DADA Lesson 3: Opinion Piece
I believe that the legal status in regards to the Dark Arts should remain unchanged. Making something illegal tends to make it appealing to those who want to act out against the social norm. Even with the status of most dark magic as it is, the fact that it's frowned upon makes it all the more temping for it's use. On top of that, making the Dark Arts entirely illegal could potentially backfire if in a duel and would limit wizards to primarily defensive magic, which theoretically could be hazardous to one's health. This would also make practical jokes that use jinxes illegal and all pranksters criminals. However, this isn't to say that ALL dark magic should be legal. The Unforgiveable Curses, for example, have every reason to be considered a severe criminal offense. In short making the Dark Art illegal, while sounding very pleasing in theory, isn't the least bit practical. I firmly believe that using descresion is the best way to deal with the use of dark magic. Harming anyone or anything just for the sake of inflicting pain or harm upon them should, however, be completely and totally illegal. In the end, everything boils down to the intent of the caster.
