Sahasrar Chakra and Brahmarandhra-Centers of Divine Powers

The human body (Microcosm) is said to be a small sample of the cosmos (Macrocosm).  The entire body of a big tree is hidden in a tiny seed.   In a small sperm lies the cast of the entire human body.  The manner in which the mutual attraction and activities of the planets of the solar system are executed, can be seen albeit at a microlevel within the atomic family represented by electrons, neutrons etc.  In the same way the entire cosmos can be seen in a microform within this small human body.  Whatever is visible / invisible in this gigantic cosmos is present within this tiny human body.  All the special characteristics of earth too are found in the human body. All the energies, special qualities and glories of earth are found in the point of balance i.e. the North and South Poles.  From here all movements /activities of earth are controlled.  As a result this earth is an active ball and a playground for all creatures.  If the North / South Poles lose their balance or they undergo some change, the entire earth will look like something totally different.  It is said that even if a minor fist blow is executed on the point of center of balance in the 2 Poles, the earth will change its orbit by leaps and bounds.  As a result this very nature of days, nights, seasons etc. will change and take up a new extreme form.  Further this minor fist blow can induce earth to dash into other stars, galaxies etc. and thus get powdered to pulp.  The cause is very clear.  In that the 2 Poles control all the movements of earth.  It is their energy centers that induce our earth to dance to its tunes like a puppet.  All earthly activities are given the necessary capacity and inspiration to function aptly.  The 2 Poles are the central points of earth’s activities and energy centers. Just as the planet earth attains energy and activities from the 2 Poles, so too the human body has 2 Poles.  The North Pole is Sahasrar Kamal in the Brahmarandhra (center of the brain).  The South Pole is the Mooladahr Chakra of Kundalini or Divine Serpent Power center at the base of Sushumna (near the genitals). According to Indian Mythology, Lord Vishnu sleeps on Lord Shesha (1000 hooded serpent) in the Ksheersagar (ocean of nectar).   This Ksheersagar is nothing but the intense white ocean of love in our brain.  Sahasrar Kamal is that atom which instead of being round like other sheaths is like serrated teeth of a cog-wheel.  These teeth are compared to the petals of a lotus.  The central point of energy lies in this atomic Pole.   This Vishnu Pole or Sahasrar Kamal (1000 petalled lotus in the brain) is the very basis of attainment of sensory and extrasensory knowledge pertaining to the innumerable conscious and unconscious units of the brain.  This region is the central point of all spiritual practices like meditation / trance / self-reflection / Yoga of devotion alongwith will power, soul power and Sidhis attained due to a strong power of resolve (Sankalps). The North Pole lies in the central point of the head called Sahasrar Chakra.  In the center of the head is a subtle 1000 petalled lotus and is called the Sahasrar Chakra. Within it dwells divine energy or Shiva.  It is over here that Kundalini or Divine Serpent Power rises from the South Pole to merge into Shiva in the North Pole.  From this area all bodily movements are controlled just as a puppeteer seated behind a curtain, controls his puppets via mere finger movements.  It is also called the region of the soul etc.   All energies and its sub-categories that create movements in this gigantic cosmos are found situated around the Sahasrar. Sacred scriptures say that Kundalini is the very life force of all energies and Sidhis.  A person who activates the otherwise latent (sleeping) Divine Serpent Power becomes the Lord of infinite grandeur of this world.  In India this has been discovered right since ancient times.  There is no end or limit to the potency of Kundalini Shakti or Divine Serpent Power. But activating the Kundalini is not the ultimate goal of a living being.   The ultimate goal of all creatures is to attain salvation (Moksha) i.e. merging the individual ego into the cosmic soul (God).  The aim of any human life is to merge into Brahman / God/ cosmic soul.  Yoga and other spiritual practices are meant exactly for this purpose.  The same holds true for Kundalini too.  This has been commented upon in Hathayoga Pradeepika as follows – “Just as a person tries to open the lock of a bolt, so too a Yogi finds the path of Sushumna via Kundalini based practices.  He then enters Brahmaloka so as to attain salvation (Moksha).” Only when a spiritual aspirant enters this Sahasrar Chakra, can he experience the joy of immortality, vision of the cosmos, control of cosmic powers and Samadhi or trance.  The Brahmaloka mentioned in the above lines is nothing but the Sahasrar Chakra.  It is very difficult to reach this Chakra.  Majority of spiritual seekers get stuck in the lower Chakras and merge into the lower type of bliss that they get in that region.  Hence Sidhis (extraordinary powers) attained during preliminary Kundalini awakening are said to be obstacles.  Just as a man thinks the material world to be the ultimate goal of life because of having immense wealth, grandeur and a beautiful wife, so too a person who activates his Divine Serpent Power thinks that Sidhis like hearing far off words, seeing far off objects, knowing other people’s thoughts, predicting the future accurately etc. attained while activating the lower Chakras, is the be all and end all of life.  Thus he totally loses sight of the supreme goal of rising upto the last Chakra i.e. Sahasrar and merging into it. Even if a person reaches the Sahasrar Chakra, he cannot dwell in this region for a great length of time.  How long can a spiritual seeker dwell in the Sahasrar Chakra?  This depends on the nature of spiritual practice which he follows and how much inner spiritual energy he possesses.  Many spiritual seekers dwell in the Sahasrar Chakra for a certain length of time and then get demoted into lower Chakras and their levels of lower bliss.  But he, who steadfastly “ripens” his Sahasrar Chakra, attains the omnipotent Lord and thus experiences infinite bliss eternally. The Sahasrar Chakra lies 2 inches within the ears and 3 inches within the eyebrows.  Its form is that of a ball of light in the hollow portion of the upper region of an opening called “Mahavivar” of the brain area.   Via the process of Divine Serpent Power awakening, this Mahavivar opening has to be widened so as to enter the state of divinity.   Hence it is called the “10th door” or Brahmarandhra too.  In the Dhyanbindupanishad it is said that – “A Yogi is one who knows the light akin to a jewel in the brain.  That jewel akin to 7 golds that is lit up by an electrical like stream, is found in the lower region of Meru and 4 fingers above the fire region.  It seeks shelter in the Svadhishthan Chakra and is subtle sound manifest” The scriptures while describing the powers attained in reaching this region say – “Such a person knows the ultimate knowledge, he becomes omniscient (i.e. knower of past, present and future) and can do anything he wishes.  He may perform any action, yet no sin accrues.  None can gain victory over such a person.” In one way Brahmarandhra is the head office of a creature.  It is a laboratory which helps us attain whatever we see in this visible world and all those things which are beyond our knowledge. According to Indian philosophy over here there are such rare auras of light made up of 17 principles which cannot be seen in the visible world with our gross eyes. All nervous elements and air tubicles come out from this area and spread out into the entire body.  The Creator seated in this white lotus, sends and receives orders and messages from any part of the body via any nerve.  He can create movements in any area.   He can clean and create a rain of vital force in any area without any technological paraphernalia which we limited creatures can never even dream of doing.  All this takes place because of emission, contraction and relaxation of auras of light.  It is this ball of light that induces the nose to smell, the ears to hear, the eyes to see, the tongue to taste and speak.  This ball of light is under the direct jurisdiction of Almighty God dwelling in the Sahasrar Chakra.  In the initial stages of meditation, this light is seen either as glow-worms, twinkling stars, shining petals or half/ full moon. Slowly and steadily its divine nature is experienced.  As a result the gross sense organs become lax and the working arena of the soul shines brilliantly in the entire world.  An ordinary individual can worry only about his immediate family members.   But a Yogi enfolds the entire world in the embrace of his soul and extends upto other Lokas (worlds) too.  He also has to ascertain whether there is any imbalance in the movements of planets, galaxies etc.  In a gross manner denizens of our planet earth too are influenced by these activities.  Hence even unknowingly such a spiritual seeker, who enters the state of Godhood, can work only for the well-being of all creatures of the cosmos.  Whatever rights and omnipotency is attained by such a great soul is taken up as a gigantic responsibility by him.  He may seem to be having a human body yet he has no body consciousness at all.  He knows everything.  He sees and hears everything and can predict future events very accurately. The substratums of the Intellectual Sheath and Mental Sheath viz. the intellect and mind dwell in this region. They unearth news of objects lying far away or those beyond the ken of the sense organs of knowledge.  When one’s soul resolve progresses into the intellectual arena after leaving the mental arena, one attains divine wisdom.  It comes out from the Ajna Chakra so as to unite with the different types of rays of the cosmos and thus attains its knowledge.  Just as with the help pf electrical waves, space shuttles can be directed to the right or left of planet earth (called traversing), just as with the help of a television you can see scenes of far off places so too man can see scenes in my part of the world or obstruct one’s cosmic movement with the help of the rays of his resolve (Sankalpa).  In the Mundak Upanishad (Chapter 2) and Chandogya Upanishad (Chapter 9) details of this self-realization have been given as follows – “A self realized saint subtly experiences that God without Kalas (divisions) in the form of a light that is whiter than white and is present in the Golden Sheath.” Many forms of Sahasrar based spiritual practices like Pratyahar (disallowing sense organs to contact their respective objects), Dharana (focusing of mind), Dhyan (meditation) and Samadhi (trance) have been put forth as studies.  A description has been given about the good results attained due to their successful execution.  The deep import of the success of that region has been given in the form of material and spiritual progress. Today even modern scientists accept that there are extraordinary energy centers in the brain.  According to research studies conducted by the brain specialist Smithy, a pure intellect is controlled by different centres of the human brain.  It is a production of a cooperative endeavour of all of them.  This is the gist (region) which creates a human character and nourishes it.  A mental level is created by memory, analysis, synthesis, selectivity etc.   Where does its admixture and production take place?  This has not been aptly deduced yet it is clear that this area should be in the cerebellum part of the brain.  This is that very sensitive spot which if undergoes ripening, can induce advancement of one’s inner personality.  Spiritual seers of yore had discovered this center and had named it Sahasrar. While deeply analyzing the brain so many layers are discovered which not only help us think but also creates our very character.  This region of special capabilities is the “Frontal lobe”.  In it one discovers man’s personality, imagination power, ambitions, social behaviour, experiences, sensations and other important functions.  It is not possible to influence this area by medicines or surgery. Only those spiritual practices like Dhyan (meditation), Dharana (Concentration) etc. can be made use of which is a part of Kundalini i.e Divine Serpent Power awakening. In the above paragraphs we have merely made a minor reference of only one center of the brain.  Yet it is well-known that the brain abounds with infinite mysterious powers.  The conclusions drawn by today’s modern scientists specializing in brain research, is very much in tandem with the discoveries of ancient Indian seers. From a grosser type of classification, the brain can be categorized into 5 parts 1) Cerebrum 2) Cerebellum 3) Mid-brain 4) Pons 5) Medulla Oblongata.  The last three parts that is mid-brain, pons and medulla oblongata together form a single unit called the “brain stem.” According to Spiritual Sciences, 0.33 billion demigods dwell in heaven represented by the brain.  But 5 of them are chief representatives.  All of these control various divine centers.  The 5 regions of the brain listed above can be said to be the region of the 5 demi-gods.  With their help the 5 energies of the 5 sheaths are produced and controlled. The 5-fold spiritual practices of Gayatri help evolve these 5 in unison.  As a result a creature dwelling in Brahmaloka or heaven, experiences a heavenly atmosphere. So far our discussion revolved around a certain type of classification.  Many scholars right since ancient times have been describing this very fact albeit in various ways.  Even today this type of discussion continues.  This one single precept pertaining to the classification of the brain and Sahasrar Chakra are described in various ways. The Sahasrar Chakra is also called the “pot of nectar”.  It is said that Som juice emanates from it.  The demi-gods drink this nectar and become immortal. According to modern brain anatomy, the brain is filled with a special “Cerebro-spinal fluid.” This fluid nourishes and protects the various centers of the brain. It drips from the brain’s membrane and is absorbed by various centers of the brain and the Sushumna (subtle spinal nerve). The “pot of nectar” has 16 coverings.  In the same way at certain places the Sahasrar is said to have 16 petals.  These are nothing but 16 important centers of the brain.  The Shiva Samhita too says that the Sahasrar Kamal has petals. “One should meditate on the Sahasrar Chakra made of 16 Kalas situated in the centre of the brain and which shines like the moon.” -YOGA MANJUSHA These 16 Kalas of the Sahasrar are the 16 points of the brain related to the cerebrospinal fluid.  If the previously 5 grossly classified parts of the brain are classified more minutely, they will add upto 16 in number as follows – 1) Cerebrum 2) Cerebellum 3) Medula Oblongata 4) Pons 5) Mid brain 6) Corpus Colosum 7) Corpus Stratum 8) Pituitary Gland 9) Pineal gland 10) Thalamus 11) Hypothalamus 12) Subthalamus 13) Metathalamus 14) Epithalamus 15) Corad plexuses 16) Ventrilces. All these above parts have centers full of ESP (Extra Sensory Potential) that control the body.  By activating the pot of nectar of Sahasrar, we can make the brain more active and thus attain extraordinary benefits.  The scriptures have clearly said – “Due to activation of the Sahasrar Kamal, a Yogi’s psyche becomes equipoised and thus merges into his soul.  He overcomes bondage of the material world.  He is full of all-round potential.  He moves freely everywhere and his speech becomes nectarine.” - SHATCHAKRA NIRUPANA “One must meditate on the Ksheersagar ocean in the core of the forehead and on the moon-like light in the Sahasrar Kamal (1000 petalled lotus).” - SHIV SAMHITA “That Yogi who continuously drinks the nectar emitted by the Sahasrar Kamal can bring in a law to ‘kill death’.  Meaning death is no longer death for him because he lives a life that has gone beyond death.  It is in the Sahasrar region that Kundalini merges itself.  At that time the 4 types of creation merge into God and everything becomes Godlike.” - SHIV SAMHITA “That Soma juice of Sahasrar Kamal which purifies Richas, Samveda, Yajurved, Brahmanas, may it purify me too.” - YAJURVED What exactly is the Sahasrar? This answer according to anatomists is that the electrical onrush from the center of the brain which controls bodily movement does not get emitted from a substratum but that a special center is responsible for it.  This is not man’s own creation but is a divine blessing.  The liver, heart and other organs function as a result of this energy attained from a divine center.  The blood nourishes various bodily organs and it is a fact.  It is also true that the lungs are responsible for respiration and the stomach for digestion.  Yet the question arises that when these organs carry out various tasks, where do they get the necessary energy to do so?  It is not correct to say that respiration, digestion etc. give us the energy to survive because if this were to be true, man could only die because of hunger or choking of breath. This electrical onrush continuously gets emitted in spurts in the central region of the brain.  It can be said to be an extraordinary electrical spring.  From there a fire-worklike light is emitted in spurts.  The heart experiences such rests in between heart-beats.  There is a rise and fall even in wave-flows of heat, sound etc.  The same holds true for the activities of the fount of energy in the central point of the brain.  Scientists opine that the energy spurts are the main basis of the activities of various centers of the brain.   This very principle has been elucidated by Indian Yogic scriptures in their own way. “In the center of the brain is a jewel-like light.  From that, electrical streams are emitted akin to heated gold.  He is a true Yogi who understands this mystery.” - DHYANBINDU UPANISHAD. “The light of Brahman (God) dwells in the Brahmarandhra as fire.  It purifies our spiritual practice.  This it self is fire of Yoga.” - MATSYA PURANA This brain dwelling energy fount can be called Sahasrar Chakra according to anatomical sciences.  “Sahastra” means 1000 but here it means infinite. The Lord is said to have 1000 heads, 1000 legs etc.  The sparks of energy emitted from the brain fount are not 1000 in number but are infinite in number.  The number of drops of that shower is not 1000 only but connotes infinite number of drops.  On the basis of this description this “1000” is the fount of energy called Sahasrar. Today’s modern science accepts that infinite streams of electricity flow from the brain.  As per requirements those streams flow in infinite special nerves in infinite directions.  Based on each one’s function, scientists have classified these nerves into various categories. For example, Ascending Reticular Activating System, Descending Reticular Activating System, Specific Thalamic Projection, Defused Thalamic Projection and Brain Stem Reticular Formation.  From the standpoint of Yoga, the combined influence of the above systems can be seen in the form of thousands of streams of electrical onrushes in the brain. This is the very basis of the Sahasrar Kamal (1000 petalled lotus) and Lord Shesha (1000 hooded serpent).   The form of Lord Vishnu sleeping on Lord Shesha abounding with Kundalini Shakti in the midst of the Ksheersagar or Brahmaloka, is meant for understanding the state of Sahasrar.   Ksheersagar means marrow of the brain.  The coiled 1000 hooded serpent means the teeth of the axle of Sahasrar Chakra.  A wheel of a cart too has an axle.  The Lord’s Sudershan Chakra (disc weapon) too has teeth.   Thus Sahasrar can be correlated to the abovementioned details. The Sahasrar has been compared to the sun (1000 rays) too.  It is the energy that lights up the solar system and induces various activities in them.  Every unit of human existence is influenced by the brain energy.  Hence if the sun is said to be the presiding deity of the ball called Bhuloka (earth), it definitely is apt.  The divine existence of Sahasrar has been compared to the sun – “O Deveshi! Within the stalk of the great lotus Sahasrar dwells the soul akin to Mercury.  Although it radiates likes crores of suns, yet during emotions it is comparable to crores of moons.  This supreme material is extremely grand and oozes with the Divine Serpent Power.” - SKAND PURANA “This sun is nothing but the divine principle and its material symbol is the material sun.” - YAJURVEDA (23/48) “Your indwelling nectar is one who is the indweller in the sun whom the sun does not know, whose body is the sun and who controls the sun by dwelling within the sun.” - BRIHADARANYAK UPANISHAD Just as our solar system gets energy from the sun, in the same way the brain gets the necessary capacity for various functions from the energy source of Sahasrar Kamal.  Many machines are used in mills, factories etc.   These machines are attached to motors, transmitting electricity.  When the motor functions, it transmits energy to the machine.  But the electricity does not belong to the motor.  It comes from another source.  The brain is our motor and the bodily organs are small / big machines.  The energy required for smooth functioning of mills, factories etc. comes from somewhere else.  It is akin to the flow of grace attained by earth from its polar regions.  This is a gift of interplanetary energy.  A man is free and the author of his own destiny.  Yet the energy that creates man’s inner personality is said to be divine grace.  The moment this stream of energy is obstructed, man dies instantly.  Even if the heartbeats have stopped completely yet via artificial means it can be re-activated.  But the moment the electrical onrush of Sahasrar stops, know for sure that this is ultimate death.   Despite the fittings of a bulb being appropriate, if the electrical connection is cut off, we face darkness.  Despite the bodily organs being healthy, if the brain energy flow stops, we cannot remain alive. Grossly we may describe birth and death of creatures in a certain manner, yet according to subtle sciences like Yoga, birth and death are totally dependent on the activities of Sahasrar Chakra.  This is not the end of the discussion because a lot more follows hereafter.  Sahasrar is not merely the source of life but it is from here that the nature of one’s character and level is charted out and determined.  Even a little extra tilt, will change the course of flow of rain.  When a particular form of slant that induces rain water to enter a particular river is changed, this rain water will enter another totally different river.  At the beginning of the slant there was a difference of only a few inches yet when the rain water enters a totally new river, the difference in number of miles of area covered amounts to thousands.  Many trains standing in queue at a railway junction travel in different directions because of change of levers.  The changed levers are separated by the few inches only yet the trains that travel in different directions are separated by thousands of miles.  The same holds true for the Sahasrar Chakra.  In that, even an infinitesimal change in the Sahasrar, can induce amazing transformations; both within and without. For a modern scientist even to think of reduction / addition in the grants given by interplanetary space to earth, means facing fearful worries and turmoil.  Even a mere thought of taking one step in this direction, induces jitters in their minds.  Even a slight bit of topsy-turvying can induce massive destruction.  As against this if some conducive solutions are found it will greatly benefit all denizens of earth.  Thus we can become lords of unimaginable comforts.  Today scientists refuse to take big steps in this direction because of lack of knowledge.  They have merely taken minor steps in conducting research on the earth’s polar region.   They have yet not found the earth’s axis and nor have they made serious efforts in this direction. But no such danger is encountered when we talk of the Sahasrar which is the axis of the brain situated in the polar region of the human body.  Material / worldly energy is like a demon.  Even minor misuse of electricity, fire etc. can kill many people.  As against this no major calamity comes in the way in the relationship of a body and its doting mother.  This is the material difference between soul consciousness and material consciousness.   Sahasrar is a center of union of the individual soul and cosmic soul i.e. God.  This is a consciousness based give and take.  Within it overflow high leveled sentiments.  The nature of spiritual practices has been conjoined to the wealth of good-will.  This divine grace of greatness overflows from it. The Sahasrar Chakra is related to the Brahmarandhra.  Brahmarandhra is the 10th door.  The 9 doors are the 2 nostrils, 2 ears, 2 eyes, 1 mouth and 2 openings of faeces and urine.  The 10th door is Brahmarandhra.  Great Yogis give up their life by passing through this 10th door.  The very reason behind which the “Kapal Kriya’ (rite) is carries out after death, is that even if a bit of vital force has remained behind, it should pass out from this 10th door and thus induced go to a higher state. A newborn baby has a bit of a hollow space in the center of the scalp.  In it there is a tissue instead of bone.  It is situated between the parietal and acivital bones. As the body grows the bones too augment in size and cover the above mentioned hollow region.  The Yogic scriptures say that divinity or cosmic consciousness enters the human body through this hollow region. From the standpoint of bodily design, this region is not merely made up of bones because below its frontal area there are other principles.  There is also the cerebral cortex beneath the bones of our forehead that covers the brain region.  Within it are carvings akin to those seen when a farmer ploughs his field.  Thus it categorizes the brain into various parts.  These parts are called sulks.  The cortex is partitioned lengthwise by the longitudinal fissure and breadthwise it is called central cortex.  The crossing or point of union of both these corresponds to the Brahmarandhra of Indian Yogic scriptures.  In front of this Brahmarandhra, lies the most mysterious gland in the upper region of the brain called the Pineal Gland. This Brahmarandhra is a very special doorway for the individual’s bodily soul to establish a bond with the cosmic soul (God).  Great Yogis give up their life force through this very doorway at the time of death.  Thus they merge into the cosmic soul or God.  It is very clear that while their bodies are alive the Brahmarandhra of great Yogis execute tasks of give and take of divine experiences and divine powers via the medium of Sahasrar Chakra of the brain.  The Sahasrar Chakra and Brahmarandhra work in tandem like a unit.  Thus in Yogic practices they are influenced and utilized in unison.

Euthanasia and the Right to Die

I. Definitions of Types of Euthanasia Euthanasia, whether in a medical setting (hospital, clinic, hospice) or not (at home) is often erroneously described as "mercy killing". Most forms of euthanasia are, indeed, motivated by (some say: misplaced) mercy. Not so others. In Greek, "eu" means both "well" and "easy" and "Thanatos" is death. Euthanasia is the intentional premature termination of another person's life either by direct intervention (active euthanasia) or by withholding life-prolonging measures and resources (passive euthanasia), either at the express or implied request of that person (voluntary euthanasia), or in the absence of such approval (non-voluntary euthanasia). Involuntary euthanasia - where the individual wishes to go on living - is an euphemism for murder. To my mind, passive euthanasia is immoral. The abrupt withdrawal of medical treatment, feeding, and hydration results in a slow and (potentially) torturous death. It took Terri Schiavo 13 days to die, when her tubes were withdrawn in the last two weeks of March 2005. Since it is impossible to conclusively prove that patients in PVS (Persistent Vegetative State) do not suffer pain, it is morally wrong to subject them to such potential gratuitous suffering. Even animals should be treated better. Moreover, passive euthanasia allows us to evade personal responsibility for the patient's death. In active euthanasia, the relationship between the act (of administering a lethal medication, for instance) and its consequences is direct and unambiguous. As the philosopher John Finnis notes, to qualify as euthanasia, the termination of life has to be the main and intended aim of the act or omission that lead to it. If the loss of life is incidental (a side effect), the agent is still morally responsible but to describe his actions and omissions as euthanasia would be misleading. Volntariness (accepting the foreseen but unintended consequences of one's actions and omissions) should be distinguished from intention. Still, this sophistry obscures the main issue: If the sanctity of life is a supreme and overriding value ("basic good"), it ought to surely preclude and proscribe all acts and omissions which may shorten it, even when the shortening of life is a mere deleterious side effect. But this is not the case. The sanctity and value of life compete with a host of other equally potent moral demands. Even the most devout pro-life ethicist accepts that certain medical decisions - for instance, to administer strong analgesics - inevitably truncate the patient's life. Yet, this is considered moral because the resulting euthanasia is not the main intention of the pain-relieving doctor. Moreover, the apparent dilemma between the two values (reduce suffering or preserve life) is non-existent. There are four possible situations. Imagine a patient writhing with insufferable pain. 1. The patient's life is not at risk if she is not medicated with painkillers (she risks dying if she is medicated) 2. The patient's life is not at risk either way, medicated or not 3.  The patient's life is at risk either way, medicated or not 4.  The patient's life is at risk if she is not medicated with painkillers In all four cases, the decisions our doctor has to make are ethically clear cut. He should administer pain-alleviating drugs, except when the patient risks dying (in 1 above). The (possible) shortening of  the patient's life (which is guesswork, at best) is immaterial. Conclusions: It is easy to distinguish euthanasia from all other forms of termination of life. Voluntary active euthanasia is morally defensible, at least in principle (see below). Not so other types of euthanasia. II. Who is or Should Be Subject to Euthanasia? The Problem of Dualism vs. Reductionism With the exception of radical animal rights activists, most philosophers and laymen consider people - human beings - to be entitled to "special treatment", to be in possession of unique rights (and commensurate obligations), and to be capable of feats unparalleled in other species. Thus, opponents of euthanasia universally oppose the killing of "persons". As the (pro-euthanasia) philosopher John Harris puts it: " ... concern for their welfare, respect for their wishes, respect for the intrinsic value of their lives and respect for their interests." Ronald Dworkin emphasizes the investments - made by nature, the person involved, and others - which euthanasia wastes. But he also draws attention to the person's "critical interests" - the interests whose satisfaction makes life better to live. The manner of one's own death may be such a critical interest. Hence, one should have the right to choose how one dies because the "right kind" of death (e.g., painless, quick, dignified) reflects on one's entire life, affirms and improves it. But who is a person? What makes us human? Many things, most of which are irrelevant to our discussion. Broadly speaking, though, there are two schools of thought: (i) That we are rendered human by the very event of our conception (egg meets sperm), or, at the latest, our birth; or (ii) That we are considered human only when we act and think as conscious humans do. The proponents of the first case (i) claim that merely possessing a human body (or the potential to come to possess such a body) is enough to qualify us as "persons". There is no distinction between mind and abode - thought, feelings, and actions are merely manifestations of one underlying unity. The fact that some of these manifestations have yet to materialize (in the case of an embryo) or are mere potentials (in the case of a comatose patient) does not detract from our essential, incontrovertible, and indivisible humanity. We may be immature or damaged persons - but we are persons all the same (and always will be persons). Though considered "religious" and "spiritual", this notion is actually a form of reductionism. The mind, "soul", and "spirit" are mere expressions of one unity, grounded in our "hardware" - in our bodies. Those who argue the second case (ii) postulate that it is possible to have a human body which does not host a person. People in Persistent Vegetative States, for instance - or fetuses, for that matter - are human but also non-persons. This is because they do not yet - or are unable to - exercise their faculties. Personhood is complexity. When the latter ceases, so does the former. Personhood is acquired and is an extensive parameter, a total, defining state of being. One is either awake or asleep, either dead or alive, either in a state of personhood or not The latter approach involves fine distinctions between potential, capacity, and skill. A human body (or fertilized egg) have the potential to think, write poetry, feel pain, and value life. At the right phase of somatic development, this potential becomes capacity and, once it is competently exercised - it is a skill. Embryos and comatose people may have the potential to do and think - but, in the absence of capacities and skills, they are not full-fledged persons. Indeed, in all important respects, they are already dead. Taken to its logical conclusion, this definition of a person also excludes newborn infants, the severely retarded, the hopelessly quadriplegic, and the catatonic. "Who is a person" becomes a matter of culturally-bound and medically-informed judgment which may be influenced by both ignorance and fashion and, thus, be arbitrary and immoral. Imagine a computer infected by a computer virus which cannot be quarantined, deleted, or fixed. The virus disables the host and renders it "dead". Is it still a computer? If someone broke into my house and stole it, can I file an insurance claim? If a colleague destroys it, can I sue her for the damages? The answer is yes. A computer is a computer for as long as it exists physically and a cure is bound to be found even against the most trenchant virus. Conclusions: The definition of personhood must rely on objective, determinate and determinable criteria. The anti-euthanasia camp relies on bodily existence as one such criterion. The pro-euthanasia faction has yet to reciprocate. III. Euthanasia and Suicide Self-sacrifice, avoidable martyrdom, engaging in life risking activities, refusal to prolong one's life through medical treatment, euthanasia, overdosing, and self-destruction that is the result of coercion - are all closely related to suicide. They all involve a deliberately self-inflicted death. But while suicide is chiefly intended to terminate a life – the other acts are aimed at perpetuating, strengthening, and defending values or other people. Many - not only religious people - are appalled by the choice implied in suicide - of death over life. They feel that it demeans life and abnegates its meaning. Life's meaning - the outcome of active selection by the individual - is either external (such as "God's plan") or internal, the outcome of an arbitrary frame of reference, such as having a career goal. Our life is rendered meaningful only by integrating into an eternal thing, process, design, or being. Suicide makes life trivial because the act is not natural - not part of the eternal framework, the undying process, the timeless cycle of birth and death. Suicide is a break with eternity. Henry Sidgwick said that only conscious (i.e., intelligent) beings can appreciate values and meanings. So, life is significant to conscious, intelligent, though finite, beings - because it is a part of some eternal goal, plan, process, thing, design, or being. Suicide flies in the face of Sidgwick's dictum. It is a statement by an intelligent and conscious being about the meaninglessness of life. If suicide is a statement, than society, in this case, is against the freedom of expression. In the case of suicide, free speech dissonantly clashes with the sanctity of a meaningful life. To rid itself of the anxiety brought on by this conflict, society cast suicide as a depraved or even criminal act and its perpetrators are much castigated. The suicide violates not only the social contract but, many will add, covenants with God or nature. St. Thomas Aquinas wrote in the "Summa Theologiae" that - since organisms strive to survive - suicide is an unnatural act. Moreover, it adversely affects the community and violates the property rights of God, the imputed owner of one's spirit. Christianity regards the immortal soul as a gift and, in Jewish writings, it is a deposit. Suicide amounts to the abuse or misuse of God's possessions, temporarily lodged in a corporeal mansion. This paternalism was propagated, centuries later, by Sir William Blackstone, the codifier of British Law. Suicide - being self-murder - is a grave felony, which the state has a right to prevent and to punish for. In certain countries this still is the case. In Israel, for instance, a soldier is considered to be "military property" and an attempted suicide is severely punished as "the corruption of an army chattel". Paternalism, a malignant mutation of benevolence, is about objectifying people and treating them as possessions. Even fully-informed and consenting adults are not granted full, unmitigated autonomy, freedom, and privacy. This tends to breed "victimless crimes". The "culprits" - gamblers, homosexuals, communists, suicides, drug addicts, alcoholics, prostitutes – are "protected from themselves" by an intrusive nanny state. The possession of a right by a person imposes on others a corresponding obligation not to act to frustrate its exercise. Suicide is often the choice of a mentally and legally competent adult. Life is such a basic and deep set phenomenon that even the incompetents - the mentally retarded or mentally insane or minors - can fully gauge its significance and make "informed" decisions, in my view. The paternalists claim counterfactually that no competent adult "in his right mind" will ever decide to commit suicide. They cite the cases of suicides who survived and felt very happy that they have - as a compelling reason to intervene. But we all make irreversible decisions for which, sometimes, we are sorry. It gives no one the right to interfere. Paternalism is a slippery slope. Should the state be allowed to prevent the birth of a genetically defective child or forbid his parents to marry in the first place? Should unhealthy adults be forced to abstain from smoking, or steer clear from alcohol? Should they be coerced to exercise? Suicide is subject to a double moral standard. People are permitted - nay, encouraged - to sacrifice their life only in certain, socially sanctioned, ways. To die on the battlefield or in defense of one's religion is commendable. This hypocrisy reveals how power structures - the state, institutional religion, political parties, national movements - aim to monopolize the lives of citizens and adherents to do with as they see fit. Suicide threatens this monopoly. Hence the taboo. Does one have a right to take one's life? The answer is: it depends. Certain cultures and societies encourage suicide. Both Japanese kamikaze and Jewish martyrs were extolled for their suicidal actions. Certain professions are knowingly life-threatening - soldiers, firemen, policemen. Certain industries - like the manufacture of armaments, cigarettes, and alcohol - boost overall mortality rates. In general, suicide is commended when it serves social ends, enhances the cohesion of the group, upholds its values, multiplies its wealth, or defends it from external and internal threats. Social structures and human collectives - empires, countries, firms, bands, institutions - often commit suicide. This is considered to be a healthy process. Back to our central dilemma: Is it morally justified to commit suicide in order to avoid certain, forthcoming, unavoidable, and unrelenting torture, pain, or coma? Is it morally justified to ask others to help you to commit suicide (for instance, if you are incapacitated)? Imagine a society that venerates life-with-dignity by making euthanasia mandatory (Trollope's Britannula in "The Fixed Period") - would it then and there be morally justified to refuse to commit suicide or to help in it? Conclusions: Though legal in many countries, suicide is still frowned upon, except when it amounts to socially-sanctioned self-sacrifice. Assisted suicide is both condemned and illegal in most parts of the world. This is logically inconsistent but reflects society's fear of a "slippery slope" which may lead from assisted suicide to murder. IV. Euthanasia and Murder Imagine killing someone before we have ascertained her preferences as to the manner of her death and whether she wants to die at all. This constitutes murder even if, after the fact, we can prove conclusively that the victim wanted to die. Is murder, therefore, merely the act of taking life, regardless of circumstances - or is it the nature of the interpersonal interaction that counts? If the latter, the victim's will counts - if the former, it is irrelevant. V. Euthanasia, the Value of Life, and the Right to Life Few philosophers, legislators, and laymen support non-voluntary or involuntary euthanasia. These types of "mercy" killing are associated with the most heinous crimes against humanity committed by the Nazi regime on both its own people and other nations. They are and were also an integral part of every program of active eugenics. The arguments against killing someone who hasn't expressed a wish to die (let alone someone who has expressed a desire to go on living) revolve around the right to life. People are assumed to value their life, cherish it, and protect it. Euthanasia - especially the non-voluntary forms - amounts to depriving someone (as well as their nearest and dearest) of something they value. The right to life - at least as far as human beings are concerned - is a rarely questioned fundamental moral principle. In Western cultures, it is assumed to be inalienable and indivisible (i.e., monolithic). Yet, it is neither. Even if we accept the axiomatic - and therefore arbitrary - source of this right, we are still faced with intractable dilemmas. All said, the right to life may be nothing more than a cultural construct, dependent on social mores, historical contexts, and exegetic systems. Rights - whether moral or legal - impose obligations or duties on third parties towards the right-holder. One has a right AGAINST other people and thus can prescribe to them certain obligatory behaviors and proscribe certain acts or omissions. Rights and duties are two sides of the same Janus-like ethical coin. This duality confuses people. They often erroneously identify rights with their attendant duties or obligations, with the morally decent, or even with the morally permissible. One's rights inform other people how they MUST behave towards one - not how they SHOULD or OUGHT to act morally. Moral behavior is not dependent on the existence of a right. Obligations are. To complicate matters further, many apparently simple and straightforward rights are amalgams of more basic moral or legal principles. To treat such rights as unities is to mistreat them. Take the right to life. It is a compendium of no less than eight distinct rights: the right to be brought to life, the right to be born, the right to have one's life maintained, the right not to be killed, the right to have one's life saved,  the right to save one's life (wrongly reduced to the right to self-defence), the right to terminate one's life, and the right to have one's life terminated. None of these rights is self-evident, or unambiguous, or universal, or immutable, or automatically applicable. It is safe to say, therefore, that these rights are not primary as hitherto believed - but derivative. Go HERE to learn more about the Right to Life. Of the eight strands comprising the right to life, we are concerned with a mere two. The Right to Have One's Life Maintained This leads to a more general quandary. To what extent can one use other people's bodies, their property, their time, their resources and to deprive them of pleasure, comfort, material possessions, income, or any other thing - in order to maintain one's life? Even if it were possible in reality, it is indefensible to maintain that I have a right to sustain, improve, or prolong my life at another's expense. I cannot demand - though I can morally expect - even a trivial and minimal sacrifice from another in order to prolong my life. I have no right to do so. Of course, the existence of an implicit, let alone explicit, contract between myself and another party would change the picture. The right to demand sacrifices commensurate with the provisions of the contract would then crystallize and create corresponding duties and obligations. No embryo has a right to sustain its life, maintain, or prolong it at its mother's expense. This is true regardless of how insignificant the sacrifice required of her is. Yet, by knowingly and intentionally conceiving the embryo, the mother can be said to have signed a contract with it. The contract causes the right of the embryo to demand such sacrifices from his mother to crystallize. It also creates corresponding duties and obligations of the mother towards her embryo. We often find ourselves in a situation where we do not have a given right against other individuals - but we do possess this very same right against society. Society owes us what no constituent-individual does. Thus, we all have a right to sustain our lives, maintain, prolong, or even improve them at society's expense - no matter how major and significant the resources required. Public hospitals, state pension schemes, and police forces may be needed in order to fulfill society's obligations to prolong, maintain, and improve our lives - but fulfill them it must. Still, each one of us can sign a contract with society - implicitly or explicitly - and abrogate this right. One can volunteer to join the army. Such an act constitutes a contract in which the individual assumes the duty or obligation to give up his or her life. The Right not to be Killed It is commonly agreed that every person has the right not to be killed unjustly. Admittedly, what is just and what is unjust is determined by an ethical calculus or a social contract - both constantly in flux. Still, even if we assume an Archimedean immutable point of moral reference - does A's right not to be killed mean that third parties are to refrain from enforcing the rights of other people against A? What if the only way to right wrongs committed by A against others - was to kill A? The moral obligation to right wrongs is about restoring the rights of the wronged. If the continued existence of A is predicated on the repeated and continuous violation of the rights of others - and these other people object to it - then A must be killed if that is the only way to right the wrong and re-assert the rights of A's victims. The Right to have One's Life Saved There is no such right because there is no moral obligation or duty to save a life. That people believe otherwise demonstrates the muddle between the morally commendable, desirable, and decent ("ought", "should") and the morally obligatory, the result of other people's rights ("must"). In some countries, the obligation to save a life is codified in the law of the land. But legal rights and obligations do not always correspond to moral rights and obligations, or give rise to them. VI. Euthanasia and Personal Autonomy The right to have one's life terminated at will (euthanasia), is subject to social, ethical, and legal strictures. In some countries - such as the Netherlands - it is legal (and socially acceptable) to have one's life terminated with the help of third parties given a sufficient deterioration in the quality of life and given the imminence of death.   One has to be of sound mind and will one's death  knowingly, intentionally, repeatedly, and forcefully. Should we have a right to die (given hopeless medical circumstances)? When our wish to end it all conflicts with society's (admittedly, paternalistic) judgment of what is right and what is good for us and for others - what should prevail? One the one hand, as Patrick Henry put it, "give me liberty or give me death". A life without personal autonomy and without the freedom to make unpopular and non-conformist decisions is, arguably, not worth living at all! As Dworkin states: "Making someone die in a way that others approve, but he believes a horrifying contradiction of his life, is a devastating, odious form of tyranny". Still, even the victim's express wishes may prove to be transient and circumstantial (due to depression, misinformation, or clouded judgment). Can we regard them as immutable and invariable? Moreover, what if the circumstances prove everyone - the victim included - wrong? What if a cure to the victim's disease is found ten minutes after the euthanasia? Conclusions: Personal autonomy is an important value in conflict with other, equally important values. Hence the debate about euthanasia. The problem is intractable and insoluble. No moral calculus (itself based implicitly or explicitly on a hierarchy of values) can tell us which value overrides another and what are the true basic goods. VII. Euthanasia and Society It is commonly accepted that where two equally potent values clash, society steps in as an arbiter. The right to material welfare (food, shelter, basic possessions) often conflicts with the right to own private property and to benefit from it. Society strikes a fine balance by, on the one hand, taking from the rich and giving to the poor (through redistributive taxation) and, on the other hand, prohibiting and punishing theft and looting. Euthanasia involves a few such finely-balanced values: the sanctity of life vs. personal autonomy, the welfare of the many vs. the welfare of the individual, the relief of pain vs. the prolongation and preservation of life. Why can't society step in as arbiter in these cases as well? Moreover, what if a person is rendered incapable of expressing his preferences with regards to the manner and timing of his death - should society step in (through the agency of his family or through the courts or legislature) and make the decision for him? In a variety of legal situations, parents, court-appointed guardians, custodians, and conservators act for, on behalf of, and in lieu of underage children, the physically and mentally challenged and the disabled. Why not here? We must distinguish between four situations: 1. The patient foresaw the circumstances and provided an advance directive (living will), asking explicitly for his life to be terminated when certain conditions are met. 2. The patient did not provide an advanced directive but expressed his preference clearly before he was incapacitated. The risk here is that self-interested family members may lie. 3. The patient did not provide an advance directive and did not express his preference aloud - but the decision to terminate his life is commensurate with both his character and with other decisions he made. 4. There is no indication, however indirect, that the patient wishes or would have wished to die had he been capable of expression but the patient is no longer a "person" and, therefore, has no interests to respect, observe, and protect. Moreover, the patient is a burden to himself, to his nearest and dearest, and to society at large. Euthanasia is the right, just, and most efficient thing to do. Conclusions: Society can (and often does) legalize euthanasia in the first case and, subject to rigorous fact checking, in the second and third cases. To prevent economically-motivated murder disguised as euthanasia, non-voluntary and involuntary euthanasia (as set in the forth case above) should be banned outright. VIII. Slippery Slope Arguments Issues in the Calculus of Rights - The Hierarchy of Rights The right to life supersedes - in Western moral and legal systems - all other rights. It overrules the right to one's body, to comfort, to the avoidance of pain, or to ownership of property. Given such lack of equivocation, the amount of dilemmas and controversies surrounding the right to life is, therefore, surprising. When there is a clash between equally potent rights - for instance, the conflicting rights to life of two people - we can decide among them randomly (by flipping a coin, or casting dice). Alternatively, we can add and subtract rights in a somewhat macabre arithmetic. Thus, if the continued life of an embryo or a fetus threatens the mother's life - that is, assuming, controversially, that both of them have an equal right to life - we can decide to kill the fetus. By adding to the mother's right to life her right to her own body we outweigh the fetus' right to life. The Difference between Killing and Letting Die Counterintuitively, there is a moral gulf between killing (taking a life) and letting die (not saving a life). The right not to be killed is undisputed. There is no right to have one's own life saved. Where there is a right - and only where there is one - there is an obligation. Thus, while there is an obligation not to kill - there is no obligation to save a life. Anti-euthanasia ethicists fear that allowing one kind of euthanasia - even under the strictest and explicit conditions - will open the floodgates. The value of life will be depreciated and made subordinate to considerations of economic efficacy and personal convenience. Murders, disguised as acts of euthanasia, will proliferate and none of us will be safe once we reach old age or become disabled. Years of legally-sanctioned euthanasia in the Netherlands, parts of Australia, and a state or two in the United States (living wills have been accepted and complied with throughout the Western world for a well over a decade now) tend to fly in the face of such fears. Doctors did not regard these shifts in public opinion and legislative climate as a blanket license to kill their charges. Family members proved to be far less bloodthirsty and avaricious than feared. Conclusions: As long as non-voluntary and involuntary types of euthanasia are treated as felonies, it seems safe to allow patients to exercise their personal autonomy and grant them the right to die. Legalizing the institution of "advance directive" will go a long way towards regulating the field - as would a new code of medical ethics that will recognize and embrace reality: doctors, patients, and family members collude in their millions to commit numerous acts and omissions of euthanasia every day. It is their way of restoring dignity to the shattered lives and bodies of loved ones.

You spent months finding the right business. The seller says that you cannot go by what the tax return shows but the business is making a lot of money, and he can prove it. Your inspection of the profit and loss statement shows that sales have been increasing slightly in the last few years. Most important, and the best news of all is; the price is right!  Does it sound too good to be true? I am sorry to tell you this, it probably is. I think it was Benjamin Franklin who said,  “A fool and his money are soon parted.” Mr. Franklin must have known a lot of business buyers. When buying appliances that break in a month, it costs you a few dollars. When you go to a swap meet and are cheated because the solid gold watch is really gold plated, it costs you a few hundred bucks. When a used car salesman cheats you, by selling you a lemon, where the speedometer has been turned back 100,000 miles, it costs you a few thousand dollars. Getting cheated buying a business can cost you many thousands to hundreds of thousands of dollars. The only investment or purchase that I know of where you can be cheated out of more money is in the area of real estate.  Real Estate fraud can runs into the hundreds of millions of dollars and does. You would be shocked at all the people between 1875 and 1950 who saw ads for prime real estate in Florida and bought swamp land. What about prime Louisiana beach front with Alligators living outside your front door? I have written a series of articles on fraud and it keeps getting bigger and bigger. I hope that the point is made. Never buy a business on someone’s word. Actually, you should never buy anything on someone’s word. Confirm everything, believe nothing and understand that you are still going to find out things, after the close of escrow, which is going to surprise you. A similar example is one known by every employer. A staff worked for a company for 4 months and complained to the personal officer that the job was just too difficult. He kept complaining that he needed more training and lower quotas. You feel sorry for him. You talk to him and talk to him about it. You listen and believe all the excuses he gives you for poor production. Finally he quit, blaming you for something that you did, this just before you were going to give up and fire him. Then you started to take over the work of finishing his incomplete projects. You are shocked, as you always re, at what he did wrong and what he had covered up, that he was not doing. This is what happens when you buy a business. You find out all the actions that the seller, not his staff, had stopped doing, from the day that he decided to sell the company. Many businesses are doing well. Sometimes the owners have personal things going on in their home life. Sometimes they have medical problems. Many times the business is not doing well and the seller is frustrated. It is very common for a seller to work hard to build his business, but because of many reasons, it doesn’t produce what the seller wants. He gets frustrated and one day he gives up. That is usually the day he calls that business broker he met and asks the big question. How long will it take you to get me out of this place? In his mind, he is gone. He just counts the days until he physically walks out. Have I scared you? Good. There is a plus side. It is worth all the grief that you go through to buy a business when you get in to the drivers seat, put all the marketing actions into place and start driving your own business. In 2000 I had a client buy a car wash soap manufacturing business for $2 Million dollars. The seller swore it was making $500,000 profit per year. Due Diligence showed it was only making $300,000. When presented with the auditors report, the seller claimed the audit was wrong. The buyer bought the company, knowing he was overpaying for the business. Why? He had done his research on the production department and sales department. He went out on the deliveries with the drivers, and met customers. He determined that he could double the sales and profit within one year. After he bought the business he found two things to be true. The profit was $300,000, as my audit found. He could double the sales and profit within 12 months, and did. The seller tried to screw the buyer, but in the end, justice was served. The seller screwed himself more than he screwed the buyer by not running his business correctly. If he had he could of sold it for a lot more than $2 Million dollars. Ok, enough with the fun stories for now. Lets get down to the details of what to look for when doing “Due Diligence.” Due Diligence Defined: The phrase is composed of two words. “Due” which the dictionary defines as “Proper or Adequate” and Diligence, which is defined as “Degree of care or caution expected of a person. Especially as a party to an agreement.” Caution: is the watchword in this definition. Financial Statements – What to look for: Add Backs: If you bought the business through a business broker you should have received the business financial statement with a separate worksheet showing adjustments to those statements. These adjustments show the owner’s benefits received from the business besides the profit and salary he receives. These can also be defined as personal expenses that need to be added back to the profit. Depreciation, incomes taxes, interest expense are add backs that are not personal. Personal includes such things as family auto expenses, owner life insurance, owner health insurance, business entertainment that was not really spent on clients, business trips not really for business, home office expenses, family cellular phones and much much more. Make the seller show you the details on some or all of these expenses to verify that they are really personal and not actually business expenses that shouldn’t be added back to profit. Spend time asking detailed questions with the general ledger in front of you. Go through individual charges and what they mean, until you fully understand what is being added back and why. Inventory: Inventory of resale merchandise must be checked for two reasons. One is you have to pay for it. Be careful, you do not want to buy merchandise that is old, worthless and not saleable anymore. Only pay for current marketable product. The price you are suppose to te pay for the inventory is the seller’s cost. The price for old slow inventory is negotiable. Always spot check the price and count the merchandise listed on the inventory list. Do people put down that there is three of an item when there are only two? Of course, especially when they think no one is going to be checking them out. Comparing prices from purchase invoices is how you check prices. You cannot check every item against the actual cost but you can do 5% of the items. Pick at random, not by any suggestion made by the seller or others. If you do not understand how marketable the inventory is that you are buying, hire an expert, from that industry. Your broker should be able to help you in finding someone. Do not be cheap, and think you do not need to spend the money on an expert adviser. I will take a lunch bet that they will pay for them selves many times over. The second reason for checking inventory is that if a seller doesn’t take inventory at least yearly and adjust his inventory value in his accounting records, accurately, the profit figure you are receiving will not be accurate. As a rule, the higher cost of goods sold, the lower the profit. Some business owners reduce the inventory value on the books, intentionally, to a lower value so as to make the business show a higher cost of goods sold, which then creates a smaller taxable profit. If they do this year after year, the profit may or may not be accurate for the current year. It might take a CPA to figure this one out for you, if you do not have a background in retail. Equipment value: Next thing to check on the financials is the real, current value of the equipment you are buying with the business. The balance sheet might, if it shows all the equipment the company owns, give you the cost of the equipment when it was purchased. If you are buying assets rather than cash flow, the equipment valuation becomes more important. No one wants to overpay for used equipment. Also check that the equipment works and is actually being used rather than sitting behind the building with other junk. Cash Sales: If all income is being reported, check sales volume activities that you have observed against the daily records during your “Due Diligence” to see if the volume corresponds to what was reported last year in the same month. If you see income of $500 per day but the seller shows sales of $1,000 per day, you need to find out why. Some smart buyers sit in the business all day, watch the sales and observe the activities of the staff. This works if the seller is not putting on a full fledge production fraud for you the buyer. Fraud: How does a seller defraud a buyer on current sales activity levels? Sellers who keep poor records or no records, many times, suggest the buyer doing a 15-day visual inspection. This helps but it is very dangerous to rely solely on physical inspections alone because the seller can still defraud the buyer. Here is the most famous of the stories I have heard over the years. Seller owns a dry cleaner. The buyer and seller have opened escrow and the deal is subject to a 15-day physical observation period. The seller doesn’t want the buyer to find out that business volume is very slow. The seller tells all his friends to bring their dry cleaning in to the shop for a two-week period, at no charge. They bring in the clothing, get it cleaned, pick it up and pay for it. Later the business owner meets the customers and reimburses all of them for the cost of their dry cleaning. The day after escrow closes all that business traffic stops. Think it never happens? The same is true of restaurants. Seller tells all his friends to bring all of their friends in for a free meal. Customers pay the bill and some time later or at home, the business owner reimburses all the customers for the cost of their meals. Actual time sellers spends working: Determine how many hours the seller really works. You are buying an income stream based on a known number of hours of work. Make sure the seller isn’t working 80 hours and telling you he is only working 40 hours, per week. I had an absentee fast food owner tell the buyers and me that he worked part time - 5 hours per week. Closer inspection showed he was working 25 hours per week. One auto repair seller, we’ll call him Bob, said he never was at the business, because he had a second full time job. Inspection found he was working 30 hours a week (4 plus hours every night, and 8 hours on Saturdays). Find out what job functions the seller does: Get a list of functions that the seller does. Is one of them bookkeeping?   Sometimes the wife does the books part time and this is never said. Again you may find the owner does the bookkeeping, at home, every night, for an extra hour. In an auto repair shop, you may find the owner is doing auto body repair work, personally, on Saturdays, which is work that you, as a buyer, will never be able to duplicate. You need to be sure you know how to do every job function that the seller does or learn them. The time to find out what technical knowledge you need to have to take over the business is when you are doing your investigation, not the day after escrow closes. Verification of things that are not on the Financial Statements: It is a common occurrence that businesses do not record all of their income on their financial statements. Yes, this is true. Many people do not, in fact, report the truth on their tax returns. In fact, when I am talking about small retail or service businesses that deal with the public directly, I find it is over 90%. “Will the people with an honest set of books, please leave the auditorium. There are two golf carts outside waiting to chauffer you home. You do not need to hear this.” The balance of this article will discuss how a buyer might do their “Due Diligence” for different types of businesses. These types of businesses include Restaurants, auto repair shops; real estate services contractors, non-real estate repair/ services, and retail stores. Restaurants- Non-Franchise: Restaurants compose over 25% of all businesses for sale. This is not because they all go broke, as the SBA reports. It is because 28% of all retail businesses are food service or food sales. It is the largest segment of the consumer market. Because it is a retail consumer business, it deals in 33% cash. Every independent-non-franchise food service business I have been into shows zero profit on the books. Some even go overboard and show a tax loss. It is because they do simple tax planning that does not require an MBA degree to figure out. If the business doesn’t show all of its cash, or any of its cash, the expenses will equal the reported income. This alone makes it attractive to many buyers. We will not discuss the moral issues of this attitude; it is what it is. What we have to discuss is how do you, the buyer, can prove that the business is making a profit? And if it is, how much? Restaurants come in two categories. 1. Fast food-counter sales. 2. Sit down. Fast food restaurants have computerized cash registers that record the sales into its computer, which has a memory. This memory has daily totals going back to the beginning of the computer’s history. Most owners close out their cash registers at the end of the day and print out the tape of each day’s activities. This does not automatically wipe out the information for the day. The computer does, I am told, have a delete button on it allowing the owner to wipe out the full memory in the computer, in the event of an audit. I have also been told, but do not believe, that an electrical blackout can wipe out the memory in the computer and that is why one seller said he couldn’t give me access to this information. If we are talking about a sit down restaurant sales information, you can use the daily order ticket, which are then imputed into the computer. This gives 3 sources: tickets, computer and daily tape totals. When this information is not available, for any reason, an experienced restaurant consultant can tell you the sales activities just by inspecting the restaurant and counting the number of customers eating at 4 key times in a day, and on several key days per week. Then the consultant can figures out what the average sales ticket amount is. With this information like magic the consultant knows the gross sales figure, for the year. A double check procedure for restaurant consultants is to then look at the food purchases and its costs and can confirm that it matches the actual sales figures.  One consultant that was hired to review a Johnny Rocket restaurant for $7,000 did the audit and put together a marketing program for the buyer. The marketing program included delivery and catering. Both of which do not normally show up on the computerized cash register. Restaurants - Franchise: You would imagine that franchise restaurants records would be very accurate because the franchise company gets a percentage of the gross income. The bigger ones connect up to the individual franchise and know what is happening faster then the owner. As stated above, the only sales that can be made and not declared to the computer are catering or delivery orders, which could be done without ringing them up. Some franchises do not hook up to the individual franchise computers and do not do audits regularly. This allows the franchise to report reduced income to the company and the IRS. In case either comes to audit, they press the delete button on the computer. If you as a buyer can get access to the computer you know the numbers are correct even if they are not complete. It is impossible for the staff or the owner to change the computer records. The information can only be deleted. Again catering and take out may not be on the computer. Theft from employees can only be in the form of 1. Employees that give free food to friends. 2. Employees not ringing up an order, which is difficult when businesses put up signs saying, “If you do not get a receipt, your order is free.” Some sellers are so paranoid of the IRS, they are not willing to show anyone their private records or computer tapes for fear that the buyer could be an IRS agent. My personal opinion, and what I advice sellers to do, is to get their books legal and honest and hire themselves a top notch CPA, like Donald Trump, and use every legal trick in the book. Martha Stewart didn’t go to jail for inside trading. They got her on lying. There are legal ways to avoid taxes so that fraud is not necessary. If you cannot find a good accountant, I will recommend one. If you ask someone "Are you a government employee or IRS agent?" and they lie to you; that might be considered entrapment and a good possible defense in court. But, I ask you. Is it worth the grief? The normal action of sellers, in this situation, is to require that the buyer take the business based on the recorded records and guess as to how profitable the place really is. This is a very difficult situation for the brokers and buyers, since sellers do not price their business based on these reported numbers but base their price on the real numbers. I hope this is of some help to you in doing due diligence on a restaurant you might be interested in buying. Auto Repair Shops: Auto repair shops are almost as bad as restaurants when it comes to under-declaring cash. The normal procedure for most, I have run across, is to declare only the checks and credit card charges. The cash they put into their pocket. The good thing, in doing audits is that almost every one of these owners keeps their work orders-invoices. These are kept in monthly manila folders and put into a drawer or file cabinet. They never tell you that they keep these records, but they do. They even tell me, as the broker, that all backup documents have been destroyed, but they are not. When I insist that they cannot sell their business without providing these invoices, they tell me of their existence. With the sales invoices an audit of income becomes simple. Since the sellers keep them in a manila folder by months, you only have to pick monthly folders at random and total the actual invoices. Then compare them to what the “State Board of Equalization” report says and calculate what percentage of the total was declared. If you do this for a few months, a pattern will develop. Some sellers have even run a calculator tape of the month’s activities and/or written it in a private ledger. You can check the actual invoice tapes against the private ledger records to confirm the private ledger information is correct. Real Estate Services/Repairs Contractors: Real estate service contractors include new construction general contractors and sub-contractors, contractors that come to your house to offer repairs on your house (plumbers, heating and air-conditioning contractors, gardeners, landscapers, termite companies, roofers, carpet cleaners, cabinet re-modelers, carpet/drapery stores, tile stores, pool service providers, pool installation contractors, landscapers, etc.) These contractors, if the owner does the work himself, do not keep their job tickets-invoices after they are paid for their services, in cash.   If the company has service men, then the owner is usually the dispatcher or other administrative person. In this situation seller, most likely, will have kept all of his invoices, so as to be able to look up prior history records of their customers. They might not have recorded the income on their records but they will have the basic records. Theses records may in a total mess, but the records do exist. If they do not, then buy the business based on what the seller can prove to you, or what you can reasonably estimate based on what percentage of the business you think is cash. What they are only going to prove to you is the total of checks and credit card charges, which is what the seller has declared on the tax return. Non Real Estate Repair/ Services: Non real estate repair/service companies include such things as large and small appliance repairs, barbershops/hair salons, nail shops, massage parlors, health clubs, pet grooming, wedding photographers, and movie theaters. These businesses usually do not even write up a ticket so unless a central cash register is used for recording income there will be no record at all. Again this is like a restaurant with cash register tapes. If the work is done at the customer’s location, then you study the serviceman’s truck schedule. If you only have some work records, from some work done in the field, you can determine what the average repair dollar volume is and then if you calculate how many calls are made on an average day, you only have to multiply the two numbers. If we are talking about hair salons, nail shops or barber shops we can gather information about how many chairs there are, how many chairs are rented on a weekly bases and what rent the owner is collecting. If the technician is not paying rent then they are on a commission split. If you know the rental income and the income split you are well on your way to determining the real profit of this kind of business. Remember to ignore the income of the owner since you as a hairdresser or non-hairdresser owner would not get the income of the old owner. The old owner will probably rent space from you so you only add another rented chair to the income. Retail Stores: A retail store is a store that carries an inventory of products that they resale. Sometimes they offer installation, which then might put them into the service company instead of a retail store. The main distinction is that they sell a product instead of a service. This includes everything from Home Depot, pet stores, clothing stores, gift shops, supermarkets, vitamin stores, and sign shops. Retail stores have cash registers and daily tapes of their sales. This is handled similarly to a restaurant and should be audited in the same manner. (See Restaurant Section Above) In addition to the cash register information, you also have purchase records, which can be studied to determine the cost of the merchandise as a percentage of the selling price. With this relationship-percentage of cost to sale price known you can calculate either the cost of goods sold or gross sales if you have either to start with.  A few smart owners buy some merchandise for cash in order to prevent a tax auditor from catching them by using this same manner. If the seller does this, he will admit it to you, if you ask. When All Else Fails With a Retail Business: The only way to protect yourself is disclosure so that you have grounds to sue for fraud. Make the seller put the real sales numbers, cost of goods percentage and any other information you are given and can not document down on a piece of paper and then have the seller sign and date the paper. If after the close of escrow you find the seller lied to you, the document will give you grounds to sue for fraud or misrepresentation. The important thing is be able to show a judge in writing what the buyer told you and to be able to show that he did this in writing. If the seller told you but never did it in writing you cannot prove it. “If it isn’t written, it isn’t so” Medical Professions and Non Medical Professionals: Professionals are a form of service business; except they charge a higher hourly rate and they have to keep patient/client files. Most people pay their professionals by credit card or check, because these expenses are usually tax deductible as medical or financial advice. If the seller doesn’t declare all the income, ask what back up records there are. Clients always get receipts for services and payments. There are records, find them and you will have all the income. When all else fails in Figuring Cash Income: If you have followed all of the earlier advice on documenting cash income and they in truth do not have documentation, you are in big trouble. You may have reached the end of your rope. You now have Two option left. 1. Walk away. 2.  If you still want to buy this business I only have one last suggestion. It is not fool proof but it is a method. Cash appears to be approximately 30%-35% of total sales. You could make this assumption to come up with a real total. Add 50% to the sales showing on the books, this amount is from credit cards and check sales. This is not an exact science; it is only a close estimate. Cash sales could actually be anywhere between 25% or 35%. I never figured it that close. Cash Expenses Verification: When you think of unrecorded cash transactions we usually think of undeclared income. Undeclared income is the biggest category, but not the only one. The other is cash expense not deducted on the books. The biggest expense item in this category is cash payroll. Unrecorded Cash Payroll: In an attempt to reduce the payroll expense, business owners will pay some of their staff’s payroll in cash. Why would they do this? Workman’s Compensation Insurance, FICA Taxes-Employer and Employee portion - Federal and State Income Taxes. Any accountant would scream at his client “You are missing out on a legal tax deduction.” Let me explain why someone would forego the tax write off by paying cash expenses. When you pay an employee $100.00 per day, on the books, the employee gets about $70.00 net on his check. If you give him $80.00 in cash, he is happy. He doesn’t have to worry about going into a higher tax bracket. The employer has to pay approx 10% to cover the employers FICA and other Federal employment taxes. You, as employer also have the workman’s compensation insurance premium. If we are talking auto repair mechanics compensation insurance alone costs 15%. If we are talking new real estate construction workers we can be talking a cost rate between 25% up to 120%. A roofer’s compensation premium is greater than his gross salary. Lets look what payroll taxes cost for a normal worker. The auto mechanic insurance rate of 25% is added to the 10% Federal costs plus the wages give us an expense that equals 135% of the wages. This comes out with the employer paying $135.00 and the employee receiving $70.00. There is a loss of $65.00 per day per employee. Some employers would rather save the $65.00 and not get the income tax deduction for the expense. Also with all the unrecorded cash the business shows, it isn’t important to have a loss on the books, since there is no need for more deductions to lower taxes. The business is already not paying any taxes. Because there is a danger that an employee might be injured and file a claim under workman’s compensation insurance, it is common among small businesses to show part of the wages on the books and the balance in cash. This means that an employee earning $40,000 per year might have $18,000 recorded on a W-2 form, creating a very low federal tax rate or no tax due at all. Since the employee is being paid part of his wages on the books if he is injured on the job he is fully insured for accidents with State Workman’s Compensation Fund, State Disability Funds, State unemployment insurance and all Social Security benefits. A win-win for employer and employee, even if not for the government. As a buyer you must figure all this out, and adjust the expenses accordingly. Unrecorded Operating Expenses: Because owners are collecting so much cash, they need a place to spend it. If you make a major purchase, you cannot just walk in and pay cash for a car. The IRS will be notified of this cash transaction. Owners with a lot of cash will pay for all repairs, gardeners and everything for the home that costs less than $10,000, in cash. Why $10,000? That is the recording cut off that a vendor or bank is required to report when receiving funds in cash.  If a business owner still has too much cash, sellers will start paying for business expenses. They start with the expenses where a service man gives a discount for cash. I found two restaurants that were paying for the hood cleaning service in cash, partly because they got a discount for paying in cash. By asking the correct questions, you can discover what is being paid in cash. Unrecorded Labor: Because we are talking small businesses, the wife comes in to the business full or part time. One of the children may come in to work part time. You must be aware of these employees who may or may not be paid. This is another form of cash payroll. If you have to replace these people with paid employees, these expenses need to be calculated in to the adjusted profit and loss calculation. . Sometimes the family member is being paid some wages but not full market value.  The adjustment is still needed but in this case only by the difference between actual payroll and the fair market payroll amount. Conclusion: It is a hard life when you own your own business; you work long hours. Many people feel that is better than the alternative, which is to work for someone else, pay high taxes, never know if you will be laid off and after years of hard work, never have anything to show for it all. If you are going to buy a business with your hard earned money, you want to make sure you get what you paid for. Many people believe it is all right to cheat the taxman but otherwise are very honest citizens. Others feel it is all right to cheap any poor sucker that comes along. Don’t be a sucker, do your due diligence and get what you paid for. Then build your new business into something you can be proud of and enjoy. While building your new business make a point to study everything you can about Tax planning, tax avoidance and reducing taxes legally. I started in College learning about the tax codes, and there are so many ways to save taxes legally, you would never believe it. You will sleep better at night, I promise you. Then 10-20 years from now when you want to sell your business, you can ask top dollar and get it. This because a buyer can do a simple due diligence and know that your business is doing exactly what your books say you are doing.

An Appeal to American Workers

Concerning the social and economic status of the United States of America... "...man seems to be in a worse state even than the brutes..." -- Samuel von Pufendorf, "On the Duty of Man and Citizen," Book 1, Chapter 3 Introduction For so long, writers of all ages have made their appeals to kings, to queens, to archbishops, saints and popes.  When trying to advance their own interests, men of letters would correspond with dukes and rulers of provinces.  By contacting those in power, they were confident that their ideals would be expressed to the people in the most succinct and powerful way.  Yet, it has been the trend of Anarchists, regardless of era, to make their appeal not to the rulers, but to the ruled -- not to the presidents or the prime ministers to beg for their mercy, but to the workers of the world's nations, and command them to action.  Since we are advocates of a certain sense of justice, since we are the prophets of social doom and resurrection, we believe that the cause of the condition of the world is the ruling class and its minions, their state-sanctioned slavery of Capitalism.  And, furthermore, we believe that to plead for mercy from those who casually mock the things that stir us, to plead for mercy would be to offer a begging hand to our executioner.  For these reasons and more, Anarchists and Freethinkers make their appeals not to kings or queens, not to "sovereign entities" and their mechanized armies, but to the people themselves, that they might liberate themselves and others.  It is in such an attitude that I present this piece...  An Appeal to the American Workers. Why Revolt? First, when I am speaking to my fellow brethren, my comrade citizens in the United States of America, I want to say this.  At first sight of the Communist and Socialist manifestos, their ideologies, the speeches made by their affiliated parties, when I heard these things for the first time, I was in complete disagreement.  The language used by these demagogues of Communism was burdened by economic vocabulary.  In some works that would be classified as liberal, I've seen the word "aggregate" used five times in a single sentence.  Through these bizarre concepts, these overly technical definitions of a so-called sociological science, these "decline in the wage conditions of proletariat" and "bourgeoise distribution of wealth," through all of these is where we hear the call for Communism.  I first want to tell my readership that I am familiar with these speeches, these pamphlets, these books, and I am familiar with the awkward and almost inhuman way that they have dealt with the economic question.  I have seen men of Socialism do nothing but reprint manifestos and sloganeer, as though their drone-like actions were about to bring about the greatest state of peace, justice, and equity for mankind ever known. While these socio-economic appeals of Communist and Socialist parties are made to the public, they are often ignored; in a way, they are regarded solely as "preaching to the choir."  They use words and phrases that the people are generally unfamiliar with.  Their politics are relatively dreary; whenever a new party pops up, its statement of faith seems to be followed a pattern completely uniform with the last party.  This is not an attack on those who are unfamiliar with the phrases and vocabulary of Communist theory.  Rather, it is an attack on those who are ridiculously stuck with such phrases.  To other Communist and Socialist comrades, those who feel that society would be greatly benefited through collective property, I ask this: that these awkward and almost erroneous phrases are abandoned now.  Not because they are no longer understood by the common people, but because they were never understood by the common people.  People must not be intellectuals that they might be revolutionaries. With that said, I want to say that I wholly and truly believe in the philosophy of Communism.  I am an advocate of the words of Karl Marx and Friedrich Engels, in matters of economics and sociology.  In many ways, I divert from the philosophy that they preached.  I am also a follower of the words of Mikhail Bakunin, Emma Goldman, and Alexander Berkman -- the late, forgotten Anarchists of yesteryear, whom openly opposed the arguments of Marxian economics.   Again, I diverge from their arguments in many ways.  I am a follower of the words of Thomas Paine, when speaks of doing justice as man's only duty; I am a follower of the words of Carl Sagan, when his words oppose the claims of religious fanatics; I am a follower of the words of Jean Jacques Rousseau when his words are of the corruptability and weakness of a Republican government -- I am the humble follower of Mark Twain, Margaret Sanger, Voltaire, Charles Darwin, and Ralph Waldo Emerson.   But, in so many cases, I find myself in disagreement.  Perhaps it would help my Communist brethren to practice a higher degree of skepticism when reading the works of Marxian economists and other political philosophers. A Revolution -- But Against What? If we are to take an objective and honest look at the situation in the United States today, we will find ourselves looking face to face with some very grim and ugly facts.  Many people are losing their jobs to outsourcing.   Corporate scandals are becoming a daily occurence.  People have lost complete faith in this system that seems to perpetuate unemployment, poverty, and misery.  This is not solely my view, but it is the view of the people.  More than half of the country does not vote.  There can be only one reason for this: people feel that both political parties and their candidates are incapable of redressing the ailments of this dying nation.  Underneath the sloganeering of "rugged individualist" philosophers, underneath phrases like "quarterly corporate gains" and "official company accounting procedures," underneath other phrases that serve to aleniate us from the subject, underneath it all, we become more and more dissatisfied with this country.  We are a modern country living in a modern world!  Yet, when we open our eyes, we still find so much poverty, so much misery, so much homelessness.  We find ourselves face to face with an economic system that nobody has tried to improve upon -- an economic system that is essentially the root of these social ills.  In so many years, with such great strides in all studies, we feel that men have inherently left one field untouched, that is, the field that deals with how to create a social and economic infrastructure, so as to remove these undesirable elements.  We are not moved by self-interest or snobby intellectualism; we are moved by the interest of all of mankind -- it is our interest to eliminate the suffering of the innocent. In a 1997 study by the U.S. Bureau of Statistics, for every dollar an employee earned, he made almost six dollars for his employer. [U.S. Census Bureau, 1997 Economic Census, Comparative Statistics, Core Business Stastitics Series, EC97X-C52, issued June 2000.]  One dollar of that six earned income goes towards the other expenses, such as replenishing the shelves and electricity. [Business Expenses, 1997 Economic Census, Company Statistic Series, 1997, Issued December 2000, EC97CS-8, US CENSUS BUREAU, U.S. Department of Commerce, Economics and Statistics Administration, U.S. CENSUS BUREAU.]  That means, for every two dollars a Capitalist spends, he is given seven dollars back.  The investor makes money because he has money, and for no other reason.  He is maintained at a situation in life where more money will do him not much better.  And while he is surrounded in elegance, lavishness, and wealth, there are millions of children starving to death in our nation. In 1980, the top 1% of the United States owned more than 25% of the nation's wealth, while the bottom 20% do not even own 1% of all the wealth. [U.S. Treasury, Internal Revenue Service. Quoted from Contemporary Macroeconomics, by Milton H. Spencer, Worth Publishers, Inc., Fourth Edition, page 45.]  If these facts alone are not enough to disturb anyone of good conscience, then I do not think anything is capable of disturbing them. I could continue to parade statistics around.  I could delve deeper and deeper in to the archives of economic thinktanks, pulling out numbers and equations used to determine the unemployment rate's fluctuation in response to the rate of interest of banks.  I could pull up a historical timeline, showing the general decrease of wages in contrast to the general increase of profits.  There are at least a million articles that discuss the economic question that I have yet to read; each of them from authors of their own particular background, whether Free-Market Capitalists or Marxian Communists.  All of these writers have contributed what discoveries they've made to the intellectual community.  They offer their words in defense of the trends or patterns they discover in economic behavior.  Some of them are motivated by political causes, whether it's the establishment of Statist Communism or the abolishment of Communist political parties in third world nations.  Many of them are motivated by their desire for prestige, to be recognized by the community as men and women of thought -- they figure, that if they can make their words more boring, dull, and formulaic than other authors, they will be recognized as men and women of genius by some university community.  Some authors have no interest, except to explore the sociological field, and find out what it is that really moves the economy, to discover what gears and what cogs in society effect what other gears.  Yes, I could pull out plenty of statistics and many arguments that these economists have utilized in demonstrating their opinions.  But, in this appeal to American workers, I must say what I think: I believe that the average man and woman have enough sense and enough experience to make the decision that the status quo is unsatisfactory. Consider a radical reorganization of the social structure.  For this reorganization to have any merit to it, we must start with the problems we observe.  So, then, let's consider the most obvious problems.  There are men and women whose job it is to hold signs on street corners, many times dressed in costumes, trying to entice people to purchase goods and services.  They make very little money, but there are men and women in corporate firms whose task is essentially the same.  Marketing and Sales executives are making six-digit salaries by devising new and different methods for convincing the public to want their goods.  Their job basically is to convince people that they want and need things that their own wit and intellect wouldn't ever tell them to purchase.  On top of these executives, there are the people of the media, the makers of commercials, billboards, radio advertisements, newspaper advertisements, graphic design for corporate logos; some people spend years doing market analysis, so that they can uncover trends in the consumer choices of citizens and workers.  At the top, there are executives and corporate officials, making millions of dollars a year, and at their disposal is an army of Walmart greeters, sales associates, clerks, manager assistants, and other professionals -- all of them solely exist to entice people to buy things that they otherwise wouldn't have wanted in the first place.  From this point, we find that the purpose of their existence is to subvert, control, and manipulate the general will of the people.  Their meaning to life is inimical to that of a free conscience. Those people who work in low-wage jobs, spending most of their lives taking orders from supervisors and being criticized for "not having company" spirit -- I cannot blame them.  I cannot blame them at all.  If being a Walmart greeter was the only job available, if it was the only thing that could help someone support their family or drug habit or pay rent, then I cannot blame them.  But to those corporate executives and company officers, these CEOs who control billions of dollars of the world economy, they are responsible for this situation.  They have built up a culture of want, consumption, and poverty.  Someone looking at it from an objective viewpoint will say that these people are simply useless, they simply do not contribute to society in any positive way, but that is light view of the situation.  Not only do sales and marketing associates fail to contribute to society in any meaningful way, but they are parasites; they are the thieves of intellectual liberty.  Their fat paychecks are only provided for by the society which they have leached themselves on to.  It is not by noble pursuits and honesty that they make their living; it is by avarice and dishonesty. This is among the first and most notable dilemmas of the Capitalist economy: the advertisement industry.  Whether we are looking at corporate executives, or people dressed in chicken suits holding signs on the sidewalk, I think I am making a fair judgment in saying this: these people do not contribute to society in any meaningful or productive way.  We see, then, the first common and obvious fault of the Capitalist economy.   What is the solution?  It's a rather simple and obvious one.  Those people who are members of this inhuman industry are to be put to productive work.  What does that entail, specifically?  Well, those employees who were stripped of their old professions would be put to work in meaningful jobs.  In particular, they would start to contribute labor to the economy so as to produce goods and services.  That means jobs in agriculture, manufacturing, construction, or transportation and distribution.  I consider these fields of the economy to be productive because they contribute in satisfying the interests of consumers.   Workers on an assembly line, for instance, are creating products that will be consumed: television sets to be watched, clothing to be worn, computers for hobbyists, CDs and DVDs as entertaining media, tools to help other workers accomplish their jobs, etc., etc..  Members of the agricultural economy are invaluable for one obvious reason: they create the food that feeds all of us.  Construction workers produce the buildings that people live and work in; they are simply a different type of manufacturing worker.  Transportation and distribution is essential, in getting the products from the site they were produced to the site they will be used at.  All of these fields are necessary to a healthy and free society. I do not want my opinion on this matter to be misunderstood or misinterpreted.  My contention is not that it should be made a crime for men and women to use their own intellect to change the opinions of others.  I think that the law should reflect a general anti-censorship ethic: whether in matters of politics or economics or religion or philosophy, or any field of study that has been subject to witch-hunts and being burned alive, I think that all should have intellectual liberty.  You should have the right to private discourse, to let the thoughts in your mind mix and meld with memories and experiences, to be the ultimate judge and jury of your own opinion; it is the right to decide that you enjoy something as much as it is the right to say that you dislike something.  You should also always have the right to publish the results of your private discourse, to speak with other members of the community in a way that reflects your thoughts, to try and convert people to your opinion on anything, whether art and culture or politics and society.  The Statists, Fascists, and others of the anti-Democratic tribe will spend hours upon hours, lamenting the tragedies that have occured and will occur again if the people have the right to intellectual freedom.  Whatever tragedies have occured from liberty of thought, they shrink to almost nothing, when one thinks of the tragedies that have occured from the suppression of liberty of thought. We criticize the advertisement industry solely for the sake that it is counter-productive, it works against the general interest and will of all men and women of good character.  It invades communities, turning them in to dry husks, destitute of any real sense of culture and destitute of any real sense of purpose.  It has turned art into a perversity, exploiting painters and sculptors, taking their passion and molding it into "Buy One, Get One Free!"  There is no excuse, no pardon, that could ever be made for this group.  However, when we look at the employment of the distribution economy, we find ourselves looking at the same faults that plagued the advertisement industry.  Distribution centers, whether they're stores or malls or shopping centers, all of them seem to operate on the same principles that the advertisement industry acts upon.  Such an enormous effort is placed on making the products or services look more appealing, so that the consumer is convinced to purchase such items.  It also seems as though these distribution centers are having less and less of specific products.  Many popular chain stores are a combination of department store and grocery.  It seems that almost every store is selling "impulse items" near the counter, including candy and cheap mini-magazines.   These impulse items are in every store, whether it's an office supplies store, a furniture store, or even something as simple as a gift card store.  Many grocery stores are also selling cooked and prepared food, ready to eat.  In their never-ending quest to boost profits and gain stockholder confidence, stores are expanding the line of products that they sell, not to make their selection complete, but to have more income from sales. Distribution centers in an ideal society would not consist in these elegant settings, with employees who act as greeters or make the store look visually appealing, nor would artists be exploited to create artwork for product packaging.  The individuals who fill these positions would be transferred to industry sectors where they can act as productive agents of society.  In examining the American and European economy structures, we have here seen the greatest reforms and changes we would enact.  That is, the greatest reforms and changes we would enact, if the economy was built to serve the interests of mankind, and not built to serve the interests of private corporations and exploiters of labor.  With the abolishment of so many professions, one might think that a massive unemployment might take place.  This is not necessarily so.  Those who would lose their jobs would be relocated to meaningful parts of the economy.  That would mean, that society would produce more goods, at a higher quality, with less hours.  Essentially, yearly wages would be doubled and work time would be halved.  The happiness and satisfaction with life that men and women have would be increased; that is the basic goal of all this discussion and research. Ultimately, in this fair and ideal economy, workers would be paid not according to suggestions and manual aids from the corporate office.  They would be paid according to the value that they create.  Instead of the minimum wage which finds itself the standard of many industrial, farming, and service jobs, workers would be paid upwards of $20 to $30 an hour, a number that certainly can be afforded by the economy.  The primary reason why such workers are not being paid this right now is remarkably simple: those who are the legal owners of capital (mines, farms, stores, factories) want as much money from their business ventures as possible.  That means paying as low as possible so that there is more profit.  It is for these reasons, that all members of the Capitalist class (those who own the productive parts of society) are regarded as the thieves of labor, the enemies of the working class, the exploiters of the proletariat, among other phrases used by Leftist groups. Among the most bitter ironies that history has taught us, it is this: workers in the year 1600 worked only ten hours a day to secure their needs.  When industrial societies arrose, and factories allowed workers to produce ten times as much as when they worked without factories, people started to work 12 to 18 hours a day, sometimes as much as 20 hours a day.  The new economic conditions that came with the industrial revolution allowed the Capitalist class to force people to work for so long, since the members of this class were also the ones who controlled food distribution in society.  And today, when man's productive power is at least several hundred times that of the 1600 worker, the average workday is 8 hours -- and that alone was a struggle that cost the lives of many workers, gunned down by thugs hired by corporate entities, just to obtain. It is for these reasons, these observations and experiences in what has always felt like a dying world, that I am a Communist and a Socialist.  For the motivation of a better world for myself, my fellow human kin of all nations, and the children of the coming generation, that I hold true to these beliefs. Subversive Tactics for Revolutionaries and Reformers There are countless ways in which a willing person can contribute to the revolution of social and economic relations in our world.  If a person becomes interested in social change and political reform, then they only have an entire history of revolution to look to for advice.  The existence of today's conservative, for example, can only be excused for those who were considered radical by society's standards several hundred years ago.  It was once common to think that a king's absolute authority of life and death over every person was just, that the rule of government can be exerted without the authority of the people, that the general will of the population is inconsequential, that the ruling class needs no excuse.  These and a thousand more foul lies were once considered public wisdom by the philosophers of the past age.  And before these things were believed, even more cruel and bitter philosophies were preached as religion.  Before this, there was no conception of justice, no idea of right or wrong.  When men thought of morality, they simply thought of what the men who spoke for god said; when men thought of fairness, they simply thought of what the men of government said.  It is true, that as we look back in history, we find eclipses in timelines, where a people were defiant, revolutionary, and bold -- where men and women dared to live by their own means, not by the guidelines of a king or priest.  But such societies were small and lasted very shortly.  Yet, all of this evidence is clear to all who are interested in changing today's social, economic, and political affairs. If you have this interest, then know this.  There is reason to hope that things will change.  And this hope is fueled by our understanding of history, our own philosophy, and of how today's society operates. The most popular and well-known of the methods of reform is that of the union.  People of a particular trade or business unite together so that they can collectively demand better conditions, through practices like a strike or boycott.  The interest of the common labor union is antithetical to every interest of the Capitalist class.  The labor union demands higher wages, fewer working hours, better working conditions, fair treatment of workers.  These are the things that drive up the costs of the businesses.  A corporation, which the sole interest of gaining power and wealth, looks to union activity as the greatest offense; it is a small group of people who have combined their power together, so that they might force oppressive groups to change their behavior.  The method of the union is the most peaceful method of social change.  The greatest threat its members ever pose to society is the threat to stop working, to start boycotting, and to start picketting.  Their goals are not achieved through violence, but by a very gandhi-like style. The effective goals of the union are simply the improvement of the working class's conditions.  It has always sought economic reorganization, demanding that nobody can be fired except with very good reason (job security) and demanding that the workers are paid fairly according to their labor.  While it is true that these are good and valid causes of any standard labor union, it shouldn't be forgotten that a union can be used as a political tool.  Consider a city council that has just been bribed by corporations to remove the living wage law (a law that provides around $15 per hour minimum wage).  The working class of the city will be greatly hurt.  Their living conditions will start to fall, and in a short while, they will feel that their condition has reached their original position.  They would either see the impending blow to their movement coming, and do nothing, lay still, take the suffering the state thinks they deserve.  Or, all labor unions would combine together, for an enormous general strike.  It must be understood, that products being produced, distributed, and consumed, is the government sanctioned form of slavery.  For everything bought or sold, money is given to taxes, to support the state.  For every hour you work, money is given to federal taxes, to support the state.  For everything owned, money is given as property taxes, to support the state.  If everyone, from every union in the city, from the services unions, the administrator unions, the manufacturing unions, the transportation unions, if every union in the city were to go out on strike at the same time, they would inflict massive, irreparable damage to the government. They could use their power as unions to force the government to change its decision, otherwise the entire infrastructure would collapse under this pressure.  This is also a worthwhile tactic if one union is having difficulty gaining better conditions for itself, and the unions its federated with could go on strike.  They go on strike, to tell their employers, to tell the other CEOs, to listen to their unions and accept some collective bargaining agreement, so that business can proceed as usual and the Capitalist system can continue. It is unfortunate that today's unions fail to see the necessity of a federation of unions and of advocating for political causes that directly effect them.   Unionizing labor today is legal.  That is something they need to realize.  True, the burden of poverty is over their heads; they must work so that they can feed themselves.  It is always the habit of the weaker victim to be less assertive, less bold in their attacks of their enemy.  But we must unite in order that we can oppose our enemies of Capitalism.  We must unite, and we must be strong, in that we can overcome our enemies.  And also, while I said it was a largely peaceful effort at social change, there is no doubt that the Capitalists have done to keep it anything but that.  Investors hired armed police squads to subdue picketters.  The social organization of our society has turned us on ourselves.  We are killing and murdering each other for crumbs.   All the while, an army of police officers are guarding corporate headquarters all across the United States, while people are suffering from poverty and want.  Unemployment is high and the wages are low.  We have a very good reason for revolting at the state of things. Another popular effort to gain control of the situation, and create a worker's paradise is to form a political party, and to try and gain as many positions in government as possible during elections.  However, it has been this method that has received the most criticisms from the general public.  Efforts of the state to achieve a truly Socialist effort has had dismal results: the U.S.S.R., the Dictatorship of Cuba, the murder by the allegedly communist governments of Vietnam and Korea.  And then, the efforts of minor socialist parties and international communist tendencies, these efforts have accomplished so little.  True, there are some European countries that have started to elect Socialist parties, and to enact Socialist legislation.  There are campaigns to reduce the average work day, to give better benefits to workers, to protect the consumers from harmful products, and to pay the workers more.  But most Communists agree that they want the economy to be in the control of the people; so too, must the political structure of a society be in the control of the people.  For this reason, most Communist and Socialist reformers have taken to the method of control via unions; to employ it to obtain political ends on behalf of the working class is to engage in a practice of Anarchy known as Anarcho-Syndicalism. There is also a popular case against voting based on Anarchist principles.  Anarchists often argue that if we refuse to vote, then the whole justification of consent with the government falls apart, and the system will collapse.  I can hardly see any justification for this.  Less than a third of the population votes anyway.  If more than two thirds of a nation is not enough force to gain superiority, then at what point do we become effective?  Many Anarchists maintain this position: that to refuse to vote is to make a revolutionary step.  I hear their arguments, and I don't quite find the logic of their evidence.  I do not see how refusing to vote is doing anything to stop the oppressors from continuing to oppress us.  If they find at least one thing sacred, or at least semi-sacred, and they are willing to respect the will of the people in electing a representative of their interests, then why should we shut off this method of social and political change?  Why should we villify it, destroy it, and inhibit all of its functions, when it is the only method we are legally allowed and encouraged to change the system?   Consider this one scenario.  There is an island with twenty people on it.  There is a Democratic vote on whether this person is to be hung for his crimes or not.  Among those who decide not to vote, they argue, "I do not think the collective should ever be able to vote on the life or death of a commune member, so, I shall not vote, and demonstrate my opinion this way," yet, if the majority votes for the killing, then it's the inaction of the Anarchist that played a great role in the murder.   For this reason, and reasons like this, we are apt to believe that we can use voting to change things, whether we are voting on a measure or a proposal, or for a person who seems to be the lesser of two evils (despite the fact that evil is evil). Perhaps some Anarchists will consider by ideals much less Anarchist and much less Libertarian if I support voting to a certain extent.  Perhaps they will say that I am a reformer, but not a revolutionary, that I am reformist Libertarian, or some other such terms.  I have only called myself an Anarchist because my ideals have been in unison with those of passed history, including Emma Goldman, Mikhail Bakunin, and Peter Kropotkin.  I disagreed with them on points, of course, but the basic philosophy remains in tact: elimination of the state, communal ownership of all property, mutual organization of social units, abolishing poverty and all drug prohibition, among so many other efforts to create a better, more lasting peace between men on earth.  If this basic philosophy cannot be defined as "Anarchism," then I can see of no other word to fit my arguments. Among many projects of the Anarchists and Communist, there is that project known as a worker colony.  A worker colony is a collection of workers, who live and work together in close quarters.   They are all assigned housing units and jobs, most of these places catering to industrial or manufacturing jobs.  Then they work four to six hours a day, and are given leisure and a suitable pay for the rest of their day.  Sir Robert Owen was a philanthropist businessman of the early eighteen hundreds, and created such a society.  Instead of the fourteen hour workday, these workers were only required to work eight hours a day.  They were given good, high quality food at inexpensive prices and they were given free medical care.  The leader of the collective, Robert Owen, was capable of turning a profit with this business venture.  In fact, many of these communities were started up by many investors, however, they soon became unfashionable at the sight of rising cost and competitive markets.  Many Anarchists of the new era have suggested the creations of such communities, so that people are capable of living as workers and consumers in a society where their happiness is the main end of all productivity.  I am not aware of any situation where Anarchists and Communists combined their finances in order to buy land and create such a community, but it is definitely a valuable idea to be considered, even if it's just on a small scale. Finally, there is the most popular and accepted method of spreading Anarchism and bringing about the revolution.  That method is propaganda.  This can take numerous forms.  It can be everything from marches and protests to picketing to leafletting.  Personally, I find that leafletting is the most effective way of swaying public opinion against their enemies.  A piece of paper briefly outlining our ideals will be something that a person approaches on their own, it is not an argument or a debate, and it allows the person to ingest the ideas at their own speed.  It is almost a re-education process.  People have to unlearn that social organization should be based upon fear and misery, and have tol earn that all social relationships should be cooperative and fair.  Plus, with more people educated and of Anarchist, Marxian, Communist, Socialist, or Libertarian opinions, there will be more people sympathetic to the cause of the unions.  There will be fewer people who will work as scabs at a striking business or shop at stores where unions are boycotting.  More people will vote for Socialist parties, environmental safe propositions, and Socialist measures.  More cities and regions are to obtain a healthy Anarchist and Socialist population. The more people in a city, the more that can contribute to a massive project like a worker colony.  The more who are convinced of the Anarchist position, the more who are likely to bring that issue to the eyes of the public, in spray painting across corporate property or marching in line at a protest.  With all of these methods, I can hardly see these Anarchists and Communists doing nothing to bring about change. A Free Society: The Appeal for Anarchism I can no doubt expect that many of these ideals are enormously progressive in the eyes of today's American worker.  He looks to these principles, these ideas of workers owning the productive forces in society, these revolutionary fundamentals of the workers being paid the wealth they produce, he looks to these, and he might as well be looking in to the future by thousands of the years.  He is impressed, but also intimidated, and almost scared of the change.  What it would take to change society, he argues, would involve moments of poverty and misery, such great reorganization of the social order, that it must be impossible.  And, even if it were possible, it would be necessary that some government should guide it, that some revolutionary vanguard party is necessary to the construction of a new society.  Without a large collection of highly armed, highly volatile, highly greedy men, nothing that we seek to change would get changed.  It is necessary, in the eyes of these men trained to be hopeless, it is necessary that a government always exist, in order that society can have civil discourse, while the cruel element of mankind is subdued by the police forces and the military barracks. I allude to one incident I uncovered in Portland, Oregon.  Fortunately, it is an extremely Leftist town, full of as many Anarchists, Communists, and Socialists, as there are Liberals and Democrats.  This has allowed some interesting experiments to come up, since so many people of the same political beliefs are collected together in this one city, and can work together on massive projects.   There is one particular cafe which advertises itself as "Worker Owned." It is called Back to Back.  In reality, it is owned by the I.W.W., or the Industrial Workers of the World (AKA: "Wobblies").  It just so happens, though, that the people who work there are not the owners, and beyond that, they are 100% volunteers.  The only payment they receive is in tips.  This is not the realization of the worker's paradise, it is the realization of his worst nightmare.  In their vanguardist efforts, the money that is raised with sales should go to two places, in the eyes of the IWW: To other Capitalists, to fund their exploitation of the working class, by helping them sell their products, and to bureaucrats, who can sit around for hours a day arguing with each other over wealth distribution, convinced that they are the essential piece to Proletarian revolution. But, I do not know all the arguments of the IWW.   Perhaps, they will use the same language of Corporate America.  "In recreating the world, we feel that it is necessary that workers are paid nothing, that they are to live humbly off of charity, while all the wealth in the world is concentrated in the hands of a very small number."  We will heard their arguments about cost production, about competition, about inflation.  They will speak on the same terms that McDonald's or Walmart would speak, in justifying cost reduction and retail increases.  We are Anarchists and Communists.  We believe that the Capitalist system must go if there is to be any justice in the economic or social sense; and, above and beyond that, we believe this change in the socio-economic sphere of the world can best be done by our own efforts.  So many great tragedies and miseries in the world have been caused by people doing exactly as they are told, by people who act without thought, becoming the slaves to some inhuman entity.  We do not need new rulers or more party politics; we need the people to rule for themselves, for each man to be his own master and his own slave. My appeal here, then, for the American people, is an appeal for a Communist economy, as much as it is an appeal for an Anarchist society.  The efforts of previous liberation groups has been in a vanguard party, in a despotic government coupled with all capital as public property, these are the greatest of dictatorships.  The essential argument behind each argument, that of Anarchism and that of Communism, is the same.  The idea of people deserving the wealth they create, and the idea of people living in a democratic society are similar in that both are a demonstration of the common will and desire of the people.  They are both based on improving the lot of the majority of people.  Besides, Communism cannot be properly carried out unless the most Democratic of conditions exist in society.  Look at the Leninist revolution.  It was followed and supported by a wide range of social reformers, but the conclusion was the over empowerment of the government, to the point of dictatorship.  Lenin held elections once.  He lost, and then used his military power to dispose of the winning political candidate.  A reign of terror, of secret police, of torture chambers, of a government subverting the natural will of the people to rule themselves.  The same can be said of the Castro-led revolution in Cuba.  At first, it was a hopeful situation for those who wanted a dramatic change in the social order of the world.  But, it was not long before the revolutionaries who sided with Castro quickly turned against him when they found out he chose himself as dictator.  Castro violated the will of the people, while parading around like he was its greatest demonstration.  So did Lenin.  In both of these international cases, it was a revolutionary party that refused to let the people rule themselves.  If we are to be successful, we must pay respect to our Socialist brothers, and understand the faults that they made.  We must create an Anarchist society, if the Communist economy is ever to be justly employed. I hope that the philosophy, the politics, the economics, and the social views displayed in this essay were enlightening or even heart-warming; I hope I have helped many other workers realize that they are not alone in their opposition of their two greatest enemies, the Capitalists and the government.  The first strips him of all his deserved wealth, the second strip him of all freedoms.  It is the poverty of slavery, the chains of misery.  I hope that the suggested methods for achieving our new world prove helpful, and that the workers of the world are bold and strong enough to try these tactics with me.  By uniting, by organizing, we are becoming stronger than the leader of our enemies.  Stay strong, and stay linked together.
