Useful Information Update About South African Social Security Agency (SASSA)
A national government organization called the South African Social Security Administration (SASSA) was set up in April 2005 to disburse social benefits on behalf of the Department of Social Development. The DSD oversees the Agency but has no operational authority over it. Additionally, it aims to move South Africa's provinces' responsibility for social security under the purview of the national government, under the Department of Social Development (DSD). The Constitutional Court invalidated the offer in 2014 after concluding that AllPay, a competing contractor, had followed illegal procedures. However, the suspension of the judgment allowed SASSA to reopen the procurement process without interfering with pension payments.

Grant recipients may withdraw their benefits without incurring any fees from any SASSA payment location in the country. Financial crisis
A ministerial working committee determined in December 2014 that SASSA should handle grant payments on its own. By deciding to source the funding in 2017, SASSA filed a fresh proposal in 2015 but did not award it.
Because legal criteria were breached, re-registering benefit recipients required extra, non-recurring spending for the 2015–2016 fiscal year, which SASSA reflected in the CPS contract.
Pravin Gordhan, the then-finance minister, advised Bathabile Dlamini, the minister of social development, to award a new contract to South African commercial banks and the South African Post (SAPO), forgo biometric identification, and demand a contract that disadvantages other contractors in comparison to CPS.
This proposal was, however, turned down on the grounds that the biometric system eliminated fraud claims totaling R2 billion per year; further work to eliminate duplicate entries could save an additional R2 billion per year; SAPO lacked a banking license; and there weren't enough post offices to distribute the benefits properly.
Dlamini said that he wanted to continue working with CPS until SASSA is ready to take over since there is a lower chance of SASSA not being able to make subsidy payments in this scenario.
She noted that the Department has already finished the first half of its four-phase plan, which will end in 2019 with the transfer of duty to the SASSA, and that the process of awarding funds via the SASSA is well under way. SASSA.
Dlamini said in 2017 that it was only in October 2016 that she discovered SASSA would likely no longer be able to collect assistance payments starting in April 2017.
According to SASSA's estimations, CPS would get around Rs 3.5 billion annually under the extended contract, an increase of between 52% and 59% over the previous one. Later, SASSA denied making such an estimate and said that it was only an adjustment for inflation, which was false.
The current CPS contract cannot be legally renewed because it has been deemed invalid by the Constitutional Court, senior attorney Wim Trengove informed Dlamini in October 2016.
She was also informed that the funding crisis was not a reason to continue using CPS because the emergency was self-created. Dlamini was informed that DSD was required to participate in competitive bidding and, as a result, could not contract with CPS.
The Constitutional Court was also instructed to be informed of SASSA's situation in December 2016 and that it "faces the highly rare potential of signing an extra year's contract with [CPS]".
The agency didn't make its appeal public until February 28, 2017, and then it quickly retracted it the next day using a letter that was dated the day before.
In February 2017, SASSA testified before the Congress' social development portfolio committee that it had encountered difficulties in its search for practical approaches to disbursing social benefits and asserted that, as of April, the only way to do so was to stick with a contracted service provider. deemed ineffective.
Early in March 2017, SASSA's Zodwa Mvulane testified before Congress that the Agency had insufficient time to remove CPS due to legal issues outside its control since it "had just one years, from September 2015, in readiness to become a payments manager." However, SASSA did "little or nothing" up to December before beginning to plan for a post-CPS settlement; the advisory committee had previously gone unheeded for many years.
A letter from Dlamini, sent on February 2, stated that CPS would no longer be required by the end of 2019. A letter from SASSA executive Thokozani Magwaza, sent a week later, stated that CPS would no longer be needed by the end of 2019. Despite having informed Congress that it lacked sufficient time, SASSA also stated before the Constitutional Court that it would no longer require CPS one year after the 2017–2018 fiscal year.
The Black Sash Trust has petitioned the Constitutional Court, via the Center for Applied Legal Studies, to order Dlamini and SASSA to take the required steps to safeguard the pension system. At the time the CPS contract expires on March 31, society and its beneficiaries are safeguarded.
The agreement with the Cash Paymaster Service was extended on March 6, 2017, and the court order was revoked. That contract's constitution was once again put on hold for a further 12 months. The Court recognized that CPS could not be expected to give benefits at a loss and ruled that neither side had "any claim to profit from the danger of infringing upon people's rights." As a result, it requested that CPS continue to offer social benefits at the rates it agreed to in 2012.
According to the Constitutional Court, the "responsible functions of SASSA" have known since April 2016 that they could not uphold an earlier promise to the Court that they would be able to provide social benefits beginning on April 1, 2017.
The Chief Justice of the Constitutional Court, Mogoeng Mogoeng, said that there was no explanation for Dlamini and SASSA's ineptitude, and the court determined that they were principally to blame for the crisis. Constitutional expert Pierre de Vos claims that the Constitutional Court came to the conclusion that SASSA and Dlamini cannot be trusted to carry out their constitutionally required duties to secure the distribution of social benefits and cannot be trusted to not lie before the court in the future.
