HKU sacks legal scholar Benny Tai for misconduct

The University of Hong Kong’s governing council on Tuesday voted to sack associate law professor Benny Tai for misconduct, over his criminal convictions related to the 2014 Occupy movement. Tai himself broke the news in a Facebook post, following a three-hour council meeting to determine his fate. A source told RTHK the council – headed by former education minister Arthur Li – voted by a majority of 18 to two to dismiss the scholar, and it is effective immediately. “The decision to terminate my appointment was made not by the University of Hong Kong but by an authority beyond the University through its agents”, Tai wrote. “If there is still any doubt of the advancement of ‘One Country, One System’ in the territory, my case should be able to remove it.”
The president of the student union, Edy Jeh, said the student body condemns the decision, positing that the composition of the council – which includes more than ten appointed members, some made directly by the Chief Executive and HKU Chancellor Carrie Lam – is to blame. “I believe that the council made this decision out of political concerns”, Jeh said. She noted that the university’s senate – a separate body comprised of teaching staff – had earlier vetted a reported compiled by a special panel, and decided that even though Tai had committed misconduct, dismissal was not warranted.

Couple, teenager cleared of rioting in Sheung Wan

Natalie Lee, 17; Elaine To, 42; and Tong Wai-hung, 39, were arrested during clashes on Des Voeux Road West on July 28 last year.
A student, and a couple who own a gym, have been cleared of rioting in Sheung Wan during last year’s anti-government protests. District Court judge, Anthony Kwok, also cleared them of illegal assembly.
In his verdict, Kwok said the trio’s attire and actions that day were very suspicious. But he said the prosecution relied entirely on circumstantial evidence, unlike in rioting cases the courts had dealt with before. The judge ruled that the prosecution could not prove that the couple were actually on Des Voeux Road West, where the clashes took place that day, and that the teenager could be just an onlooker. He said the court had to adopt long-standing principles including the presumption of innocence. To and Tong, however, were convicted of possession of walkie-talkies without a licence, and are fined HK$10,000 each. Dozens of supporters of the accused had turned up at the court, and applause and sighs of relief were heard in the courtroom as the verdict was read out.
