bar [me] from making the determination” — based on the student’s speech — “that [the student] was unable to meet the professional demands of being a [lawyer].”
An education school administrator might worry that a student who makes a policy argument against age-of-consent laws might in the future molest students. Indeed, that is precisely the reasoning that the Ninth Circuit approved in Oyama. All such student speech could thus lead to discipline and even expulsion. Yet public colleges should not be freed to silence the expression of dissenting views, regardless of what various organizations’ standards advocate.
Many courts have struck down campus speech codes in recent decades. In Dambrot v. Central Michigan University, for instance, the Sixth Circuit held that a speech code restricting written literature or slogans that “infer[red] negative connotations about … individual[s’] racial or ethnic affiliation” was unconstitutional. 55 F.3d 1177, 1184-85 (6th Cir. 1995). In DeJohn v. Temple University, the Third Circuit struck down as unconstitutional a ban on “gender-motivated” speech that was likely to cause disruption. 537 F.3d 301, 316-17, 320 (3d Cir. 2008).
Likewise, in McCauley v. University of the Virgin Islands, the Third Circuit held that a student code of conduct prohibiting speech that “tends to injure or actually injures, frightens, demeans, degrades or disgraces any person” was unconstitutionally overbroad. 618 F.3d 232, 237-38, 250 (3d Cir. 2010). For more decisions striking down campus speech restrictions, see Iota Xi Chapter of Sigma Chi Fraternity v. George Mason Univ., 993 F.3d 386, 388-89, 391, 393 (4th Cir. 1993); College Republicans v. Reed, 523 F. Supp. 2d 1005, 1010-11, 1021 (N.D. Cal. 2007); Roberts v. Haragan, 346 F. Supp. 2d 853, 870-72 (N.D. Tex. 2004); Bair v. Shippensburg Univ., 280 F. Supp. 2d 357, 373 (M.D. Pa. 2003); Booher v. Bd. of Regents of N. Ky. Univ., 1998 U.S. Dist. LEXIS 11404, *28-*31 (E.D. Ky. 1998); UWM Post, Inc. v. Regents, 774 F. Supp. 1163, 1165-66, 1173, 1177 (E.D. Wis. 1991); Doe v. Univ. of Mich., 721 F. Supp. 852, 856, 864-66 (E.D. Mich. 1989). Yet the opinion below gives administrators a roadmap for speech codes that are even vaguer and broader than the ones struck down in these decisions.
There is ample appetite for such restrictions, as recent events have shown. University administrators often feel pressure from activists, legislators, faculty, or students to impose speech codes; and of course they may support such codes themselves. Thus, to give just a few examples:
A University of Idaho student was charged under a university speech code with “discrimination” and “harassment” for (a) saying “illegal immigration destroyed my home state of California” in between songs at a musical concert on Cesar Chavez Day, and (b) shouting “liberalism is destroying America” at a “Take Back the Night” march.
A University of Wisconsin-La Crosse student newspaper published a satirical article titled “Cheney Kills Five Crips in Inner-City Hunting Accident.” As a result, the newspaper was charged with “racist, sexist, homophobic, ablest [sic], anti-Semitists [sic] speech” that would “threaten the recruitment and retention of students from underrepresented groups,” and was ordered to cut its distribution by 97%.
A Muslim student at William Paterson University received an unsolicited email from a professor discussing a film described as “a lesbian relationship story.” He replied with an email asking that he not be sent “any mail about ‘Connie and Sally’ and ‘Adam and Steve.’ These are perversions. The absence of God in higher education brings on confusion.” The student was charged with sexual harassment for his use of the word “perversion” to refer to homosexuality.
The speakers in these cases were eventually absolved because of First Amendment concerns. But the decision below, and the Ninth Circuit Oyama decision on which the decision below relies, takes the view that such constitutional concerns are misplaced — so long as the speech can be labeled “unprofessional speech,” it can be punished. Under the reasoning of these decisions (and especially the decision below to extend Oyama even outside the classroom), all such speech would be subject to suppression.
Indeed, the rationale of the court below could easily apply not just to satire or slogans, but to normal, reasoned, and substantive discussion of contested policy issues, as was the case in Oyama. Faced with this danger, even careful and thoughtful students will tend not to express themselves on certain topics, for fear that they will be expelled from their academic programs.
The way “to avoid these ends” is “by avoiding these beginnings.” West Va. Bd. of Ed. v. Barnette, 319 U.S. 624, 641 (1943). This Court should step in and make clear, to the Eighth Circuit, the Ninth Circuit, and other courts — as well as to college administrators — that college students cannot be expelled simply because an administrator concludes that they engaged in “unprofessional speech.”
Conclusion
The logic of the decision below would let colleges punish a vast range of student views that administrators view as “unprofessional speech.” It would apply not just to nursing students, but to students at law schools, business schools, and other academic institutions.
The decision cannot be defended on the grounds that such restrictions are “viewpoint-neutral,” or cover only speech “at the wrong place and time.” Indeed, it relies on and endorses cases that have upheld viewpoint-based restrictions — and, in any event, even viewpoint-neutral but content-based restrictions on university speech are unconstitutional.
The decision is thus inconsistent with the decisions of this Court, and the decisions of other federal courts. This Court should therefore grant certiorari, and reverse the judgment of the Court of Appeals.

May a college expel a student for ‘unprofessional speech’ in Facebook posts?
Say a student is in a professional education program at a college — law school, medical school, nursing school, business school, school of education or the like. May the college expel him from the program, on the grounds that certain speech of his is “unprofessional” and therefore casts doubt on his professional temperament and likely future behavior?
We’re not talking here about speech within a curricular assignment — a thesis, a term paper, a practicum client counseling session or even a seminar discussion in which participation is graded. Colleges have to evaluate the content of such curricular speech, though even there they may be constrained. (If I grade class participation at UCLA, for instance, I can only count it as part of the final grade, and I’m supposed to grade it in a way that’s as ideologically neutral as possible.) Rather, we’re talking about speech outside such graded discussions, often outside class and sometimes even outside school.
In Keefe v. Adams, a split 2-1 8th Circuit panel upheld such an expulsion; the Supreme Court will on Friday consider the petition for certiorari, filed by Robert Corn-Revere, Ronald London and Lisa Zycherman of Davis Wright Tremaine. And just today, I filed an amicus brief (written by my students Jenna Mersereau, Jennifer Milazzo and Joshua Ostrer, and me) supporting the petition, on behalf of the Cato Institute, the Electronic Frontier Foundation, the National Coalition Against Censorship and the Student Press Law Center. We’re hoping that the court will call for a response from the state defendants (the next step in the process, if the court is to grant review), and then ultimately agree to hear the case.
I quote the brief below so you can see the heart of our argument (though for the full text, including the footnotes, see the PDF). Note that the student’s speech in this case was pretty rude, angry and insulting, as well as basically unideological:
Glad group projects are group projects. I give her a big fat F for changing the group power point at eleven last night and resubmitting. Not enough whiskey to control that anger.

But, as we argue below, the logic of the opinion below — and the cases on which it relies — would extend to supposedly “unprofessional” speech far beyond this. (Also, to the extent that a school thinks that off-campus speech constitutes a “true threat” of violence, it could punish a student for that; but the panel’s rationale extends far more broadly, to a potentially wide range of “unprofessional speech.”)
Summary of Argument
The opinion below authorizes college administrators to expel students for their speech, whenever that speech — including speech entirely outside any curricular project — supposedly fails to comply with professional norms.
This principle could easily apply to, for instance, speech about educational policies, proper rules governing sexual relationships, and “social justice.” Indeed, it has already been applied to such speech in a precedent on which the opinion below relied.
And this principle could easily apply to law schools, business schools, medical schools, and other programs. Armed with this opinion and other circuit court opinions that it endorses, colleges can revive and broaden campus speech codes under the pretext of applying professional standards.
The opinion below is inconsistent with past circuit and district court cases that have uniformly struck down such speech codes. (The petition helpfully canvasses the split between this case and other circuit precedents.) It is also inconsistent with this Court’s precedents. See Papish v. Bd. of Curators of Univ. of Missouri, 410 U.S. 667, 671 (1973) (per curiam); Healy v. James, 408 U.S. 169, 180 (1972). And it is profoundly damaging to free speech at colleges and universities, on which free speech throughout American society depends.
Argument
First Amendment protection is critical at universities, “one of the vital centers for the Nation’s intellectual life.” Rosenberger v. Rector & Visitors of Univ. of Va., 515 U.S. 819, 835-36 (1995). If uncorrected, the opinion below, and other recent circuit decisions like it, will set a dangerous precedent: Colleges will be able to punish students for expressing their views, based simply on administrators’ judgments that certain speech is inconsistent with their subjective understanding of professionalism.
I. The Logic of the Decision Below Would Let Colleges Punish Views That Administrators See as Contrary to Professional Norms
A. The Code of Ethics for Nurses Embodies Ideological Commitments
Central Lakes College expelled Craig Keefe from its nursing program under the program’s student code of conduct, which permits such expulsion for “behavior unbecoming of the Nursing Profession” or a “transgression of professional boundaries.” The court below upheld that decision, on the theory that the First Amendment does not protect “unprofessional speech” such as speech that violates the Nursing Code of Ethics.
But this rationale would cover a vast range of speech. The same “professionalism” policy in the Nursing Program handbook also says, for example, “Integral to the profession of nursing is a concern … for social justice” — right before stating that “students who fail to meet the moral, ethical, or professional behavioral standards of the nursing program are not eligible to progress in the nursing program.” If a student can be expelled for speech “unbecoming of the Nursing Profession,” he can thus be expelled for lack of “concern … for social justice” as well.
Indeed, the Code of Ethics for Nurses expressly endorses many controversial ideological positions. Or a business school administrator might conclude that a student who condemns the free-market system is likely to betray the interests of stockholders, or to misunderstand economics.
A law school administrator might conclude that a student who argues that the attorney-client privilege is immoral might violate professional norms. After all, the administrator might argue, “The First Amendment did not bar [me] from making the determination” — based on the student’s speech — “that [the student] was unable to meet the professional demands of being a [lawyer].”
An education school administrator might worry that a student who makes a policy argument against age-of-consent laws might in the future molest students. Indeed, that is precisely the reasoning that the Ninth Circuit approved in Oyama. All such student speech could thus lead to discipline and even expulsion. Yet public colleges should not be freed to silence the expression of dissenting views, regardless of what various organizations’ standards advocate.
Many courts have struck down campus speech codes in recent decades. In Dambrot v. Central Michigan University, for instance, the Sixth Circuit held that a speech code restricting written literature or slogans that “infer[red] negative connotations about … individual[s’] racial or ethnic affiliation” was unconstitutional. 55 F.3d 1177, 1184-85 (6th Cir. 1995). In DeJohn v. Temple University, the Third Circuit struck down as unconstitutional a ban on “gender-motivated” speech that was likely to cause disruption. 537 F.3d 301, 316-17, 320 (3d Cir. 2008).
Likewise, in McCauley v. University of the Virgin Islands, the Third Circuit held that a student code of conduct prohibiting speech that “tends to injure or actually injures, frightens, demeans, degrades or disgraces any person” was unconstitutionally overbroad. 618 F.3d 232, 237-38, 250 (3d Cir. 2010). Reed, 523 F. Supp. 2d 1005, 1010-11, 1021 (N.D. Cal. 2007); Roberts v. Haragan, 346 F. Supp. 2d 853, 870-72 (N.D. Tex. 2004); Bair v. Shippensburg Univ., 280 F. Supp. 2d 357, 373 (M.D. Pa. 2003); Booher v. Bd. of Regents of N. Ky. Univ., 1998 U.S. Dist. LEXIS 11404, *28-*31 (E.D. Ky. 1998); UWM Post, Inc. v. Regents, 774 F. Supp. 1163, 1165-66, 1173, 1177 (E.D. Wis. 1991); Doe v. Univ. of Mich., 721 F. Supp. 852, 856, 864-66 (E.D. Mich. 1989). Yet the opinion below gives administrators a roadmap for speech codes that are even vaguer and broader than the ones struck down in these decisions.
There is ample appetite for such restrictions, as recent events have shown. University administrators often feel pressure from activists, legislators, faculty, or students to impose speech codes; and of course they may support such codes themselves. Thus, to give just a few examples:
A University of Idaho student was charged under a university speech code with “discrimination” and “harassment” for (a) saying “illegal immigration destroyed my home state of California” in between songs at a musical concert on Cesar Chavez Day, and (b) shouting “liberalism is destroying America” at a “Take Back the Night” march.
A University of Wisconsin-La Crosse student newspaper published a satirical article titled “Cheney Kills Five Crips in Inner-City Hunting Accident.” As a result, the newspaper was charged with “racist, sexist, homophobic, ablest [sic], anti-Semitists [sic] speech” that would “threaten the recruitment and retention of students from underrepresented groups,” and was ordered to cut its distribution by 97%.
A Muslim student at William Paterson University received an unsolicited email from a professor discussing a film described as “a lesbian relationship story.” He replied with an email asking that he not be sent “any mail about ‘Connie and Sally’ and ‘Adam and Steve.’ These are perversions. The absence of God in higher education brings on confusion.” The student was charged with sexual harassment for his use of the word “perversion” to refer to homosexuality.
The speakers in these cases were eventually absolved because of First Amendment concerns. But the decision below, and the Ninth Circuit Oyama decision on which the decision below relies, takes the view that such constitutional concerns are misplaced — so long as the speech can be labeled “unprofessional speech,” it can be punished. Under the reasoning of these decisions (and especially the decision below to extend Oyama even outside the classroom), all such speech would be subject to suppression.
Indeed, the rationale of the court below could easily apply not just to satire or slogans, but to normal, reasoned, and substantive discussion of contested policy issues, as was the case in Oyama. Faced with this danger, even careful and thoughtful students will tend not to express themselves on certain topics, for fear that they will be expelled from their academic programs.
The way “to avoid these ends” is “by avoiding these beginnings.” West Va. Bd. of Ed. v. Barnette, 319 U.S. 624, 641 (1943). This Court should step in and make clear, to the Eighth Circuit, the Ninth Circuit, and other courts — as well as to college administrators — that college students cannot be expelled simply because an administrator concludes that they engaged in “unprofessional speech.”
Conclusion
The logic of the decision below would let colleges punish a vast range of student views that administrators view as “unprofessional speech.” It would apply not just to nursing students, but to students at law schools, business schools, and other academic institutions.
The decision cannot be defended on the grounds that such restrictions are “viewpoint-neutral,” or cover only speech “at the wrong place and time.” Indeed, it relies on and endorses cases that have upheld viewpoint-based restrictions — and, in any event, even viewpoint-neutral but content-based restrictions on university speech are unconstitutional.
The decision is thus inconsistent with the decisions of this Court, and the decisions of other federal courts. This Court should therefore grant certiorari, and reverse the judgment of the Court of Appeals.
