In the end, nine amicus curiae briefs where filed, the majority with the university. The final ruling declared that affirmative action was constitutional but invalidated using racial quotas.

Even though the University was claiming the problem to be age, Bakke thought that it was because of his race. Bakke said, and I quote, that he had suffered “reverse racism”. His backup was the Civil Rights Act of 1964 and the equal protection clause of the 14th Amendment.

In 1976, the university filed a petition asking for Writ of Certiorari. The case was tried 3 times in January and February, but they needed four votes to grant the writ of certiorari. Finally, on February 22nd, the court granted it. Their main argument was that Bakke was too old, and they wanted to have younger students, which was completely legal at the time.

First, when Bakke applied to the University of California, he was rejected, twice. He was wondering why he was rejected and the school said it was because of his age, mind you, he was early 30′s at this point. He thought differently though. He believed the point of him not being accepted, was because of his race.

Allan Bakke was born in 1940 and was a grade A student, graduating from the University Of Minnesota with a 3.51 GPA. He formerly was a marine officer, eventually reaching the rank of captain, then he was discharged. After his honorable discharge, he became an engineer at NASA. Before that, he stated that his interest in medicine started in Vietnam, but grew when he joined NASA. Then, in 1972, he applied to two schools, the University of Southern California and Northwestern University.
