I HAVE OVERSTAYED MY 90 DAY TOURIST VISA NOW WHAT?

First of all, let me start out by saying this is never a good idea and there are very real risk involved in doing so, there is a tremendous amount of misinformation out there about this subject and my goal is the clear up the confusion and give you the facts.

Sometimes your Tourist Visa can be for only 30 days, it is important to review your passport and see how many days you were given when you entered the county.

Costa Rica, allows you to drive for 90 days on your foreign driver’s license.

If you are driving here on your foreign driver’s license and get stopped by the Transit Police you can be given a ticket and required to pay a fine.

If you are driving and have an accident, your INS policy will not cover the accident because you were driving passed your permission period.

When you do leave the country and enter Costa Rica, again you can be fined $100 for every month you over stayed your visa or you can be denied entry and required to stay out for the county for 3 x the amount of time you over stayed your visa. So for example, if you over stayed 60 days you will not be allowed to enter Costa Rica, again for 180 days.*

If you are arrested or detained by the Costa Rica, Immigration Police they can start a deportation process against you.

You cannot change your immigration status until you leave and reenter the county. For example, if you want to start the residence process, you cannot do so until your visa is current.

There is a dark side of all this and I must address this, many people who have over stayed their visa are crossing the border into Nicaragua and Panama, and then paying a bribe to get back into Costa Rica, this is illegal and involves risk. How do you know if you are paying a fine or a bribe when you reenter Costa Rica, the answer is simple, if you are given a receipt from the government it is not a bribe.
