A U.S. lawyer, citizen, and his wife, also a lawyer, re-entering the U.S. from Canada, were detained by CPB Agents for six hours, handcuffed, had their cell phones seized, and were placed in separate locked cells, all the while given no reason for the Government's action except they were "doing their jobs." Trump has created a "wall," alright. No tourist wants to visit the U.S., and no U.S. citizen is safe to leave with the uncertainty that they will be let back into the Country. Trump and The Insurrection Act and Martial Law--Just In Case
A report from DHS Secretary Kristi Noem and Defense Secretary Pete Hegseth, due to Trump on April 20, could include a recommendation to invoke the Insurrection Act of 1807 as part of Trump’s effort to "secure" the southern border, which could potentially lead to Martial Law. The Insurrection Act is not "Martial Law." It provides a statutory exception to the Posse Comitatus Act (1878) that prohibits the president's deployment of the U.S. military to enforce either civil law or criminal law within the United States. The term "Martial Law" has no established definition, but it is generally understood as a power that allows the military to take over the role of civilian government in an emergency. Under current law, the president has no authority to declare martial law. The 51-year-old woman in this video did everything the Court asked of her, and she had an employment authorization card. ICE agents twice tried to arrest her at her house, but didn't have a warrant. ICE also needs a warrant to break into a car, but that didn't stop them, as she and her daughter were on their way to work. ICE accuses her of having MS-13 gang affiliations. Additionally, the Supreme Court ordered that a Maryland man, whom the Trump Administration admits was accidentally deported to an infamous high-security prison in El Salvador, must be returned to the U.S. The Administration told the lower court they can't bring him back. Remember those two Amendments that apply to "all persons in the jurisdiction of the U.S.?": 5th Procedural due process; Procedural Due Process; the right to be heard in court, and 14th Substantive Due Process; The federal and State Governments cannot deprive anyone of "life, liberty, or property." A federal judge in TEXAS issued an order Wednesday temporarily blocking the Trump administration’s use of the Alien Enemies Act to deport people held in a south Texas immigration detention center without due process. A second federal judge in New York said in a hearing that he planned a similar order applying to migrants held in the Southern District of New York. The Supreme Court had flipped the burden of proof to whomever Trump plucks off the street to deport. That is, the person subject to deportation must bring a "show-cause" habeas corpus suit. Trump has removed a picture of Harriet Tubman from the National Park Service page on the Underground Railroad, as first reported by The Washington Post. It also changed the words “enslaved African Americans” to “enslaved workers” and removed a section that discussed Benjamin Franklin being a slave owner. Tubman was born into slavery and escaped in 1849. She had the courage to come back and help 70 other enslaved African Americans escape via the Underground Railroad. She also served as a scout and spy for the Union Army. But, of course, he then did the most Trumpian thing, talking on both sides of an issue and sowing confusion when hours later he praised the work of a doctor who has been known for discussing the dangers of vaccines and recommending "unconventional therapy." The reality is that Trump/Musk cut $11 billion for pandemic preparedness, overdose prevention, and community health programs, and from the Substance Abuse and Mental Health Services Administration for addiction treatment and suicide prevention. TRACKING TRUMP: Authoritarianism. Disney, Facebook, CNN, Columbia University, the law offices, and others that have submitted to Trump's intimidation and blackmail when they would have won in court should be remembered and boycotted. These organizations have millions to pay Trump’s extortion, but can't raise salaries for their workers. Bar associations strongly encourage pro bono work, but apparently, these capitulating law firms believe that the Sixth Amendment’s right to a jury trial applies only to the wealthy. I cancelled my subscription to the Washington Post and subscribed to the Atlantic Magazine months ago when Bezos stated that WAPO’s Opinion Page cannot differ from his beliefs.
