NJ’s Top Doctor Advocates For Medical Cannabis
Shereed Elnahal, M.D., Commissioner Of Health, (NJDOH) blasts roadblocks to medical cannabis.
Shereed Elnahal, M.D. once again came out strong this week against the classification of cannabis as a Schedule 1 narcotic. He emphasized the struggle that this creates in the medical marijuana industry and most importantly, for patients.

The state’s top doc also implied that due to the barriers and misunderstanding of cannabis, medical patients themselves are often more informed than the medical community.

Governor Phil Murphy today announced that the New Jersey Department of Health has received 146 cannabis dispensary applications from 106 organizations to operate medical marijuana dispensaries in the state. Applicants had to identify the region of the state where they would like to operate an Alternative Treatment Center (ATC). Applications were rather evenly distributed with 50 applicants for the northern region, 45 in the central region and 51 in the southern region.

A recent Quinnipiac poll, conducted August 15-20, asked NJ residents if they supported the legalization, expungement of criminal records, and sale of cannabis in their communities.
The poll found that New Jersey voters continue to support allowing adults to legally possess small amounts of cannabis for personal use by an overwhelming 62% – 33% majority. This is an increase compared to 59% – 37% on March 13.
Voters also support expunging, or erasing, criminal records for marijuana possession by an even larger margin of 63% – 27%
An overwelming 90% of residents ages 18-34 support the legalization of cannabis throughout New Jersey, and 81% support the sale in their community.
By a smaller majority of 50% – 45%, voters support the sale of cannabis in their community. So far, over 30 towns have banned the sale of cannabis, while a few have taken a wait and see approach. Yet there are others, such as Jersey City, Trenton, Atlantic City, and Asbury Park have all publicly embraced the idea of cannabis in their communities.
Along political lines, the poll also found that only 28% of Republicans supported legal cannabis being sold in their communities, compared to 66% of Democrats. For overall legalization, the survey found that 78% of Democrats supported legal cannabis in New Jersey, compared to 41% of Republicans.
NJ residents with college degrees also overwhelmingly support the legalization, expungement of records, and sale of cannabis in New Jersey.
From August 15 – 20, Quinnipiac University surveyed 908 New Jersey voters with a margin of error of +/- 4.6 percentage points, including the design effect. Live interviewers call landlines and cell phones. Residents were asked about the legalization, expungement of records, and sale of cannabis in their community and throughout the state.
Although there is no specific bill yet presented to the legislature, there are two bills being finalized. The poll results come just on the heels of Senate President Steve Sweeneydeclaring he likely has the votes required for legalization to pass.
Who Do You Agree With?
Kevin Sabet, president of Smart Approaches to Marijuana, a leading marijuana prohibitionist group in the country, said the poll shows that marijuana support isn’t as high when people think about the potential impact of weed. But it seems like these arguments are becoming continually less believable.
“We know that most people who say they favor legalization really favor simply not putting people in prison for pot,” Sabet said, as reported by NJ.COM. “That’s very different than selling and advertising highly potent edibles, candies and concentrates.”

A Quinnipiac poll found that while nearly two-thirds of New Jerseyans support marijuana legalization, only half want it in their towns.
Cannabis legalization and expansion will likely be a hot-button issue during this election cycle. With many towns rushing to ban cannabis without seeing or knowing what a bill may even look like, these politicians are likely walking on thin ice.

Medical Marijuana Program In New Jersey Continues To Grow
Although Governor Murphy has not yet received a bill to sign that would legalize cannabis, he has called for expansion of the medical marijuana program in New Jersey. Subsequently, the program has seen rapid expansion since Murphy took office in January. Furthermore, several lawmakers have been working diligently on medical, expungement and legalization bills.
As of June 11, 2018, the number of patients enrolled in the program has increased 25 percent to just over 23,000 patients and 87 new physicians have enrolled since Governor Murphy announced reforms to the program on March 26. The program is growing at a rate of 100 patients a day.
And in another major development, Harmony Dispensary in Secaucus finally opened today, Monday, June 18, after years of delay.

BREAKING: NJ AG “End Cannabis Prosecutions Through September”
Although Governor Murphy campaigned on legalizing cannabis for adult-use, the law has not yet changed. However, the medical program already doubled since Murphy took office. Just last week, Mayor Steven Fulop of Jersey announced he would be issuing guidance to his police officers and prosecutors to end cannabis prosecutions in NJ. Today, State Attorney General Gurbir Grewal issued a memo to municipal prosecutors calling for the end of marijuana prosecutions in New Jersey.
In a letter to prosecutors New Jersey Attorney General Gurbir Grewal wrote that he was asking “that all municipal prosecutors in New Jersey seek an adjournment until September 4, 2018, or later, of any matter involving a marijuana-related offense pending in municipal court” while developing “appropriate guidance” for prosecutors.
Boom! very excited about the announcement coming today from the Attorney General on marijuana arrests statewide. I’m proud JerseyCity pushed this policy + we stood our ground as the right side of the issue. We are lucky to have in NJ a thoughtful and problem solving AG. Forward!

Just yesterday, Heady NJ was questioning why the Attorney General Gurbir Grewal and Governor Murphy were not supporting Jersey City’s stance to end cannabis prosecutions while they are working towards legalization.

One day after the City of Jersey City had enacted a policy to decriminalize marijuana, Grewal sent a letter to Chief Municipal Prosecutor Jake Hudnut stating that he did not have the legal authority to take such an action, therefore the policy was “void.”
Jersey City undoubtedly has prosecution discretion + the ability to implement that. We aren’t changing law but we’ll continue a support our Chief Prosecutor’s judgment which we outlined in decrim policy we’ll follow. We respect the letter but don’t agree. JC = right side here

However, Grewal’s office met with Hudnut and other public safety officials from Jersey City yesterday in hopes of finding some middle ground.
Moving forward, the AG’s office will convene a steering committee to strategize approaches for addressing marijuana in the future.
It is also expected that the state legislature and governor will legalize cannabis before the September date referenced by Grewal in the memo issued to the municipal prosecutors.
“I took the job as Chief Prosecutor in Jersey City to help build a progressive, proactive, and thoughtful prosecutors office. We want to make sure that Jersey City is at the forefront of these conversations and I’m proud to have pushed this issue from the onset,” Hudnut said.
In 2016, approximately 36,000 people were arrested in New Jersey for cannabis, of which 32,000 were for simple possession, non-violent offenses.

BREAKING: Medical Cannabis Dispensary Expansion Sought By Gov. Murphy
Today, the Murphy Administration announced it is seeking up to six new applicants for medicinal cannabis dispensary expansion with two dispensaries each in the northern, central and Southern regions of the state. This is in addition to the 6 dispensaries currently operating in the state throughout the same regions.
“We look forward to the opening of six new dispensaries so we can ensure that all qualifying patients who want access to medicinal marijuana can have it,’’ said Governor Phil Murphy. “Due to the steps that Commissioner Elnahal and I have taken since January, we have seen the addition of 10,000 new patients. Accordingly, we have to expand the number of businesses who are growing product and serving patients.”

A Request for Applications (RFA) was released and notes that applicants would have to operate a seed-to-sale style operation with a dispensary and facilities for cultivation, manufacturing along with dispensing. It is also a requirement to provide evidence of site control and proof for approval of the governing body in the municipality where they intend to operate. The dispensary can be either nonprofit or for profit. The RFA is available at: http://nj.gov/health/medicalmarijuana/documents/ATC_RFA_July2018.pdf.
Applicants can submit applications for more than one region of the state but must submit a separate application for each region. The fee for applying is $20,000, although $18,000 of that fee will be returned to unsuccessful applicants.
The Department will electronically accept questions until 4 p.m. on Tuesday, Aug. 7 from all potential applicants via email at [email protected]. Applications are due Friday, Aug. 31, 2018. Applicants chosen to proceed in the permitting process will be announced Nov. 1, 2018.
The six currently operating ATCs are not eligible to participate in this application process. Existing ATCs already have the opportunity to add additional sites for cultivating, manufacturing and dispensing. Additional opportunities to apply to build cultivating, manufacturing and dispensing sites will be available in the future.
Medical Cannabis Expansion Steady In New Jersey
Currently, more than 25,000 patients, 1,000 caregivers and 700 physicians are participating in the program. These numbers are up from the start of the Murphy administration taking office. Murphy ran on cannabis legalization and continues to voice his support for full legalization.
Several NJ lawmakers continue to work behind the scenes on furthering medical cannabis expansion in the state.
The Commissioner is also working to expand physician participation in the program. Last week, he conducted two grand rounds lectures with 300 physicians at teaching hospitals to dispel myths and reduce stigma in the medical community. Although more than 100 new doctors have signed up since the expansion began, only 700 of the 28,000 licensed physicians in New Jersey are currently registered to participate in the Department of Health’s Medicinal Marijuana program.
Marijuana needs to be descheduled at the federal level. Enough is enough.

Just last week, a New Jersey worker’s compensation judge ordered that Freehold Township must pay for its worker’s medical cannabis. This is a ground-breaking decision and one that will have great impacts on the future of assisting medical patients in the state.
