Blagojevich Impeachment and Conviction Make History
In 2020, former Illinois Democratic governor Rod Blagojevich left prison after serving eight years of a 14-year sentence. Before being removed from office, convicted on corruption charges, and serving time in federal prison, Blagojevich served as governor from 2003 to 2009. His conviction is one of eight impeachments of governors throughout American history.
The Illinois legislature impeached Blagojevich after two trials. The first trial culminated in a hung jury with an 11 to 1 vote on all counts. He was found guilty of lying to federal prosecutors. In the second trial, the court found Blagojevich guilty of 17 of 20 corruption charges.
The list of Blagojevich's misdeeds was long, including trying to sell Barack Obama's senate seat after he was elected president. Blagojevich was also convicted of shaking down a racetrack owner, a building executive, and a children's hospital.
The trial had dramatic moments, including Rep. Jesse Jackson Jr.'s testimony that Blagojevich punished him for not donating $25,000 to his campaign, which the former governor said he did not recall. The court also heard recordings of Blagojevich discussing the Obama senate seat.
The trial was an extension of Blagojevich's larger-than-life personality outside public office. His carefully coiffed hair, love for Elvis Presley songs, and jogging drew public attention. He was also the first elected Democratic governor in Illinois in 30 years.
During the trial, Blagojevich's public persona reached new heights when he participated in Donald Trump's reality TV show, Celebrity Apprentice. Participants worked on teams to build a business idea, with Trump eliminating one team each week. Blagojevich made it to week four before Trump "fired" him for leading his team to a loss.
Blagojevich's conviction and subsequent impeachment, which ended in a Senate 59-0 vote, concluded in what a 2009 Chicago Tribune article described as "six years of scandal and crippling political infighting." The impeachment removed Blagojevich from office and made it impossible for him to run for office again in Illinois.
After the impeachment, Blagojevich continued to fight his conviction, stating that it was unfair. However, when the case went to appeal, the US Supreme Court and federal appellate courts refused to hear the case. An appellate court threw out five charges, but even so, the court sentenced Blagojevich to 14 years in prison, essentially upholding the original sentence of 14 years.
In 2020, President Donald Trump commuted Blagojevich's sentence. The former governor filed a federal civil rights complaint in 2021. This time, Blagojevich states that what happened to him (not referencing his conviction or impeachment) in 2009 was unconstitutional because he was not allowed to call witnesses, cross-examine government witnesses, or present evidence, particularly undercover tape recordings.
Blagojevich's position is that his inability to defend himself properly culminated in conviction and impeachment and made him ineligible to run for office again. Furthermore, since Blagojevich cannot run for office, the government has taken away people'sle's right to vote for whomever they want.
Prosecutors and federal judges disagree that Blagojevich was a victim of overzealous prosecution. Conversely, they report that the government submitted overwhelming evidence of the former governor's abuse of the law. As of March 2023, the court has not decided on his complaint.
