A Special Sitting of the House of Representatives was called for today, Friday. It is the second in a month and caught just about everyone by surprise. There were two bills left over from the committees and a motion for the re-appointment of Ombudsman Lionel Arzu to a further one-year term. The majority of the House’s time, however, was spent debating two new bills, both related to recent developments regarding the over one hundred million Belize dollars in arbitral awards. That hefty sum was awarded to Belize Social Development Limited and Caribbean Investment Holdings Limited in 2014 by the District Court for the District of Columbia for litigation related to the Accommodation Agreement and Settlement Deed. Both were negotiated in 2006 and 2007, respectively. While the U.S. Supreme Court has refused to hear government’s claim from the Court of Appeal of the D.C. Circuit, Prime Minister Dean Barrow told the House two weeks ago that he would not pay a penny of either award and essentially dared the companies to go after Belize’s foreign assets. It turns out that they have taken him up on that, and his administration found it urgent to create new legislation that would immunize the Central Bank from such awards. In introducing the bill, the Prime Minister noted that he took a page straight from the Americans’ books to defeat a previous decision. source

It intends to make provisions on enforcements of foreign judgments against the Crown, and is also a direct answer to the efforts of B.S.D.L. and Caribbean Investment Holdings to enforce the arbitral awards. According to the Prime Minister, notwithstanding the refusal of Belize’s courts, including the Caribbean Court of Justice, to enforce the arbitral awards which they have said are unconstitutional, repugnant to public policy and void, the companies insist on moving forward, and so they are forced to come down on them and their agents. source

On the second reading of the new bill, a debate was held in which the Opposition raised its concerns of punitive action against Caribbean Investment Holdings and B.S.D.L. and the extremely short notice on which the bill was brought to the House, something for which the Prime Minister apologized in length several times. He noted that in other circumstances, he would have consulted Leader of the Opposition John Briceño, but he wanted to avoid the beans possibly being spilled to Senior Counsel Eamon Courtenay, who has represented various concerns of Lord Michael Ashcroft and whom Briceño counts as a major adviser, in addition to being his chief second in the Senate. While ultimately supporting the bill, both Briceño and attorney Kareem Musa of Caribbean Shores opined that this matter could have been settled a long time ago. source

Thursday evening saw the time elapse for Belize’s consent solicitation offer to holders of the Belize 2038 U.S. Dollar Bonds, aka the Superbond. But the Government has confirmed that the offer, which was roundly rejected by bondholders, has been extended to five in the evening on Friday, February third – a week from today. They sought further statements from the Barrow administration on its plans to keep Belize from further risks with its financial stability. The Government’s offer is to bring the interest rate down to a uniform four percent from the stepped-up rate of six point seven percent due in August, and to defer the principal payments to the years 2036, 2037, and 2038. The Government also reminds that, “Belize has proposed no other amendments to the terms of the 2038 Bonds. In particular, Belize has not proposed any reduction in the principal amount due under the instruments nor has it asked for an extension of the final maturity date of the Bonds.” Today, the Prime Minister expressed cautious optimism. source
